Notary Public 101 — Identification

IDENTIFICATION

As a Notary Public, the most important thing you do is to identify a signer. Different states have different rules for what identification document you can use and how someone is to be identified. If a Notary fails to do a good job identifying a signer, that Notary can quickly end up in court as a witness or defendant. In my opinion if you don’t do a good job identifying signers, you might as well not be a Notary Public.

Identification Documents & Characteristics
Commonly accepted ID’s include passports, driver’s licenses, state issued ID cards, military ID’s. Green cards (permanent resident cards) are not necessarily allowed, so look that one up in your handbook. As a rule, an acceptable ID must be:

Current — (there are exceptions in California, Tennessee and perhaps other states that allow the ID to be issued within five years even if it is expired.)

Government Issued — Some Notaries think that a signature affidavit or gas bill is a good secondary form of ID, but those are not government issued and you don’t know what the source of the information for the names on them are.

Photo ID — An acceptable ID should have a photo. I do not think that many states allow social security cards as secondary identifications. However, you can look that up in your handbook.

Physical Description — the ID would say your height, eye color, etc.

Serial Number — the ID should have a number such as A58362D.

Expiration Date — the ID should have an expiration date somewhere. Normally there is an issue date as well somewhere.

Signature — the signature on the ID is important because you will need to compare that to the one in your journal and on the document made by the same person.

THE NAME ON THE ID

Different states have different rules for what the name on the ID should say relative to the name on the document. Some states do not require the names to match. Others require that the Notary be reasonably sure that the person in the ID and the person on the document are the same person. Reasonably sure is a wishy-washy term. You can never be 100% sure it is the same person because ID’s can be falsified and there could be multiple people with the same name as well as multiple people who look similar to each other. Identifying humans is easier than identifying squirrels, but there can still be confusion. The name on the document’s signature must be provable to the name on the ID, otherwise it would be questionable and risky to notarize that signature.

PROCEDURE

When you do a Notary act, you ask for the signer’s identification. You record that information in your journal and you keep a journal whether your state requires it or not as that is your only evidence in court. You compare the name on the ID to the name on the document. If the name on the document is not provable based on the ID then you are advised to decline the notarization, especially if it is for a Deed. Here is a summary of the ID and acknowledgment notarization process.

(1) Ask for ID.
(2) Record ID information in journal
(3) Have signer(s) sign your journal and the document(s)
(4) Compare the name in the document to the name on the ID. Make sure the name on the document is provable based on the ID.
(5) Make sure the signature in the journal, document and ID all match.
(6) Fill out the certificate, sign and seal.

Examples of provability in ID
ID says John Smith — document says John W Smith…. name is NOT provable.
ID says John W Smith — document says John W Smith… name is provable
ID says John William Smith — document says John W Smith… name is provable based on the ID.

FAKE ID

Keep an eye out for fake ID’s. There are guide books that can yelp you identify a false identification. If there is peeling lamination or the signature is above the lamination then it is fake. You can ask the signer what his sign is or what his birthday or height is. If he does not know his sign or birthday based on the ID, then his ID is fake. If he does know his sign that is great, but does not prove the ID is real.

THUMBPRINTS

If you value your life, ask for journal thumbprints. They can keep you out of court. People might complain about being asked to be thumbprinted as it can seem like an invasion of privacy and a hassle — but a thumbprint is the only way an investigative agency can have a paper trail leading to an arrest of an identity thief. Thumbprints are the only unique form of identification a Notary can use at this point in time. No two thumbprints are alike, and they cannot be forged at a Notary appointment unless they wear a latex thumbprint on their thumb which would be easily detectable.

123notary’s comprehensive guide to getting reviews

To do well on 123notary, you need our certification (not someone else’s,) a good notes section on your profile, and a few good reviews. You don’t need a million reviews (although Ken in NYC thinks he does and has close to a million now.) But, at least one solid review every quarter will keep you far ahead of the game. The catch is how to get reviews, how to ask for them, who to ask, when, and what else to do? Here are some pointers, and then the articles listed below will keep you entertained for the rest of the evening!

