Fraud and Forgery in the notary business 

There are many types of fraud that a notary might run into in their notarial career, forgery being one of the more common types of fraud. But, let’s take a closer look at what specific types of things could happen.
 
(1) Someone could forge your seal and pretend to be you.  It happened to me.  Unfortunately for them, they didn’t forge my signature very well, and didn’t copy my style of embossing every page either.  Putting technicalities aside, I bet they were not able to forge my quirky sense of humor either.  Notary seal forgery is not common. In my case, I think they used a really good photocopier.  BTW, a photocopier can NOT copy the RAISED impression of an inkless embossed seal which is why I used it on all of my notarizations.
 
(2) Page swapping — the old bait and switch routine.  I got called to notarize many multi-page documents. I put my embossing seal through all of the pages leaving a raised impression on each page.  I usually did these individually. Sometimes it is better to do all pages together so the seal goes through the same location in each page.  However, the seal comes out more clearly if you go page by page.  In any case, if you see a ten page document where all of the pages EXCEPT for page four are embossed, that would raise my eyebrows.  I have had many situations, where the signer wants me to give them another acknowledgment certificate for a new page they are adding to the document. I tell them that I have to notarize their signature ALL OVER AGAIN, and that is the law no matter how many times you say, “Oh, come on”.  With that attitude you might as well notarize your own signature as a non-notary!
 
(3) Title companies have a common practice of initialing for the borrower if the borrower misses an initial. It is “easier” than sending the documents back to the borrower.  Whether it is signature forgery to forge initials is a matter for an attorney to decide, but it seems pretty illegal to me to engage in initial forgery. I don’t think that anyone audits loan documents to see if anyone is engaging in initial forgery, but perhaps they should — many Title companies might get busted or investigated at a minimum.
 
(4) Refusal to be thumbprinted?  You must be up to something if you don’t want your thumbprint recorded. Maybe you have a fake identification card, right?  You can fake an ID, but you can not fake a thumbprint.
 
(5) Signature forgery.  If someone forged a signature on a document, they will have to have a fake ID and forge the same signature on the ID and in your journal. It would be a tough crime to pull off. I think that nobody in their right mind would attempt this.  Normally, people try to do crimes of fraud in private, and wouldn’t be willing to let other parties see what they are doing, no matter what!
 
(6) Notarizing out of state?  If you don’t have a commission in a particular state, you can not notarize there, with a few exceptions. Military notaries have special rules. A Virginia notary public may notarize out of the state of Virginia, but only for documents that are to be recorded within the state of Virginia. In any case, from time to time we will hear rumors that a notary public is operating illegally in a bordering state where they are not commissioned, and people want us to enforce the rule. I tell them to report the individual to the state notary division where the Notary in question is commissioned.
 
(7) Charging more than the state maximum notary fees is illegal, and charging more travel fee than your state allows (roughly eight states have restrictions for travel fees) can get you in trouble too.
 
(8) Filling out an Acknowledgment or Jurat form when you never saw the signer and never had the signer sign your journal is a really serious act of notarial misconduct.  You can lose your commission and get fined or jailed for this.

Penalties for notary misdeeds & misconduct!

Penalties for notary misconduct, crimes, and misdeeds 

I very rarely hear about notaries engaging in any type of illegal activity or illegal notarizations. The normal problem with notaries is lack of skill, neglegence, or bad tempers in a few cases.  I have only heard of one notary that engaged in a serious crime, and he went to jail.  This blog entry will discuss various types of notary misconduct and types of penalties for this misconduct in California. Please keep in mind that the notary rules are different in each of the 50 states, and that notary rules are also always changing.  However, if something is illegal in one state, there is a high chance that it will also be illegal in your state — although the penalties might be different. The information here is time sensitive and could change at any time. These are listed in the order of which I feel they are important to mobile notaries.
 
Asking a notary to do an improper notarization.
This is a misdemeanor.  If it involves real property, then it is much more serious.  Clients might ask you to notarize them using a different name variation that is not documented, or put a false date.  This is illegal. They are guilty for asking you to do this, and you will be guilty if you give in to their pressure. If you have driven thirty minutes to a job, you have a beneficial interest in notarizing their document unless you have gotten your travel fee up front when you walk in the door.  So, legally, you MUST get your travel fee BEFORE you see the document, or are informed who the signers are, or see their ID, because a conflict of interest can easily happen.  If someone asks you to do something illegal, you can threaten to report them to the Secretary of State’s office. This is a serious crime and you should treat it as such.
 
