Bounced Checks, Collection Agencies, FBI reports: Learn which companies are involved!

Bounced Checks, Collection Agencies, FBI reports…

For some of you, this is old information that you have already been following. However, many notaries do not have time to read everything that goes on on the forum, and this news about signing companies will be of interest and a convenience to them!  It is hard for me to keep up with what is going on on the forums on a daily basis, but I have noticed that a lot of bad things happened in September 2011.  There were a few loan signing companies that had a reasonable reputation that suddenly stopped paying notaries.  One or more companies was reported to be out of business.  I am going to summarize the more important events of the last month or two here. I will only mention the more noteworthy signing companies here.
 
All Service Notary & Signings
Sept 16 – A notary gives up on trying to collect their bill and hands it over to a collection agency. Additionally, this notary reports the signing company to a credit bureau!  Another notary reports trouble getting paid from this company.  A third notary says, that after a long time, they finally received their check — but, that was in early August. The situation looks like it has deteriorated since then.
 
CRES Closers
One notary says that they are the BEST to work for!  Another says they met his fee and that they were great to work for. A third notary claims that they sent payment super fast!  Wow, it is nice to hear good things about a signing company these days!
 
Equifax Settlement Services
One notary got paid, but says the company says that they will take THREE MONTHS to pay for jobs in the future because they have to wait until the loans fund.  Another notary discusses the letter they sent to the BBB about this company. A third notary discusses the difference in what this company offers different notaries for the same work.  One gets $85, while another is offered $125!
 
FASS – First American Signature Services
Notaries are complaining, but not about payment issues.  One notary was taken off the list because FASS found a less expensive notary.  Back in 2010, FASS took over service for a big Title company and dropped the notary who had been servicing the signings for that Title company.  Another notary feels that they were treated rudely after some sort of argument about “quality issues”.  Although there is a lot of complaining going on here, I don’t see any wrongdoing on the part of FASS. They are just shopping around to find the best notaries for them — and trying to get high quality service as well. America is a free country and nobody is obligated to keep the same notary for life.
 
Final Link
Three notaries have complained that this company doesn’t do a good job of getting back to people. Not returning calls, etc.
 
First Preference Signing
Four notaries all claim in unison that this is the best company that they have ever worked for. 
 
Harvard Abstract
Three notaries are claiming that this company is easy to work for and that they pay quickly.
 
HVR Notaries
Two notaries claim that this is a good company to work for.  One says, “They met my fee”, which is a very good sign these days with all the low balling.
 
Insured Closings
Notaries claim that there have been several reports of BOUNCED CHECKS from this company.  Watch out!
 
National Loan Closers
This company is reported to be asking for $25 to keep notaries on their list. This is causing a lot of disturbance in the notary world.  Notaries feel that companies should be paying them, and not vice versa. 
 
Nations Direct
We have gotten many complaints about low-balling and micromanagement. One notary’s signing was interrupted by a phone call, where she was asked if she was using a blue pen.  On the other hand, it is prudent for a signing company who uses many newer notaries to call and check up on people. Obviously, many of the notaries they hired screwed up and ruined many loans which is the reason for all of the babysitting.  Please try to look at things from the signing company’s perspective. They are trying to get the job done.  Also see: Nations Direct has been around for more than a decade!
 
Nowclosings.com
Many notaries are claiming that this is one of the BEST signing companies they have ever worked for.

N3 Notary
A few notaries are complaining that company has badgered them too much during their signings. 

Pacific Document Services
Checks that they sent out have allegedly gotten LOST in the mail. One notary has filed an official complaint with the FBI to try to get this company shut down. Another notary received a check that BOUNCED.  This is one of the most serious cases I have seen all year!  The opinions expressed here are the opinions of particular notaries and not of 123notary.com.
  
Safir Signing Agents
Multiple notaries are complaining about no-pay and SLOW-PAY.
 
Service Link
This company has lowered their fees, and we have had many complaints from notaries about LOW-BALLING from this company.
 
Superior Closings
The people that run this company have been functioning under four different business names over the course of time.  They are reported to be out of business now.
 
The Notary Biz
Many notaries are discussing whether or not this company is still in business.  One notary had a discussion with the owner who claimed that they were no longer in business.
 
The R&R Group
Several notaries are complaining about non-payment, and one is owed $375 by this company
 
Trans State Services
Many notaries are really happy with this company.  Good working conditions and timely pay!
 
Vital Signings
This company has a good payment record, but many notaries are complaining that there are too many steps involved in the signing process and a lot of babysitting.

