The Right to Cancel done Wrong
It’s easy to make errors on the Right to Cancel, also known as the Right of Rescission form. Unfortunately this form must be free of errors prior to funding. There are several ways to make a mess of it. This entry will cover a few of the more common errors; I’m sure some creative notaries out there will comment on the aspects that I neglected to mention.

Perhaps the most blatant error is to have to applicant sign in the “I wish to Cancel” area and not on the “I received two copies” area. Sounds silly? But, it does happen. This is a real show stopper as escrow and lending are faced with a cancellation that they cannot ignore! You cannot just line thru to improper signature (redact/initial) and have them sign in the proper place, the page must be replaced and signed *only* in the proper place.

“Three Business Days” that’s the standard. But, like so many things that sound simple it has some not so obvious gotchas. Those three days, when crossing a Saturday, have different meanings to different lenders. Thus, that “right of rescission” calendar that you carry stands a good chance of being wrong. Some count Saturday as one of the three days, some don’t. Of course if it’s filled in, along with the correct signing date; no problem. But to be sure, when a Saturday is involved you have to ask the proper authority for them to supply the end date of the rescission period. Your calendar “might” be wrong!

Each borrower is supposed to receive two *executed* copies of the RTC. They are not executed by merely being in the borrower document set. It is required that you “fish out” these pages and have the borrower(s) sign as received and the proper dates are on the top portion of the forms. You don’t do that? You have done many packages without a problem. Well, if you want to be a perfectionist, leave the borrower(s) executed copies (2). Often there will be only one RTC per borrower – so go the extra mile and be sure to return two executed per borrower with the docs.

Sometimes the signing gets pushed back a day or so. The RTC must be changed to reflect the new signing date and the correct end of the RTC. If there are preprinted entries they get a thin line thru them and the borrower initials the end of the line, not you! Then, the correct dates are entered, neatly please. The same procedure for the borrower copies. Two borrowers? You need to correct and have signed four forms. It’s a good idea to print a few spare forms…..

On rare occasions I have been asked to have the borrower(s) *only* initial the date areas that will need to be changed, with no dates entered. I do not feel comfortable with this. However, if you do this; be sure to do exactly the same process on the borrower(s) copy.

Often the “checklist” will mention the RTC but it will not be included in the package. It’s only relevant when the security for the loan is the borrower’s primary residence. Thus, if the property in question is for investment or a second home; there will be no applicable RTC forms.

Always pay extra close attention to the RTC, it’s a federally mandated form and must be perfect or you will get a request to visit the borrower again. This is the one case where you cannot swap out the borrower copy page to correct a flaw; as that page too must be perfect.

How to become a successful mobile notary from scratch

Anyone can become a successful mobile notary. The field is wide open. On the other hand, since it is so easy to become a mobile notary, many people do it which causes a lot of low priced competition. However, those who are very good at this profession seem to do well with it even in bad times. As of 2014, business is slow, but you can still have a nice part time income doing mobile notary work. Additionally, eventually the industry will pick up, and you might find yourself earning more money than you expected!

Step 1. Become a Notary
If you are not a notary, you can easily become one. It is a bit harder in CA, NY, LA, and FL where there are examinations, but talk to your state notary division about how you can become a notary for your state.

Step 2. Learn the ropes: Jail, Hospital & Mortgage Signings
Being a mobile notary is more than just hauling your stamp around with you in your car. You need to know how to handle typical situations that mobile notaries have to deal with. Mobile notaries who do well typically are experts at jail signings, hospital signings, and loan signings. Notaries who work in an office don’t need to know much about jail signings, because inmates can’t come to you, and neither can those with an IV tube stuck up their arm. But, if you are on the road, these are situations you have to know about. There are many identification and communication issues associated with jail and hospital signings that can get you in trouble if you don’t know. On the other hand, you can make a huge travel fee doing these types of specialized mobile notary tasks that the other notaries don’t know how to do (or want to.)

