Mistakes notaries make w/ Title Companies

Notaries all want Title Company business, but not all of them get it. Why?

Experience is half of the problem, and skills are the other half. But, what about the THIRD half?

Communication skills
Do you use bad grammar? Do you make spelling mistakes in your notes section?

I also make spelling mistakes. Fewer than I used to make ten years ago since I write more.

But, Title Companies will reject a notary based on these factors.

What if there is no useful information in your notes section?
Do you ramble when people talk to you, and go on and on?
Do you go off on a tangent during a conversation and not stick to the topic at hand?
Do you give dumb sounding answers to simple loan signing questions?
Is there background noise when a title company calls you?
Do you answer the phone by saying “Hullo?”
Do your children answer the phone?

Does your answering machine have unprofessional sounding music?
Does your answering machine state your name?
Is your message system full?
Do you have reviews on your profile?
Are you certified by 123notary?
Do you have a tone of voice that is uninviting?
Do you ask people to repeat what they said?

Notary: Hello?
Tammy: Hi, this is Tammy from Tammy’s Title
Notary: Who is this?
Tammy: TAMMY from Tammy’s Title

Tammy: Yes, Tammy’s Title! May I speak to Linda please
Notary: This is her.

Jeremy’s comment: Are you deaf? Tammy stated her personal and company name very clearly when she called you, what’s the problem. Are you not paying attention? Or, do you just not know how to respond, so you ask a stupid question? Tammy thinks you are very stupid by now. Did you know that roughly 15% of notaries ask me to repeat information that I stated very clearly? I am not sure what their problem is. If I ask a quiz question, then 80% of the notaries make me repeat the entire thing twice — but, that is more tricky, so it is allowed in that context.

BTW, it is bad etiquette to say hello when answering the phone. State who you are otherwise the other person will have to guess or ask you. Also, don’t say, “This is her” as that is bad grammar. “This is she” is correct even though it sounds strange.

To sum up the point of this article.
If you want Title companies to think well of you and hire you — don’t act stupid. Have your act in order, and be able to answer questions quickly. Be professional — otherwise they will hire someone else who is professional. Title companies pay up to $150 a pop and notaries line up for these types of jobs. Title companies have choices — you don’t!

Must a thumbprint accompany a notarized document? 

To deter fraud in notarizing, thumbprints are sometimes required by law in certain states, but are always a good idea.  California notary law stipulates that the notary must take a journal thumbprint when notarizing signatures on powers of attorney or deeds effecting real property such as Grant Deeds, Quit Claim Deeds, Mortgages, Subordination Agreements, etc.   Other states have their own rules.  Texas has some rules restricting the use of thumbprints, but I don’t know enough about those restrictions to comment.
 
Prevent fraud
As a general rule, if the notary public you use takes a journal thumbprint (many do not bother with this or even own a thumbprinting pad), you have more security.  The thumbprint is proof that nobody faked an ID and pretended to be you, or forged your signature.
 
Serious documents should have a thumbprint
If you are having a serious document notarized, you might ask ahead of time if the notary carries a thumbprinting pad.  They are two inches in diameter and weigh about half an ounce, so it is not a burden to the notary, assuming he/she is prudent about notarizing (that is assuming a lot).
 
Does the thumbprint go on the actual document?
I have never heard of a procedure which requires a thumbprint on an actual document, but it is not a bad idea. You could neatly put it to the right of a signature and document which thumb was used from which individual.  If you are missing a thumb, you can use the other thumb or a finger, just document it somewhere.

Best excuses why a signing company didn’t pay their notary

Top excuses why a signing company doesn’t pay the notary 

After looking through my list of signing companies today, I saw that the majority had more negative reviews than positive ones.  It is a shame.  Please do your homework BEFORE you accept a job from any of these characters.  However, if you ever want to start a signing company of your own, and string notaries along, you need to learn the ropes.  Here are some basic stringing along techniques.  If you follow these techniques to a tee, then I can almost guarantee you that you will get in trouble with the BBB, the FBI, ripoffreport, perhaps even the district attorney and even the Secretary of State if you are lucky! Additionally, you will win the grand prize of having everyone hate you, creating the worst possible karma imaginable,  and going out of business for sure which is the goal of 90% of signing companies – or so the evidence makes it seem.
 