Speaking of the opposite, Seinfeld’s George changed his life and career around in the much remembered and loved episode, “The Opposite,” by doing just that: The opposite. If you don’t want to be unemployed and living with your parents, you need to start really nailing your notary and signing agent knowledge, not to mention your communication and following direction skills. Do you follow me?

George Costanza, the notary, is doing everything wrong.

GEORGE: It’s not working, Jerry.

JERRY: What’s not working?

GEORGE: I’m trying to charge too much, and settling for too little! I’ve been advertising on one of those other notary sites that do nothing to move my business forward. I haven’t been studying enough for my certification test. I haven’t even cracked a book.

JERRY: I’d be more impressed if you read one. So here’s your chance to do the opposite. If you work harder, get more experience, you’ll be able to charge what you’re worth! And advertise on 123notary.com.

GEORGE: And the heck with my paid listing with Notary Rotary and a free listing with no certification on 123notary.com. I’m gonna do the opposite!

JERRY: If you aren’t certified, do the opposite. Go to elite certification!

GEORGE: Does being a certified lunatic count?

JERRY: Nope. The opposite.

GEORGE: I will do the opposite! I’ll know my terminology. I’ll have more buzzwords than a beekeeper. I’ll know my documents.

JERRY: Other than the pages that say “this space intentionally left blank”?

GEORGE: If it was really intentionally left blank, they wouldn’t fill it up with words that say “this space intentionally left blank.”

JERRY: Good point.

GEORGE: Look at me, Jerry. You’re telling me I made a good point! It’s already working! I’ll finally know what I’m doing and won’t just wing it!

JERRY: Good! Not knowing what you’re doing and just winging it never got anybody anywhere. Unless you’re Donald Trump or work for Wingstop.

George should go from not reading any notary materials to reading all of them. Even change the people he’s dating. From dating no-notaries (who, after he broke up with them, swore but never under oath) to dating notaries! As for the former, they were office shredders. The opposite of those who keep records! At least he’s dating the opposite sex. So he’s on the right track, unless you prefer the opposite of the opposite, not that there’s anything wrong with that.

Instead of certifying a copy of a vital record, George does the opposite and obtains it from the agency that holds the original vital record. Instead of not getting paid for travel time, George does the opposite… and doesn’t get paid for sitting on his ass. Meaning if you want to get paid, don’t sit on yours! Are you not done reading this? Do the opposite!

E&O insurance: where do I get it & how much do I get?

Everybody is getting E&O insurance these days. Ironically, the only notaries who I have heard about having claims on their policies are the ones who went overboard and got a million dollars of coverage just for show which turned them into a target. But, on a brighter note, you need E&O in order to get hired. Yes, it is more of a fashion show than something you actually need, but the fact that signing companies don’t take you seriously if you don’t have it makes it a necessity. The question is — how much & who do you get it from?

Lots of vendors sell E&O insurance.
Notary Rotary sells it. NNA offers one stop shopping for notaries including E&O. One notary claims that Merchant Bonding offers the best rate on E&O. One notary said that Traveler’s charged him only $170 for 100K for four years which is excellent as others charged $265 for the same coverage. It seems that companies that cater exclusively to notaries do not always have the best rates on insurance, although the convenience of one stop shopping makes it worth while to pay a little more.

How much should you get?
The quantity of your E&O depends on who you are trying to impress. If you just do signings for signing companies, perhaps 25K is enough. If you are full-time and want to appear professional, it is better to have 100K rather than claiming in your notes section to be professional. Don’t say it — show it! If you want to work on the white glove list for major Title companies, then 500K or a million might be in order. I don’t know what that costs, but if you are getting paid big bucks regularly, then whatever they charge is probably worth it.

We get complaints from notaries every single day who are not getting paid on time, or not getting paid at all.  Since I care deeply about this situation, I have networked with Carmen (who I work with), and a few other very seasoned notaries to create a system for getting paid which is almost foolproof.  Nothing is perfect, but this system is as good as it gets.

How to make sure you get paid signing agent  
Our system starts with the notary background checking ALL companies they work for.  Asking for references, and checking the company on the BBB website is a must.  If you already accepted the job, you could cancel if they have a margin of a few hours.  Otherwise, take your chances.  Keeping faxes and work orders in order is critical, and keeping the stub from company checks is a life and death issue. This is all talked about in detail on the how to make sure you get paid page. Notaries need to fax fills regularly with all pertinent information on the fax.  But, if you did everything right and STILL didn’t get paid — there is the template of our demand letter.
 
