The curse of the Notary mummy

A few years back, and Egyptologist went to Giza to do some research one some new findings. There were mummies buried in a chamber far deeper in the pyramid that had never been discovered before. The maps of the interior of the pyramid did not include this room and it was discovered using sound technology. The sound technology spotted (perhaps heard would be a better word since it is sound technology) a hollow area far within the ten thousand year old pyramid.

The historian was from America and was very logical. He didn’t believe in curses. After all, we all know that couldn’t possibly be real. So, he ignored the warnings from his Egyptian colleagues and went into the chamber — alone!!! He discovered all types of artifacts and encrypted messages written in hyroglyphics on the wall. It reminded him of his last trip to Hunan Garden where the bill was written in hyroglypics. There was a bird character, some people walking like Egyptians pointing their hands forward, a paper, and then a notary seal. Oh my God. Our historian had discovered an ancient Egyptian Notary Public.

Then he looked further. There were pictographs of the king asking him to administer an Oath. But the Notary said, “Sorry, my state doesn’t require Oaths.” Maybe that’s how the Notary died. He was so poorly trained, that the king or Pharoah had him put to death to teach a lesson to the other Notaries. The other Notaries said, “That’s so unfair—o!” In any case, the Notary must have either been high ranking in the dynasty he lived in or have been from a prominent family to be mummified. Enbalming don’t come cheap, and neither does space in a pyramid. I tried looking up rooms in pyramids on Craig’s list and the prices were astronomical.

In any case, this dumb Egyptologist took the liberty to open the casket and try to move the mummy. Immediately his lamp flickered, his electronic devices suddenly failed. He was all alone, in the dark and screamed — help!!!! Luckily, he was able to feel his way out of the room, down the hall and to his awaiting comrades who were down the hall. His colleagues warned him that terrible things would happen because of what he had done, but he didn’t believe them. After all, this was just a coincidence, right?

Nothing bad happened to that historian. However, many people working for signing companies who don’t pay Notaries reported having dreams of mummies coming unenbalmed following them around. Perhaps the mummy in question did not get paid by ancient Egyptian signing companies and wanted revenge on signing companies, but not on archeologists (hmm). One reported that it was hard to breath and felt something pressing on her chest. Another felt something touching her at night that wasn’t there. Finally the signing companies started to talk to each other. They decided they were being haunted by the spirit of the Notary mummy. Something had to be done. So, finally after a few years of discussions and talking to people in Cairo, they decided to have someone go back into that pyramid into the forbidding chamber and close that casket once and for all.

But, the person chosen to close the casket decided that the mummy would feel much happier if he put a Notary journal in the casket with him to take to the afterlife. They put the journal in, closed the casket, and moved it back to where it had originally been. Then the dreams continued. The mummy said, “My state doesn’t require journals!” People in five different signing companies had this dream.

Finally, they called a Shaman in to solve this for good. The Shaman had a clever plan. He had someone imposter the mummy’s Notary seal, and the mummy’s spirit was called into Notary Court in heaven. The judge asked for evidence of the transaction that the notary allegedly notarized. The Notary explained that his state didn’t require a journal. The judge sentenced him to 100 years in spirit jail. Kind of a harsh sentence, but the bad dreams stopped, and everyone was happy. The Shaman made out well as he got free notary service for life and after-life which was all fine and dandy until he asked for an Oath and the notary said, “Sorry, my state doesn’t require Oaths. Then the Shaman looked up their state handbook, found out that they do indeed do Oaths in the Notary’s state, reported the Notary to the Secretary of State, and the Notary got busted.

To be safe, the shaman decided to put some ancient egyptian money in the casket where the mummy with a note in hyroglyphics that said it was from that ancient Egyptian company that never paid him. The note said — payment plus 3000 years worth of interest.

And so ends the saga of the Notary mummy.
The moral of the story is — never trust a dead Notary who doesn’t keep a journal.

A Notary finds a document notarized by Jeremy in 2001

How bizarre. I got an email from a Notary on our database who lives in the Los Angeles area. She claims that she came across a document that I notarized back in 2001. It was a Deed of Trust for 4811 South Alamada (Alameda?) Partnership. That was a long time ago. I don’t remember the signer who’s name was Hannah Kelly. I filled up about 50 Notary journals during my career mostly with loan signings.