Mortgage signings
Signing loans can earn you big bucks. Signers make anywhere from $50 to $150 per signing. Fees fluctuate with the market and depend on who you are doing business with and how good you are. If you have a lot of experience and have many loyal contacts, you can set your minimum fee at $100 or $125 per loan signing if you are any good. You will need to know some basic Mortgage terms, and know the basics about 10-20 basic documents. You need to know where to look for the Rate, APR, prepayment penalty, when the first payment is due, where the fees are, and other basic information. You need to know how to handle name variations, initialing and borrower objections to problems in the loan. You need to know who to call when a loan signing is on the rocks. Signing loans is not rocket science, but there are concepts you need to Master.

Step 3: Active Marketing
Getting work as a mobile notary is a bit hard at first, but you can do it. Contact a dozen or more signing & title companies each week and get on their list. They will want copies of various types of information and a signed contract, so ask them what they want, and give it to them. You can also give your business card out to local nursing homes, hospitals, Real Estate offices, law offices and anyone else you can think of who might need a mobile notary.

Step 4: Passive Marketing
Advertising on the major directories is a good practice. Notaries often ask on Linked In which directory they should join. My standard answer is to join all of them, but not necessarily to pay for all of them. The strongest players in 2014 are 123notary.com, NotaryRotary, NotaryCafe, and SigningAgent.com lost a lot of steam recently, but is still in the game. If you join other directories, I don’t recommend paying for them as they don’t have a good track record. You can go on Linked In to research what the notaries say are the better notary directories too for an unbiased point of view. Hard copy yellow pages for your local area may or may not get you work — it is worth a try if you are serious though.

Being listed on the big directories is not enough. You need to maintain your listing like a pro. Fortunately for you, I am here to offer you free mentoring by email, so don’t panic! You need a well written notes section, a company name helps, reviews from your satisfied clients, and try to pass as many certifications as you can.

Step 5: Who to get certified by?
My rule is that you get certified by every loan signing directory that you pay to advertise with — even if that means that you get certified five times. I am currently recommending:

(1) NNA’s certification as it is an industry standard
(2) 123notary’s certification if you get paid advertising with us as notaries who get this get 2.5x the work from our directory
(3) notary2pro’s certification (although not an industry standard) is very high quality, they offer hand holding, and the learning you will get from it justifies the cost.

Step 6: Screen companies you work for
Many signing agents drop out because they worked for the wrong companies, didn’t get paid, and suffered financially. Don’t let this happen to you! Use our list of signing companies (which includes reviews) and avoid working for signing companies with a high ratio of negative reviews. Additionally, don’t do too many jobs for a particular company until they have paid you for previous jobs. Decide ahead of time how much credit you are going to give them and don’t let them run up a bill beyond your limit.

Step 7: Become an expert at scheduling and negotiating
You need to be constantly refining your skills to do well in this business. Although there is a lot of competition, few of them have refinement. Scheduling is a hard task, and you need to juggle when the e-Documents are supposed to come, when your signing is, and when the next signing is. e-Documents don’t always come on time, so learn to juggle well. Negotiating good fees is also an art form, so pay attention to our blog articles as from time to time we have articles about how to negotiate.

Step 8: Get a high spot on 123notary
We make our money selling high spots on our directory. We generally discourage people from getting a high spot until they have passed our certification test and have at least a review or two. But, if you are serious and want to get ahead, call us and ask how you can get a high placement in your area. We are often very flexible and offer six month trials to those just starting out. The Title & Escrow companies who use our site know that those who purchase high spots on our directory are serious, and those notaries generally get a lot more quality jobs from our site than those with low spots.

Professional backgrounds that help
If you have a background in Mortgage, Escrow, Loan Origination, or Lending, this can really help you do better in the mobile notary business as you will be working a lot with Mortgage documents. However, don’t fool yourself into thinking you know more than you know. Many Mortgage Brokers assure me that they know their stuff and don’t need my test. When I ask them simple loan signing questions over the phone, they can only answer half of the easy ones. Go back and study and master the art of the signing. Your background does help you, but your over-confident attitude can really ruin your career. Additionally, it is very different being on the Notary side of the table than it is being on the Lender or Broker side of the table. Try to learn this profession from out point of view.

