Dr. Phil moderates dispute: Notaries vs. Signing Companies

Dr. PHIL: You have asked me to moderate your ongoing dispute between Notaries and signing companies. I hope that we will have a fruitful session and resolve some of your issues.

FRANK: Thank you Dr. Phil. We Notaries have been complaining for years about low-ball fees. We are sick of it and want to get paid what we deserve.

SAMANTHA: Thank you Dr. Phil. We signing companies used to have better quality Notaries to work for us. In the last several years, the quality keeps going down and down. We feel we shouldn’t have to pay much money to these Notaries who in our opinion, should not be commissioned in the first place.

FRANK: If you want better quality Notaries you are not going to get them based on what you pay.

SAMANTHA: Well, if you want more money, you won’t get it with your communication and notary skills.

Dr. PHIL: Which came first, the chicken or the egg? This conversation isn’t going anywhere. Now, Frank, I don’t know what your level of competency is as a Notary Public. If you want to get paid good money, you have to be good at what you do.

FRANK: Oh, I’m good at what I do.

SAMANTHA: No he’s not. He claims to be good at what he does. We tested him and he got 30% on our test which is so easy, high-school student could pass. We only hire him because the other Notaries are either just as bad, or charge a lot more.

Dr. PHIL: Too bad you don’t get paid for deluding yourself, you’re good at that. Now, you think you are good at what you do, but Samantha here has given you a standardized test and you failed. How can you call yourself a great Notary when you failed a very basic sounding standardized test?

FRANK: Well that’s because I’m anything but a standard Notary. And by the way, you’re just as bad as she is.

Dr. PHIL: Well, what do you think your average standard person is going to think if they know you failed your test?

FRANK: They’ll think I’m an idiot.

Dr. PHIL: So, do you think someone functioning at the level of an idiot deserves high pay? Do you think they deserve to be hired at all? Would you hire someone who failed a professional exam?

FRANK: Oh, well now that you put it that way. Hmmm. Well I thought I was good at what I did. I don’t get complaints?

Dr. PHIL: You have a complaint sitting right next to you. Do you think you’re being honest with yourself?

FRANK: In all honesty, yes… wait, can I start being honest now? Well at least I thought I was being honest with my self.

Dr. PHIL: The fact remains that you are not honest with yourself about how you are severely lacking in your knowledge of notary and signing basics. Those that hire you are not happy about that fact. They will never pay you much as long as you don’t live up to their expectations.

FRANK: What about my expectations?

SAMANTHA: We put up with this type of attitude to save $50 per signing. If we didn’t do that, we would not be able to turn a profit.

Dr. PHIL: Well you get what you pay for. Frank here is not living in reality and exhibits no willingness to learn his profession to the point where he seems hireable. Now, let me ask you a few questions Samantha. How often do the Notaries you hire make mistakes and what are the potential damages to your finances when they do make mistakes? Try to give me as many realistic scenarios as possible.

SAMANTHA: When we hire new Notaries, we screen them out first to get rid of the ones that sound really bad on the phone. The ones we hire, we encounter a 3% error rate, at least with the new hires.

Dr. PHIL: And what are the damages?

SAMANTHA: It’s really hard to say. Sometimes we have to resign. Other times we have to redraw documents. Once , a client lost his lock. But, in one isolated incident, an identity thief was notarized with a fake ID that a good Notary would have spotted. That cost us $20,000 and time in court.

Dr. PHIL: So, that sounds dangerous to me. What is the average cost of a notary mistake, all factors considered?

SAMANTHA: After doing the math, it looks like the average mistake might cost $400. Since mistakes only happen 3% of the time the cost per average job hiring questionable notaries might be $12. We are saving a lot more than $12 to hire cheaper Notaries so it seems worth it to me.

Dr. PHIL: What about the cost to your reputation and the risk of losing clients because you hire less than perfect Notaries?

SAMANTHA: That is always an issue, but since we clean up problems quickly, we haven’t lost more than a few clients. But, that does seem to be a bigger issue. How many Title Company clients have we lost due to the quality of the Notaries we have hired, and how many more would we retain or attract if we used better Notaries. It might be worth $30 extra to hire a better Notary.

