Marcy, The Baby, and the FHA Signing

Marcy was a little big traumatized after her last signing, but she wouldn’t be able to face her neighbor Patricia if she quit now. So, she decided to just do it. She waited patiently by the phone as she watched her toddler. Her husband often worked nights, so she was all by herself with the exception of her screaming child.

And then the phone rang. It was Nicole from Hawaii Title. They needed a loan signed that night and couldn’t find anyone.

NICOLE: Hi, this is Nicole from Hawaii Title.

MARCY: Aloha. (child screaming in the background, radio playing loudly too)

NICOLE: I hope that’s not a dissatisfied customer.

MARCY: No, he’s a little cranky tonight. I just told him a bedtime story called Snow White and the Seven Lenders. Don’t get me started on Grumpy.

NICOLE: Oh, is this the one with the wicked Escrow officer who gives her a poisoned prepayment penalty?

MARCY: No, that part was too scary.

NICOLE: Well, we have an FHA loan we need…

TODDLER: Wahhhhh! Wahhhh!

NICOLE: Is something wrong?

MARCY: Oh, well Chuckie doesn’t like the word FHA. You see, in the story, the evil Escrow Officer did mostly FHA loans.

TODDLER: Wahhhh! Wahhh!

NICOLE: Okay. No problem, I’ll call it a Federal HA loan. I know it can’t be easy raising a young child. But, it’s not easy for callers to endure any type of distractions. I noticed that not only is your toddler screaming, but there is also a radio playing in the background. Putting aside how difficult to hear you over this noise, it is also considered very unprofessional to have any type of background noise on a professional call. I’m sorry to give you a lecture on this, but I think you sound serious about this business and you need to know. Many companies just won’t hire you if they sense any unprofessional behavior on your part be it oral communication, if your notes section has spelling mistakes on 123notary, or mistakes on loan documents.

MARCY: Oh, I had no idea. But, that makes sense, now that you tell me. I’m just so used to Chuckie, that I don’t realize that other people might not be so immune to his antics. I’ll put the baby in the other room. And my husband will be back soon, so I can go out to do a signing the minute he returns.

NICOLE: Okay. Just keep in mind that FHA… oops, I meant to say Federal HA loans, take considerably longer to sign than straight Refinances. But, I will be on the other end of the line the whole time in case you have questions. And we require fax backs.

MARCY: Okay, 123notary told me that companies that require fax backs do so to ensure that the loan is correctly signed when a beginner is working for them. This makes sense as I am a beginner — a very enthusiastic beginner. So, I won’t complain about fax backs like the other notaries!

NICOLE: That’s what I like to hear.

MARCY: Bring it on!!!! I’m ready for your FHA

NICOLE: Wahhhh… Just kidding.

Point (2) The Note
The Note (also called ‘the agreement’ by some companies) is the basic contract between the borrower and the Lender; it includes the basic terms, conditions, and information about the loan being signed.

The Note includes:

(1) The Rate

(2) The Prepayment Terms (these are usually explained in two paragraphs on the first or second page)

(3) The Payment Amount of Principal and Interest (this doesn’t include taxes and insurance).

(4) The day that monthly payments are due.

(5) Penalties for late payment

(6) The amount of the loan

The Note also specifies that it is secured by a ‘security instrument.’ (This will be discussed in the next section, specifies where to make payments to — many other kinds of information are also in the note. It is simplest to understand the note as merely a list of agreements, as previously mentioned. Adjustable Rate Notes. This document is a note with information about what the adjustable rate is based on and how it can fluctuate.

Please note that the best place to look for information about the prepayment terms are in the Note or a Prepayment Rider if there is one, and NOT on other documents as other documents do not have thorough information about this topic. Please also note that The Note is not normally a notarized document.

Low Ball Signing Companies

Low Ball Signing Companies

Notaries are always complaining about low ball signing companies. My advice is to just say yes or no. As long as its quick and they pay you, you have nothing to lose, but your dignity. Sometimes a quick $40 is not so bad. If it takes you an hour or slightly more for the whole affair, that is not bad pay. Just don’t take a low ball job and have to do fax backs, and wait for two hours while the borrower reads each phrase of each page and asks a million questions.