1. Get a new review at least once per quarter.
You don’t need a new review every week, just once every few months. This will keep you ahead of the competition in most cases, or at least not far behind if you live where the real review sharks are. Ken has over 400 reviews now, so competing with him will be impossible. But, doing your best will impress all.

2. Understand the 8% rule
Only 8% of people you ask will give you a review. You might have better luck if you deliver stellar service, show up on time, and offer to do extra at no cost. You get more by giving more without asking for return, so give to charity, help thy neighbor, and do extra for your Notary clients.

3. Only ask those who praise you
It is a waste of time to ask for reviews from those who didn’t like your work. Ask those who liked your work and ask right after they say how much they liked your work.

4. Individuals are easier to get reviews from than title & escrow or signing companies.
Signing companies and big companies that hire many Notaries are bombarded with requests for reviews. Yes, ask them, but don’t base your success at getting reviews on the big guys. You stand a 3% chance of getting a review. If this means you should accept a few jobs from regular clients who just want an Affidavit notarized, it might be a good idea as reviews are life and death.

5. Email a link
It is difficult for people to maneouver 123notary. There are too many pages, and too much going on. Make their life simple and email a link to your review page. Ask for their email and send a link. If they can’t find the review page, they won’t write a review.

6. Don’t get three reviews the same day
Many Notaries do this and it looks tacky. They get three reviews within hours of each other and then no reviews for years. If you ask a list of people for reviews, then spread it out over time. If we think your reviews are fake or that you posted them yourself, you are in trouble!

7. Old reviews lose their steam
If you have all of your reviews from 2012, and no new ones, you will get as much business as if you didn’t have any reviews. Keep your reviews current if you want to get business.

8. Five or Six reviews doubles your business!
What? Oh my God! Only five or six? That might mean asking eighty or so people. But, the benefits of these reviews will last for years. Imagine paying 123notary the same amount of money, but getting double the output from your listing, plus having more pride!

Fake it until you make it with your number of signings.

We have many notaries on 123notary. Some are honest, others are clueless, a few are motivated, but most just want an easy ride. Recently, I have become aware, unpleasantly, that there is a small percentage of fakers.

We had one lady who claimed to have signed 2000 loans. When I asked her what type of loans she signed, she drew a blank. I immediately sensed that she didn’t know anything and was a fake signing agent. We had another who had signed 200 loans — allegedly who couldn’t name even a single loan type. I had to drag it out of him what the names of the documents were that he had notarized — and the answer sounded like he was reading a list from a journal, and not by memory. A sign of inexperience. We had a third gentleman who had signed 100 loans who didn’t know that the figure most commonly used to compare loans was the APR. How can he not know that?

The think you need to realize is that people who fake their number of signings do not get jobs. People who call them immediately sense that they are incompetent as notaries and shouldn’t be hired. 123notary is expert at presenting notaries to the public. But, if your presentation doesn’t match up to your oral skills, you will be standing in the unemployement line. Yes — present yourself well, but don’t fake it until you make it. You ruin your credibility and ours as well.

Rather than being dishonest, just evade the topic of how many signings you have done (if there are not that many) and talk about what you have done in terms of specifics. List loan types, or specific companies you have worked for. List documents you are intimate with. Specifics sell a lot more than generalities like “Lots of experience”, or “Professional and reliable”. People want real information, not unverifiable claims.

Blaming the government for the will of the people & Covid Karma

I have been so upset with the government for allowing our constitutional rights to be betrayed for light and transient cause — a fake pandemic with fake death statistics where hospitals get paid extra if they say a death is Covid19 related.

But, the people want this, at least in California. In Georgia people want to go out with their guns and protect their church. In California people want to sit, do nothing and behave as if we are in grave danger from some fake emergency that requires the shutting down of most aspects of society and then lots of nagging and other unnecessary restrictions.

I still have not seen anyone even cough and only heard of one person who knows someone who I have met who died. One person dying is not a pandemic. If this were a real pandemic, you would see people dying in mass on the street, overflowing hospitals, and real panic.

