Your notary did what?

Tales of the outrageous.

MARY: My notary was so bad, he parked on my lawn and goofed on the notarization for the Deed of Trust as well as the borrower copy Deed of Trust.

SHARON: Girl, I can’t believe he did that.

MARY: Do you have a story too?

SHARON: I asked the Notary to do something exciting during the Notarization. He asked me what I had in mind. I said, “Do something fun with that seal, or something that I will remember long after the fact.” He said he couldn’t think of anything. Then he asked me to do something exciting, so I got on the table and danced. Then, he carelessly got his carry all bag tangled in my weave and all of my hair came right off.

MARY: And what did you say?

SHARON: I said, “Oh no you didn’t.”

MARY: You were clothed while you were dancing, right?

SHARON: Of course I was. What kind of a girl do you think I am?

MARY: Temporarily bald.

SHARON: Don’t go there.

VERONICA: I had an experience with a Notary.

MARY: I like the way you are talking about it. The way you phrase it it sounds like he did more than just notarize.

VERONICA: Oh, he tried. I had to practically chase him out of the house with a broom.

SHARON: Yeah I heard about that guy. The girls at the salon call him “The Notarizer.” Every girl he gets with he says he “notarized.” Wish I could have been there.

VERONICA: Excuse you me?

MARY: Hey, some people like getting notarized. To each their own.

ALICE: I hired a Notary to come to the house. When he left, he left with half my oxy-codene.

MARY: Looks like you’re going to have to go back to Mexico sooner than you anticipated.

ALICE: You’re telling me, and those border guards don’t play either!

NANCY: I hired a Notary once. He asked me — if I could be any notary item, what would I be?

MARY: Knowing you, probably a loose certificate.

NANCY: Well at least my certificate got filled out unlike some of the other people in this room.

ALICE: Damn!!!! So, were you a loose certificate?

NANCY: No, actually I wasn’t. I told him I would be a document date — tomorrow at 3pm. The Notary was fine!

ALICE: That’s a date and time, but it works. And by the way, not many Notaries are fine other than Jeremy, and that’s only if you can put up with his jokes.

NANCY: Who?

MARY: Never mind. I think that pretty much wraps up our session. It was fun.

Getting paid – a comprehensive timeline

Many Notaries have a problem getting paid. It’s not you — it’s the industry. But, by using good principles, you can avoid most of the drama. Here are some guidelines to help you through every step of the process.

BEFORE THE SIGNING
When you get that call from a particular company, you need to either have records on each company out there, or be able to look them up. That means you either need online records on a cloud, or accessible from your iPhone, or have a cheat sheet in your glove compartment with up to date records on all signing companies. You need to keep track of:

1. How many jobs have they given you
2. Payment record — average # of days to pay
3. How much outstanding
4. Are they pleasant to work for
5. Cancellation rate.
6. What is their track record on the forums and 123notary’s list of signing companies.

If company cancels too much, you should up their rate or make them pay a cancellation fee or nonrefundable deposit up front, otherwise you will be left holding the bag (and the freshly printed documents.) If a company owes you more than a few hundred, you should deny service until they pay up. If a company has no track record with you, please consider asking them to pay up front via Paypal. If you are a newer signing agent and desperate to get experience, you should be more flexible and take more risks so you get experience. People who use 123notary reward Notaries for having a lot of experience.

You can check new companies on your iPhone while on the road to see how they do on the various forums and 123notary’s list of signing companies with reviews. If a company has a bad track record of payment, you should charge up front or you will likely get stiffed. Some of these companies have no remorse.

CONFIRMING THE SIGNING
Confirming the signing using our tips in the real life scenarios section of Notary Public 101 will not help you get paid, but will help you reduce the amount of signings that end in mid-air. If the signer doesn’t have ID with matching names, or if the other signers aren’t going to be there, or if they don’t have that cashier’s check they need — you are better off not going to their house as it will be a waste of time. Signings that end in “no signs” often do not get paid, so by avoiding this type of scenario, you will have less unpaid jobs as a total percentage.

