Notary kidnapped by borrowers

I know, I know, I know. The borrowers like the Notary so much, they wouldn’t let him leave. That’s not what happened.

A guy goes to a signing like he always does. He sits down at the table, and has people sign the documents. The family was rude and used profanity when asking him who he was and what this was about. But, they signed the documents. Then, there was an issue about title, and with a foreclosure issue. The Notary told them that the Note was enough without having a Grant Deed, or QuitClaim to foreclose on the house. He attempted to leave the house, but the husband blocked the door, and the wife jumped on him from behind.

The Notary forced his way out the door. Basically, the family did NOT want him leaving with those documents. He explained that the documents were the property of the title company and not the borrower’s documents and that is why he needed to take them. I’m not sure it was worth it.

After the Notary was out the door and on his way to the car, the son of the couple came out of the house with a baseball bat. This family just isn’t kidding around. The Notary warned the kid that he had a gun and that the gun would be a lot more effective than a baseball bat.

The Notary drove away, and reported the issue to the Sheriff. The Sheriff asked if he wanted them to press charges and he said he just wanted law enforcement to give them a stern lecture since nobody was hurt.

So, when people ask, “Is the mobile notary profession a safe one?” The answer is, if there is a serious issue with the rate, APR, or with a foreclosure, it might not be. This is the second incident of violence against a Notary that I have heard of after serving 65,000 Notaries. It pays to confirm the signing by phone to see if the people are complete nutcases. That extra minute spent could save you some grief down the line.

Notary Public 101 — Journals

NOTARY JOURNALS

Not all states require keeping an official journal of Notarial acts, but 123notary requires it as that is the only evidence you have should you go to court. There are identity thieves and cons all over the place. They might pretend to be a home owner to steal that person’s equity or con grandma into giving her fortune away to some crooks. If your notarization ever goes to court, your journal is the only record of what happened and who signed what, etc. Most Notaries think keeping a journal is an annoying task that they do because they have to. It is the same attitude that children have towards doing their homework at age seven. But, your journal can save your neck, and I know many whose hides have been saved who ended up in court.

ONE JOURNAL ENTRY PER PERSON PER DOCUMENT

Most Notaries think that you create one entry for each signer and then cram in the names of all of the documents you are notarizing. This is very sloppy. If you pick up five packages from FedEx, do you sign once or do you sign five times, each for a particular tracking number? If you keep one journal entry per person per document, then you have a signature proving consent to be notarized for each document you notarize. Additionally, you must name the particular and complete name of each document, and not just say “loan docs.”

INFORMATION

In your journal you write the date, time, type of notary act, name of document (the full name, no abbreviations or check boxes here please) and the document date. You need to record the name, address, and ID of the signer as well. Then the signature, thumbprint and notary fee. Let’s focus on the document information in this section though. You need to record the:

Full name of the document, not an abbreviation.

Document Date — many documents have a document date inscribed within that is an arbitrary date created by the document drafter. It could be the date the document was drafted, or the date it was intended to be signed, or a random arbitrary date.

Other distinguishing factors — if you are signing multiple documents with the same name such as Deeds of Trust, Grant Deeds, etc., you need to differentiate them somehow. Escrow numbers, names of grantors, grantees, APN numbers, property addresses, number of pages, or anything else can help identify a document after the fact in case you end up in court.

Signatures — each line of your journal needs to be signed by the corresponding person. If John and Sally are each signing three notarized documents, then John gets entry 1, 2, and 3 while sally gets 4, 5, and 6. Each signer must sign their three entries otherwise the entries are meaningless.

Thumbprints — I am skipping mentioning more about the other things that belong in a journal as most Notaries get it, however, few Notaries keep thumbprints. Your journal thumbprint is the one piece of evidence the FBI will ask for when they come knocking on your front door. Additionally, it discourages fraud as fraudulent people do not want to be thumbprinted.

Other Information — Although I am skipping elaborating about the other journal fields, I will make a quick note about the additional information section in a journal. That leaves space for information about credible witnesses, subscribing witnesses, unusual facts about the signers, the location, or the circumstances in which you are signing. If the signer claims that they are being kidnapped, write that down in the additional information section of your journal, then call the police. If the signer has a weird neck tattoo, you might need to remember that in court. Put it in your journal. The judge will think you are a very thorough Notary.