But, what type of karma would a person have for wanting to put their neighbor out of a job? That could kill their neighbor. No work means no money. That can lead to evictions and starvation. If you encourage your governor to shut everything down, are you responsible if your neighbor dies?

The interesting thing is that most of the people out of work in California like the idea of being out of work and like the idea of saving themselves from the inescapable clutches of this mystery Covid19 that I had not seen a single soul have. So, can I say that they are “doing it to themselves?” Putting themselves out of work?

Some people are just so dumb. They don’t realize there is a problem until it hits them in the face. Do we have to wait until people are dying on the street because they were evicted in mass? Do we have to wait until people die of starvation in their apartments? The economy might bounce back in Republican states, but the air is so clean in Los Angeles that the economy cannot be functioning at more than 40% at best.

Let me sum it up for dummies.
Not working >> Not having money >> Getting evicted >> Starving in the street.

Now, if the government gives you a temporary hand out to tide you over, but your job doesn’t rematerialize magically when the government check dries out — the eviction and starvation is temporarily delayed by a few weeks.

It is kind of like staying at home doesn’t save you from Covid, it just delays how fast you are likely to get it by a few weeks. It doesn’t prevent you from getting it.

Vitamin D prevents Covid.
Having a job prevents evictions.
We would all be so much better off taking vitamin D pills, A, C, veggies and keeping going to work. But the damage is already done. We did it to ourselves. This is our karma.

All I can say is thank God I have a job. When my site went down for 7.5 days I began to see how hopeless it might be for the others who don’t have work. But, I cried not having work. People in my part of town don’t seem the slightest bit upset that most people aren’t working. Are they insane? Or do they just had bad karma.

Notary confidence

There is real confidence and there is a false sense of security. Many Notaries go through many stages in the evolution of their Notary confidence.

Complete beginners go through terror and a complete lack of confidence. They don’t know what to do. I remember being there back in 1998 and 1999. Those were the days. The solution is to take courses and get experience with companies who will babysit you. These days there are many companies ready to micromanage you. Treat it like a blessing.

Then there are those with a little experience who get too confident when they know very little. They boast about how dependable they are and their .0001% error rate. Both of these claims are completely unverifiable and anyone can make those claims making them not worth saying. But, the least dependable and least knowledgeable notaries tend to make the highest quantity of BS sounding claims. It is counterproductive to make these claims. Having a false sense of confidence is bad. It pays to be modest until you have some verifiable evidence that you are awesome.

Next, there are those that studied hard and mastered basic notary and signing concepts. They might have book smarts, but do they have life smarts? Many cannot function in real life situations and may or may not have good phone etiquette or business skills. In the notary business, those with masterful business skills tend to do well. Those who were successful in another career tend to transfer that success on over.

Finally, there are Notary Signing Agents with 5000 loans signed, and that have passed many different certification tests from different agencies. These Notaries can masterfully answer any notary question and don’t whine when you ask them technical questions to verify their ability. These Notaries realize how critical it is to verify their skill because these are the Notaries who clean up after other Notaries who are idiots who make a mess out of Acknowledgements, Jurats, and people’s loans.

A Notary who has Notary confidence doesn’t need to boast like the other novice Notaries. They have an air of confidence. They are more than happy to indulge you with even the most nit-picky and annoying of technical notary questions and give you the most professional answer without making it a point to inform you that they are, “very professional.” They routinely show up on time to all of their appointments and get documents back in a punctual manner without needing to inform you that they are, “reliable and dependable.” These Notaries show you how great they are with their behavior and question answering capabilities without all of the song and dance that the other Notaries give — always trying to show off and give you an answer five times as long as what you asked for so they can squeeze in more information that you didn’t ask for. Always doing a sales pitch is annoying and a sign that you have fake confidence. Someone with real Notary confidence knows it all, but doesn’t need to advertise it — it just shows. So, don’t be like these cheap sounding Notaries always boasting as much as they can and covering up for what they don’t know. Know your stuff, pass some certification tests, get some experience and be a signer with real Notary confidence!