AT THE SIGNING — MISTAKES
Most Notaries brag about how they have a 99.9% accuracy rate. The truth is that most Notaries make mistakes from time to time, and sometimes FedEx or the Lender screws up too resulting in a second trip. In my experience it is very hard to get paid for a second trip. Companies will often offer to pay, and then not pay you. So, triple checking your work and getting packages to FedEx fast will help reduce your rate of non-paying jobs and also help you from getting fired as much.

AFTER THE SIGNING — FAX
After you are done with your signing, fax a bill and include all pertinent information such as the borrower’s name, property address, loan number, and whatever else the signing or title company wants. Send a bill every week by fax or email or whatever medium your company wants. Also, keep records of every signing company you work for, and all of the jobs they assigned to you. When they pay you, you can indicate the date when they paid you to the right of the job description, borrower name, property address on your records. Your records can be paper or online. It is very fast to do this by paper by the way and less chance of data loss unless you keep the paper in your car.

EVERY MONTH — RECORDS
Every month or so, update your records that you keep in your car. Keep records on each signing company. Track how many jobs they gave you, how fast they pay, what they still owe you, how much you like them. You can assign them a grade too. You can have a customized pricing strategy for each company depending on their track record. You can give lower prices for companies you like. I would base prices on estimated time spent and NOT a fixed price. You could have a — near, medium and far price, or a price that is more intricate depending on number of pages, number of signers, distance, time of day, etc. That is up to you. But, having an intricate pricing strategy will make your life a little more complicated, but will weed out the more difficult companies, or at least make them pay for grief they cause you. Otherwise, those companies will think they can get away with causing Notaries endless headaches. You could keep two sets of these records and update them monthly. One at home and one in the car. If someone offers you a job, don’t quote a price until you look at your records and see if they are on the “A” list.

30 DAYS
If a company is past 30 days, time to consider sending them a demand letter. Or you could wait until the 45 day mark depending on how tough you are. We have a demand letter (from hell) template on our resources page. People have had consistently excellent luck with it, and it was given to us by our very most seasoned Notaries on the site.

45-60 DAYS
If anyone gets to this point, definitely send them a demand letter, but consider hiring an Attorney to write a letter threatening them. There are Attorneys who will write a letter for about $30 using their legal assistants. If a company owe you $300 or more, it might be worth it to write a letter. You can also charge for damages which include your time lost and legal fees.

CONTRACTS
We wrote another article on contracts. Signing companies have contracts to protect their interests. Their contract defends what is convenient and good for the signing company but not what is good for the Notary. You can have your own contract too and make people sign it if they want your services. If you are inexperienced, many companies might not sign it. But, if they need you and you have experience, they just might. You can state terms about partial signings, no shows, cancelled jobs, printing fees, resigns, and whatever else you want. Try to be reasonable in your terms if you expect anyone to sign it and continue using your services.

CREDIT
Try to determine before hand how much credit to offer to particular companies. This needs to be customized. Companies with a bad track record should not get any credit and must pay up front. Companies that have been solid towards you for years might get $400. But, don’t offer more than that because good companies turn bad all the time the minute they run into credit problems. Each company you work for should have a credit rating with you and an individual amount of credit you will offer them. When they offer you a job, see how much they are in debt to you already before saying yes, otherwise — it’s Paypal — or no job!

Do your research FIRST before you buy anything.
Know the ends and outs of the notary business that you are trying to undertake.
know the difference between a notary and a signing agent. These are 2 different hats that can conflict with each other
Know what is expected of you.
Know how many notaries in your area.
Try to find out if they are busy.

Find answers to the following questions:

Is there any work in your area?
How do I get the work?
How much money will it cost me to get started?
What supplies and hardware do I need?
What license or insurance do I need?
How long will it take me to make a profit?