A notary used our demand letter, and the company threatened her with a LAW SUIT!!!
Oh my gosh!  Is it really true?  Actually, the notary only sent a “watered down” version of our template letter, but the reaction was almost postal…  The notary stated that they repeatedly contacted the company by phone and email, but never got paid for various jobs done. Then, the notary said that they would take the following actions by a particular date if not paid:

a.         Notify the Attorney General of the details and circumstances of the occurrence.
b.         Notify the Secretary of the State of Texas to look into the matter
c.         Notify other notaries public of the details of non-payment.
d.         Register the details of the occurrence with the BBB.
 
The signing company got back to her and said…
 
I feel obligated at this time to inform you that Ck # 15533 for $45 cleared your bank on 7-11-11, presented on 7-8-11 for Account #134554 (for a particular name).  That was less than 13 days after i sent you the email asking you to do the notary job in the (name of town), TX area.  Your email is making libelous or slanderous threats against myself and my company for which you can be sued in civil court  (i.e. notifying others in the industry that I do not pay my bills).  I feel it is now my duty to report you to the Texas Notary Division of Austin for making such threats when I can prove that you were fully paid within 2 weeks of the service provided.  I will be forwarding a copy of this email to them immediately.   It is a shame that you did not do your own research regarding payment of this service, before making such libelous threats…. (name of owner),  (name of business)
 
My opinion
I think the notary should have listed the particular jobs that were not paid for, i.e. the names of the borrowers, loan numbers, addresses, etc. I think that the notary should have kept track of all payments and all of the check numbers of all payments in the past, so that she would know what that check was for, and if it even existed.  It is easy for signing companies to scam notaries by making up fake check numbers. Most notaries don’t keep good enough records to keep track of it all — but you have to — or you might never see your money…

Welcome to the Notary Zoo!

After visiting the Notary Zoo for the first time, I noticed that things were a little “different” there. There were animals that didn’t exist in real life, and situations that were often opposite of what they normally were.

Before entering the zoo, right before the entrance, you see a huge venue carved into the granite floor. The venue says, “State of California, County of Los Angeles.” I’m glad the zoo helps me remember where I am because at that place, it’s easy to forget. Then, I went to pay my entrance fee. There was a huge sign saying that all customers needed to “personally appear” before the ticket seller with the seal of approval, who won the crowd’s approval after the seal juggled a ball on its nose. I needed to produce positive identification, asked how much it was to visit the zoo, and the clerk said it depended on how many signatures I wanted. I wanted admittance for just myself, which would be one signature at $10 per signature. The lady stamped my ticket and let me in.

As Trump might say, the zoo was “huge.”

There were walkways going every which direction. To the left I saw the Juratffs. I had never seen a Juratff before. I asked what I was supposed to do there, and the guard said that people swear at this animal all day long. So, I said, “I solemnly swear blah blah blah.” But, the juratff ignored me and kept eating leaves. At least he stuck his neck out for me. In the next exhibit down the corridor I saw a giant refrigerator with a sign saying, “How can you fit a juratff in a refrigerator?” Then a baby juratff waltzed in the refrigerator, stuck its neck out the hole in the top, and munched on some low hanging leaves.

Don’t feed the Notaries

Next, there was an area where some Notaries were hanging around. The visitors were led down an underground passage and then up some stairs into a huge cage that had a sign: “Don’t feed the Notaries.” The Notaries just went about their business and ignored the tourists’ constant taunts and whistling. The Notaries sat at desks, walked around, ID’d people and stamped pieces of paper. I didn’t understand the logic of this as they were notarizing other Notaries and not getting paid. Later on I learned that this was some sort of an asylum for people who were convinced that they were Notaries, but never passed the state Notary exam for reasons unknown. They were NOTaries.

The next exhibit had a Notary comedian. Not only was there an applause sign. There was an applause signer.

He started cracking jokes. “How do you define a loose acknowledgment? It’s an acknowledgement that attaches itself to different documents — on the first date before it even knows your first name — at least the first name on your ID.” Then our comedian friend made another joke about pastry. “I just found out that a Mexican wedding cake is exactly the same thing as a Russian tea cake. They are both two inches wide and made from shortbread. I guess one man’s tea is another man’s wedding!”

They just sat in the tree all day long saying, “Hoo — is the signer?” Next to the owls was the judge from Noternity court who said, “Who is the signer? Who is the Notary? We’ve examined the DNA evidence and handwriting analysis and you ARE the Notary!”