Flipping cars: ride with a quick-thinking WV Notary

One successful West Virginia notary public explains, “I do a lot of car title work for guys who flip cars. You know, buy them and then sell them quickly for a profit. I notarize all the documents that need to be done. A lot of people do this part-time to earn extra money. They buy cars from private people or even from auctions. They know about cars, and they know how to repair them. But they don’t know about fraud, ” explains the WV notary. “Through all my dealings with young men in this business, I have learned how dirty the used car market is and how to recognize a fake check or a counterfeit money order. Fraud is also a big business, particularly when people are out of work” she comments.

“One time,” says our bright-eyed West Virginia notary, “this gung-ho young man called me and told me he had just sold a car for $3000. Wanted me to notarize the car title so he could turn the title over to the buyer. In West Virginia, you have to notarize the car title. I met him a few minutes after his call. Anyway, in this situation, the seller had just given the car to the buyer a few minutes before. Oops.”

“This young man named Chris, the seller, showed me three money orders for $1000 each. I questioned that. Why would a buyer give him three separate money orders? I told the seller and suggested he wait before cashing them. He needed a ride home. When I gave him a ride home, we passed a bank. I asked Chris, ‘Let’s just stop for a bit. I know someone at this bank. My friend the manager knows all about counterfeit money and fraud, and has testified as an expert witness,’ I told him.”

“I took the money orders into the bank and showed them to the manager, who happened to be filling in for a teller that day. She touched one of the money orders and said they were fake! ‘Rub this circle, ‘ she said, pointing to a place on the face of the money order. ‘It did not turn white.’ She explained that it did not use the proper ink and chemical process and showed me it was also missing a line and some hidden text next to a watermark. The ‘buyer’ had probably gotten the counterfeit money orders off the Internet, where there is also additional information about the counterfeit money order scam,” explained our West Virginia notary.

“I went back to the car. Then, I called the buyer and told him my husband worked for the sheriff: ‘If you don’t return the car, you’ll have a whole batch of police on your back and worse. Fraud is a federal offense…’ Then I rattled off the penalties, which I happened to remember He got mad and tried to lie, but I told him to hold the BS and told him where to meet us off the Interstate. He was only 5 minutes away. We recovered the car!” smiles our West Virginia notary. “Over the past few years, I have done a lot of notary work for this young man. And– he is going to write me a review–not that I understand how that will help me,” she adds.

Over the past few years, this notary has kept in touch with Chris, who has provided her with a lot of referrals. Her husband the sheriff? That was a bluff; but by standing her ground and using her righteous indignation and knowledge, this notary did a good deed and also upheld the law. Pretty good for a morning’s work!

A Notary from Florida travels to India

A customer went to a Notary in Florida.

CUSTOMER: I need to be notarized. Can you notarize me?

FLORIDA NOTARY: Sure I can. I just need a document.

CUSTOMER: Here is the document.

FLORIDA NOTARY: You already signed it. I cannot notarize it.

CUSTOMER: That’s not what the law says. Notaries are required to know their state laws. And anyway, you can verify the signature when I sign your journal.

FLORIDA NOTARY: But my state doesn’t require me to keep a journal.

CUSTOMER: What if I give you a fake ID, steal a million dollars from Fred’s house, and then disappear. You are the one who will be the suspect in court because you have no evidence to defend yourself. You became a Notary to make a few extra bucks and now look what happened.

FLORIDA NOTARY: I don’t think I feel comfortable notarizing you.

CUSTOMER: I don’t think I feel comfortable being notarized BY you.

(one month later)

Mr. FIBBS: My house was compromised and I’m out a million dollars. You were the Notary who notarized the transaction. The FBI is investigating and we need to see your journal.

FLORIDA NOTARY: Oh, I don’t keep a journal because my state doesn’t require me to.

FBI: Mr. Florida Notary, please come with us. You are under arrest for identity fraud conspiracy.

FLORIDA NOTARY: But, I’m not in cahutz with anyone. I just notarized a document.

