How long do you wait if nobody is home?

If you go to a signing, and nobody is home, how long do you wait? Some people will wait all night while others will leave immediately. Try to take into consideration that there might have been a delay coming back from work or the market. Allowing ten or twenty minutes might make sense. Or you could try to see if your next client of the evening wants to sign early and then circle back afterwards to the original place as you don’t know how long they will keep you.

The best thing to do first is call the signer and see what is up. If they do not call back within ten or fifteen minutes, you can go. But, keep the phone by your side. They usually call the minute you drive off. It is Murphy’s law and it seems to be accurate.

But, on a brighter note, if you are religious about confirming appointments, you would have gone over the times and if they were on a tight schedule they would be likely to reveal that to you during the phone conversation. Yet another reason to be more adamant about confirming signings rather than just showing up.

So, how long you wait depends on what else you have going on. But to be fair, I would wait at least ten minutes and call the signer.

From the start of my career as a notary, I learned from 123Notary to do my homework (up front): review the package, flag important and/or unusual things soothes are not missed; doing any other necessary research (e.g., trusts/adoption documents; attorneys in fact, etc.). The more knowledgeable I am about documents and procedures, the better notary I am. Also, I prefer to “re-do” rather than correct and initial. I like for my work to be correct and error-free. Clients notice (as reflected in some of my 123Notary reviews.)

4. I have taken your marketing advice to heart, and its paying off more and more. I make it easy for people to not only find me, but to make them want to use me.

a. Increasingly my better paying jobs are coming as a result of the 123 website. I anticipate that paying for a higher listing will more than pay for itself with my first two orders coming from it.

b. I instill a sense of security in my client as a matter of course by advising them of receipt of confirmation, meeting/closing with the client, dropping/tracking of documents.

c. Occasionally I contact people who have used me more than once to thank them —in an attempt to keep my name before them without being pushy. Sometimes enclose a thank you note with my invoice and asking them to let me know what I can do to better serve them.

d. All of my marketing materials are coordinated in their look and easily identifiable (business cards, stationery, website, invoices, note cards, etc.).

5. Both my corporate and individual clients appreciate that I text my photo and/or business card with my photo confirming our meeting. I never knew how impactful this would become. People like to know with whom they are meeting (especially for coffee shop or hospital signings as well as with seniors and single women)…and the “ice is already broken” before I show up.

6. More and more I’m learning what separates me from the pack:

a. I always ask how they found me. Many answer 123Notary. If other than 123, I encourage them to read my 123 reviews.

b. Doing my research…usually on your blogs, NNA and the internet, bookmarking or maintaining notes.

c. Paying attention to detail.

d. Professionalism in my dress, communications and manners.

e. Being honest in what I do and do not know.

f. Getting back to designated contact(s) after noting issues during the closing. This only happened rarely and in the beginning of my
practice, but I always let Borrower know that we can communicate with their loan officer, etc.

g. Finally, the notary’s client is a person just as we are. I relate to them as such. (This is frequently mentioned in my 123 reviews.)

h. My overall knowledge of mortgage documents, types of residents (primary vs. second), homesteads, trusts/trustees; subscribing witnesses/signature by mark; Apostilles, etc.

i. For me personally, I both hate and appreciate doing detailed journal entries and loose certificates. It takes more time, but my record are perfect and my loose certificates always specify the document name, number of pages and date.

The Starbucks Oath Question

I created a quiz question for written quizzes about Starbucks. It is a very interesting and caffeinated question. Here it is…

A Notary goes to a signing.

The Affiant asks for an Oath on a document that is an Affidavit that reads, “I love Starbucks.”

The Notary proceeds to attach a Jurat…
and made a statement that was, “Do you solemnly affirm that you are the one who signed this document and that your name is John Smith?”

What did the Notary do wrong?

COMMON RESPONSES

1. Ask for ID?
Many Notaries feel the Notary should ask for ID. It is true that Notaries are responsible for identifying people. However, that is not central to this question and since the document, certificate, and journal entry have not been completed or stamped, that is irrelevant at this point. Unfortunately, Notaries tend to get sidetracked on irrelevant details that are not central to situations while missing very critical points that can get them in trouble. Talking about ID at this point would be going off on a tangent, especially if that is the only thing you mentioned — although in most states you probably would have to identify the signer.

2. Create a journal entry.
Yes, you should ideally create a journal entry. But, that too is not central to the question at hand.

3. The notary used Acknowledgment wording.
I have never heard of a state that makes you take an Oath while doing an Acknowledgment except perhaps that Massachusetts wants to make sure the signer signed on their own free will and makes them make some sort of statement confirming that fact.