FINAL NOTE

The purpose of journals is not only to please your state’s Secretary of State, but also to please judges and FBI agents. Keeping a clean, correct and thorough journal will make a positive impression on the authorities and could keep you from being named as a suspect if God forbid you ever unknowingly Notarize an identity thief, fraud, or otherwise bad person. Notaries don’t get in trouble that often, but for those who make a career out of being a Notary, eventually you will be investigated at least once and perhaps end up in court, so keep your paperwork in order so the investigation is fast and smooth. Otherwise you might end up in court for a very long time — no joke! Roughly 1/7 of the Notaries on our site have ended up in court due to something that they notarized.

Jane the Virgin Notary

Disclaimer: This post may not be appropriate for those of you who have lost their virginity, or their sense of humor!

Jane goes to her first signing for the Owens. They are going to sign a Refinance and get a better rate.

Mr. OWENS: Welcome Jane. So, you are going be our Notary tonight.

JANE: This is my first time.

Mr. OWENS: Gee that’s interesting. When the last Notary showed up, I asked, “Are you experienced?”

JANE: Wow, you have quite a record collection over there. I bet you have a lot of Hendrix.

Mrs. OWENS: Just make sure he doesn’t call you foxy lady.

JANE: So, I’ve never done this before.

Mr. OWENS: Oh, it’s nothing to be ashamed of. I’ll be gentle.

JANE: Okay, so here’s the Deed of Trust. Just initial here, and sign here.

Mr. OWENS: So you haven’t done the Deed or the dirty Deed yet.

JANE: I can attest to the fact that I haven’t, and bear witness to the fact that I’ve never been with a bare witness.

Mrs. OWENS: But, he’s not bare!

Mr. OWENS: Is that the naked truth?

JANE: I’m going to affix my seal now. Brace yourselves.

Mr. OWENS: Oh, that looks very therapeutic, just like… well, you know…

JANE: Well, I wouldn’t know. I’m not only a virgin as a signing agent, but I’m also still a virgin in real life.

Mrs. OWENS: Well knock us over with a feather. If you dropped any more hints, I would have gotten out my chastity belt. Can we affix you up with someone? I know a nice Notary who lives not far from here. He’ll understand all of that mumbo jumbo you folks talk about at signings that confuses us like scilicit which is an archaic Latin term.

JANE: Oh, I thought you were talking about soliciting which I’ve never done because I’m a … well, you know.

Mr. OWENS: If you did that with another Notary whose term hasn’t expired, you’d be doing it in the commissionary position.

JANE: I don’t even know what that is.

Mr. OWENS: Don’t worry honey, after a few more signings, you’ll really be on top of things… unless of course you prefer to have the signers on top.

Mrs. OWENS: So, what comes next?

JANE: I thought you’ve done this before. We just need to sign these last three documents, and then we’re done.

Mrs. OWENS: Okay, we’re done. That felt good.

Mr. OWENS: Was it good for you?

Mrs. OWENS: I think this was our best signing honey. I really liked how you signed the HUD. Wow Jane, you look completely different. Look George, she’s glowing!

JANE: Wow, I feel completely different now.

Mr. OWENS: Does it bother anyone if I smoke?

Mrs. OWENS: Since when do you smoke?

Mr. OWENS: I always smoke after a signing, or after a book burning if the book is 50 shades of gray.

30 Point Test Course Book: Synopsis

30 Points in Your Favor!
The 30 point course book is yet another certification course offered by 123notary.com. But, this one is different. Our original certification course was a very dryly written quick course designed to teach notaries basic competency in loan signing. Our Elite course was written in late 2012 and was designed to teach very sophisticated aspects of doing business as a mobile notary such as communication, marketing, hiring others, and the finer aspects of notary and signing agent work. This new 30 point course will have some elements from both of these previously written courses, but will focus only on the technical aspects of notary and signing agent work of all levels ranging from basic to very advanced. How is it different from the Elite course?
The Elite certification course was designed to get its students an upper arm in the notary business. It was designed to help them be a pro at negotiation, growing their business, and handling difficult strategic situations. The overall aim of the course was to help them make more money, grow their business, and gain attention from having the Yellow Elite Certification Icon next to their name on the search results. Notaries who passed are far more intelligent, sophisticated, and get a lot more work than their competitors in high spots on 123notary who lack the Elite designation. Based on my personal experience, I would vouch for the fact that a 123notary Elite signer has quadruple the signing agent knowledge as an uncertified signer. Although they don’t know everything, the depth and breadth of their knowledge is quite noticeable if you talk shop with them for more than a few minutes.