You cannot listen to folks who are selling classes. They have one objective-sell you their course. They will tell you what you what to hear. Keep in mind it takes quite a white to build a successful notary business. You need to market, market and market some more.

2. Make sure you know YOUR states notary laws; cold. This is of the utmost important. This knowledge is what will keep you out of
trouble. And it is far more important than loan signing. If you are a great notary you will be an exceptional signing agent.

Know what ID is acceptable in YOUR state. What to do if they don’t have acceptable ID. What if it is expired? Can you still use it?
Where to place your seal.
When can you use credible witnesses? and why would you use them?. What are they and how many do you need in your state?
Who’s sole responsibility is it to fix a notarial certificate?
When is it a must that you change the venue? Do you even know what a venue is?
Who’s responsibility is it to initial these changes?
Can you use another states notarial certificate? And if yes when?
When are you supposed to give an oath?

These two things seem to be the most the notaries argue about;

Notaries continue to argue about whether they can use another states acknowledgement or not.
They consiisting argue about making changes to the documents.

Who’s sole responsibility is it to fix a notarial certificate?
Who’s responsibility is it to initial certain changes on the notarial certificate?

How a video game reminded me what a noble profession we have

So, you’re probably wondering why I’m even talking about a video game. After all, working as a notary is serious business and you wouldn’t be wrong in saying that it is a profession where errors are seriously frowned upon. Our experience in the profession varies, but the one thing that’s constant among all notaries is that there are professional standards that need to be met.

Some tasks are straightforward and simple, while others are more complex. Yet, no matter how simple the task may be, the smallest error can put others at risk. The game I’m referring to, called Papers, Please, offers is a similar — albeit virtual — experience.

First Off, What Exactly Is Papers, Please?

A recently released point and click game game, Papers, Please places the player in the shoes of a border inspector of a country called Arstotska. The player’s task is to screen each person who wants to enter the country and to try to adhere to standards set by the government. There are many other aspects of the game, but this is the aspect that I want to put a heavy emphasis on. In the game, making an error gets you a citation, and in the later stages an error means letting dangerous people through the border, which puts lives at risk. You essentially handle sensitive data, check it for accuracy and truthfulness, and decide whether you’d allow the person into the country or not.

It’s quite similar to how we check statements and decide if the facts hold up. In fact, most, if not all court proceedings rely heavily on notarized documents, especially during personal injury cases, according to the lawyers at tariolaw.com.

Why Should We Care About This Game?

Well, that’s where the error is. You assume that this is about the game. It’s not. What really struck me was how the tasks got more and more complicated as the game progressed. You have to assess various pieces of information and decide whether to stamp a traveller’s passport, allowing them access through the border.

This puts an air of risk in the game, even when all the player does is to look through papers and counter-check facts presented by a traveller. And the way that the travelers interact with the player in an attempt to appeal to the player’s kinder nature forces you to make hard decisions.

How Is It Related To The Profession?

It reminded me a lot of how we, as public notaries, are the front line of defense against any attempts to commit fraud. In the same way that the inspector in Papers, Please is the first line of defense against people who would do the country harm, we are the first line of defense against people who want to put falsehoods onto paper or when they try to twist the truth in their favor.

And it’s rather funny that I was unexpectedly reminded of this duty by a video game that I happened to stumble across whilst browsing my YouTube feed in my free time!

I mean, whether you’ve had 30 years of experience in the profession or you’re a rookie who’s learning the ropes, it can be draining to do the same thing over and over if you forget your purpose. I’ll say it again, ours is a profession that can’t have any mistakes, whether they’re big mistakes or common mistakes — we are all about accuracy and precision. And sometimes it can be quite draining, but always remember that the seal that we stamp has power and authority. People are depending on us to verify facts and to educate them on what they’re getting into by signing a document.