Issuing a false certificate
A notary who issues false certificates, and this could include backdated certificates would be guilty of a misdemeanor.  A false Acknowledgment certificate constitutes FORGERY.   Additionaly, the notary could have their commission revoked if found guilty of this crime, with an additional fine of $1500 per incident.
 
Failure to Identify a Credible Witness
A fine of $10,000 per incident could occur if a notary fails to check a credible witness’s identification documents and see that they have acceptable identification.
 
Failure to get a thumbprint!!!
This is my favorite.  Thumbprints are critical for identifying a signer if fraud is suspected.  Powers of Attorney and Deeds require a journal thumbprint in California.  A fine of up to $2500 per incident would be the penalty.
 
Failure to administer an Oath
A fine of $750 per incident could be incurred, not to mention revocation, or suspention of a notary commission, or refusal to grant a commission.
 
Felony Convictions
If you have a felony conviction or have been convicted of a crime involving dishonesty or moral turpitude, you will most likely not be allowed to get a notary commission in the first place.  If you already had a notary commission, it would be suspended or revoked the minute your state’s ntoary division finds out about it!
 
Professional Misconduct
This refers to dishonesty in your professional activities.  The penalty would once again be suspension, revocation, or refusal to grant a notary commission.
 
Failure of Duty
This means that you refuse to serve a member of the public who has a legitimate request for a notarization.  However, if the signer doesn’t have proper identification, or doesn’t have a properly filled out document, or seems very questionable, you have the right to refuse service to such a client.  The penalty would be refusal to grant a notary commission, suspension, or revocation of a notary commission. Additionally a fine of $750 could be imposed on the California notary public.
 
Falsely Acting as a Notary
This is a misdemeanor
 
Making false statements to a notary
Anyone who induces a notary to make an improper notarization with regards to real property can be found guilty of a FELONY.  This is the most serious type of fraud possible in the notary profession.
 
False or misleading notary advertising
Making false statements in notary advertising is illegal, and the penalty for California notaries is $1500 per incident.  Additionally, such a notary’s commission could be suspended, revoked, or there could be a refusal to issue a commission.  Claiming to be an immigration expert, or be able to give legal advice could be a serious example of false advertising. 
 
Selling personal information
If the notary sells or misuses personal information of those he/she has notarized, that is illegal as well.  Remember to keep your journals locked up, so that nobody can have access to that information. When making copies of journal entries, make sure that the neighboring journal entries are covered, so that their information is not shared with the public.  Once again, your application could be denied, or your commission could be suspended or revoked for such a crime.

Here are some other crimes… I will just list them here, but may or may  not describe the penalties.
 
Failure to deliver a journal to the county clerk at the end of your commission. – misdemeanor
Failure to safeguard seal and journal – revoke/suspend/refuse
Failure to report a lost or damaged seal – $1500 fine
Nonpayment of judgement / Refusal to pay child support – refusal to issue a commission
Failure to keep a journal – such notaries will be prosecuted
 
There are a few others laws that I am not going to mention, but these were the interesting ones…

Have you ever heard this phrase before?  These are the words a lender will tell you when they want you to backdate.  If you leave a blank page in your journal a day before the signing, then it will look like you really did notarize their loan documents on the date that you claimed you did.  This is completely illegal, but this is what many lenders will ask from you when they are in a pinch.
 
The lock
Lenders can offer their borrowers a particular rate, but there are expiration dates.  If a loan has a lock that expires on the 28th at midnight, and the loan documents were not ready to be compiled, sent, printed, etc., on the 27th or 28th, then the lender is in a bind. They will have to redraw all of the loan documents all over again and have a slightly higher rate, and an irate borrower. To save themselves this nightmare, they will often ask the notary to fudge a date when in this situation.
 
It’s your notary commission
If you get involved in this type of fraud, you could get fined by your state notary division, lose your notary commission, or perhaps even be looking at jail time.  Since there is no intent to harm anyone, jail time doesn’t seem probable, but laws differ from state to state, and the laws are always changing.
 