This 30 point course is only designed to teach notaries how to deal with technical situations like a pro, but not designed to help them get rich (although more knowledge never hurts). If you do well on the 30 point test, you can consider taking our Elite course. It will be easy for you if you got a high score on the 30 point test.

Summary of the 30 point course
The 30 point course will cover a wide range of notary and signing agent technical topics including following directions, best practices, understanding what information is where in the documents and more. Additionally, we added some entertaining stories to help make the text more enjoyable for the reader. There will be many stories which are designed to drive certain technical facts home in a pleasant and absorbing way.

Notary Stories From the Edge

Rarely, but sometimes, a notary signing agent will meet people who try to give him or her an unacceptable ID…or people who claim they really do not need an ID at all– because they do not want to sign! An ID must be government-issued; unacceptable forms of ID are fishing licenses, YMCA cards, or medical marijuana cards. Gun permits are government issued, and in some states are the most popular form of ID. You may have read elsewhere here about the mistress who actually had a fake ID made up so she could pass as the man’s wife and they could take all the money out of the home (!). Being sure people are who they say they are can be a real challenge, it seems.

The most unusual situation I’ve heard about is the time that, when asked for his ID, a borrower bragged–foolishly–to an Ohio notary signing agent that his identical twin had once gotten a driver’s license for him! He went to the Bureau of Motor Vehicles, posed as his brother, and obtained the license. Our Ohio notary signing agent reports, “This twin I was doing a signing for thought this ‘joke’ was quite funny, and then proceeded to tell me another notary had laughed about it, too…and had presumably accepted his ID without question…but,” says our cautious Ohio notary, “I then made this borrower take an oath that the identification he presented to me was in fact his driver’s license obtained by him–ditto his passport! Otherwise, it would not only be an unacceptable ID; it would be mortgage fraud! I also notified the mortgage company, and they agreed I had done the correct thing by asking the man to take an oath. Of course, this all made a dandy entry in the ‘unusual circumstances’ section of notes in my notary journal, where I recorded the details and the fact I had him sign an oath. I also sent an original page entitled ‘closing notes’ and included it in the package with the documents. I get a lot of work referred to me from this company now because they were impressed by my way of thinking and handling this guy.”

“Sometimes,” says another an Ohio notary signing agent, “I have come across a non-borrowing spouse who does not want to sign. These are often angry people who do not want the spouse to get the loan. In the presence of an Ohio notary, the non-borrowing spouse is usually required to sign the deed of trust; the truth in lending agreement;the itemization of the total amount financed; a document correction statement; an agreement about fees due; and the right to cancel. There may also be affidavits…so it’s always best to check with the title company. In any case, there have been many arguments between spouses where one does not see why he/ she has to sign, or one spouse does not want the non-borrowing spouse to sign and seems ready to dissolve the marriage!

One wife ended up walking out on her husband because he found out how much money she had spent–and why she was refinancing. The moment of truth! One husband punched a hole in the wall when he found out how much his wife had spent. Scary! It is always necessary to write it down in notes in your notary journal–and call the loan officer or a legal adviser–when there are any issues that prevent the signing from happening.”

Another Ohio notary told us, “One time when I asked for copies of a signer’s ID, she got nasty. She was the non-borrowing spouse, and she hated her husband; I can’t print here the awful things she was saying about him. It made me feel really uncomfortable. She also made sure there was no room to sign at the table, and then she put a huge glass of Coke on the table–right next to the documents. I was expecting her to knock it over any minute. When I asked her to be careful, she went to the refrigerator and added even MORE Coke to the glass until it was filled to the very brim. She took a sip– then refused to sign at all and started cursing. Then, I called the loan officer. After he got her all calmed down, we signed everything– but I had to go back the next day because an attachment was missing! The minute I drove into the driveway, she started cursing at me that I was wasting her time: “Are you STUPID?” was her greeting. As an Ohio notary, what did I learn from all this? Always check out the people really well before you take a job. If they seem at all irritable or peculiar, figure out if you really need this particular job.”

Notary Hell – “Yeah, but it’s a dry heat”

Welcome to Notary Hell

Notaries who have done bad deeds (or signed bad Deeds) in their personal or professional life are often committed to Notary Purgatory, or Notary Hell. Many Buddhist Notaries commented that there are seven heavens and seven hells, birth, death, and rebirth. In Notary Hell, the Power of the Devil, supersedes the Power of Attorney (even if it is Authenticated by the Secretary of State.)

In Notary Hell, misdeeds, negligence, and malfeasance are considered good things, although they prefer active acts of treachery.

