It is easy to hire a notary public in California that you found online. But, how do you know they are reputable, or any good?  You don’t.  You take your chances. However, some notaries on 123notary.com have reviews about them.  You can read who has good reviews or bad reviews.  It is not always safe picking a random notary. As far as horror cases go, we have only had a handful of serious nightmarish notaries over the last decade, and we remove them once we have determined that they are a source of endless trouble!
 
The Kinko’s story
We had a California notary public fail to print out documents and have the borrower’s pick her up, drive her to Kinko’s where she could print the documents and then driver her to their home.  Borrowers are not chauffers, and this notary got dropped off once the borrowers got a hold of the lender.  A year later — the drama continues.  The California notary public in question is operating under a business name, and hiring other notaries to do tasks for her such as obtaining apostilles in Sacramento.  The problem is, that when checks come, they all have an elastic characteristic.  Notaries have complained on the forum about this company several times, and this particular California notary is one of the worst notary nightmares we have ever experienced and goes down in history as a legend.

24 hour service?
Another California notary public advertised 24 hour service.  An individual calls them at 6am with an emergency.  The notary hangs up on the individual claiming that it is “too early”.  If you are not offering 24 hour service, don’t CLAIM that you do.  It is a requirement that if you want the 24 hour icon, you have to be willing to answer the phone after midnight whether you feel like it or not.
 
The white out story
A notary in California goes to a signing. She forgets to have the wife sign the Mortgage (oops), and then uses white out to change some information in the loan documents.  The worst possible thing you can do during a loan signing is to use white out which voids the usability of the document.  It gets better — then, the notary blames the Title company for not hilighting the signature areas in the documents where the wife was supposed to sign.  When she was requested to return to the borrower’s house to finish the incomplete signing, the notary recommended that they find someone else.  The notary replied to this complaint against her by stating that she used the mother-in-law as a required witness to the signing. Then, the Title company asked her to use someone else at which point she used white out to remove the mother-in-law’s signature and go and get a neighbor. 
 
123notary’s opinion: There is no crime in having an additional witness.  The problem is using white out, and cross outs also look unprofessional in a loan signing and can cause a loan not to fund. Additionally, a witness should be a party who doesn’t have a beneficial interest in the transaction — they should be uninvolved like a neighbor or stranger.
 
The four hour rule
Another California notary accepts a job for a signing.  Then she cancels at the last minute because she learns that the company who hired her doesn’t pay their bills.  There were a few forum posts about the company stating that the company didn’t pay their notaries.  In any case, the notary could have researched the company simultaneously while talking to them by using www.123notary.com/s and would have learned that they didn’t pay BEFORE accepting a job from them. Or, the notary could have researched them soon after the phone call and then cancelled.  The last minute cancellations cause a lot of grief to many parties and are not acceptable. The Lender emails me stating that the notary cancelled 2 hours after the signing and said that she was, “not able to help”.  Then, the notary replies to me stating that she EMAILED the borrower 45 minutes before the signing (that is considerably sooner than 2 hours after like the lender stated).  The notary claimed they called the borrowers but couldn’t get an answer or a voice mail. I’m not sure I believe all of this story, do you?  How many people do you know who don’t have an answering machine or a disfunctional one?  I think that the notary should have given four hours notice in a case like this and should have kept trying the borrowers every 30 minutes until she got them. You can’t just leave people high and dry!

All you need to know about notary work 

There is a lot to know about notary work.  You should visit your state’s notary division website to learn what they want you to know about your state’s notary laws. Regardless of what state you are in, you need to know:
 
Who can become a notary?
Generally state residents who are 18 or older who don’t have a felony conviction or misdemeanor involving dishonesty.  Some states allow residents of neighboring states to apply to be a notary as well.
 
What is the application process to become a notary?
Some states have online applications, while others require you to mail it in. Each state has a different application fee. Check your state’s notary division website for more information
 
What is the procedure to get my official notary seal (notary stamp)?
Most states require the use of a notarial seal, but some states have authorization forms to get your seal.
 