Lose the client?
I was asked to do this a few times.  I said no, and lost the client. Maybe I’m better off. Lenders love notaries who will lie, cheat, and steal on their behalf.  They will love you if you can look at a loan which is an obvious rip off and say nothing while the borrower is signing it. Of course, its not your job or entitlement to make commentary about someone else’s loan. You will be making someone lose thousands by butting in, and its not your right.  Lenders also love someone who will forge an initial or put yesterday’s date on a Jurat certificate upon request. You would not believe how many Title company staff members have forged omitted initials on Deeds of Trust, and other documents that require initialing.  Few of them would dare forge a signature as that would involve jail time, but some feel that its open season on initials.
 
Just say no
Don’t get involved in this nonsense. Its your life, your karma, and your commission.  If you get armtwisted once, you could easily get in the habit, not to mention feel ashamed for the rest of your life.   Additionally, it is recommended that you avoid screwy companies like the plague. These are exactly the same companies who will have no qualms about cheating a notary out of their pay for little or no reasons at all.

Reverse Blackmail at a Notary Signing

A notary accidentally notarizes an incompletely filled out document. The client holds on to it with hopes of blackmailing the notary. The notary gets a call:
Client: “Hello, I have an incompletely filled out document that was notarized by you… I am going to report you to the Secretary of State and your commission can be revoked, suspended or terminated if I do so. I need you to do 20 notarizations over the next few weeks, otherwise I will report you!”

Notary: “You mean, I have to be your notary on call? How degrading! I can’t believe I made a mistake like that! Please make a copy of the notarization and forward it to me so I can see it.”
Client: “Well, I can get it to you right away. I need something notarized, but don’t have ID. This is why I am having so much trouble.
Notary: “Can you put your request in writing? Email it to me and I will take a look at it right away.”
Client: “Okay, I’ll send it in an email”
Notary: “Ha HA, you just committed a misdemeanor, and I have it in writing! Give me my original document back, and I won’t report YOU to the Secretary of State!
Client: “You wouldn’t!”
Notary: “You gave me no choice. Now the hunter is the hunted.”
Client: “Ah…. could you put that in writing…”

Notary Hell – “Yeah, but it’s a dry heat”

Welcome to Notary Hell

Notaries who have done bad deeds (or signed bad Deeds) in their personal or professional life are often committed to Notary Purgatory, or Notary Hell. Many Buddhist Notaries commented that there are seven heavens and seven hells, birth, death, and rebirth. In Notary Hell, the Power of the Devil, supersedes the Power of Attorney (even if it is Authenticated by the Secretary of State.)

In Notary Hell, misdeeds, negligence, and malfeasance are considered good things, although they prefer active acts of treachery.

Common Experiences
Notaries who are condemned to Notary Hell are subjected to all types of cruel, but not unusual tortures. Some notaries have all of their documents burned in the eternal fires of hell. Others have to do a daily signing for a “reader” who reads every letter of every page, and then claims not to be sure if they want to sign. These “readers” can take up to three hundred hours to complete a signing in 130 degree heat. The devils in Notary Hell are very despotic, they like to emboss the notaries around. One devil came around with a giant red hot steel embosser and embossed a notary’s hand. Other notaries are branded on their left shoulder with a red hot iron notary seal, so that it will be obvious which part of Notary Hell they are confined to.

One notary had a near death experience that he shared with us. His soul actually left his body. Unfortunately, because of all of the misdeeds he had committed (including backdating) that he went to hell. At first he was concerned that he was in hell. But, then after a few minutes he realized that he recognized half the people there since they were his Mortgage Broker clients.

Another notary commented that when he was in Notary Hell, everything he notarized was in invisible ink, so all of his work was virtually erased.

The Warning Signs
For those who are weak in terms of their conscious, a not so subtle warning sign is often sent to the notary from the higher world. The notary will be sent to Notary Hell for a few minutes in a dream, to scare the hell out of them. If the notary does not repent, the next time the notary commits a serious error or omission, the gates of Notary Hell will open up, and the Notary Devil himself will come for a personal visit to the notary’s official address based on their records with the Secretary of State.