Excuses for not paying notaries
 
1.  We pay the second Friday of each month… that Friday hasn’t come yet.
2.  Oh, sorry, my accountant is out sick this week (and probably every week)
3.  My Quickbooks keeps crashing
4.  My brother deleted the email you sent asking for payment
5.  My apologies, I lost your fax invoice… and the one before that… and the one two weeks ago on Thursday too (oops!)
6.  The check was sent out three days ago… check your mailbox
7.  Sorry, the loan never funded, so I can’t pay you
8.  Sorry, I’m not in charge of payment, please talk to Marsha (who never answers the phone or emails by the way)
9.  Sorry, but you made a mistake on the HUD-1, and we are telling you now!
10. Sorry, but we took over for XYZ company, and our new name is ZYX, and we can’t assume responsibility for their business with you.
11. We sent the check and here is the check number (a number which doesn’t exist)
12. You never sent us an invoice!
13.  Oh, sorry, did the check we sent you bounce?
14. Sorry, the check must have gotten lost in the postal system.  Maybe it’s because of their pay cuts!
15.  Sorry, checks are being sent out late, we are experiencing a “temporary” cash flow issue.
16.  We pay 60 days after the closing (take your chances!)
17. We are having a hard time getting in touch with the accounting department!
18.  Sorry, our phone is disconnected!!!
19. We can’t pay you until we get paid!
20.  Sorry, we don’t have a copy of your W-9 in our files! (even though you faxed it six times)
21.  Conversations always begin with – I have the easiest job for you today — but then it’s not so easy to collect on it.
22.  Sorry we were rude to you on the phone!
23.  Sorry, but the title company refuses to pay for second visits, even though it was because the documents weren’t drawn correctly the first time!
24.  The check will go out in the “next batch”.
25.  I am owed more than $100,000 and am paying as fast as I can.
26.  You were supposed to collect from the borrower for this signing — that was the arrangement (even though we didn’t tell you beforehand, and even though the borrower’s settlement statement shows a $175 fee for notary on it that already was paid.)
27.  You will get an answer in 10 business days!
28. It takes 3 months for the loan to fund.
29.  Please call back in five weeks because we have a “change in our system”
30.  An “email” will be sent to accounting
31.  Sorry, you must have been faxing to Gary… Gary is no longer with us.  I am the new contact person… just fax me your invoices for the $600 we owe you… It will get paid right away… I promise!!!
32. Sorry, we can’t pay the whole thing, we’ll send a partial payment!
33.  Please hold…….
34.  The check is in the mail…
35. Sorry, we didn’t have your current mailing address!
 
A third notary told some great stories.  He heard from R&R that they thought the check was in the mail.  The next excuse was that their Quickbooks crashed.  The manager’s brother deleted his email, and they kept losing incoming faxes.  Boy… I should write a book of excuses why signing companies can’t pay their notaries.
 
I have also learned that you can get convicted of wire fraud for engaging in crime via the internet! 941 18 U.S.C. 1343
 
Tell us your favorite (or least favorite) excuses.  It makes for good conversation.  If you RESEARCH your companies before you work for them, you won’t ever hear these type of excuses to begin with!

The Notary, The Mafia & The Fedex Drop Box

This was originally published many years ago.

An uneventful signing
It was a gray Monday afternoon in the first week of November. Kary went to her signing with the Thompsons. They signed the documents without too much reading or complaining. Kary had one other signing after that. When all was done, she made her way to the Fedex drop box. She had a habit of always going to that same drop box. It was near her home, and it felt like a safe place to go at night, being a single woman.

Luckily for her she was nowhere near the San Diego mayor’s office.

This poor woman’s luck — she ran into someone who was still mourning the loss of the great James Gandolfini AKA Tony Soprano. He was such a fan of the show that he decided to pull a mafioso type move on this poor unexpecting woman. This thug Tony Baritone had been in the drug trade for years, but wanted to step it up a notch. His old M.O. was meeting for the swap in a dark alley, giving them the briefcase, taking the package — you know the drill. But, he wanted to do it more like they do in the movies this time. This was his first attempt at simulating the panache of his television alter-ego.

Just about to drop the FedEx and…
So, this woman was just about to drop her package in the box. Her finger was on the handle of the box. She noticed a large garbage backing up about 50 feet away. She disregarded the truck whose distinctive oder was wafting her way. She put the Fedex in the Fedex drop box, and then proceded back to her car. The garbage truck nearly ran her car off the road as she left her parking space. It was so abrupt, she stopped the car to get out and see what this maniac’s problem was.