FBI: Yes, but without the journal and a journal thumbprint, you are covering up incriminating evidence which makes you look very suspicious which is why you are under arrest.

Mr. FIBBS: My life is ruined and all because of that damn Notary and the damn Florida Notary Division which doesn’t require the one thing that would have saved my finances — namely a journal with paw prints. Boo hoo hoo. I’ll be in a mess for at least a year and could end up homeless too.

(two days later after paying bail.)

FLORIDA NOTARY: Oh no, my son needs a new kidney and the only place I can get one is in India. I’ll book our flights today and hope I get back in time for my court appearance as a suspect in an identity fraud ring.

RAHUL: Yes, Ms. Frieda Florida Notary Public. We can have your kidney which you have been on a list for two years come in on Friday. It will be no problem. You will need to show up at that Rajeev Gandhi National Hospital in Bangalore on the 3rd. Will that be okay?

FLORIDA NOTARY: Yes, that will be fine.

TAXI DRIVER: Where are you going?

FLORIDA NOTARY: We are going to the Rajeev Gandhi Hospital in JP Nagar in Bangalore.

TAXI DRIVER: That will be 80 rupees. Meter broken.

(ten minutes later there was a terrible crash.)

FLORIDA NOTARY: Oh no, we’ve been in a deadly car crash since we were dodging that elephant to the right and that ox to the left. My son is dead. And this cab has no seatbelts. You Mr. Taxi Driver are responsible for my son’s death because there are no seatbelts in this vehicle.

TAXI DRIVER: Oh no, you see in India, we are not LEGALLY REQUIRED to have seatbelts. So, you see it is not my fault. Accidents happen, what can you do?

FLORIDA NOTARY: Now my life is ruined because of that damned taxi driver and the damned Indian government for not requiring thumbprints.

(coincidentally, the driver carrying the kidney was in the car that crashed into Florida Notary and was also killed because he too was not wearing a seatbelt, and the kidney went flying out the window and ended up on the back of an elephant.)

TAXI DRIVER: Yes, Mr. pharmacist, I need some holistic remedy to a bug infestation in my house. What do you recommend?

PHARMACIST: There is tea tree oil. It is not expensive and microscopic insects are often killed from it.

(the taxi driver uses the tea tree oil and has a horrible reaction to it that ends him up in the hospital for two days.)

TAXI DRIVER: Hey, that oil you sold me is toxic to humans and you did not warn me.

PHARMACIST: The government of India, and coincidentally America does not regulate this type of products. You buy at your own risk.

(meanwhile Mr. Fibbs and his wife move to India since they lost almost all of their money in the identity theft and get exactly the same taxi driver that the Florida Notary did.)

Mr. FIBBS: Taxi! We are going to the Himalayas to live. We lost almost all our money because of this damn Notary. Can you believe it?”

TAXI DRIVER: Was she about 5’10”, dark hair and really annoying, with a thick Florida accent?

Mr. FIBBS: Yes, that was her. Why. Do you know her?

TAXI DRIVER: Never seen her in my life. No just kidding. She was in our car when a bus came out of nowhere and I had to swerve to the left and there was a terrible accident. This type of thing happens a lot in India. Maybe I’m telling you too much.

Mr. FIBBS: Well that woman deserves to die.

TAXI DRIVER: Funny that you mention that. And by the way, what do you do for a living?

Mr. FIBBS: I give investment advice.

TAXI DRIVER: Oh, I know somebody who needs advice at the pharmacy.

PHARMACIST: Yes, Mr. Fibbs. I am wanting to know, which US stocks are you liking?

Mr. FIBBS: You could pick a good index fund, but my favorite is Cola Cola stock. They have a good business model and solid management. I would put most of my money in that stock if I only bought one stock.

PHARMACIST: You saved my life.

(two weeks later coca-cola stock crashes, Mr. Fibbs and his wife decide it is better to be paupers in America then live in India under any circumstances and our characters all meet again.)

PHARMACIST: Mr. Fibbs. You are back. But, I have lost all my money. Coca-Cola stock crashed. You have given me very bad advice. Very very bad advice. You are a very very bad man.