Entry Procedures
All notaries are required to register with the Secretary of Hell, or as the locals call it, “The Demon Vee” within 30 days of arrival. You must have an identification document that was issued in the last ten years, but hasn’t been burned (or melted) yet. Notaries are required to take their Oath of Office. There is no prerequisite residency requirement for entry. Applicants must be 18 years or older and have committed a Felony or multiple acts of Mural Turpitude. There is no proctored exam necessary as an entry requirement for Notary Hell. References from scummy people are appreciated although not required.

But, you only get a cramped spot in the basement of the mansion next to the boiler room. Although Notary Hell is horribly unpleasant, due to funding cuts in the Secretary of Hell, most of the torturous punishments have been put on hold — at least for now.

DEVIL: Welcome to Notary Hell

NOTARY: But, all I did was backdate a few times

DEVIL: You don’t know how that affected other people’s lives, do you?

NOTARY: Are you preaching to me?

DEVIL: Well, I’m not exactly the most credible of witnesses, but let’s just say, that I’m aware of the severity of your mal-actions.

NOTARY: So, what now?

DEVIL: It’s time to get you registered. Right this way.

CLERK: ID Please?

NOTARY: Here it is. By the way, it’s hot in here!

DEVIL: Yeah, but it’s a dry heat.

CLERK: Have you visited Notary Hell before?

NOTARY: The time when my client wouldn’t turn down his TV came pretty close.

CLERK: Birth and death date

NOTARY: What’s the point, I’m dead aren’t I?

CLERK: Well, we like to keep track of these things. We like to keep accurate journal entries, just like good notaries are supposed to do — hint, hint.

NOTARY: Journal Schmournal. So, I kept a journal. People signed it. Big deal.

CLERK: We take these things very seriously in the brighter world. If it had been a lesser infraction, we would have sent you to Notary Heck.

NOTARY: Okay, okay, okay. I got it.

CLERK: If every notary were as negligent as you, the entire profession would be compromised. Ha! More business for me!

NOTARY: Okay, so what now?

CLERK: Now, we take you to your accommodations. Follow the demon dressed in red, and take a left at the pitchfork in the road.

NOTARY: Got it.

DEMON: Welcome to Notary Hell.

(walking to the notary’s accommodations)

NOTARY: Oh, look to the left. I didn’t know Saddam Hussein was a Notary.

DEMON: Little mix-up. We sent him to the wrong hell.

NOTARY: Oh look at those cauldrons, notaries are being boiled in oil.

DEMON: The one good thing about having Saddam around is that we never run out of oil.

NOTARY: Just out of curiosity, is there wifi here?

DEMON: No, but we have cable. We have the Kardashian channel playing 24/7.

NOTARY: Is this my cell?

DEMON: Here’s your palatial estate.

NOTARY: And you call this notary hell?

DEMON: Yeah, but now all your dead relatives know you have a palatial estate and they’ll be visiting you in one hour. And by the way, the thermostat is on the mantle. You can turn it down to 130 during daylight hours — if you like.

NOTARY: That’s quite thoughtful of you.

DEMON: Shhhh. don’t let that get out!

Assisting with Immigration issues
If you are not an immigration expert, don’t answer immigration questions and don’t advertise yourself as an immigration expert. However, notaries are allowed to notarize many types of immigration documents. Just don’t give advice.

Assisting with legal advice
If asked for legal advice, if you are not an attorney, please refrain from giving legal advice as it might constitute unauthorized practice of law. Drafting legal documents, i.e. documents to be used in court or submitted to a judge or attorney could constitute legal advice or service (unauthorized practice of law) in many states. Don’t even offer to recommened particular notary procedures for their document, as that also could constitute unauthorized practice of law.

Backdating
Putting a date on a document’s notary certificate section that is previous to the current date is considered backdating and is illegal. Don’t backdate. Many signing companies will ask you to backdate when they are in a pinch and will lose their lock on the borrower’s loan. That is their problem, not yours. If you backdate you could lose your commission if you get caught. It is a misdemeanor in many states to ask a notary to commit fraud, so you can report a company that asks you or coerces you into backdating.

Don’t make notarial recommendations
Customers always ask what type of notarization they should get. You are not allowed to tell them in many states. You can describe the attributes of the various types of notarizations and ask what the document custodian would like too. Just don’t make recommendations.