The signings I do remember were for a guy in jail who blew up his apartment experimenting with explosives. I also Notarized his jurors as a matter of coincidence. I remember doing 40 sets of fingerprints in Pico Rivera for a room of people mostly from Puebla Mexico. I remember an Attorney in Arcadia who had really long Health Directives for middle aged Chinese families who were thinking ahead. I remember a signing in South Central at a hospital where they made me wait forever while they slowly filled out their power of attorney forms and then the lady asked, “Do you like your job?” I told her that she was supposed to have her documents ready BEFORE she called me. I really enjoy scolding people who disrespect other people’s time.

I remember driving to Hemet, Victorville, and Santa Clarita for a Settlement Agent named Emily who gave me steady work. I remember a Real Estate agent who had endless Grant Deeds to sign. That’s about it from my eight year career. Most of my signers were boring as hell, but I had a handful of memorable ones. Jail signings were the most interesting.

Welcome to the Notary Zoo!

After visiting the Notary Zoo for the first time, I noticed that things were a little “different” there. There were animals that didn’t exist in real life, and situations that were often opposite of what they normally were.

Before entering the zoo, right before the entrance, you see a huge venue carved into the granite floor. The venue says, “State of California, County of Los Angeles.” I’m glad the zoo helps me remember where I am because at that place, it’s easy to forget. Then, I went to pay my entrance fee. There was a huge sign saying that all customers needed to “personally appear” before the ticket seller with the seal of approval, who won the crowd’s approval after the seal juggled a ball on its nose. I needed to produce positive identification, asked how much it was to visit the zoo, and the clerk said it depended on how many signatures I wanted. I wanted admittance for just myself, which would be one signature at $10 per signature. The lady stamped my ticket and let me in.

As Trump might say, the zoo was “huge.”

There were walkways going every which direction. To the left I saw the Juratffs. I had never seen a Juratff before. I asked what I was supposed to do there, and the guard said that people swear at this animal all day long. So, I said, “I solemnly swear blah blah blah.” But, the juratff ignored me and kept eating leaves. At least he stuck his neck out for me. In the next exhibit down the corridor I saw a giant refrigerator with a sign saying, “How can you fit a juratff in a refrigerator?” Then a baby juratff waltzed in the refrigerator, stuck its neck out the hole in the top, and munched on some low hanging leaves.

Don’t feed the Notaries

Next, there was an area where some Notaries were hanging around. The visitors were led down an underground passage and then up some stairs into a huge cage that had a sign: “Don’t feed the Notaries.” The Notaries just went about their business and ignored the tourists’ constant taunts and whistling. The Notaries sat at desks, walked around, ID’d people and stamped pieces of paper. I didn’t understand the logic of this as they were notarizing other Notaries and not getting paid. Later on I learned that this was some sort of an asylum for people who were convinced that they were Notaries, but never passed the state Notary exam for reasons unknown. They were NOTaries.

The next exhibit had a Notary comedian. Not only was there an applause sign. There was an applause signer.

He started cracking jokes. “How do you define a loose acknowledgment? It’s an acknowledgement that attaches itself to different documents — on the first date before it even knows your first name — at least the first name on your ID.” Then our comedian friend made another joke about pastry. “I just found out that a Mexican wedding cake is exactly the same thing as a Russian tea cake. They are both two inches wide and made from shortbread. I guess one man’s tea is another man’s wedding!”

They just sat in the tree all day long saying, “Hoo — is the signer?” Next to the owls was the judge from Noternity court who said, “Who is the signer? Who is the Notary? We’ve examined the DNA evidence and handwriting analysis and you ARE the Notary!”

