Notary fees are regulated by the laws of the various fifty states. So, each state has a different rate that a Notary can charge and a different procedure for a Notary to get a Notary commission. In addition to charging officially designated maximum Notary fees, many Notaries on our directory travel to their clients and charge travel fees in addition to waiting fees if you keep them waiting too long. It is common for Notaries to have a fixed price for loan signing packages that range from $75 to $150 per signing which is a price that might include printing eDocuments. But, let’s try to give you a better idea of what particular states offer as Notary fees.

Please keep in mind that there are also fees for Oaths & Affirmations which are done in all states that I am aware of. There are also more obscure Notary acts done in particular states that are not done in all states.

How much can an Alabama Notary charge?
$5 for an Acknowledgment or Jurat.

How much can an Alaska Notary charge?
There is no set fee but I heard that in remote areas Notaries get paid in moose or salmon (generally fresh).

How much can an Arizona Notary charge?
An AZ Notary may charge $10 per Acknowledgment (for the first signer) and $10 per Jurat.
Fees changed as of March 2018 up from $2 per signature.

How much can a California Notary charge?
A California Notary Public may charge $15 per Acknolwedged signature or per Jurat. There are other types of fees, but those are the most common.

How much can a Florida Notary charge?
A Florida Notary Public may charge $10 per Acknowledgment, however the price is fixed no matter how many signatures are on the notarized document. Jurats would also be $10.

How much can an Illinois Notary charge?
An Illinois Notary may charge a whopping $1 per Acknowledged signature or for a Jurat.

How much can an Indiana Notary charge?
$2 per Acknowledgment or Jurat

How much can a Maryland Notary charge?
A Maryland Notary may charge $4 per Acknowledgment or Jurat

How much can a Michigan Notary charge?
A Michigan Notary may charge up to $10 per Jurat or Acknowledged signature.

How much can a Minnesota Notary charge?
Generally $2 per Acknowledgment or Jurat

How much can a New Jersey Notary charge?
A New Jersey Notary can charge $2.50 per Acknowledgment, Jurat, or Oath

How much can a New York Notary charge?
A New York Notary may only charge $2 per Acknowledged signature or Jurat or for each sworn witness.

How much can a North Carolina Notary charge?
A North Carolina Notary may charge $5 per principal signature on an Acknowledgment or Jurat.

How much can a Pennsylvania Notary Public charge?
A Pennsylvania Notary may charge $5 for the first Acknowledged signature and $2 for each subsequent signature. Jurats are $5 per piece.

A Texas Notary Public may charge $6 for the first Acknowledged signature and $1 for each additional plus $6 for administering an Oath.

Notarization for an exorcism

A Notary was called in to notarize an exorcism. He was asked if he had experience notarizing exorcisms and he said he did not, but asked, “Will I be notarizing the spirit, the person who was possessed, or the priest?” The priest who was hiring the notary said that he would have to swear under Oath to a statement. The Notary agreed to come. Meanwhile the Notary was going through a mid-life crisis. He was trying to find that happy medium between work and play, because working all day made Jack the Notary a dull semi-balding middle-aged boy.

The lady who was possessed was named Chelle. She exhibited signs of dual personality disorder (which is better than my last girlfriend who suffered from no personality disorder). One minute she would be Chelle and would be very nice and accommodating. The next minute Gertrude would take over and do mean things to people. It was so out of character.

On June 5th, the Notary showed up.

PRIEST: We are gathered here to witness this unholy union of inhabiting spirit and human to be broken. Do you solemnly take this uninvited spirit to no longer be your lawfully wedded possessor?

CHELLE: I do.

PRIEST: Do you, spirit, take this lady to be your lawfully unwedded possessee and agree to get out of her immediately? Notice to quit with a three second grace period.

SPIRIT: Do I have a choice?

PRIEST: Not really. If you don’t come out, I’ll summon in the angels and then you’ll really have had it.

NOTARY: Oh, you know how to talk to spirits!!!

PRIEST: (sarcastically) Only the bad ones!

CHELLE: So, what do I do now?

PRIEST: Just wait there. Now, what is that damn spirit doing hovering up there?

SPIRIT: Me, I’m just coming out of my Chelle (pronounced shell).

PRIEST: I’ve heard it all now. Now, Notary. Please administer an Oath on this verbal statement that says, “I hereby declare that Chelle has been ridden of spirit possession, so help me God.”

NOTARY: Okay, raise your right hand.

PRIEST: My right hand is raised.

NOTARY: Do you solemnly swear that the statement you are about to make is true and correct?

PRIEST: I do.

NOTARY: I pronounce you notarized.

PRIEST: But, I didn’t make the statement yet under Oath. I told you the statement I was going to make but did not make it when we had our hands raised.