Dr. Phil moderates dispute: Notaries vs. Signing Companies

Dr. PHIL: You have asked me to moderate your ongoing dispute between Notaries and signing companies. I hope that we will have a fruitful session and resolve some of your issues.

FRANK: Thank you Dr. Phil. We Notaries have been complaining for years about low-ball fees. We are sick of it and want to get paid what we deserve.

SAMANTHA: Thank you Dr. Phil. We signing companies used to have better quality Notaries to work for us. In the last several years, the quality keeps going down and down. We feel we shouldn’t have to pay much money to these Notaries who in our opinion, should not be commissioned in the first place.

FRANK: If you want better quality Notaries you are not going to get them based on what you pay.

SAMANTHA: Well, if you want more money, you won’t get it with your communication and notary skills.

Dr. PHIL: Which came first, the chicken or the egg? This conversation isn’t going anywhere. Now, Frank, I don’t know what your level of competency is as a Notary Public. If you want to get paid good money, you have to be good at what you do.

FRANK: Oh, I’m good at what I do.

SAMANTHA: No he’s not. He claims to be good at what he does. We tested him and he got 30% on our test which is so easy, high-school student could pass. We only hire him because the other Notaries are either just as bad, or charge a lot more.

Dr. PHIL: Too bad you don’t get paid for deluding yourself, you’re good at that. Now, you think you are good at what you do, but Samantha here has given you a standardized test and you failed. How can you call yourself a great Notary when you failed a very basic sounding standardized test?

FRANK: Well that’s because I’m anything but a standard Notary. And by the way, you’re just as bad as she is.

Dr. PHIL: Well, what do you think your average standard person is going to think if they know you failed your test?

FRANK: They’ll think I’m an idiot.

Dr. PHIL: So, do you think someone functioning at the level of an idiot deserves high pay? Do you think they deserve to be hired at all? Would you hire someone who failed a professional exam?

FRANK: Oh, well now that you put it that way. Hmmm. Well I thought I was good at what I did. I don’t get complaints?

Dr. PHIL: You have a complaint sitting right next to you. Do you think you’re being honest with yourself?

FRANK: In all honesty, yes… wait, can I start being honest now? Well at least I thought I was being honest with my self.

Dr. PHIL: The fact remains that you are not honest with yourself about how you are severely lacking in your knowledge of notary and signing basics. Those that hire you are not happy about that fact. They will never pay you much as long as you don’t live up to their expectations.

FRANK: What about my expectations?

SAMANTHA: We put up with this type of attitude to save $50 per signing. If we didn’t do that, we would not be able to turn a profit.

Dr. PHIL: Well you get what you pay for. Frank here is not living in reality and exhibits no willingness to learn his profession to the point where he seems hireable. Now, let me ask you a few questions Samantha. How often do the Notaries you hire make mistakes and what are the potential damages to your finances when they do make mistakes? Try to give me as many realistic scenarios as possible.

SAMANTHA: When we hire new Notaries, we screen them out first to get rid of the ones that sound really bad on the phone. The ones we hire, we encounter a 3% error rate, at least with the new hires.

Dr. PHIL: And what are the damages?

SAMANTHA: It’s really hard to say. Sometimes we have to resign. Other times we have to redraw documents. Once , a client lost his lock. But, in one isolated incident, an identity thief was notarized with a fake ID that a good Notary would have spotted. That cost us $20,000 and time in court.

Dr. PHIL: So, that sounds dangerous to me. What is the average cost of a notary mistake, all factors considered?

SAMANTHA: After doing the math, it looks like the average mistake might cost $400. Since mistakes only happen 3% of the time the cost per average job hiring questionable notaries might be $12. We are saving a lot more than $12 to hire cheaper Notaries so it seems worth it to me.

Dr. PHIL: What about the cost to your reputation and the risk of losing clients because you hire less than perfect Notaries?