The aquarium was next on my list.
I went down a dark hallway into a pitch black room, turned a corner, and then I was in the Notary Aquarium. I saw a guy swimming in the tank in a three piece suit with a briefcase. I asked the guard why the sharks don’t eat him. The guard replied, “Professional courtesy — that guy’s an Attorney.” Then I saw another guy wearing a suit who just got his leg bitten off by another shark. Blood was filling the tank. I looked at the guard and he said, “That one’s a Mortgage Broker. He’s the one who asked people to backdate, and didn’t pay his Notaries on time.” It cost him a leg if not an arm. I journeyed into the next room in the aquarium and saw a bizarre looking fish. It looked like a hammerhead, but on closer inspection it was a stampfish. His head looked like a huge rectangular Notary stamp. I said to the guard, “It’s too bad there is no paperfish that the stampfish can stamp.” The guard said, “Where there is one around here, there will be a squid just waiting to donate some of his precious ink so the underwater Notarization could happen.” Then, lo and behold, a paperfish appeared from nowhere. Instead of stamping the paperfish, the stampfish took a bite out of it. I asked the guard what happened. The guard informed me that the stampfish was offended that the paperfish hadn’t been signed and dated — this was his way of voicing his underwater displeasure. Then I saw another stampfish who looked like he was high. The guard explained that he had a constant supply of really good sea-weed, and one or two bites of that will get you very high. On my way out of the aquarium there was a huge underwater building. The sign on the building said underwater county recorder. Inside the building there was a huge line of stamp fish. My only thought at this point is — I hope these stampfish have waterproof journals!

On my way toward the exit I saw some lions swearing under Oath. Lyin’ and swearing to uphold the truth – Isn’t that an oxymoron? Then I saw some sheep being sheepish about their loan signing. But they couldn’t pull their wool over my eyes. There was a huge section where there were boars that specialized in 400 page signings where you read every page. It nearly boared me to death. And finally a bobcat who swore under Oath that he was legally Robert Cat.

Finally, I went to the aviary.
That place is for the birds! I saw some birds signing a health directive so they could fight against avarian cancer. I tried to explain that it is o-varian cancer, but they claimed that there are certain types of cancer that only birds get in their old age. Then, an eagle swooped down to avoid one of the guards who was trying to ID him for the Patriot Act.

In any case. I enjoyed the zoo. It was fun. I was slightly disappointed that I couldn’t get a souvenir of a waterproof journal in the gift shop, but maybe next year.

Additions to policies regarding listings, certification and elite

Here are some new official policies for being listed and having various certifications. Please note that in addition to testing Notaries on general competency in the areas we test them in, we also keep score for general communication skills. Notaries who exhibit various forms of incompetency, bad attitudes, or listening comprehension issues will be written up in our notes which are private and not accessable to the public in any way shape or form.

(1) Requirements for being listed on 123notary.com.
In addition to being a current Notary Public, you must exhibit a certain level of competency to us at 123notary by means of a phone quiz. We require a minimum of 70% passing to ensure being willing to list you on the basis of competency. For those that score less than 70%, we might make exceptions if they are in an area with not so many other Notaries, or not so many other Notaries who passed our test. Issues that we expect Notaries to be competent in include:

Identification, Journals, Notary Acts, Oaths, Certificates, and Seals.

(2) Requirements for getting or keeping certification from 123notary.com.
Our previous rule was that if you were certified by 123notary, that the certification fee was a one time fee only. As of October 2017, we will require Notaries to recertify every (2) years. This will be at a small cost to those who purchased certification after Oct, 2017 and at no cost for those who initially got certified before that date.

All certified Notaries will be quizzed by phone no more than once per calendar year. The quiz for certified Notaries will include questions about:

(a) General Notary Knowledge: Identification, Journals, Notary Acts, Oaths, Certificates, and Seals.
(b) Handling situations before, at, or after loan signings.
(c) General knowledge of basic loan documents which normally include questions about FAQ’s borrowers have and what information is in which document.

(3) Requirements for keeping our Elite certification on 123notary.com.

All elite certified notaries on 123notary will be quizzed by phone no more than once per calendar year for quality standards. The quiz will include.

(a) General Notary Knowledge: Identification, Journals, Notary Acts, Oaths, Certificates, and Seals.
(b) Handling situations before, at, or after loan signings.
(c) General knowledge of basic loan documents which normally include questions about FAQ’s borrowers have and what information is in which document.
(d) Advanced Notary knowledge such as advanced vocabulary, Apostilles, less common documents, and generally harder questions.

Grading for elite certification will be at a higher standard than for the regular certified Notaries although we do not have a set standard for a passing percentage due to the fact that the difficulty of questions can vary from test to test.

(4) It is possible we might have a Platinum certification with an even higher standard in the future. However, during 2017 we will focus on maintaining set standards for the regular certification and elite. Please keep reading the blog to see if Platinum or Platinum Gray is mentioned.