Mr. FIBBS: First of all, Coca-Cola is a very solid company. But, you can’t buy a stock and sell it on a whim under unfavorable circumstances or you could lose your money with any stock. And second, I am NOT LEGALLY REQUIRED to back my investment advice. It is just an opinion and not an intrinsic truth. I am not a psychic.

PSYCHIC: Did someone call? I can tell you your future. You will be broke and die in misery. 50 rupees please. I need a new turban. This one makes me look fat.

ALL WATCHING: Get lost!!!!

PHARMACIST: You ruined my life. You damned investment advisor and your damn American laws not requiring that you take responsibility for what you tell people.

TAXI DRIVER: Well you almost ended my life with that tea tree oil without a warning.

FLORIDA NOTARY: (who came out of nowhere) well you ended my son’s life because you didn’t bother having seatbelts. It wouldn’t kill you to invest a thousand rupees to save someone’s life.

Mr. FIBBS: Well you ruined my finances by not having a journal. It costs $15 to have a journal and another $16 to get a thumbprinter from the NNA. I know this because I was so upset with you that I decided to become a Notary. But instead of being a shoddy Notary, I decided to become the most thorough Notary in the world besides Jeremy at 123notary.com who by the way is an ex-Notary, but a very thorough ex-Notary.

TAXI DRIVER: I guess we all ruined each others lives. Perhaps it is our karma that we should meet under such unfortunate circumstances.

GURU: I have been observing this entire conversation and situation for the last month and it is in deed very karmically perplexing, complex and yet still deeply interesting. I have only one more thing to say.

TAXI DRIVER: What’s that?

GURU: Tag — you’re it!!!!!

Being a notary vs. waiting on table

When I have new notaries on board, I normally give them a welcome call. I asked one guy what his professional background was. He told me he was a Notary for a month. I told him that a month doesn’t constitute a professional background, but that a 20 year teaching background would. Then he said that he was a Real Estate intern for half a year. Finally, I asked him, “Are you young?” I forget that young people don’t have a professional background or necessarily know what one is. But, if they keep having a boring and dull life going into the office, they will attain one in 10 short years. But, what about being a waiter?

WAITER: Welcome to Mel’s Diner, can we interest you in a drink?

CUSTOMER: I’ll have the jackhammer.

WAITER: Can I see some ID?

CUSTOMER: I’ll sign the journal, but I won’t thumbprint.

WAITER: Hmmm. So, what’s your sign?

CUSTOMER: I’m a Leo.

WAITER: So, you were born, July 28th, 1997.

CUSTOMER: You are trying to trick me. I was born the 29th.

WAITER: I wasn’t trying to trick you. I have bad eyesight. And I don’t use a journal because my state doesn’t require waiters to use a journal.

NOTARY: You sound like a Notary in one of those states that doesn’t require journals. But, when you get busted by the FBI and the journal is your only evidence that you weren’t involved in a serious act of fraud, you could get put in jail or end up in court forever.

WAITER: Good point. What if someone orders an illegal drink with a fake ID, I don’t keep a record of it, and he gets in his car, runs someone over, and I get blamed. That “journal of official waitorial acts” could be my only defense.

CUSTOMER: I never thought of that. You know, you CAN thumbprint me. I even brought my NNA thumbprinter.

NOTARY: Are you a Notary too?

CUSTOMER: Not yet, but I’m going to become one, and I’m learning something right here about being a Notary. It can be a dangerous job if something goes wrong.

NOTARY: It’s like driving. It’s safe 99.9% of the time, and then something unusual happens and then only your seatbelt can help.

WAITER: Many people don’t like precautions unless they sound like Covid-19 precautions — then they like endless restrictions and precautions.

CUSTOMER: If I were running this joint I would say — you can have that jackhammer, BUT ONLY if you sign this journal. But, you can’t sign the journal unless you wash your hands three times and say hail Mary, and then walk around in a circle counter clockwise, use a sanitized pen, and then sign it wearing an N-95 facemask.