Common Experiences
Notaries who are condemned to Notary Hell are subjected to all types of cruel, but not unusual tortures. Some notaries have all of their documents burned in the eternal fires of hell. Others have to do a daily signing for a “reader” who reads every letter of every page, and then claims not to be sure if they want to sign. These “readers” can take up to three hundred hours to complete a signing in 130 degree heat. The devils in Notary Hell are very despotic, they like to emboss the notaries around. One devil came around with a giant red hot steel embosser and embossed a notary’s hand. Other notaries are branded on their left shoulder with a red hot iron notary seal, so that it will be obvious which part of Notary Hell they are confined to.

One notary had a near death experience that he shared with us. His soul actually left his body. Unfortunately, because of all of the misdeeds he had committed (including backdating) that he went to hell. At first he was concerned that he was in hell. But, then after a few minutes he realized that he recognized half the people there since they were his Mortgage Broker clients.

Another notary commented that when he was in Notary Hell, everything he notarized was in invisible ink, so all of his work was virtually erased.

The Warning Signs
For those who are weak in terms of their conscious, a not so subtle warning sign is often sent to the notary from the higher world. The notary will be sent to Notary Hell for a few minutes in a dream, to scare the hell out of them. If the notary does not repent, the next time the notary commits a serious error or omission, the gates of Notary Hell will open up, and the Notary Devil himself will come for a personal visit to the notary’s official address based on their records with the Secretary of State.

Entry Procedures
All notaries are required to register with the Secretary of Hell, or as the locals call it, “The Demon Vee” within 30 days of arrival. You must have an identification document that was issued in the last ten years, but hasn’t been burned (or melted) yet. Notaries are required to take their Oath of Office. There is no prerequisite residency requirement for entry. Applicants must be 18 years or older and have committed a Felony or multiple acts of Mural Turpitude. There is no proctored exam necessary as an entry requirement for Notary Hell. References from scummy people are appreciated although not required.

But, you only get a cramped spot in the basement of the mansion next to the boiler room. Although Notary Hell is horribly unpleasant, due to funding cuts in the Secretary of Hell, most of the torturous punishments have been put on hold — at least for now.

DEVIL: Welcome to Notary Hell

NOTARY: But, all I did was backdate a few times

DEVIL: You don’t know how that affected other people’s lives, do you?

NOTARY: Are you preaching to me?

DEVIL: Well, I’m not exactly the most credible of witnesses, but let’s just say, that I’m aware of the severity of your mal-actions.

NOTARY: So, what now?

DEVIL: It’s time to get you registered. Right this way.

CLERK: ID Please?

NOTARY: Here it is. By the way, it’s hot in here!

DEVIL: Yeah, but it’s a dry heat.

CLERK: Have you visited Notary Hell before?

NOTARY: The time when my client wouldn’t turn down his TV came pretty close.

CLERK: Birth and death date

CLERK: Well, we like to keep track of these things. We like to keep accurate journal entries, just like good notaries are supposed to do — hint, hint.

NOTARY: Journal Schmournal. So, I kept a journal. People signed it. Big deal.

CLERK: We take these things very seriously in the brighter world. If it had been a lesser infraction, we would have sent you to Notary Heck.

NOTARY: Okay, okay, okay. I got it.

CLERK: If every notary were as negligent as you, the entire profession would be compromised. Ha! More business for me!

NOTARY: Okay, so what now?

CLERK: Now, we take you to your accommodations. Follow the demon dressed in red, and take a left at the pitchfork in the road.

NOTARY: Got it.

DEMON: Welcome to Notary Hell.

(walking to the notary’s accommodations)

NOTARY: Oh, look to the left. I didn’t know Saddam Hussein was a Notary.

DEMON: Little mix-up. We sent him to the wrong hell.

NOTARY: Oh look at those cauldrons, notaries are being boiled in oil.

DEMON: The one good thing about having Saddam around is that we never run out of oil.

NOTARY: Just out of curiosity, is there wifi here?

DEMON: No, but we have cable. We have the Kardashian channel playing 24/7.

NOTARY: Is this my cell?

DEMON: Here’s your palatial estate.

NOTARY: And you call this notary hell?

DEMON: Yeah, but now all your dead relatives know you have a palatial estate and they’ll be visiting you in one hour. And by the way, the thermostat is on the mantle. You can turn it down to 130 during daylight hours — if you like.

NOTARY: That’s quite thoughtful of you.

DEMON: Shhhh. don’t let that get out!