How do I get my notary commission paperwork?
Most states will mail this to you.  Many states require you to file an Oath and Bond at a county recorder’s office, or some other government office in your area.

 Do I need to be bonded to be a notary?
Refer to your state’s notary division website for information
 
What notary acts do I need to know about?
Most states allow notaries to perform notarial acts such as:Acknowledgments, Jurats, Affirmations, Oaths, and Protests.  Some states allow copy certifications for particular documents, and there are other types of notary acts as well that are particular to certain states. Please read your state’s notary division website to learn the details.

 Do I need to keep a journal of notarial acts?
Most states require a journal, but even if they don’t, you should keep a journal for your records in case you are called into court.  A well maintained journal is evidence that can be used in court, or keep you out of court.  You will not remember someone you notarized five years ago, so keep good notes in your journal if something strange happens at the notarization.
 
How do I identify signers?
Generally, a current drivers’s license, state identification card, or password will do.  The ID should be a current government issued photo-ID with a physical description, signature, serial number, and expiration date.  Other forms of identification might be allowed, so please visit your state’s notary division website to learn the details of your state’s rules
 
Attaching certificates.
Notary acts such as Jurats and Acknowledgments require notarial paperwork to accompany the act.  Oaths often do not require a certificate though. Notary certificates come in pads, and you simply fill out the certificate with information about the document and the signer, the date you notarized the document and a few other pieces of information — then you stamp the certificate paper, and staple it to the document.  The document itself might have the certificate on it which means that you do not have to attach a loose certificate.
 
What else do I need to know?
You could learn about how to use credible witnesses, signature by mark, and other types of notary procedures.  You should learn how to take journal thumbprints for your security in identifying potential frauds.  Become an expert on your state notary handbook (if your state has one).  You are responsible for all laws pertaining to notaries in your state.
 
Can a notary notarize outside of their state?
There are some weird exceptions in two states, but as a general rule, you are not authorized to perform notary acts outside of your state boundaries.  If you live near a border, consider getting commissioned in the neighboring state if that state will allow it.
 
How long is a notary term?
Notary terms can range from three years to life, however, the majority of states have a four or five year notary commission term.

Fraud and Forgery in the notary business 

There are many types of fraud that a notary might run into in their notarial career, forgery being one of the more common types of fraud. But, let’s take a closer look at what specific types of things could happen.
 
(1) Someone could forge your seal and pretend to be you.  It happened to me.  Unfortunately for them, they didn’t forge my signature very well, and didn’t copy my style of embossing every page either.  Putting technicalities aside, I bet they were not able to forge my quirky sense of humor either.  Notary seal forgery is not common. In my case, I think they used a really good photocopier.  BTW, a photocopier can NOT copy the RAISED impression of an inkless embossed seal which is why I used it on all of my notarizations.
 
(2) Page swapping — the old bait and switch routine.  I got called to notarize many multi-page documents. I put my embossing seal through all of the pages leaving a raised impression on each page.  I usually did these individually. Sometimes it is better to do all pages together so the seal goes through the same location in each page.  However, the seal comes out more clearly if you go page by page.  In any case, if you see a ten page document where all of the pages EXCEPT for page four are embossed, that would raise my eyebrows.  I have had many situations, where the signer wants me to give them another acknowledgment certificate for a new page they are adding to the document. I tell them that I have to notarize their signature ALL OVER AGAIN, and that is the law no matter how many times you say, “Oh, come on”.  With that attitude you might as well notarize your own signature as a non-notary!
 
(3) Title companies have a common practice of initialing for the borrower if the borrower misses an initial. It is “easier” than sending the documents back to the borrower.  Whether it is signature forgery to forge initials is a matter for an attorney to decide, but it seems pretty illegal to me to engage in initial forgery. I don’t think that anyone audits loan documents to see if anyone is engaging in initial forgery, but perhaps they should — many Title companies might get busted or investigated at a minimum.
 