NOTARY: Sorry, I don’t do Oaths, I only do Refinances.

PRIEST: Every refinance I’ve ever seen had at least three Oaths. The signature affidavit, occupancy affidavit and identity affidavit. Don’t you do oaths on these?

NOTARY: Nobody checks.

PRIEST: Do you want to get reported to the Secretary of State for refusal to administer acts that Notaries are legally responsible for administering to the public?

NOTARY: Oh, are you theatening me? You’re being rude.

PRIEST: (ring ring…) Hi, Secretary of State? A Notary named Jack Tripper… he refused to correctly administer an Oath to me for a verbal statement. Can you decommission him?

SOS: Could you send us an email with his name, commission # and expiration date?

PRIEST: I will.

SOS: Do you swear?

PRIEST: I not only swear but affirm.

NOTARY: Well, I may not know how to administer Oaths correctly, but I found my happy medium — you. You are happy and can talk to spirits. That makes you a happy medium.

PRIEST: No – I’m an angry medium because you messed up my exorcism by not doing your fricking job — idiot!!!! I have no formal record of what happened unless you follow proper procedure.

NOTARY: Take it easy man… wow this guy is uptight!

(a few days later, the NOTARY goes to the secretary of state’s office.)

NOTARY: I am here to turn myself in.

SOS: For what?

NOTARY: Wait a second, how did I get here, what am I doing here?

SOS: Excuse me?

NOTARY: My name is Gertrude. I am a spirit possessing this body. I witnessed Jack (the dull boy) doing an improper Notarization and I wish to report him, or me, well actually him, but I am temporarily in his body until we get this issue resolved. My uncle Binkelthorp died because a Notary filled out a medical power of attorney wrong and I want revenge on all bad Notaries.

SOS: So, let me get this straight. You want to report yourself for committing Notarial malpractice?

NOTARY: No, not myself. I have only been in this body for 24 hours. The regular soul’s name is Jack, and although physically he looks exactly like how I look in front of you, his soul is the rightful custodian of this body and his soul is the one who committed Notarial malpractice. Just quiz him on Oath procedure and I’ll jump out of his body while he does it.

SOS: This sounds crazy but here goes. Please administer an Oath to me for a document that says, I committed Notarial fraud.

NOTARY: Um… I don’t understand the question.

SOS: Do you not know how to administer an Oath? That is one of your powers as a state commissioned Notary Public and you will lose your license if you don’t know how to do it.. How many years have you been a Notary?

NOTARY: Duh…

SOS: Okay, I am having your commission suspended, revoked, and terminated, and contacting the priest to get a statement about how you refused a member of the public for service — which is a crime. As a Notary Public, you are required to perform any legal request for a Notary act for any member of the public who has identified themselves properly and is in front of you. Otherwise you would be a Notary Private if you select the customer or which jobs you are willing to do.

NOTARY: I can’t believe this is happening. But, I’ve been a Notary for 20 years, and therefore must know what I’m doing.

SOS: You have clearly demonstrated that you have no idea what you are doing. You must have been sleeping for 20 years. If you were a brand new Notary, I might have you attend a class, but you have demonstrated a complete lack of respect for lawfulness. Let me get the priest on the phone who you disserved.

PRIEST: Hello, priest service. Jim speaking.

SOS: Hi, this is Frank at the Secretary of State’s office. We have a Notary named Gertrude who is also Jack. One of his personalities reported him to us for Notarial malpractice on you while you were doing some sort of an exorcism. Is that correct?

PRIEST: Correct.

SOS: It looks like you might have committed malpractice on the exorcism by allowing this spirit to inhabit this poor excuse of a Notary.

PRIEST: I neither allowed it nor discouraged it. Wandering spirits like to inhabit the bodies of the weak-willed. People who don’t take care of their health, mind, spirit, or in this case, their obedience towards proper Notary procedure.

SOS: Good point. In any case, did this Notary refuse to administer an Oath to you after you had appeared before him… or her.. and produced acceptable identification?

PRIEST: He most certainly did, and he was a he when I saw him… before Gertrude entered the picture… or the body… or exited one body and came into the other body.

SOS: We could use someone like Gertrude to clean up the Notary industry.

PRIEST: Umm, I’m not so sure that is a good idea. Gertrude can be very vindictive. She is considered to be bad news.

SOS: Yes, but that means she will help us convict bad Notaries because she suffered a horrible loss due to a bad Notary two decades ago and she wants revenge.

PRIEST: Oh… well, in that case, two wrongs make a right I guess. As a man of the cloth, I will have to stay out of this. We don’t like to be involved in anything punitive or vindictive — we leave that up to the holy father — he can be very punitive at times. That’s why I carry a lightening rod wherever I go — I keep it in the trunk. You never know when you’ll need it.