The garbage truck backed up
The truck had backed up almost into the Fedex box, and had jaws that clamped the Fedex drop box and tore it from its bearings and lifted it into the truck. The woman started screaming, “What are you doing? Are you crazy?”

Blonde #2 appears
Then another blonde lady appeared out of nowhere who looked almost exactly like the notary. She was the same age, same hair color, and same height, and also had a Fedex package that she wanted to drop. The other lady looked very puzzled. She said to herself, “Wait a second, my instructions were to put the Fedex in the drop box and leave — but, that truck just took the Fedex drop box away!” Blonde #2 (also an unnatural blonde) was unbeknowingly carrying $10,000,000 in drug money that she was to deposit in the Fedex box — which was to be removed by the garbage truck. But, their plan got foiled.

We have to get rid of the witness
The driver said to his friend, “We have two problems — the money is not in the Fedex Box, AND, there’s a witness. We need to get rid of the witness, but I can’t tell them apart.”
His friend said,“You have to look for the roots, real blondes have roots — our blond is a real blonde!”
Driver: “No she ain’t, I’ve seen the broad before, she has a different hairstyle every several months”
Friend: “So, you can tell the two chicks apart!”
Driver: “Not from this distance without my glasses. Let’s get my money first. The broad with the package has the money.”

The mafia chases the blonde
So, the driver and his friend jump out of the truck (which is parked in the middle of the boulevard) and run towards the blonde with the Fedex. The irony is that she doesn’t know that they are the intended recipients of the package because her instructions were only to “Put the Fedex in the drop box”. So, she runs away from these scary people — who are actually her boyfriend’s best friends, and the ones who gave the $10,000 to her boyfriend to pay her to do the drop. Meanwhile the notary lady decides to chase after these scumbags to get them to give her package back.

She loses them and then finds them
In the heat of the chase, she loses them, and then finds them again. The other blonde escapes from these thugs, finds the drop box in the back of the garbage truck, puts it in, and runs away. Meanwhile, notary lady catches up to the thugs, and throws her embosser at them — leaving a raised seal of disapproval (in the form of a bruise) on the now unconscious mafia garbage truck driver’s left temple. The irony of the story is that the character with the concealed weapon is not one the mafia characters, but is the notary who was carrying a stainless steel embosser.

The Notary recovers the loan docs
After that, the driver’s friend ran away and the notary proceeded to the unattended garbage truck to pick up her package. She picked up the highest package in the box in such a hurry, she didn’t realize that she had picked up $10,000,000 in dirty drug money. She gets in her car and drives off with her “loan docs” finally in her possession again. She calls the signing company and lets them know about the problem. Then, she proceeds to her nearest staffed Fedex station — where there won’t be any garbage trucks (let’s hope). She pats the package in glee to have gotten it back after a small altercation. But, she notices a distinct bulge in the package that didn’t feel like loan documents.

But, what she had was not really the loan docs after all
The five seconds after she realized that her loan documents were not in her possession, she saw a large garbage truck driving down the street.

Mental note to self: “Take out the garbage”

Who is the authority at a Notary Loan Signing?

Notary Public Authority

We often ask questions about authority to signing agents, and the results are horrifying. Most Notaries do not know who is in charge of what. So, this article will sum it up clearly.

Notary Public
A Notary Public is a state appointed state official who is paid by customers, but whose “boss” or authority is the state Notary division. Many Notaries Public seem to be confused as to who their boss is, the one paying them or the one commissioning them. The problem is further complicated by the fact that the ones paying them often pay them for more than just Notary services as travel, pick up, drop off, and supervision of non-notarized signatures and packages seem to be part of the deal if you are a Signing Agent.

The Notary is the sole authority regarding what goes in a Notary certificate such as an Acknowledgment, Jurat, etc., what goes in the journal, what is allowed or not allowed, and how a notarization should be done.

It is common that Notaries have questions during a loan signing and direct those questions to the Lender or Title representative. This is okay for Title or Lending questions, but not for Notary questions where the Notary may only turn for help to their state Notary division, official Notary handbook, or perhaps the NNA hotline.

Notaries should NOT ask the Lender for Notary advice because:
1. The Lender is probably not a Notary
2. If the Lender is a Notary they might be in a different state
3. If the Lender is a Notary and in the same state they might not be knowledgeable.
4. If the Lender is a Notary, in the same state, and knowledgeable, they might (are likely to) give you advice that would make the job go more smoothly for them, yet have tremendous liability for you.
5. You are the one appointed to the job, so even if the person you are asking for advice is a Notary, they are not the one whose commission number gets put on the certificate, and you are the one going to jail if something goes wrong. Therefor, you have to know your laws and what you can and cannot do, etc.