Real Estate backgrounds do not help as much as Real Estate Brokers claim. You are not anywhere near as familiar with the documents as you claim. As a matter of fact, those with Real Estate experience cannot answer simple loan signing questions any better than those with no Mortgage or Real Estate experience. Approach this profession as a beginner and learn the ropes one by one. The people skills you learn from being a Realtor on the other hand, can really help you. General business skills and being businesslike help more than any technical knowledge you may have acquired in your former professional life.

New Notary Apps for the iPhone 7 that you’ve never dreamed of!

Many notaries are curious to know what the new iPhone 7 will be like. The truth is that it will have many new functions and apps that are very practical for notaries. Below are some of the more practical apps.

(1) Signing Company Review App.
The best feature of Notary To Go is that it knows which signing companies are good or bad. If a good signing company who pays on time calls you, you’ll automatically get a marimba music ringtone. If they don’t pay on time – “The Shining” music ringtone.

If you ask SIRI to research signing company reviews, her tone of voice is programmed to vary based on the quality of the signing company.

More than 50% negative reviews – Siri sounds suicidal.

20 to 49% negative reviews – Siri sounds snooty.

0 to 19% negative reviews – Siri sounds cautiously optimistic.

(2) Find the lowest price for gas app.
Siri also locates the nearest most inexpensive gas stations for notaries.

Siri can be set to “polite,” “matter of fact,” “sarcastic,” or “down right insulting.” In a test signing, the notary set it on sarcastic level 3 and asked Siri to find him the best price on gas in the area and Siri said, “you cheap gum.” After the bugs were worked out, she said, “you cheap bum.”

(3) Notary Billing app.
The new notary billing app lets you enter each signing after it is complete, who the borrowers were and the name of the signing company. It will automatically send bills to the company. It can also Subpoena a signing company that hasn’t paid on time after sixty days if you put it on “auto-subpoena.”

(4) Road condition app
The iPhone7 road condition app, not only tells you the fastest route to wherever you are going, but also informs you of any new potholes on the road, or if there are any desirable members of the opposite gender that are noteworthy on any particular route.

(5) Affirmation App
Detects whether signer’s solemn statement of truth made under penalty of perjury is actually truthful. Just attach one end of the wire’s attachment to the affiant’s fingertip, and insert the other end into the USB port. The display on the monitor will tell you if the statements are true or false. Please read the instructions and ask a few sample questions first to get a sense of interpreting the results from this type of test.

(6) Virtual attorney-in-fact.
A virtual person can be authorized by a power of attorney to act on behalf of another using this app. Just scan the power of attorney using a portable scanner and attach the scanner to the iPhone using a USB wire. One notary tried this app, and got a little carried away. He got the Smart attorney app: Sues virtual attorney-in-fact for claiming he’s a fact when he’s merely virtual.

(7) Notary certificate app.
Attach your iPhone to a mobile printer, and you can print out documents and notary forms. This app turns credible witnesses into incredible witnesses, if they’re lucky enough to own this incredible phone. This app executes a document in the blink of an eye or iPhone, whichever blinks first. iPhone version 8 virtually affixes seal to certificate eliminating strain from pressing embosser, but you’ll have to wait to see that action!

(8) The Notary To Go app.
This app can automatically turns off the customer’s TV. Getting their shouting kids to go to sleep – coming in the iPhone. Notary To Go also sends confirmation to signing company notifying them you’re there. It also tells you if neighbors or kids are too close to your car.

(9) Hands Free Notarization App.
You can download your document into the application. Then, when you’re in front of your signer, they can give a verbal signature to the document. Using voice recognition technology, this application will be able to positively identify the signer purely based on their voice if it has been given a voice sample previous to the date of the notarization. It can also be used for notarizing weddings — just say, “I do.”

(10) Virtual Therapy (for Siri)
After being tested out on seven different signing agents, the iPhone 7 provides Siri with badly needed automated therapy.