Tough times are here
We are living in tough times, and people in foreign countries live on a quarter of the income you have. They have simpler habits and smaller cars or mopeds. They eat less meat and more beans and rice or “Rad Na” if they live in Thailand. Its better to take what you can get and save up for a rainy day. I used to work for very little. When I was booked, my prices would go up. When things were slow, I would accept jobs for very little, no matter what. My bills didn’t care how many dollars per hour I made. My mistake was not to ask for high amounts of money. Some people and companies will pay you double what you think they will. Just ask. If they say no, then take less if you have to. Its better than starving.

Your lives are not that bad
Assuming you don’t have a health emergency and are not having your life threatened by your local gang, and assuming that a tsunami didn’t visit your neighborhood, your life is not that bad (I’m guessing). As a world traveler, I see how middle class people live in India. Broken roads, clunky cars, the other drivers’ purpose in life is to run you off the road and kill you, food that gives you dysentary, traffic from hell, salaries 20% of what Americans make, expensive rent, cab drivers that always try to rip you off. Just crossing the street in Pune, India is an ordeal that most of you will never have to face. Additionally, they have terrorist attacks on a regular basis and its not safe for women to go out after dark. Few of you have any of these situations to contend with. So, count your blessings. Even in America, I know many who work for minimum wage who ride a bicycle to work through dangerous areas. If you own a car, you are doing better than my bicycle riding friends who can barely pay their rent.

Vital Signings
……If you want to support Vital signings be aware YOU will not make any money. After a dozen signings I calculated I made $18.00 per signing. They get the bucks, you don’t.
The best micro-managers in the business. What a pain. They can’t pay me enough to work for them again.

Firma Signing Solutions
…..So, you can imagine how hard my chin hit the floor when he quoted $35.00 for the whole thing! The low ballers fail to remember what all it takes to become adept at this job, you have to know what you’re doing. You’re not “just a notary” but a certified signing agent, which takes training and education to fully understand this process. I will just decline the job if the price doesn’t meet my fees, it’s just not worth it…..

Fax Backs
…. (scroll to the bottom) Has anyone else had jobs recently where they want the whole package faxed back? I have had two from Nations Direct. Of course, as usual, they are low balling the price and then state that the whole package needs to be faxed back. Both times I have told them I will not do a job for their low price, especially with all of the fax backs. Yesterday, for example, they asked me to go 30 miles away with edocs and fax back the whole package for $70. I don’t think so.

Question 2 Price Formula
……Rule of thumb: The lower the offer, the bigger th PITA it will be. It never fails….when you agree to a lower fee, docs will be late, the closing will go awry somehow, you will have a ton of fax-backs and need permission to ship…AND…you’ll wait at least 60 days to get paid the low ball fee. HONEST !! ………

Pricing for notary work: different strokes for different folks

Pricing for notary work – different strokes for different folks

Notaries argue endlessly about what to charge and what others should charge.
Some notaries wish that there could be a set fee in the industry for certain jobs. That is not legal or possible. Other notaries complain when low-ball signing companies offer them work for $40 or $50 which is better than nothing. Many notaries complain that they did lots of work and didn’t get paid, which is a very serious issue. So, what should you charge and why?

What fancy signers do
I know of many signers who will not leave the house for less than a particular set fee. One notary public I know will not leave the house for less than $150, while others will not leave for less than $125. They figure that they have to put up with getting dressed nicely, traffic, borrowers who want to take forever reading, lenders, and then trying to get paid. It’s just not worth it for less. But, these notaries have something that some of the rest of us don’t always have: something to keep them busy during the rest of their time when they are not doing notaries. If you rely exclusively on mobile notary and signing agent work to keep you busy, you have to take almost every job that comes your way. If you sell insurance, real estate, or have some other type of job, then you can pick and choose what type of notary work you do. If the company has a bad reputation, or doesn’t pay enough, or if the job is even one mile outside of your coverage area, you have the luxury of saying no.

Additionally, many high-priced signers will not leave the house to notarize single documents for less than $50 travel fee no matter how close the job is. Finding notaries who are available, close, and answer their phone is hard, so you can often get high travel fees if people can find you.

FYI: Notaries who are in the high price range generally have experience and finesse to back up their high prices. They are normally very reliable, well trained, well dressed, and have good business skills. Those of us who don’t have all of our skill sets polished will have trouble commanding such high prices for signings.