FRANK: Now, I’m out of business for sure.

SAMANTHA: Unless you study. It wouldn’t kill you to crack a book.

FRANK: It might.

Dr. PHIL: It looks like we have had a good discussion here. I have learned something, and I think you, Samantha have learned more about the various factors in this complicated equation of who you hire, how much you pay them, and why. Now, Frank, have you also learned that you need to study more to be able to pass standardized tests to make a good impression on people who hire you?

FRANK: 123notary is the only entity who has quizzed me recently, and they are a directory. They don’t even hire people. I don’t think anyone else cares if I know anything, so why should I care?

Dr. PHIL: If you want to get more work at higher prices, you should care. I read an article that says that 123notary certified signers make $8 more per signing and get a heck of a lot more work.

The way you treat Jeremy might be the same way you treat Title

Many Notaries think they can be stubborn and difficult with me during our interactions. The fact is that I assume that if you are rude to me, that you will also be rude to title companies. Then the Notaries say that because they are paying me, they have the right to be rude to me. What an attitude! These are the same people who think they have the right to claim to know what they are doing when they don’t.

Then I talked to Jen who confirmed my theory. She had many title clients and she said that if a Notary is rude to me, they will be rude to others too. I was thinking that since Notaries get paid by title they will start out polite. But, if anything goes wrong, that the rudeness will come out fast.

My spiritual master says that if someone is rude to one person, then they are just rude and will eventually be rude to everybody. I have no way of proving this true. But, I have seen behaviors of friends who were hostile to strangers. This hostility came to me too, but not right away. I had to wait six years to see that hostility come back to me, but it came loud and clear.

So, if you see red flags, don’t discount those flags. They are real, and the consequences of the behavior is real too.

123notary is a directory that caters to Escrow and Title. We need professional Notaries who take their job seriously. Otherwise, the end users will get a bad impress of me, and I can’t afford that. So, treat me professionally, otherwise I will assume you are unprofessional towards everyone sooner or later.

“I have not received payment since my assignment and invoice to WFG on November 28. Despite numerous emails saying it’s in the mail, or will be in the mail, zero.

“WFG in Westlake Village, CA is giving me the run around with my fee being received. Completed signing on 9-30-16, it is now 11-29-16. Unacceptable. They claim they are going through a transitional period since Michael Crowder is no longer with them. What has that got to do with A/P getting my money to me?”

“May not be dealing with them again. Huge packages, lots of work, difficult to get through to anyone and get a response. They pay $125 but if I do anything again its going to be $150.”

“I have noticed that the loan packages are getting very large…so I have begun to notify, particularly WFG whose files average 170 copies…that my minimum fee is increased by another $20.00..As I mentioned before I have had no problems getting paid and have asked each time if the file is larger than 120 pages to add in another $20…but I’ve had to followup to make sure that it was…..so this week I am sending out notifications to most of the companies I work for to increase my minimum fee to include the $20. Whenever I accept a signing…they will need to include it in the order or I will return the assignment right there and then………We all have to begin to hold the line on our fees or if you accept less then you only have yourself to blame….Good Luck!”

“I agreed to perform a signing for WFG for 10:30am the next day. At 8am I had yet to receive any documents. WFG did not answer any of the 4 phone numbers I called. Nor did they respond to the emails I sent to 3 different people. My last email was that I was going to call the borrower and let them know the signing was cancelled. Moments later (10am) I received a response not to call the borrower that the documents were coming. Then I got an email stating the day would be changed. I called the borrower and basically said to stand by. I requested to be paid via PayPal. I got a call from Mike stating they never pay via PayPal and he would remove me from there list of notaries. I said fine. Be carful here folks. Read the other reviews.”