Who can initial and where?
Any initials on a Notary certificate are done exclusively by the Notary Public. It looks like tampering if the borrower or anyone else makes marks on a Notary certificate. The borrower may initial documents, but not the Notary certificate or Notary section in or attached to a notarized document

The Lender
The Lender is the “boss” of what happens with loan documents. If the Lender authorizes a change, initialing, cross outs, etc., on an actual loan document that is NOT in the notary section, that is up to them and they are the authority on that matter, not the Notary. The minute the issue becomes with a Notary certificate, then the authority swings over to the Notary (even if the Notary doesn’t have a clue what to do.)

The Title Officer
The appointed Title company might be a good source of information about how to handle any issues that might come up with Title documents or recorded documents. You can ask them if you have questions, but don’t let them answer Notary questions.

Issues of Preference can be asked to the Lender
Sometimes there is more than one legal way to handle a situation. If there is an error on a preprinted Acknowledgment, and your state allows a choice of crossing out & initialing vs. using a fresh Acknowledgment form, you have a choice. The Notary has the right to make that choice on his/her own and choose the option that he/she feels is more prudent or ask the Lender. However, this is a situation where the Notary can ask the Lender not for advice, but for preference. If the Lender would prefer a loose Acknowledgment stapled on to the document rather than crossing out & initialing the original form, the Notary can proceed accordingly.

The Borrower
The borrower has the right to sign, not sign, tell you where to park and more. Their preferences matter as well.

Your State
Your state Notary division decides what the laws are in your state, how they are explained or document in your official Notary handbook, etc. They are your boss, so you do whatever they say. Additionally, if you are weak on your Notary knowledge, that can lead to ending up in court as a witness, having your commission revoked, suspended or terminated. Additionally, it is possible to be convicted of a crime if you are thought to be involved in property related fraud, or if you filled out a form stating that an Oath was taken when in fact it was never taken which is a daily fraud that most Notaries engage in that is unacceptable.

If you are offered a job at 7:45 and the phone just rings?

Here is a scenario that Jennifer gave to me. I really like it because you can see how people handle situations in less than twenty seconds with this question.

The Title company offers you a job to do a signing at the Anderson’s at 7:45. It is already confirmed, but not by you.

It is 7pm now. You just called the Andersons, but they are not answering. If you leave now you will be exactly on time. Should you:

(a) Just wing it and go to the signing. Perhaps make more calls on the road.
(b) Make a quick call to title letting them know you are going but that nobody is answering.
(c) Keep calling all related parties and wait for a response before going.

There is no correct answer here. The issue is — who do you want to please? Do you want to make sure you don’t waste a trip? Or do you want to make sure you get there on time. Hmmm. This is sort of a personality quiz.

Notary kidnapped by borrowers

I know, I know, I know. The borrowers like the Notary so much, they wouldn’t let him leave. That’s not what happened.

A guy goes to a signing like he always does. He sits down at the table, and has people sign the documents. The family was rude and used profanity when asking him who he was and what this was about. But, they signed the documents. Then, there was an issue about title, and with a foreclosure issue. The Notary told them that the Note was enough without having a Grant Deed, or QuitClaim to foreclose on the house. He attempted to leave the house, but the husband blocked the door, and the wife jumped on him from behind.

The Notary forced his way out the door. Basically, the family did NOT want him leaving with those documents. He explained that the documents were the property of the title company and not the borrower’s documents and that is why he needed to take them. I’m not sure it was worth it.

After the Notary was out the door and on his way to the car, the son of the couple came out of the house with a baseball bat. This family just isn’t kidding around. The Notary warned the kid that he had a gun and that the gun would be a lot more effective than a baseball bat.

The Notary drove away, and reported the issue to the Sheriff. The Sheriff asked if he wanted them to press charges and he said he just wanted law enforcement to give them a stern lecture since nobody was hurt.

So, when people ask, “Is the mobile notary profession a safe one?” The answer is, if there is a serious issue with the rate, APR, or with a foreclosure, it might not be. This is the second incident of violence against a Notary that I have heard of after serving 65,000 Notaries. It pays to confirm the signing by phone to see if the people are complete nutcases. That extra minute spent could save you some grief down the line.