Letting your boss review your journal
Your boss can not inspect your journal on their own. However, if you are present, then its okay if your boss inspects the journal. The notary should not let the public see journal entries unrelated to their specific business. Its best to make a copy of the journal entry that blocks out other entries to protect the privacy of the others who you notarized. If not all of the notarizations are related to your boss, it would be better if you make a copy of the journal entry in question rather than letting the boss look at the whole journal while you are there.

Blanks?
Don’t notarize a document with blanks in it. The blanks must somehow be filled in or crossed out. Otherwise you must decline from notarizing that document.

Lock up your seal and journal
Not all states require a seal and journal, but these instruments are the exclusive property of the notary and must be kept under lock and key. Don’t let others use them or you can get in big trouble, and so can the person who used them.

Don’t notarize parts of documents
If you are handed page three of a long document, you can not notarize it as a separate entity. Documents must be in their complete form to be notarized. Don’t only notarize the last page of a document — the page that contains the certificate wording either.

Failure to emboss?
Its not required by law to emboss pages, but if you choose to emboss every page of every document you notarized, it becomes difficult to substitute pages of documents without getting caught. Embossers leave a raised seal that can not be photocopied, so you will be detering a lot of funny business using an embosser.

Typical things notaries do wrong.
Notaries do many things incorrectly, particalar inexperienced, or unschooled notaries.  Clients will ask you to do all sorts of things.  Some things are merely unorthodox, while others are purely illegal.  Here are some things that notaries do wrong.
 
Copies of vital records
From time to time, a notary is asked to notarize a certified copy of a vital record such as a birth certificate, marriage or death certificate.  This is not legal, and not recommended.  It is legal, but not recommended to do what is called a copy certification by document custodian. This notary act is a glorified Jurat, where the individual who is in charge of the document swears to the authenticity of a copy of the document. 
 
Going to hospitals and jails without asking the right questions.
Many notaries don’t want to go to hospitals and jails because they are afraid.  There is nothing to be afraid of, but there are pitfalls.  Many signers in hospitals are elderly and don’t have ID.  Inmates NEVER have ID.  So, the notary must first be sure the signer or their family members / associates have their ID and it is wise to have them read the ID# and expiration date to the notary, so the notary can be sure that they really have the ID and that its current.
 
Leaving seals and journals unattended.
As a notary public, you and only you are responsible for safeguarding your seal and journal.  Even if your boss or co-workers want to use your seal or inspect your journal, its completely illegal. Only the notary can do a journal query, or use their seal.   Carelessly leaving your seal in an unlocked area is also a very serious notary error.  Seals and journals must always be kept under lock and key.
 
Not having the signer present.
Its common for a client to request that a notary notarize a document when the signer is not around. This is completely illegal.  The signer must be  in front of the notary during a signing.  This means within a few feet and able to communicate directly with the notary.
 
Having an interpreter
Many immigrant families have older members who don’t speak English.  They often attend to their business with their children along to explain things and translate.  When they call the notary over, they often don’t explain that the signer can not speak English, since its not a problem due to the fact that they can translate. But, the notary must be able to communicate directly with the signer.  If the signer only speaks Uzbek, and the notary doesn’t speak Uzbek, then the signing is off.   On the other hand, if the document is in Chinese, and the notary only speaks English, that is okay, since the notary is not liable for the contents of the document.
 
Overcharging
The maximum notary fees vary from state to state.  California and Florida are  “generous” offering $10 per acknolwedged signature, while many other states offer as low as 25 cents or two dollars per signature which is hardly enough to make a living.  It is tempting for notaries to charge more than they are supposed to to make it worth their while. This is illegal.  Also, many states have restrictions for what notaries can charge for travel fees.  Many notaries overlook these restrictions.
 
Journal thumbprints and notes
It is critical that notaries get the right thumbprint of the signer in their journal, especially for deeds and powers of attorneys.  This is a great way to deter fraud, and will keep a notary out of court in many instances.  Additional notes are important to keep in a journal too.  If a notary goes to court, they will never remember a signing that took place years ago, unless some notes are kept about anything unusual at the venue of the signing, or anything that is unusual about the signer.

Backdating
Almost all signing agents will be asked to backdate at one or more times during their career.  Don’t do it.  Backdating is illegal.  Backdating means putting a date prior to the actual date of the notarization on a notary certificate. The date of the notarization is when the signer signs the journal, although the signer can sign a document before the notarization of an acknowledged signature.  Here is some more information about backdating.