(4) Refusal to be thumbprinted?  You must be up to something if you don’t want your thumbprint recorded. Maybe you have a fake identification card, right?  You can fake an ID, but you can not fake a thumbprint.
 
(5) Signature forgery.  If someone forged a signature on a document, they will have to have a fake ID and forge the same signature on the ID and in your journal. It would be a tough crime to pull off. I think that nobody in their right mind would attempt this.  Normally, people try to do crimes of fraud in private, and wouldn’t be willing to let other parties see what they are doing, no matter what!
 
(6) Notarizing out of state?  If you don’t have a commission in a particular state, you can not notarize there, with a few exceptions. Military notaries have special rules. A Virginia notary public may notarize out of the state of Virginia, but only for documents that are to be recorded within the state of Virginia. In any case, from time to time we will hear rumors that a notary public is operating illegally in a bordering state where they are not commissioned, and people want us to enforce the rule. I tell them to report the individual to the state notary division where the Notary in question is commissioned.
 
(7) Charging more than the state maximum notary fees is illegal, and charging more travel fee than your state allows (roughly eight states have restrictions for travel fees) can get you in trouble too.
 
(8) Filling out an Acknowledgment or Jurat form when you never saw the signer and never had the signer sign your journal is a really serious act of notarial misconduct.  You can lose your commission and get fined or jailed for this.

Notaries often make mistakes.  Many make notary mistakes due to lack of education and lack of skill.  Those notaries will not likely catch their mistakes, and will not understand if others point out their mistakes. However, a knowledgeable notary public, will be likely to catch their own mistakes.
 
The point of having notaries in society is to have some sort of record keeping for the signing of documents, and the identifying of signers.  The notary hopefully keeps a journal (required in most states), and also fills out certificate sections, or attaches certificate forms to documents.
 
So, most notary mistakes that could be made would likely be in the journal, or certificate area.  If there is a mistake on the journal, it might be that the notary didn’t properly indicate what type of document was being notarized, or left out some critical documentation information.  Or, the signer might have “forgotten” to sign the journal which is much more serious.  If a signer forgets to sign, the notary can try to call the signer and have them come and sign the journal, or the notary can go to them.  An experienced notary wouldn’t let such a thing happen, but if there is a lot of confusion and people are in a hurry, then something could go wrong.
 
If there is a mistake in the notary certificate, then a new certificate can be made without seeing the signer, providing that the old certificate is destroyed.  You can not legally have two certificates for the same document for the same signer — unless there are two journal entries for the same signature by the same person on the same document which is very fishy indeed!
 
What about forgetting to administer an Oath to credible witnesses, or forgetting to administer an Oath for a Jurat?  In such a case, first of all, the notary could lose their commission or be fined by their state government for such a blatant infraction of notary law!  But, the notary could try to find the affiant and try to make them take their Oath after the fact.  Better late than never. I don’t think that makes it “okay”, but is better than nothing.

How to make a complaint about a notary public
If a notary public in your state did something wrong, then you should complain about this notary.  But, who do you complain to about a particular notary public?  If it is a petty complaint, then you can keep it to yourself, or visit the BBB site. However, if there was a criminal act committed by the notary involving fraud, or some other serious issue, then please contact the notary division in your particular state.

Do you know a notary in trouble?  Have you ever heard of a notary losing their commission or getting fined for misconduct or neglegence?  The answer is — yes, but they generally don’t get caught.  If you are a notary public, it is your responsibility to know your state notary laws, and keep up to date with law changes.  Notary laws change little by little, year by year.  As a general rule, if you deliberatly do something fraudulent that injures another party, you could get in huge trouble or even jailed.  If you make an honest mistake and someone else has a financial loss, you might get in trouble too. If you make a minor mistake or are neglegent in maintaining your certificates or journal, you could get in trouble, but there would be no pressing reason for the authorities to catch up to you.  My advice is to be an expert in your trade and don’t goof!!!  Don’t take liberties, and follow the law to the letter without going to excesses.  Some notaries on our site go overboard and don’t want to advise someone to breath without consulting an attorney — those people are extremists!!!
 