What desperate signers do
Anyone who is not a convicted felon can be a mobile notary . This profession is open and easy to get into which means that there will be a lot of competition and a lot of newbies who will do anything to get work. Some people become mobile notaries who are successful in what they do, but prefer the free lifestyle. Others get into this because they have mouths to feed, and this is the only way they can think of to sustain themselves. Desperate signers are often new in the business, lacking experience, and are poorly trained. They will often not be certified by 123notary, or NNA. They will not know what they can get away with charging, and the quality of their work? Who knows? Desperate signers will work for $40 per signing, do fax backs, drive long distances paying a lot for gas, and then often not even get paid. We wish these desperate types would consult us. We would tell them to research all companies before working for them. No matter how hungry you are, working for somoene who won’t pay you doesn’t make sense. You would be better off at home twiddling your thumbs.

What makes sense
We have another notary blog entry that goes over the components in price computations. Its very complicated and goes over many factors. The biggest factor is how desperate you are. If you don’t have enough work, then you need to become a regular for more companies. It makes sense to accept lower paying work until your schedule is filled slightly more than you can comfortably handle. Once you reach that threshold, then raise your minimum a notch or tighten your radius a notch. Supply and demand is the ultimate deciding factor in what you charge. No set fee schedule or recommendation from a friend can help you here.

Should I mention what I charge in my profile?
As a general rule, we say no. Notaries change their pricing all the time, and with all the variables, you would have to write a novel to document exactly what you charge. Its easier if someone just calls and asks. The low-ball companies call (bother) everyone, so you won’t be left out by them. The high-payers start with the top of the list and gravitate towards elite certified folks. Changing your notes section to include fees doesn’t get you at the top of the list or elite certified, and won’t increase your business by much if at all. Companies who know what you charge will still bother you to offer you jobs at half of what you charge.

Marketing Marketing Marketing
The main thing to remember is to market yourself well. If you have a bigger net, you catch more fish, and then you keep the ones you like. Even if you are busy, having more offers doesn’t hurt. If you can take more jobs from companies you like, and decline jobs from companies who are less than your favorites, that is a beneficial way to go.

Notary Hotel 2 — the sequel

Welcome to The Notary Hotel, for all things notarial.

Customer: “Wow, this hotel is so notarial, even the notepad comes with Jurat wording!”
Reception: “We cater to a very specific market over here.”
Customer: “That is great, but honestly, at one of those other Notary Hotels, there were ink stains on the wash cloth!”
Reception: “Oh, I’m very sorry to hear about that. That must be the hotel on the other side of town that is currently out of commission, right?”
Customer: “That’s the one, but I don’t like to mention names!”
Reception: “I understand”
Customer: “And they were annoying too. Each room had a fax machine, so they could fax the bill to you, and they required three dozen fax backs before they would let you check out!”
Reception: “Sounds like that other notary hotel, or the Notel, as we call it was owned by a signing service.”
Customer: “Tell me about it.”
Reception: “We are notarial, but in a good way over here, well at least we like to think we are. You’ll enjoy our notarial breakfast. You get an embossed waffle. Instead of having the regular grid, you will get a huge impression of a circular embossed notary seal. Instead of an expiration date on the seal, we say — best if consumed before 6-01-2014 — for example.
Customer: “I’m hungry already.

Can you expedite my express-o?
Reception: “Then, you’ll enjoy a cup or two of our signature French roast coffee — but, you don’t have to notarize the signature.”
Customer: “Great, because I don’t feel comfortable with foreign language notarizations.”
Reception: “Oh no, it’s not a French language roast, the coffee is English speaking, and so is the signature.”
Customer: “In that case, that will be fine. I prefer espresso though.”
Reception: “Well, since we are a boutique hotel, we can make espresso upon special request.”
Customer: “Can you expedite my express-o? No pun intended.”
Reception: “And over here, instead of paying by the night, you can stay for a pre-arranged number of days, weeks or months — we call that period of time a commission!”
Customer: “Boy, you guys are just too notarial. Next thing you know, I’ll have to take a proctored test to stay here.”

What type of Notelarization?
Reception: “Well, we test you in other less pronounced ways — to make sure you know what you’re doing. Can you sign the register please, I mean the journal? We like our guests to sign it. We’re a bit old fashioned.”
Customer: “So, where you do you want me to sign it?”
Reception: “That was part of the test. You are the notary, you are supposed to know. You sign in the signature section!”
Customer: “Right… what was I thinking. I’ve been doing this job for twenty years and still have to be reminded! I’ll put the type of Notelarization as well — acknowledged overnight stay.”
Reception: “Super. Let me check your ID, to make sure the name matches the one in the journal. Your ID says, Ralph E Emerson, and you signed Ralph Wemerson? Am I missing something?”
Customer: “Well, over time, my E became sideways and began to look more like a W. You understand, right?”
Reception: “Well, at least it’s not like Wang Zhu Ming from China who signed in Chinese characters.”
Customer: “That’s nothing, I had an Egyptian who signed in hieroglyphics once, or at least it looked that way!”