NOTARY: How about sound effects. If someone orders a jackhammer, shouldn’t that come with sound effects. Maybe get some sampling?

WAITER: How about this? “Chu chuh chuh chuh chuh…… HEY SULLY, we’re that pipe you brought ovuh? chuh chuh chuh chuh …. WHAT? I CAN”T HEAR YOU. I got my ear plugs on.”

CUSTOMER: Wow, that changed the whole customer experience in an even better way than those meaningless restrictions.

WAITER: Sully says he likes the part about the hail Mary as you go around three times.

NOTARY: Is Sully a real person?

WAITER: He’s real to me! So, let me guess. Would you like to try a virgin Notarita?

NOTARY: Sounds great, but the drink sounds underaged. I don’t want to get in trouble.

CUSTOMER: It’s okay, the drink has been aged 21 years. We just need to make sure that you are of proper age and sound of mind.

NOTARY: Here’s my ID. Wow, this is like life in reverse.

WAITER: So you could notarize that drink because it’s old enough.

NOTARY: It’s age is passing, but it doesn’t have an ID.

WAITER: But, it does have a signature — in fact it’s our signature drink.

NOTARY: In that case, that makes it okay. So, honestly, are all of your clients as interesting as us?

WAITER: Some are a lot more interesting. But, it’s hit and miss, especially the ones who forgot their ID.

Precautions as a notary are like wearing your seat belt

One out of seven seasoned Notaries I talked to has ended up in court at least once. Generally this happens because of something outside of the Notary’s control. Fraud, theft, or someone taking advantage of a confused elder are the main reasons for court cases.

Notaries who have never been to court think it will never happen to them. It is like car accidents. Bad ones do not happen much, but when they do, if you are not wearing a seatbelt and/or don’t have good airbags, you might be in big trouble. Just because it hasn’t happened yet, doesn’t mean it won’t happen tomorrow, or in twenty years. So, take precautions. Think of these as wearing a facemask if that makes it more relatable.

If a signer is senile, elderly, in a hospital or nursing home, make sure you can identify they correctly and that they can explain to you what they are signing. Don’t ask yes or no questions as they will say yes to anything and are probably on morphine and not all there. If they go over the document point by point, then they know what they are signing today. They might not remember a year from now though, and that is dangerous for you if it goes to court.

Your journal is your only evidence, so if you say, “My state doesn’t require a journal” you are a fool. The state might not require it, but a judge or investigator needs the journal as that is your only evidence of what actually happened.

PRECAUTIONS
1. Make sure the name on the ID proves the name on the document. Don’t use the “you can have more but not less” rule, because notaries always forget which document you can have more on – the ID or the document. So, remember my rule. “The name on the ID must prove the name on the document.” The ID name can be matching but longer, or matching and identical to prove the name.

2. Take a thumbprint unless your state forbids it. I personally might take a thumbprint anyway in Texas because the state forbids selling or distributing that information and not taking it — and that is your only hard evidence of the identity of the signer. Fake ID’s abound, but fake thumbprints do not.

3. In the “Additional Notes” section of your journal write down about the situation, the mental state of the signer, who else is there, and that the signer explained the document to you. This could save your rear if you go to court three years later because you will not remember what happened off the top of your head. Write down anything else noteworthy about the situation to job your memory when investigated.

4. Decline jobs that are too sketchy or if you are unsure that the signer knows what is going on.

5. Have the signer verify who the other people are with them if they are elderly. Sometimes they are not related and sometimes they are scamming the signer.

6. Make sure you know how to give Oaths correctly. You could lose your commission if a judge finds out otherwise.

SUMMARY
I was investigated 3 times, but had my paperwork and thumbprints in order. It took me minutes to query jobs done a year or so ago since I had a stack of journals all in chronological order. I always identified people correctly and took notes in my journal for credible witnesses and other pertinent facts. Be sure to do the same, or even more. If you do everything correctly, you still might end up in court, but it will be a shorter case as you have more compelling evidence as to what happened — especially the thumbprint which is your only hardcoded proof of identity.