Can a notary get in trouble for notarizing a family member?
Notaries can not notarize a document that they have a beneficial interest in, and family business might be of financial interest to you.  I would avoid notarizing your spouse’s signature or close family member’s signature especially if the document has any financial overtones.  However, distant family members where you have no financial entanglements might be okay.  This is a gray area, and it is better to be safe than sorry. It’s more “kosher” to find a notary who is a third party who is not involved in your life.
 
Can a notary get in trouble for not witnessing a signature?
A notary must witness the signing of a document when performing a Jurat.  However, the notary is NOT responsible for witnessing the signature in an Acknowledged signature.  But, the notary MUST witness the signer signing the notary journal (if your state requires journals — and it is a good idea to keep a journal in any case).  A notary is not exactly a witness except they can function as a witness as an official notary act in Delaware and New Hampshire as far as I know.  The notary’s main responsibility is to identify the signer and be sure that the signer is the one who really signed the document.
 
Can I get in trouble for being a notary?
Just follow the laws and have E&O insurance, and you will most likely be okay.
 
Can notaries get in trouble? Can a notary be in trouble? Could a notary be in trouble?
Yes they can get in big trouble, but if they follow the law, then they will most likely be okay.
 
Can a notary get in trouble for goofing a signature?
The notary signs their own signature on the certificate form generally nearby where their stamp goes.  But, it is the signer who signs the document, and it if the signer goofs their signature, they can sign again.
 
Can you get in trouble for signing a loan document?
Yes, the borrower is responsible for the loan that they sign. The notary is responsible for making sure everything is signed properly.
 
Have notaries ever got in trouble?
I have only heard of one serious case where a notary commited some serious intentional fraud and was put in jail.  Most notaries do not know what they are doing and fill out forms incorrectly, but for some reason don’t seem to get in trouble.
 
How can a notary get in trouble?
If you engage in fraud involving real property you can be jailed, and that is the most serious crime that I have heard of for notaries.  Assisting a party forge a signature and getting notarized is very serious in any case.  If you send notary certificates without a party being notarized, that is a case where a notary can be fined and lose their commission.  There are notary handbooks that go over several dozen types of violations and what the fines are. The fines are different across state lines, but notaries can be fined, and their commissions can be revoked, suspended, terminated, or their notary division could refuse to renew their commission, etc.

The Judge, The Jury & Waiting Room

I am always upset when I have to do jury duty. I like being on a jury, but all the waiting time, delays, and inefficiencies drive me up the wall. Most of all, I don’t like being held captive for an indefinite period of time. I have things to do and I lack patience.

I think that for a jury to give someone “justice” they should not only be impartial, but intellectually capable of understanding a complicated case with conflicting information. Additionally, they should have the discipline to go through all aspects of the case during deliberation point by point in a meticulous way. When I was on a case, the other people did not want to discuss the case during deliberation. They all made up their mind within one second just like that. I was a bit offended, but what could I do. I wanted to discuss the benefit of the doubt, but they wanted to vote guilty as they had no doubts.

For a jury to be a good one, people should be tested to see if they are really impartial and can make fair decisions. Most people cannot. Most people don’t have the patience to sit in court for days and sort complicated issues out. But, what if juries were trained and selected so that only people who were fair and disciplined could be on a jury. And what if those people were paid as well? This is not the same as being a professional juror, but a screened juror. Just my idea.

THE STORY
A judge had to be in court by 11am for his case. He went to the gas station. It was closed, and there was a sign on the front saying, “closed for jury duty.” A guy cleaning up in the back called the clerk for the judge. The clerk was in the court building but in the waiting room doing nothing. The judge was out of gas and needed help. He needed to be towed to the next closest gas station, but the tow truck only took cash. So, the judge went to the bank, but the bank had a line 80 people long because most of the tellers were on jury duty. The manager at the bank called the tellers on the judge’s behalf only to find that they were also in the waiting room and not on a case. Finally the judge called the tow truck company and told them he could not get cash in time. They said it did not matter anyway because they were short staffed as their main driver was doing jury duty, but once again not on a case as he was in the waiting room.