2016 Companies That Will Hire New Signing Agents

Here are some companies that typically hire new notaries. We published a similar list a few years ago and removed companies that have slowed down and added SnapDocs as they are a source of revenue to newer Notaries. As a new notary, your primary responsibility to yourself is to get some experience under your belt. Don’t be too picky about how much you pay or how pleasant it is to work for some of these companies. The outfits that typically will hire newbies low-ball, require fax-backs, and micromanage you to the point of exasperation. But, tolerate this, because that is how you pay your dues and get your experience. Once you have 1000 signings under your belt, the higher paying Title companies will start to take you more seriously.

The 90 days no payment list of signing companies

We’ve created all types of lists of signing companies over the years. But, here is a brand new idea. There are fast pays, 30 day pays, slow pays which might be 45-75 days, and then really slow pays. This list includes signing companies that were reported by Notaries on our forum to be at least 90 days late on paying at least one particular invoice. I wonder if they will pay at all. If you don’t like being paid late, read the reviews before you work for any signing company. Slow payers or no payers need to pay you up front with Paypal otherwise you are on your own, buddy!

I cannot say if they offer big bucks, but at least they are not low-balling (for now.) A Newbie at a Title Company

A Newbie at Title Co.
Most of our jobs are quite routine. Once in a while, thankfully not often; something crosses our path that is extraordinary. It could be very nice, or a mess; as you might have expected – I write about a mess. The docs are the docs, we are expected to make them work. However, there are limits to what, as notaries, we can process. Title has an agenda. It’s their objective to get the papers processed as quickly as possible. It has to be a mess of galactic proportions for them to either dump it, or redraw the docs. Notaries also have an agenda, and one item usually at the top of the list is to do the assignment legally. It’s not our job to enforce the law; merely to abide by it.

After accepting the “piggyback”, for a fair, but modest fee; I learn it’s to be via POA. OK, kinda, they take longer but that is our lot in life. I am told that some “special signing instructions” will be sent to me. I assume it’s their preferred POA phraseology. Some want “Mickey Mouse by Minnie Mouse, his attorney in fact”. Others reverse it: “Minnie Mouse as attorney in fact for Mickey Mouse”. I prefer the latter because the name to be sworn comes first. Both are not at all a factor in the notary section where *only* Minnie would be named. But, this assignment tried to, IMHO, not bend, but break the rules.

The instructions directed me to name the affiant and POA issuer, as sworn. Thus, before me appeared: “Minnie Mouse & Mickey Mouse via POA”. To me that was a new twist. It would appear that Minnie would be, based on the POA; taking my oath issued to Mickey! Just as we cannot delegate our notary status to someone else; oath taking cannot be via proxy. Sayeth title: “there are two signature lines on the notarized document, thus there needs to be two persons named in the notary section”. Admirable logic, a bit of arithmetic; 2=2; that’s hard to argue.

But, that would be an improper notarization. Only the person(s) who actually “appeared before me…” can be named. This set of docs had it both ways. Some had both names filled in the notary section; some had “via Power of Attorney”; and a few were for me to write in. When I called title, informing of the need for me to redact all entries other than “Minnie Mouse”; I received more bad news.

“Her legal first name is not “Minnie”, it’s “Min”. However she took title as Minnie, and an AKA form is not allowed – you just have to notarize her as Minnie””. Strike Two – this job was going downhill faster than the Cyclone at Coney Island. I call Ms. Mouse, to my surprise and delight her driver license had “Minnie”. She told me she used that name all her life; though Min was on her birth certificate. Words, Words; to me it’s what is on the driver license that counts.

During my chat with Ms. Mouse she also mentions that the papers need to be processed quickly. It seems that Mr. Mouse is deceased! Whoa, hold on partner – in every state when the agent knows of the principal’s demise – their authority ceases to exist. Title and Ms. Mouse want to proceed with a voided Power of Attorney! What is my position? My notarizations would make no mention to a Power of Attorney. In my Jurat “before me appeared Minnie Mouse” would be the only entry, and she does have valid ID in that name. I never did find out if title knew of the demise of Mr. Mouse.

I bail out. There had been too many heated exchanges with Title; my insistence on proper format soured them. She told me her legal name was Min, so some doubt. Worst of all would be to facilitate the use of a no longer valid Power of Attorney. Best to not be a party to the eventual litigation!