SAMANTHA: That is always an issue, but since we clean up problems quickly, we haven’t lost more than a few clients. But, that does seem to be a bigger issue. How many Title Company clients have we lost due to the quality of the Notaries we have hired, and how many more would we retain or attract if we used better Notaries. It might be worth $30 extra to hire a better Notary.

FRANK: Now, I’m out of business for sure.

SAMANTHA: Unless you study. It wouldn’t kill you to crack a book.

FRANK: It might.

Dr. PHIL: It looks like we have had a good discussion here. I have learned something, and I think you, Samantha have learned more about the various factors in this complicated equation of who you hire, how much you pay them, and why. Now, Frank, have you also learned that you need to study more to be able to pass standardized tests to make a good impression on people who hire you?

FRANK: 123notary is the only entity who has quizzed me recently, and they are a directory. They don’t even hire people. I don’t think anyone else cares if I know anything, so why should I care?

Dr. PHIL: If you want to get more work at higher prices, you should care. I read an article that says that 123notary certified signers make $8 more per signing and get a heck of a lot more work.

Beginner Notaries 103 — What beginners need to know

As a beginner Notary, there is a lot you need to know. Many things that experienced Notaries take for granted might take you a year or two to find out. Here are some quick pointers that might be valuable.

1. Your Listing’s Performance.
Listings on 123notary for new Notaries can give you miracle performance. However, no matter how much you pay for a listing on 123notary, the listing will not perform well unless you have a good notes section, reviews, and it helps a lot if you are 123notary certified (especially for newer Notaries.)

2. Your Profile’s Notes Section
Listings that lack a good notes section typically get ignored as that is the first piece of information that companies look for when they are hiring. If your notes are blank, short, or incomplete, your incoming phone log from companies will be equally blank. People want to get a sense of who you are, your professional background, and your skills before they invest in a phone call. Additionally, notes sections with spelling or grammar mistakes will be a huge issue for title companies who will bypass you if they have any cause for concern. 123notary’s blog has an entire section on how to write a great notes section with dozens of unique articles.

3. Notary Reviews
Reviews are your ticket to success. Never mind how great you say you are, talk is cheap if you are complimenting yourself. But, what your customers, especially title companies say about you really matters to those thinking of hiring you. 123notary has many articles about how to get reviews, so I suggest becoming an expert on the topic.

4. Reading Suggestions
Notaries should ideally read Notary blogs, forums, visit the NNA & 123notary Facebook groups (but not the private groups), newsletters, courses, handbooks, and anything else that could be considered helpful. Getting Notary advice from semi-unemployed Notaries who frequent Facebook is a very poor idea. Get your official Notary advice only from your state Notary division and no other source otherwise you might be very sorry.

Smart Notaries and dumb notaries alike realize that they need to spend time reading to keep up. Smart Notaries get courses from helpful companies and improve their skill sets. Smart Notaries also read what other Notaries say about various signing companies as some signing companies are not the best bet to work for. Dumb Notaries spend their time gossiping with other disgruntled Notaries on various private Facebook groups that generally engage in a lot of complaining and bashing. These dumb Notaries are also dumb enough to get Notary advice from Notaries on these groups who don’t know what they are doing. It is a perfect example of what Jesus said about the blind leading the blind. Get your notary advice from your state notary division. If you get any notary advice from any other source, cross check it with your state. We teach general notary concepts here at 123notary, but we cannot say with any certainty of our principles apply to your state.

5. Experience Counts
Signing and especially Title companies typically do not want to hire someone with less than two years of experience unless they are confident about that person’s knowledge. If you have an escrow background or are certified by 123notary, that will help compensate for your lack of experience. Knowing your documents inside out will help as well which would be a side effect of our certification.

6. Low-Ball Signing Companies
Companies that hire newer signing agents are generally not fun to work for. They require fax backs, micromanage, pay poorly and might nag you a lot. They have to, otherwise they would not be able to hire beginners and provide a high level of accuracy to their clients. So, expect to be treated like a child. Once you get some experience under your belt, you might be able to start accumulating title company clients little by little. On our blog we publish a list of companies that will hire beginners. You should talk to every company on that list.