Having juries is an important part of American due process and justice. However, society suffers when services are not rendered because people are on a jury. Perhaps that is a price that society has to pay for justice. But, society also pays a price when the court system virtually hijacks people and makes them sit all day in waiting rooms — however, there is no benefit to society to force people to sit idle for hours on end. Maybe one day the court system will figure this out.

In any case, the judge had to walk to court in the rain. It took him two hours. But the time he got there it was 12:30pm. By the time he got there the jurors were all at lunch. So, he had to wait until 1:15pm to get started. Finally, 1:15 arrived, a bunch of jurors came up to see if they could be selected. However, the case involved a police officer who had been involved in some type of misconduct. The prospective jurors were interviewed briefly by an Attorney who dismissed all of them as they all had some type of bias against police officers. The moral of the story is that the jurors had their time virtually stolen from them not for jury duty but for court inefficiencies which was bad not only for them, but for their clients.

The tow truck juror gave the judge a lift to his car, and then came back with a tow truck, and then towed him to another gas station. The judge got gas, thanked everybody and then went home only to find a summons. The judge had been selected for jury duty. He would have to give up all of his cases indefinitely because he too had jury duty and would be on the hook indefinitely as they don’t accept hardship as an excuse anymore.

I hope you enjoyed my cute story. The moral of the story is to screen people over the phone or using an app rather than having people sit doing nothing all day long for no reason. I’m sure the millennials will agree with me on this issue.

Complaints are taken seriously at 123notary.com.  None of the notaries on board have voiced an opinion supporting our review system which allows browsers to post legitimate complaints about notaries.  Many notaries on board feel that they have a license to cause trouble, and that I have no right to ask questions or do anything about it since they pay us for advertising. Many notaries want the right to harm others without being held accountable.  My point of view is that if you cause misconduct while on our site, ITS MY BUSINESS, and you will be held accountable. 
 
I want to take a positive approach to this problem and let the notaries know what the common things that go wrong are, so that you can avoid getting a complaint in the first place.   I’m going to list types of complaints in order of how frequently they come up.
 
(1) Rudeness
Of all the complaints we have gotten, the largest category was rudeness which includes using bad words, hostility, hanging up on people, rude tones of voice, antagonism, harrassment, and threats.  If a signing company doesn’t treat you the way you like, DON’T WORK FOR THEM.  Don’t threaten to use their fedex account.  Don’t threaten to put a lien on the borrowers house if you don’t get paid.  Don’t withold a borrower’s documents until you get paid.  Have a policy for what you accept from others.  If others violate your terms, then stop dealing with them.  Period!
 
(2) No Show no call
It amazes me that notaries think they can completely blow off a signing without even calling. Then, the excuses notaries give remind me of being a substitute teacher in eighth grade. The excuses are clevely worded so that you will feel guilty for asking them any more questions.  Heartbreaking stories, grueling conditions, family crisises, and earthshaking emergencies.  Many of these excuses are true, but there is no way to verify, because not once have I ever been offered a scan of a document that proves someone’s argument one way or the other.  If you are offered a signing and you can’t make it, call at least two hours in advance.  If you are having a family emergency, in a snow storm, in WW3, in a flood, or are almost dead, you better call otherwise you will get a complaint, and I am not too interested in the excuses.
 
(3) Notary Mistakes
Many notaries make mistakes. The good notaries triple check their work and are willing to go back if they made even one small mistake.  But, not all notaries are good notaries. Many will be unwilling to go back to an appointment a second time to fix what they did wrong.   If you make a mistake, fix it whether you get paid to or not, otherwise you will lose clients and get complaints.
 