Standards at the Notary Hotel
Reception: “At our Notel, we have standards. If any of the maids fails to abide by the following regulations, their commissions can be suspended, revoked, or terminated.”

(1) Failure to require the guest to sign for their food delivered during room service
(2) Failure to administer an Oath for the late night lasagna Jurat
(3) Failure to honor the 3 minute right to rescind on midnight tacos

Affidavit of Maid Services must be signed at the door. The date and time must be documented as well, along with an indication of the type of maid-torial act. For example, they could acknowledge that they made up the room.

Customer: “It sounds wonderful. This Notel operates for the benefit of the customer. What about late night pay-per-flick. Is there a rescission period for that if I don’t like the movie?”
Reception: “Yes, you can mail, or fax your…”
Customer: “Stop right there, did you say fax? I’m out of here!”
Reception: “No wait… come back…”

Commission Impossible…

COMMISSION IMPOSSIBLE

Your commission, should you choose to accept it, is for an impossible mission that few notaries’ businesses live to tell about… The ones not worth commissioning…

Look out! The signer isn’t present! Right behind you! That document is incomplete! Not a good sign – The signer is the notary’s spouse! Watch out! The signer can’t produce acceptable identification! If their driver’s license picture is Waldo of “Where’s Waldo” fame, beware! Whether you can spot him in a crowd, or not, Waldo doesn’t really exist! Danger! The notary has a financial interest in the transaction! In that case, your interest must be in finding a commission impossible!

Oh no! The document doesn’t have a prepared notary certificate! Prepare yourself for disaster or no commission, whichever comes first! Danger! The notary thinks the signer is being coerced to sign! Coerce yourself out of that situation! What’s that, you say? The notary suspects the transaction is fake or deceptive? That’s as conducive to landing a commission as landing a punch in a fake wrestling match!

Look out!! The signer can’t pay the notary’s fee? Commission impossible! The signer’s a minor? Commission impossible! The signer seems drunk? Face this sober fact – Commission impossible!!

Don’t let the signer intimidate you into notarizing when the law prohibits it! If you use good judgment, you’ll get the commission the right way. Oh, and since this is “Commission Impossible,” at the end you’ll also get the girl, even if you’re not Tom Cruise. If you’re a female notary, you’ll get the guy. Even if he’s not Tom Cruise!

Low-Ball Signing Co’s? How to get biz directly from Title

Do you get business from low-ball signing companies? Are you sick of it? Aren’t we all.
Notaries do a lot of reactive posts about bad offers, but look at it from a different point of view. Let’s be proactive instead of reactive here.

First of all, it doesn’t matter how many bad offers you get as long as you get a few good offers.

Second of all, if you have little experience or training as a signing agent, you are not entitled to anything better than a low-ball offer.

Third, consider this. Some notaries are saying that low-ball signing companies need notaries more than notaries need them. I think that if this were true, that no notary would work for them. Yet, notaries do work for them. However, if you have had it up to here with these bad offers, here is a not too sophisticated strategy that can get these guys to stop bothering you.

Take an offer from a low-ball signing company. Do a nice job with a smile. Do all the fax-backs, etc. Then, find out who the Title company is who offered this job to the signing company. Contact the Title company directly and offer them your services directly at a reasonable price.

Keep in mind that signing companies are in business for a reason. If they charge $150 and pay the notaries $60, why do Title companies use them in the first place? Signing companies can take huge quantities of work off the shoulders of Title companies with a 100% reliability rate. They not only supervise the work, but they guarantee that all of thework will get done correctly and on time, otherwise they get fired. But, what if you are a responsible notary who is a better quality notary than what those signign companies use and charge $85 to work direct with Title. Okay, that’s not enough. What about $95? Think about it. Make your offer attractive to Title and you can “steal” some Title companies away from these nitwits who keep texting you! Teach them a lesson.

On the other hand, I do not recommend contacting Title companies directly unless you have signed at least 700 loans, are certified by at least three agencies, and have a very stellar track record. Title companies don’t play around with beginner’s luck — they want professionals!

I won’t sign up with that company as too many notaries got cheated out of their just fees. They don’t care or give a damn!