7. Getting Title Company Work
Migrating from signing companies to working for title companies (who usually pay more, but how much more depends on how the industry is doing) is something people do as they gain experience, knowledge and skill. However, most Notaries cannot work purely for title companies after two years. It sometimes takes many more years before all of your clients are high paying wonderful clients who you love working for. So, there will be a lot of paying your dues.

8. Notary Etiquette
Most Notaries do not have good phone answering skills, nor do they have good communication skills. Having good Notary etiquette and good business skills can help you succeed. If your business skills are not completely up to par, it might be good to read our articles about etiquette and brush up. Answering the phone stating your name is a first. Answering questions the way they were asked without rambling on and on matters too. Accepting instruction from others and not engaging in bragging or whining matters a lot as well. Good etiquette will make you popular with all parties.

9. Notary Education
All Notaries need to study up and be experts at their state’s notary laws. But, knowing how to handle situations, and knowing your documents matters just as much. Reading blogs is a good way to keep informed, but there is no substitute for taking actual classes. For newer Notaries, passing our certification test is a great way to gain credibility as well.

10. Risks and Liability
It is risky being a Notary. 15% of our long term full-time Notaries have been to court at least once generally as a witness. A few Notaries even get sued or end up in legal trouble that can cost them big bucks. It behooves you to keep good records and follow Notary law to a T. Understanding Notary law is not enough. You need to know how to explain to clients what you can and cannot do as well as explain to a judge why you did what you did in a particular situation. One lady turned down a Notarization on correct grounds, got sued and lost because she could not communicate clearly to the judge what her reason was for declining the notarization. You also need to have direct communication with all signers and make sure people are aware of what they are signing, particularly if they are elderly. The Notary does not need to understand the documents, but the signers do, otherwise you might end up in court.

11. Your Attitude
Most Notaries have the attitude that they already know it all and there is nothing more that they need to know. Those who are NNA certified think of themselves as blessings to the industry. The fact is that those who have passed NNA’s test typically get very poor grades on our test. There is always more to learn in this business. It is best to stay open, assume that you do not know everything, and accept criticism from those in hiring capacities or those who run Notary agencies (like me.) You will be more popular with all parties involved if you are open to suggestion and take guidance from those who are a lot more experienced and knowledgeable than you are.

12. Advertising on 123notary.
Companies that pay well love 123notary. However, they typically only hire from the top of the list. If you are not in the top three or top five, you will probably only hear from companies that don’t pay that well. Top spots are not always available, so what should you do? Get the best spot you can, and then try to pass our certification, write a good notes section, and keep getting reviews. That way if a better spot opens up, I will be likely to give it to you rather than someone else. I give open spots to the most qualified member downline, so while you are waiting, try to work on your merit, so that you get the promotion!

13. Marketing Plan
Do you have a marketing plan? Many Notaries just wing it. That is not advisable. We suggest having a definitive, well thought out written plan. You can discuss that plan with others too for suggestions.

When are Notaries rude to title companies?

I wrote an article a few months ago stating that if you are rude to Jeremy (that’s me) that you are probably rude to title. I got lots of hateful responses. The point is that Notaries used the excuse that since I was not paying them, that they had the right to be rude to me and also that I was rude. But, I am only rude to people who provoke the hell out of me — which includes a long list of people.

But, this week, I talked to a few people who worked at signing and title companies to get the truth from their point of view. Here is what I found out.

Company 1.
A person who used to work in title for years told me that Notaries were regularly rude to people working in title, but that problem was no greater than any other problem they had.

Company 2
Another person who had worked in escrow as an assistant claimed that she had not heard of Notaries being rude to title officers. Hmm. A completely different story.