The aquarium was next on my list.
I went down a dark hallway into a pitch black room, turned a corner, and then I was in the Notary Aquarium. I saw a guy swimming in the tank in a three piece suit with a briefcase. I asked the guard why the sharks don’t eat him. The guard replied, “Professional courtesy — that guy’s an Attorney.” Then I saw another guy wearing a suit who just got his leg bitten off by another shark. Blood was filling the tank. I looked at the guard and he said, “That one’s a Mortgage Broker. He’s the one who asked people to backdate, and didn’t pay his Notaries on time.” It cost him a leg if not an arm. I journeyed into the next room in the aquarium and saw a bizarre looking fish. It looked like a hammerhead, but on closer inspection it was a stampfish. His head looked like a huge rectangular Notary stamp. I said to the guard, “It’s too bad there is no paperfish that the stampfish can stamp.” The guard said, “Where there is one around here, there will be a squid just waiting to donate some of his precious ink so the underwater Notarization could happen.” Then, lo and behold, a paperfish appeared from nowhere. Instead of stamping the paperfish, the stampfish took a bite out of it. I asked the guard what happened. The guard informed me that the stampfish was offended that the paperfish hadn’t been signed and dated — this was his way of voicing his underwater displeasure. Then I saw another stampfish who looked like he was high. The guard explained that he had a constant supply of really good sea-weed, and one or two bites of that will get you very high. On my way out of the aquarium there was a huge underwater building. The sign on the building said underwater county recorder. Inside the building there was a huge line of stamp fish. My only thought at this point is — I hope these stampfish have waterproof journals!

On my way toward the exit I saw some lions swearing under Oath. Lyin’ and swearing to uphold the truth – Isn’t that an oxymoron? Then I saw some sheep being sheepish about their loan signing. But they couldn’t pull their wool over my eyes. There was a huge section where there were boars that specialized in 400 page signings where you read every page. It nearly boared me to death. And finally a bobcat who swore under Oath that he was legally Robert Cat.

Finally, I went to the aviary.
That place is for the birds! I saw some birds signing a health directive so they could fight against avarian cancer. I tried to explain that it is o-varian cancer, but they claimed that there are certain types of cancer that only birds get in their old age. Then, an eagle swooped down to avoid one of the guards who was trying to ID him for the Patriot Act.

In any case. I enjoyed the zoo. It was fun. I was slightly disappointed that I couldn’t get a souvenir of a waterproof journal in the gift shop, but maybe next year.

Threatening for payment?

Taking the job
I dont like to do a job and then have to threaten folks to get paid. It goes against my general fiber and overall nature. I excel at what I do and expect to paid accordingly.  I took a job toward the end of the month (May). It was a settlement company. You know the ones that broker the rich and famous insurance polices that are worth 4 or 5 million and they pay out  a fraction of what they are worth, and then wait for them to  die so they can collect the full value of the policy. This is similar to JG Wentworth’s policies.

Agreeing on a fee
Well, we agree on a handsome fee of 150.00. I successfully complete the assignment.  Nothing eventful and everything went well. I was even early..:)  After the completion of the assignment, I completed a W-9 and submitted an invoice and patiently waited. After about 2 weeks I emailed my contact on a Monday and was told that I would have payment toward the  end of the following week.  My eyebrows cautiously started to rise, but, I understand company billing policies, so I let it go. By the following week on Thursday there was no check. I emailed once again, and the reply I got was that they had missed the cut off and I would receive a check at least by the next Friday.

Contacting the signing company’s client for payment?
Now, I am becoming VERY angry. So I wrote back that this sounds very much like the run around to me and it is unacceptable . I also let them know that if forced I will have to take matters into my own hands meaning that if I don’t receive payment ASAP I will be contacting their client for payment. With correspondence sent I waited. The following afternoon I receive a brief response. and I quote  “Carmen, accounting pushed your check and it’s in the mail” And I thought to myself. Great BUT why did I have to be strung along and lied to in the first place. Why didn’t you just cut the check and be done with it.  It has been a month already. Why did I have to threaten you and worse  yet  now our relationship has been strained and severed. I am confident they will never call me again Nor do I want them to. I don’t want to have to put up a fight to get paid. If I perform a job without incident and give it 100% with no error on my part I except to get paid. PERIOD. I have every right to expect this. We have every right to expect this!!!

It is a shame that we have to resort to all sorts of threats, trickery, letters/emails phone calls, etc just to get our money. This is a job in itself and It is very time consuming to keep up with these slow or no pay companies.

In closing, I know the task itself is hard but you have got to stay on top of it. As one of our notaries expressed to me…the longer you wait to try an collect the more likely you never will see a dime…..and this is the sad truth. PLEASE Check out these companies when you can BEFOREHAND.  It is not entirely foolproof but it can help weed out some of the bad ones before it costs you in time and money! Be on top of your billing, comply with all their billing request, such as W-9’s and start the collection process early.