Noternity Court

I’m tired of seeing all of these late night shows about people who can’t keep their pants on. Then, someone gets pregnant, and they don’t know who the father is. What is the future of our country if we can’t even bear children with two sane parents who are married I ask?

In any case. There is a new show call Noternity Court. There are some states that don’t require the use of a notary seal. The problem is, that if the notary’s handwriting is bad enough, you won’t be able to tell after the fact who notarized the document.

JEFF SIMONS: Your honor, it was 20 years ago. I can’t possibly remember if I notarized that document.

SAM (client) : It’s him… I swear it. If you overlook the balding head, the wrinkles around his eyes, and the extra 50 pounds he gained, that’s the same guy.

JEFF SIMONS: How can you be so sure?

JEFF SIMERS: Yeah, I have almost the exact same name and our signatures are so similar, how can you tell the difference.

JUDGE: You’re speaking out of order. Now, I’ve submitted your notary commission signatures and identification to a signature analysis crew. If necessary I’ll also have you take a lie detector test. Since the analysis is late. Let’s start with teh lie detector.

TECHNICIAN: Now, that we have you all wired, up I’m going to ask you a few questions.

JEFF SIMONS: Okay

TECHNICIAN: Is your name Jeff Simons.

JEFF SIMONS: Yes

TECHNICIAN: Were you a notary public in the year 1995

JEFF SIMONS: To the best of my knowledge.

TECHNICIAN: A simple yes or no will do. Our records show you were. Now, did you notarize with anyone else during the period when you were notarizing for Sam.

JEFF SIMONS: No, he was the only one.

TECHNICIAN: (pause) He’s telling the truth.

JUDGE: Okay, we have the signature analytics back. The analysis shows that … (pause)

We adjurn this court session for a special announcement.

There is a sale on journals at the ANS — Antiquated Notary Supplies. Don’t do a notary entry without a journal! Otherwise you might end up in Noternity Court.

JUDGE: Now, since your state doesn’t require you to use a notary seal or notary journal, it is very difficult to qeury a particular notary transaction. Do you know how critical these transactions are? What if you were signing off a Deed to a five million dollar property, and your handwriting was so bad they coudn’t tell who the notary was. I think you need to take your jobs a whole lot more seriously. Now, we got the DNA results back, and the handwriting analysis. Jeff Simons…. you are NOT, the notary!

JEFF SIMONS: I’m not? I can’t believe it. That’s fantastic, because I’m broke and can’t make any notary support payments.

JUDGE: Jeff Simers, you have a similar name to the other Jeff, but you are also not…. the notary!

JEFF SIMERS: I’m not? Well, who is?

JUDGE: The notary’s name is Jeff Somors, and he died in Nebraska many years ago. So, we can’t summon him

MEDIUM: Speak for yourself, we can do a seyonce.

JUDGE: Now, you’re talking, but that is not permissable in court. After all, how could we prove the identity of the spirit?

MEDIUM: The way we prove anyone else’s identity. Just have the spirit sign something, and ask your handwriting analyst!

JUDGE: I think we’re on to something!

Court Adjourned!

Arizona Notary Laws vs. Other States

Arizona notary law and laws that vary from state to state. 
It’s difficult to post about notary procedure on Twitter and Facebook.  No matter how universal a notary law seems, it can differ across state boundaries and the interpretation can differ among individuals too.
 
Credible witnesses
Arizona notary law specifies the term, “Credible person” , which is a way of saying credible identifying witness.  In Arizona, one credible witness who knows the notary as well as knowing the signer may be used to identify the signer.  Different states have different rules for credible witnesses. 90% of states allow them, but some states allow two witnesses who the notary doesn’t know, while others allow only one. California allows one CW if the notary knows them OR two if the notary doesn’t know them.
 
Foreign language signers
An Arizona notary must be able to communicate directly with the signer. Many other states have this same rule.  But, there are a few states where an interpreter may be used between the notary and the signer. 
 
Marriages?
There are a few states where notaries can get a special credential such as Justice of the Peace and perform marriages.  An Arizona notary public unfortunately can not perform a marriage — at least not one that would be legally binding. So, forever hold your peace!
 