Company 3
This third person owned a small signing company in Arizona. He claimed that Notaries were rude to him, but only when he confronted them with something they did wrong that they were unwilling to take responsibility for. He confirmed my complaint that Notaries by and large make claims to be amazing, and are very unwilling to acknowledge their flaws or mistakes.

Summary
It seems to me that the reason for rudeness on the part of Notaries is coming from the same place as the self-promoting lies that Notaries tell. Most Notaries I deal with go on and on about how great they are, how much experience they have and how they never make mistakes. This is not only phony sounding, a pain in the neck (and ear) but a snow job. People who hire Notaries can see through the nonsense very quickly. When I ask people how many loans they have signed, 70% of people will give me a very long story about their career without answering my question which is a headache that I have to endure every time I do welcome calls. This type of bragging and not following instructions by answering the question the way it was asked is coming from the same place that the rudeness is coming from. A lack of modesty and a childish and confrontational attitude.

It would be better if Notaries would just answer questions as they were asked, adopt a more modest attitude about their work, study harder, and accept the fact that they are not perfect and that others in hiring or evaluative positions will scrutinize them. It is childish to assume that you are perfect and immature to get hostile if someone criticizes you. Expect criticism and accept it. In fact, you would be a better notary if you would hold yourself to higher standards.

If Notaries would scrutinize themselves and spend more time learning in a cautious and meticulous way, there would be less for others to criticize about them. This is a profession and there is no reason not to study. Only about 1% of our Notaries on board are willing to study on their own initiative. It should be 50% at least. Accepting the fact that even though you might have a lot of years on the job that there might be a lot you don’t know that you need to know would be another act of self-honesty and modesty.

I am not saying you should go through life berating yourselves, but the attitude of most Notaries is that of an immature show-off who cannot tolerate criticism. That kind of behavior and attitude is not professional and not attractive to hiring parties. If someone in a higher position than you says that you did something wrong or don’t know something you need to, rather than fight with them, accept their words as valuable input — because it is valuable input that might keep you from getting fired or locked up one day. Try to see things from a bigger perspective. And if you don’t like me berating you, then most of you need to act a lot more professional. If you acted professional as a group, there would be no reason to berate you in the first place.

Logic errors can cost you as a Notary

Many of the mistakes that Notaries make are logic errors. Not being a logical person, or having a low IQ are dangerous in the Notary profession. I believe that state Notary divisions should require an IQ of 95 minimum simply because the misapplication of rules often happens because of incompetent or sloppy thinking. Additionally, not being meticulous can really cost you and your clients as a Notary. Missing items on forms, or missing items when you check forms can lead to court cases. One wrong number or one missing initial can ruin a loan. It is not safe being a Notary unless you are a very cautious and logical person. Let me elaborate how an illogical Notary can get in trouble.

1. Additional Information Sections in Loose Acknowledgements.
The illogical notary says, “This is not legally required, therefore I will not fill it out.” Unfortunately, a fraud can switch the acknowledgment from the document it was supposed to be on to another document signed by the same person which was not “notarized” and get away with it. The reason being that the Loose Acknowledgment was not labeled as to which document it belonged to.

The optional additional information section goes over the document name, document date, number of pages, other signers, capacities, and perhaps more. With all of that specific information, it would make it difficult but not impossible to find another similar document to swap the certificate to. If you want to be even more cautious like me, get a secondary embosser seal that leaves a raised impression and emboss all of the pages in everything you notarize. Then, if someone swaps pages or an Acknowledgment, it would be easy to catch the fraudulent act.

2. Not stapling forms together
If you do not affix, attach, or staple an Acknowledgment form to a document, or if you do not staple the document together, it is easy to swap pages after the notarization is complete. Swapping pages is illegal and unethical and dangerous, so you want to prevent this from happening. In California, not stapling Acknowledgments to documents is also illegal. An illogical person would not see the necessity of stapling forms as they do not bother to think of the reason why they should be doing it and what can go wrong if they don’t. Yet another reason why illogical people should not be Notaries.