(4) Failure to return calls or emails after a signing
This is another type of problem that people have every conceivable type of excuse for.  Personally, when I’m on vacation, I answer emails.  I had a vacation where I slept in my car, slept in a tent, and couldn’t find an internet cafe for half a day. I kept looking until I found it and answered as many emails as I could.  Signing agents will go on vacation, or say they did, and use that as an excuse not to return phone calls or emails.  I won’t accept this as an excuse.  You have to be available up to 48 hours after a job is done in case there is a problem, and the problem could very well be the fault of the title company, but you still have to be available.  No excuses.

 (5) Slandering or sabotaging companies you work for
One notary said that the terms of the loan were not good.  Another tried to sell the borrower a modification right at the signing.  A third threatened to use the lender’s Fedex account # because she said she didn’t get paid enough.  Another one sent porno spam to us and others. 
 
(6) Other types of misconduct.
Some notaries just cause a lot of various types of trouble.  Others are unwilling to fix mistakes they made.  Once in a while a signer will outsource jobs to another signer and then not pay them.  Last minute cancellations are completely unacceptable unless there is a documented health emergency or other type of uncontrollable circumstances.  One notary has a habit of double booking appointments and then trying to reschedule them at the last minute.  Two notaries walked out of an appointment.  One had a family emergency and flaked.  He forgot to even tell the borrowers who were in the other room that he was going to the hospital.
 
The moral of the story is to avoid all of these problems by being very careful to go to all your appointments, be polite even if others are not polite to you, and do a good follow up after the job is done.  I’m personally tired of all the complaints, excuses, the dramas, and irresponsibility.  We want good notaries on 123notary, and for the most part, the notaries on board are excellent. We do not want a few bad apples to cause a bad reputation for the others.

Florida notaries with complaints

Notary Public Florida: a complaint story
 
Here is a complaint from soneone who used a particular Florida notary:

“This is the first time we have used this Florida notary public for a closing. The Notary made a mistake on the documents where she had the borrower date everything 5/7/2011 instead of 7/5/2011 which was a notary mistake that ended up costing the broker $1000.00. Two weeks after the closing the notary called the title company directly demanding her payment of the full signing fee because she had bills to pay. She threatened to sue everyone involved with the transaction even though we were the company that hired her. This Notary was very unprofessional. The Notary was paid at 30 days by our company.”
 
The notary claims that the borrower signed the dates incorrectly and that she asked the borrowers to put the correct date, but they refused.  Then, the Florida notary claimed that the borrower wouldn’t sign where it said borrower, because she considered herself to be the co-borrower. Additionally, the notary claims that the borrower was very rude and condescending to her. The notary claims that she spent two hours at the signing and that the borrower couldn’t read the small print and wouldn’t cooperate. It is hard to know who is right or wrong here.  Was this a notary mistake or just the borrower acting crazy — or both?
 
The bigger issue is that the notary threatened to sue everyone before her payment was even late. It is professional to allow people 45 days to make payment before you start making legal threats.  Also, suing someone for $60 doesn’t really make sense in the real world.
 
Another Florida notary public wrote a complaint about 123notary.
The notary was late confirming her listing, and I called the notary to see if she was still alive and in business.  We have notaries move, quit, and end up in the hospital, and die all the time without even informing us. If I ever die, I will have the consideration to inform everyone within (5) business days. In any case, I called this Florida notary’s phone, and her message stated that she was no longer doing loan signings.   I assumed from this message that she was out of business as a mobile notary — boy was I wrong.  Rather than contacting me and politely informing me that she was still in business, she started slandering us on forums telling the world about the horrible crime that we had commited by temporarily removing her listing.    She created all types of drama over nothing.  I think that her MISLEADING phone message should have stated that she is still doing mobile notary work, but not doing loan signings.  That way, anyone calling her about work would have a clear impression that she was still in business. I hate being blamed for other people’s bad communication skills. People need to take responsibility for their own incompetent actions.  In any case, her listing went right back on the minute she asked me to reinstate her.  Unfortunately for her, I documented her zany behavior in the review section.  I stated that she committed no acts of misconduct, but created an unnecessary drama over nothing!  This case was  a business mistake on her part, not a notary mistake, but it is still ridiculous!