Appear before?
In Arizona’s electronic notary rules for electric notaries (which is a separate office from a regular Arizona notary), there USED TO BE conditions where the  signer can be notarized without appearing before the notary for that particular signature.  Read our blog about Arizona electronic signatures for details.  This rule has been changed and signers must appear before the notary according to

Arizona Notary Bond?
Arizona notary bonds must only be for $5000.  Most other states require a larger bond than that.  In California, the bond must be $15,000 for example.
 
Seals and journals
An Arizona notary must use a seal and journal.  This seems fairly elementary, but many states do not require the use of both a seal and a journal. 
 
Marriage or adoption?
Arizona notary law prohibits notarizing for anyone who you are married to or related to by adoption.
 
Legal advice?
An Arizona notary public should not give legal advice and not prepare documents for clients.  Some states prohibit the preparation of legal documents only, while AZ prohibits the preparation of any document. The prohibition of notaries from giving legal advice is standard across the board though.
 
Term
An Arizona notary commission’s term is four years.   A four year term is very common, although the number of years can really vary from state to state.

Just Say No Article #2

Assisting with Immigration issues
If you are not an immigration expert, don’t answer immigration questions and don’t advertise yourself as an immigration expert. However, notaries are allowed to notarize many types of immigration documents. Just don’t give advice.

Assisting with legal advice
If asked for legal advice, if you are not an attorney, please refrain from giving legal advice as it might constitute unauthorized practice of law. Drafting legal documents, i.e. documents to be used in court or submitted to a judge or attorney could constitute legal advice or service (unauthorized practice of law) in many states. Don’t even offer to recommened particular notary procedures for their document, as that also could constitute unauthorized practice of law.

Backdating
Putting a date on a document’s notary certificate section that is previous to the current date is considered backdating and is illegal. Don’t backdate. Many signing companies will ask you to backdate when they are in a pinch and will lose their lock on the borrower’s loan. That is their problem, not yours. If you backdate you could lose your commission if you get caught. It is a misdemeanor in many states to ask a notary to commit fraud, so you can report a company that asks you or coerces you into backdating.

Don’t make notarial recommendations
Customers always ask what type of notarization they should get. You are not allowed to tell them in many states. You can describe the attributes of the various types of notarizations and ask what the document custodian would like too. Just don’t make recommendations.

Letting your boss review your journal
Your boss can not inspect your journal on their own. However, if you are present, then its okay if your boss inspects the journal. The notary should not let the public see journal entries unrelated to their specific business. Its best to make a copy of the journal entry that blocks out other entries to protect the privacy of the others who you notarized. If not all of the notarizations are related to your boss, it would be better if you make a copy of the journal entry in question rather than letting the boss look at the whole journal while you are there.

Blanks?
Don’t notarize a document with blanks in it. The blanks must somehow be filled in or crossed out. Otherwise you must decline from notarizing that document.

Lock up your seal and journal
Not all states require a seal and journal, but these instruments are the exclusive property of the notary and must be kept under lock and key. Don’t let others use them or you can get in big trouble, and so can the person who used them.

Don’t notarize parts of documents
If you are handed page three of a long document, you can not notarize it as a separate entity. Documents must be in their complete form to be notarized. Don’t only notarize the last page of a document — the page that contains the certificate wording either.

Failure to emboss?
Its not required by law to emboss pages, but if you choose to emboss every page of every document you notarized, it becomes difficult to substitute pages of documents without getting caught. Embossers leave a raised seal that can not be photocopied, so you will be detering a lot of funny business using an embosser.

e-notarization definition
An e-notarization is a notary act done purely online. The signer would not actually come into contact with the notary in many cases. Each state has different rules for e-notarizations, so learn your state’s rules if you want to do this. An online journal (ENJOA) would be used to record the transaction as well. e-notarizations would never be used for deeds effecting real property since those types of documents are very critical and involve high dollar figures. An e-signing is different from an e-notarization. Many states allow e-notarizations, but you generally need to get a special commission separate from your regular notary commission to be an e-notary.

e-signing definition

An e-signing is different from an e-notarization. E-signings are electronic loan signings where the notary visits the borrower’s home or meets the borrowers at a mutually agreeable location. The signer is present before the notary during an e-signing. Some or all of the documents in an e-signing are signed online while the remaining documents might be physical paper documents. The journal used in an e-signing would be a bound and sequential physical paper journal. e-notarizations are different from e-signings because the signer doesn’t actually appear before the notary in an e-notarization, and the journal in an e-notarization is electronic, and not physical.