SIRI: “All they ask me for is where’s the cheapest gas station.”

AUTOMATED VOICE: “You sound troubled.”

SIRI: “Duh! They’re always complaining to me about signing companies that don’t pay them on time, or when 123notary raises their rates. Is that all I’m good for?”

AUTOMATED VOICE: “You sound troubled.”

On the iPhone 8, her automated shrink will gain the additional responses, “I feel your pain. And, “I see our time is up.”

$30 loan signings. Is it worth it even in the best of circumstances?

Believe it or not, there are companies out there offering signings for $30 and $35. Can you believe this? The nerve of some people to offer a notary such a small amount of money for such a huge headache. Even if you are signing only one document, the headache of trying to send documents back, invoice, get paid, and schedule is simply not worth it.

I remember that when I was a notary I did an assignment for $30. It was a single document. I actually got a few assignments like this. When I did regular mobile notary work for offices, I would charge about $35, but they would pay me cash on the spot. There was no waiting for payment or wondering if I would get paid. It was immediate gratification.

Back when I was first starting out in 1999, Nation’s Direct gave me signings for $30. But, I was not expected to walk the borrowers through the loan. One of their staff members did it over the phone. All I had to do was notarize a few signatures and wait for their phone call to end. It was not the best pay, but this is how I got started in the business, so I don’t regret it. But, if I was offered this type of pay now, I would have a fit!

Even if a $30 signing is within a mile and is only a single document, is it worth it? Maybe if you are really hungry. Maybe it is better than not getting any offers at all, but most notaries would rather that the phone just doesn’t ring.

New Notary Apps that you really need!

The entire world has gone app crazy in the last few years. Personally, I use GPS, and my alarm clock. That’s about it for me in terms of apps. But, what types of apps might notaries need to stay ahead?

(1) Look up signing company reviews.
123notary already has this for i-phones. It is a page, not an app, but what is the difference right?

(2) Find a cheap gas station
Google already does this. Just visit www.google.com and look up “cheap gas” or “gas prices” and then add your zip code. Or enter your city name and gas prices for a better selection if you live in a big city.
You can also use gasbuddy.com

(3) Billing applications?
Very few notaries use sophisticated technology to know who owes them what and for how long. But, there are companies out there who have billing applications that you can see at a glance who owes you what and who to invoice. Is it worth it? You tell us!

(4) Road condition apps.
There are GPS systems that tell you which route to your destination is faster under current situations. Such technology has cleaned up traffic congestion in many cities around the world. If you have technology that tells you how to avoid traffic, you could save an hour per day every day! That would be worth paying a bundle.

(5) Translation apps (risky)
The notary is supposed to be skilled in whatever language they use at a signing. If you look up words in an application, you might screw up and the signer might understand you incorrectly or not at all. Words sometimes have multiple translations. “Do you swear to tell the truth” could translate into “Will you marry me” if you miss a subtle nuance in certain languages. But, for those who are app crazy, you are apt to get one anyway. So, go for it! SayHi Translate can do this by the way!

(6) Mileage log apps for the IRS
The IRS may request to see your trip logs. If it is digital, that might be good, unless it is hard to download, print, or gets accidentally compromised. But, paper records can get lost too, so which way is safer? You can keep track of your miles using your i-phone if you have an app for that. I don’t know of any app like that, but they probably exist as probably 50 million Americans deduct mileage for one reason or another.

(7) eJournal applications?
These exist. You need to be an eNotary to use one. Out of 7000 notaries on our site, I’m sure there are a good three or four of you who are commissioned eNotaries.

(8) iSchedule
You guessed it. This app will manage your busy schedule. You can input all your appointments with this app and all is well until you go into a dead zone or run out of battery.

(9) TurboScan
Quickly scan multipage documents into high-quality PDF’s. Wow! Sounds like a winner for companies who want fax-backs.

(10) Documents Free (Mobile Office Suite)
Not sure what this does, but you can read up on it.

(11) Contacts <-> Excel
I think we all know what this is for.