3. The John Smith Dilemma
When I ask dumb Notaries this question, they normally get it wrong which is dangerous as you can end up in court for screwing this up regularly.

If the ID says John Smith, but the signature on the document says John W Smith, would it be prudent to notarize the signature under the circumstances.

The most common answers include:
You can always over sign — this is a title rule and not a legal rule. The legal rule is that you must prove a signer’s name/identity in order to notarize them. The meaning of “you can always over sign” means that if the name inscribed in the signature section of a document says John Smith, but the signer wants to sign John W Smith, that Title will not mind. Although in real life that is a matter of preference and Title might mind.
Just ask for another ID — once again, another illogical answer. Of course you can always ask for another ID, but in this circumstance there is no other ID. Having a second ID would be a different circumstance, and not the one mentioned. Additionally, in a yes/no question, you need to give a yes/no answer otherwise you are not being logical and also not proving you know the answer to the question which is NO.
The longer not shorter rule — this is not a rule and can easily be reversed. Never memorize a rule that can be reversed. The ID can be matching but longer than the name notarized. But, the ID cannot just be longer. The signature notarized can never be longer than the ID if you follow prudent procedure although some states have wishy-washy identification rules and might allow this.

My logical answer is that the ID must prove the name you are going to notarize the signer under. The ID can be matching but longer than the signature on the document, but not unmatching or shorter.

4. Understanding basic notary acts
You could get in trouble for not understanding basic notary acts. If a client asks if you can notarize an Acknowledgment when they ALREADY signed the document, most Notaries would say no. However, almost all states do not require the signer to sign in the presence of the Notary, but only to Acknowledge in the presence of the Notary — a distinction an illogical person often cannot make. So, by not understanding the rules, you will deny a valid request for notarization which is by definition — illegal. Many Notaries deny legal requests all day long and then accept illegal requests because they are completely ignorant of Notary law and procedure which describes most of the Notaries on our site which is appalling.

5. Omitting or scrambling required Oaths & Affirmations
The illogical Notary doesn’t realize that Oaths are administered in all states by Notaries and that they are required for Jurats. The illogical Notary makes the following mistakes.

Omitting the Oath / Affirmation — It can be considered a felony of perjury to omit an Oath when you filled out a paper stating that an Oath was taken. Yet many Notaries are completely unaware that they need to administer Oaths and don’t even care until they get busted and have their commission revoked which doesn’t happen very often.
Giving an Affirmation instead of an Oath — Many Notaries who were asked to give an Oath used the word affirm because they don’t like the idea of swearing. That constitutes choosing the Notary act for the signer which is not allowed. The signer decides if they want an Oath or Affirmation, so you should probably ask if the law allows for either or.
Giving an Oath as to the identity of the signer — if you are giving an Oath about a document, having the signer swear their name is John Smith does not constitute an Oath about the document unless the document says, “My name is John Smith.” An Oath is incomplete or not administered unless it is topical to the subject matter. An Oath for a document should be regarding the truthfulness of the document.
Giving an Oath regarding that the signer signed the document — once again, by law a Jurat signature must be signed in the presence of the Notary, and the Oath should be about the truthfulness of the document and not whether they signed it.
Unique state laws — if your state requires more than just swearing that the document is correct, then by all means, fulfill your state requirements which we know nothing about here at 123notary. However, if you fulfill the other state requirements, but don’t administer an Oath regarding the truthfulness of the document and I caught you as a judge or notary division worker — your commission would be revoked on the first offense as that is perjury and undermines the integrity of the Notary profession and society.

In short, being illogical as a Notary can not only cost Title companies thousands and get you fired, or sued. Being illogical as a Notary can even get you jail sentence of up to five years for perjury which is a federal law which has no regard to the particular laws of your particular state. So, learn to be a correct Notary and keep in touch with your Notary division so you don’t goof on anything.