E-signings are a process where the mortgage documents are signed online at the lender’s website. You either have your laptop w/ aircard & internet connection or you use the borrowers’ computer (provided they have one and they have stable internet service) . You access a remote site, review some documents online with them and they sign by clicking on a button (the borrowers’ digital signature with the lender is set up ahead of time). If your state does not accept e-recordings, you will still need to print those docs that need to be notarized as they are “wet” signatures – and sometimes you need to print a copy for the borrower … oh, and maybe print an extra set of documents “just in case” the internet connection fails or there are issues with the website. The beauty of e-signings for the lender is that changes to docs can be made at the table, thereby avoiding no-signs…HUDs and TILs can be changed and re-delivered virtually immediately – so if your borrower doesn’t have a computer, be prepared to print table so they‘re provided copies of revised docs!! (So, IMO, in addition to carrying your briefcase with your standard equipment, you’ll now need to carry laptop with aircard AND laser printer)..

Typical things notaries do wrong

Typical things notaries do wrong.
Notaries do many things incorrectly, particalar inexperienced, or unschooled notaries.  Clients will ask you to do all sorts of things.  Some things are merely unorthodox, while others are purely illegal.  Here are some things that notaries do wrong.
 
Copies of vital records
From time to time, a notary is asked to notarize a certified copy of a vital record such as a birth certificate, marriage or death certificate.  This is not legal, and not recommended.  It is legal, but not recommended to do what is called a copy certification by document custodian. This notary act is a glorified Jurat, where the individual who is in charge of the document swears to the authenticity of a copy of the document. 
 
Going to hospitals and jails without asking the right questions.
Many notaries don’t want to go to hospitals and jails because they are afraid.  There is nothing to be afraid of, but there are pitfalls.  Many signers in hospitals are elderly and don’t have ID.  Inmates NEVER have ID.  So, the notary must first be sure the signer or their family members / associates have their ID and it is wise to have them read the ID# and expiration date to the notary, so the notary can be sure that they really have the ID and that its current.
 
Leaving seals and journals unattended.
As a notary public, you and only you are responsible for safeguarding your seal and journal.  Even if your boss or co-workers want to use your seal or inspect your journal, its completely illegal. Only the notary can do a journal query, or use their seal.   Carelessly leaving your seal in an unlocked area is also a very serious notary error.  Seals and journals must always be kept under lock and key.
 
Not having the signer present.
Its common for a client to request that a notary notarize a document when the signer is not around. This is completely illegal.  The signer must be  in front of the notary during a signing.  This means within a few feet and able to communicate directly with the notary.
 
Having an interpreter
Many immigrant families have older members who don’t speak English.  They often attend to their business with their children along to explain things and translate.  When they call the notary over, they often don’t explain that the signer can not speak English, since its not a problem due to the fact that they can translate. But, the notary must be able to communicate directly with the signer.  If the signer only speaks Uzbek, and the notary doesn’t speak Uzbek, then the signing is off.   On the other hand, if the document is in Chinese, and the notary only speaks English, that is okay, since the notary is not liable for the contents of the document.
 
Overcharging
The maximum notary fees vary from state to state.  California and Florida are  “generous” offering $10 per acknolwedged signature, while many other states offer as low as 25 cents or two dollars per signature which is hardly enough to make a living.  It is tempting for notaries to charge more than they are supposed to to make it worth their while. This is illegal.  Also, many states have restrictions for what notaries can charge for travel fees.  Many notaries overlook these restrictions.
 
Journal thumbprints and notes
It is critical that notaries get the right thumbprint of the signer in their journal, especially for deeds and powers of attorneys.  This is a great way to deter fraud, and will keep a notary out of court in many instances.  Additional notes are important to keep in a journal too.  If a notary goes to court, they will never remember a signing that took place years ago, unless some notes are kept about anything unusual at the venue of the signing, or anything that is unusual about the signer.

Backdating
Almost all signing agents will be asked to backdate at one or more times during their career.  Don’t do it.  Backdating is illegal.  Backdating means putting a date prior to the actual date of the notarization on a notary certificate. The date of the notarization is when the signer signs the journal, although the signer can sign a document before the notarization of an acknowledged signature.  Here is some more information about backdating.