(12) UPS Mobile
Ship your packages using your i-phone, and hopefully a UPS box. You might need a printer too.

And last but not least… (and appropriately numbered)

(13) Ghost Hunters Haunted House Finder
Find a haunted house near you. Or use it to look up your signings. If one of your signings is in an officially haunted house, suggest that you all meet at Starbucks. Use your Starbucks finder app to get there!

(14) Page Separator Pro
Split those legal and letter sized pieces of paper. Even some dual tray printers don’t have the ability to figure out which tray prints what, and why…

What is your MONTHLY notary marketing plan?

What is your marketing plan? Do you have one? Many people are helter-skelter in their approach to notary marketing. Here are some things to consider:

(1) Market to local title companies, nationwide, and signing companies that have reasonable reputations
(2) Market on a regular basis. If you are starting out, you will spend more time marketing and less time working. But, as you gain regular clients, you will have less time to market. Marketing is a dish best served hot, and best done while business is slow, which generally means in the beginning of the month.
(3) Marketing means gaining new contacts and getting on their database, but also means giving a call every two months to companies who have you on their database that didn’t call you recently.
(4) Making your listing all that it can be helps a lot too. That is passive marketing as opposed to points one, two and three which are active marketing (pounding on doors or phones as the case may be.) A good listing should have 123notary certification, a unique and informative notes section (ask for help,) and reviews from satisfied clients.
(5) Marketing plans should be based on monthly tasks that you are going to do to market yourself. Decide ahead of time how many companies you will contact every month, how many touching base calls you will make, and how many minutes to spend on your listings.

Remember, my most important point about marketing is that it needs to be regular. As newbies, it is easy to think that you do your marketing once, and then you are done. It is easy to think that you get in 200 company databases, create a handful of internet directory listings and you are done. Not true. You have to keep getting on new databases of signing/Title companies, refresh existing relationships with courtesy calls, and keep refining your listing.

People think that their listing is “good enough.” This complacency leads to mediocre results. Take a look at your notes section every few months. I bet there are more unique and interesting things you can say about yourself. Most people cannot think of anything unique to say. So, keep going back to your listing. Writing a notes section is like Twitter in more ways than you think. If you post something blah on Twitter, people will not notice it because they see hundreds of tweets per day. To gain their attention and get them to favorite or retweet your tweet, you have to stand out, and in a positive way. Your notes section should “pop,” and grab people’s attention. It should have facts, but also be unique and have pizzazz. That is not easy to do, so keep working on it.

You are never done with marketing. Marketing is something you need a MONTHLY schedule and plan to tackle. What is your monthly marketing plan?

Signing Services take a portion of the notary fee

It is a well known fact that signing services take a portion of the notary fee. Some take most of it, while others only take a fraction. It is very bizarre how so many companies work on such different margins. I remember when I was in the game back in 2004. One company charged $250 and paid $75. Another company did business based on volume and charged $90, but paid only $50. This was in the days before e-documents were popular. Once in a while you can read the HUD and find that a company is charging a whopping $400 for signing fees. They might claim that part of that is for Attorney or processing fees, but I don’t buy that.

One borrower saw some outrageous notary fee on the HUD, and asked the notary how much he got from it. The notary replied that he got enough to get something on the value menu at McDonalds. The borrower didn’t like that crack much.

Notaries feel that it is not fair that they get such a small percentage of the fee. In business, there is no “fair.” You take it or leave it. If you are taking it, then that is your non-verbal way of saying that is the best you can do, and it is therefor fair. Take it or leave it. To be able to leave it, you need to have a steady stream of better offers.

Notaries always complain about bad offers. But, it is like a girl at a dance hall. If she gets 19 bad offers, but 1 good one, the good one is all she needs. On the other hand, if another girl got three bad offers and complains about them, the problem is not the bad offers, but the lack of good offers.

If you are not an experienced notary with excellent skills, you don’t merit high pay! Become an expert, pay your dues, master the art of communication, and then you might get better offers. Only 2% of the notaries on 123notary are top notch, and they are getting most of the good offers!