The “It can be more but not less” rule

Don’t learn this rule. It is interpreted backwards as often as it is interpreted correctly, or scrambled completely.

BAD RULE: “It can be more but not less” rule.
APPLICATION: You can SIGN more but not less…
QUESTION: More but not less than WHAT?
More but not less than what it says on the ID or the document?

This stupid quick rule does not elaborate what you can sign more than and also misses a very critical point. If you cannot prove the name on the document using a photo ID, then you are taking a huge risk as a Notary.

Different states have different standards for identification. Georgia requires you to look at the ID but doesn’t mention whether the ID should match (might be outdated information, but that was what I read a few years ago.) California requires the name on the document to be proven based on the ID and also requires thumbprints for powers of attorney and deeds affecting real property (smart move.) But, regardless of the state, taking precautions and keeping thorough records can keep you out of court and shorten the length of investigations.

BAD RULE: “You can always sign more.”
QUESTION: More than WHAT?
Don’t use rules that leave ambiguities otherwise you will miss critical points due to an omission in the logical process.

JEREMY’S RULE: “The ID must prove the name on the document.”
Interpretation: The name on the ID can be matching and identical or matching but longer than the name typed in the signature section of the document. Additionally, the name you put in the Acknowledgment section should be provable based on the ID. It is possible to put a shorter name on the Acknowledgement than the name signed or printed on the document.

Example.
If the ID says John Smith
But, the document printed name says John W Smith
You could notarize this person as John Smith even if the person signs John W Smith.
Would the title company get mad at you? Would the county recorder record the notarization? Not sure, but at least you would not be breaking notary law by notarizing this way!

JEREMY’S RULE #2: “You can sign more than how the name is printed in the signature section, but not less.”
COMMENT: This is a more elaborate and thorough version of the more but not less rule. If you memorize incomplete rules, you will make logic mistakes and could end up in court as a consequence. It doesn’t happen often, but it could eventually. Why take chances and why be a bad notary? Understand all of the aspects of notarization and yes — it is a lot more complicated than you thought and requires intricate thinking.

Double dipping

Recently, I got a disdtubing call from a title company. They had previously wanted my services but I was unavailable so I referred her to a couple of others in the area on 123notary.com. She used one of them I rhad ecommended and emailed her the information and documents for printing. I assumed all was well. But unfortunately, a subsequent call a few days later provided otherwise. It seems that this notary I referred had doubled dipped in th e cookie jar. She had invoiced tille and when the signer/borrower offered to pay her on the spot sat the table she accepted a check then as well. Needless to say, title was not happy in the least. The borrower noticed after the fact. SO this notary was paid twice fo the same job. 400.00 to be exact. Title waswas very upset and told me not to EVER refer this notary to anyone in the future. She said she was not a truthful honest person. I am shocked to say the least. I know this person and I was very disappointed with them.

To make it even worse title wanted me NOT to say anything to the notary, I was like “ Why in the world not she unquestionable needs to be reprimanded”. I have got to say something” but she swore me to secretary. She didnt want a big confrontation with the notary, themselves or their borrower. So to this day I have not said a word. I do think if the notary in question read this blog they know who they are. This was nothing short of being shameful. Her behavior says allot about this persons character. We are supposed to be above reproach, trustworthy and honest. This should just come with the territory of being a notary public, You are after all a sworn government official. She needs to act like it. I know it has been slow at times but come on. This is stealing. Plain and simple.

One day after some time has passed I WILL mention it. I need to. This person made me and 123notary look very bad. Thankfully this title company still uses me.

SnapDocs is a clearinghouse for the lowest paid and most undignified Notary work out there. Notaries get cattle calls via mass texts to all Notaries in the area for low paying jobs that often only pay $50 or $60 per signing. If you are a beginner and want to get your feet wet then try them. However, Notaries with experience are dropping off this medium like flies!

NotaryCafe
This is a much smaller directory that capitalizes on quality Notaries. Jobs are often higher paying, but there are not a lot of jobs to go around. Quantity is not a specialty of NotaryCafe unfortunately, but we still recommend them to more experienced Notaries.

SigningAgent.com
NNA’s directory has a lot of Notaries. Most of the Notaries are newer while there are a few experienced ones on board. The high point of this directory is that you can see the dates when Notaries became NNA certified and/or background screened which means a lot to signing companies. However, this company has not generated that much work for signing agents for years.