4. Make sure the venue has the correct information.
This document has no venue, and Oaths in all states but Florida (not completely sure about this by the way) do not have certificates. Certificates have venues, but if you don’t have a certificate, you don’t have a venue. Oaths once again typically do not have certificates, and therefore do not have venues.

CORRECT RESPONSE

1. The Notary did three things wrong

(a) The Notary added a Jurat when he was asked for an Oath. Although Jurats have Oaths or Affirmations, Oaths do not have Jurats. Humans have diabetes, but diabetes does not have humans. So, please do not assume that an Oath has a Jurat. An Oath can be done as an independent notary act, and most Notaries don’t know this because they do not read up on Notary tutorials, nor do they ever do Oaths as independent acts. In fact, most Notaries do not do Oaths as part of Jurats either — they just skip over it and assume nobody will notice, or they think that filling out the subscribed and sworn written verbiage is the actual Oath (which is not true because Oaths are verbal by definition.) An Oath is a purely verbal act, however, in Jurats there is a written documentation that accompanies and documents the verbal act.

(b) The Notary gave an Affirmation when he was asked to administer an Oath which is bad for two reasons — one, because the notary did not do what he was asked and, two, because the notary CHOSE the Notary act on behalf of the signer which you are not allowed to do. Only the signer or client can choose the Notary act. So, what the Notary did looks like it is bad service, but also illegal.

(c) The statement the notary made was about the signature and the name of the affiant, but not about the content of the document. The Affiant asked for an Oath on their document, so therefore, the Oath should be made purely on the content of the document.

“Do you solemnly swear that this document is true and correct to the best of your knowledge so help you God?” — would be okay.

“Do you solemnly swear that you love Starbucks? — is paraphrasing and is okay assuming you don’t butcher the statement in any way that detracts from the logic of the statement.

“Do you solemnly swear that you love Starbucks, so help you the Starbucks Goddess.” — if you are politically correct and have multiple choice for what divine entity you want to swear to, you might be able to get away with this one. Read your state notary handbook and see if they allow swearing to the Starbucks Goddess, or as I call her — The Goddess of Caffeine.

Florida notaries with complaints

Notary Public Florida: a complaint story
 
Here is a complaint from soneone who used a particular Florida notary:

“This is the first time we have used this Florida notary public for a closing. The Notary made a mistake on the documents where she had the borrower date everything 5/7/2011 instead of 7/5/2011 which was a notary mistake that ended up costing the broker $1000.00. Two weeks after the closing the notary called the title company directly demanding her payment of the full signing fee because she had bills to pay. She threatened to sue everyone involved with the transaction even though we were the company that hired her. This Notary was very unprofessional. The Notary was paid at 30 days by our company.”
 
The notary claims that the borrower signed the dates incorrectly and that she asked the borrowers to put the correct date, but they refused.  Then, the Florida notary claimed that the borrower wouldn’t sign where it said borrower, because she considered herself to be the co-borrower. Additionally, the notary claims that the borrower was very rude and condescending to her. The notary claims that she spent two hours at the signing and that the borrower couldn’t read the small print and wouldn’t cooperate. It is hard to know who is right or wrong here.  Was this a notary mistake or just the borrower acting crazy — or both?
 
The bigger issue is that the notary threatened to sue everyone before her payment was even late. It is professional to allow people 45 days to make payment before you start making legal threats.  Also, suing someone for $60 doesn’t really make sense in the real world.
 
Another Florida notary public wrote a complaint about 123notary.
The notary was late confirming her listing, and I called the notary to see if she was still alive and in business.  We have notaries move, quit, and end up in the hospital, and die all the time without even informing us. If I ever die, I will have the consideration to inform everyone within (5) business days. In any case, I called this Florida notary’s phone, and her message stated that she was no longer doing loan signings.   I assumed from this message that she was out of business as a mobile notary — boy was I wrong.  Rather than contacting me and politely informing me that she was still in business, she started slandering us on forums telling the world about the horrible crime that we had commited by temporarily removing her listing.    She created all types of drama over nothing.  I think that her MISLEADING phone message should have stated that she is still doing mobile notary work, but not doing loan signings.  That way, anyone calling her about work would have a clear impression that she was still in business. I hate being blamed for other people’s bad communication skills. People need to take responsibility for their own incompetent actions.  In any case, her listing went right back on the minute she asked me to reinstate her.  Unfortunately for her, I documented her zany behavior in the review section.  I stated that she committed no acts of misconduct, but created an unnecessary drama over nothing!  This case was  a business mistake on her part, not a notary mistake, but it is still ridiculous!