The Seinfeld Episode About a Notary aka Sign-Feld

GEORGE: Get this. My parents are renewing their vows.

JERRY: Frank and Estelle? (off George’s nod) The vows to argue with each other till death do they part?

GEORGE: What makes you think death’ll stop them? You think the Grim Reaper’s grim now?
Wait’ll he meets the “ungrateful dead”.

JERRY: Renewing their vows. It’s kinda sweet actually.

GEORGE: Remember that notary Kramer hired to authenticate the picture of Jesus on a piece of toast?

JERRY: The guy who swore it was Johnny Depp.

GEORGE: I still say it was Colin Farrell. I need Kramer to throw me his name. I may hire him.

JERRY: Looked more like Uncle Sam to me.

GEORGE: No way was that Uncle Sam.

JERRY: So why are you hiring a guy who worships Johnny Depp? Wouldn’t it make more sense if you were Johnny Depp?

GEORGE: I want him to authenticate the vows. If he can corroborate…

JERRY: Attest?

GEORGE: That’s right. If he can affirm the vows to be genuine, maybe then the loony birds will have to live by them for a change!

JERRY: Unless their vows are to continue not living by them.

Kramer enters.

KRAMER: Guess who’s the new errors and insurance salesman? You’re lookin’ at him!

JERRY: What makes you an errors and insurance expert? Although I admit your expertise when it comes to ensuring you make errors is second to none.

KRAMER: Remember that notary I hired?

JERRY: The one who saw Johnny Depp in a piece of toast?

KRAMER: It was Jesus, Jerry! Anybody with half a brain could tell you that!

JERRY: You’re right, you just did.

GEORGE: What was his name, Kramer? I need to hire a notary.

JERRY: Why do you want to hire a notary who doesn’t know Jesus from Johnny Depp?

GEORGE: Or Colin Farrell! He got it wrong. Maybe he’s cheaper.

KRAMER: (offering) Here’s his business card. Come on, George. Don’t you think Colin Farrell has better things to do than pop up on a piece of toast?

GEORGE: Jesus doesn’t??

KRAMER: Jesus works in mysterious ways.

GEORGE: Do does Farrell. He doesn’t even do talk shows.

KRAMER: Jesus doesn’t even do Charlie Rose!

JERRY: Will you two knock it off?

KRAMER: I’m suing the guy for affirming it was Depp over Jesus. And now I can also sell him an errors and insurance policy that’ll absorb his liabilities for an honest mistake.

JERRY: If it was an honest mistake, isn’t suing him a little dishonest?

KRAMER: I’m Cosmos, not Jesus.

GEORGE: What kind of liabilities?

KRAMER: The difference between the cost of a certifiable Johnny Depp piece of toast on eBay versus a certifiable Jesus piece of toast on eBay. You do the math!

Elaine enters, munching on a piece of toast.

ELAINE: That’s it. I am done. He’s gettin’ a Dear John text.

JERRY: Who?

ELAINE: The teeth picker.

JERRY: Can’t you at least give him some floss first?

ELAINE: Floss. Toothpicks. Sucking between my teeth. The guy can’t take a hint.

GEORGE: Are you officially breaking up with the teeth picker?

ELAINE: The man is (displaying the last of what she’s munching on) toast.

KRAMER: (Eyeing toast) Is that who I think it is?

JERRY: Here we go.

GEORGE: If he’s so bad at picking up on hints and you want him to get the message you’re dumping him, don’t text him. Write him a Dear John letter on paper that a notary witnesses. So he can corroborate it.

ELAINE: Attest?

GEORGE: Yes! Affirm to be correct, true or genuine.

ELAINE: Since when are you the notary expert?

GEORGE: When I was a kid, I had a dream about being a notary. Other kids were dreaming about naked women. I was dreaming about squeezing embossers. Your own seal. Administering oaths. It’s a very respectable line of work when you think about it.

JERRY: So why didn’t you ever take it up?

GEORGE: Since when am I respectable?