SOS: I’ve heard it all now. Hey Jack… We are sending you to Notary jail, fining you $1500 and revoking your commission. What do you think about that?

NOTARY: Ummm. But, I’ve been a Notary for 20 years and never had a problem.

SOS: You had plenty of problems, but the people you were working for didn’t know the difference — that is how you got away with it so long.

PRIEST: Looks like someone needs an exorcism by the way, not that I am using this misfortune as a way to get a new client.

GERTRUDE: I’ll go on my own. I have some other Notaries to possess.

PRIEST: And by the way… Here’s my card. I also do weddings and Bar Mitzvahs.

SOS: Bar Mitzvahs??? Aren’t you a priest?

PRIEST: In my neighborhood, its the only way to keep busy… Besides, what they don’t know won’t kill them.

SOS: Hold on, let me call 411. Hey, what’s the number for the Secretary of State Rabbi Division? I think I need to report someone.

How do you get a Power of Attorney Document?

I run a Notary directory, and people who hire Notaries often have Power of Attorney documents of various descriptions. It is important to understand that not all Power of Attorney documents were created equal and there are legal standards as well as preferences of the document custodians that need to be taken into consideration.

Legal Considerations
Legally, you probably need to consult an Attorney to figure out what rights to grant to another person (grantee) and under what circumstances and what legal language to grant such powers. I cannot assist with this because I am not an Attorney, and even if I were, I would probably not be practicing in your state.

Document Custodian Considerations
Document custodians are another party that you have to please with Powers of Attorney. A document custodian is the party that accepts your document. For example, if you get a POA for a particular bank, they will want a Banking Power of Attorney done their way which often means using their forms and not some form you got at a stationary store that looks equally good to you. The custodian has the right to choose what type of form they want in many instances.

Recording Documents
I am not an Attorney and do not know if/when/how/why Power of Attorney forms are recorded at your county’s county recorder. But, find out if you need to record it in their files ahead of time. There is normally a fee for this and it involves a visit to a government office, standing in line, not knowing what room to go to, etc.

Types of Powers of Attorney.
There are Medical Powers of Attorney, Durable Powers of Attorney where you can switch powers on an off sometimes, Banking Power of Attorney documents, and Limited Powers of Attorney as well. Living Wills are yet another specialized type of Medical Power of Attorney that deal specifically with what happens if the Grantor becomes incapacitated or is unable to make their own decisions while bedridden, etc.

Drafting of Documents
Normally, it is a good idea to consult with an Attorney before creating a Power of Attorney. Since it is a legal document, you cannot have any old person draft it for you. It should be an Attorney, or someone legally authorized to draft documents which rules out most Notary Public practitioners. Banks normally use their own forms, so ask the bank what form they require. Additionally, there are legal support firms who employ Legal Assistants, Paralegals, and a few who outsource low paying legal work to New Delhi where they do a very good job at a third of the cost. You can ask these types of agencies what they recommend and who is authorized to draft your document. Your best bet however, is an Attorney if you can afford it. Even if the Attorney doesn’t draft the document him/herself, at least he/she is supervising and taking responsibility for it which makes it potentially a lot safer for you to get a quality output.

Notarizing Documents
Any commissioned Notary Public can notarize your document in their state of commission. Please do not expect or ask the Notary to explain or understand any legal document. Non-Attorney Notaries may not give specific interpretations or explanations of documents other than general statements (in certain states) about what the document is generally about with no specifics mentioned. The Notary’s job is simply to check your ID, make sure you signed the document, the journal (required in most states, recommended by us in any state as that is your only written evidence of the notarial transaction), and fill out certificate forms that correspond to your document.

Legal Technical Terms
If you are creating a Power of Attorney, there is a lot of legalese which an Attorney can help you understand. The main terms are:

Grantor — the person giving power to another
Grantee — the person receiving special powers from the document
Agent — another name for the person who receives power and can complete tasks for the Grantor.
Principal — the main person signing the document who is the Grantor by definition.
Attorney in Fact — the most commonly used term for the agent / person receiving power of attorney.
Capacity — If you have special powers or a special position in a company, that can be described as a capacity. Being an Attorney in Fact or AIF is considered a capacity that can be indicated on certain Notary forms.

Signing in your capacity as Attorney in Fact.
There are eight ways that I have seen to sign as an Attorney in Fact. Please be advised that the particular verbiage is very particular and can be decided by an Attorney or document custodian. If they want it one way, and you sign with even one comma out of place, the entire document might be rejected and need to be resigned. Here are some common ways to sign, but ask your contact person before you sign anything, as the verbiage does matter.

John Smith, as Attorney in Fact for Sally Smith
Sally Smith, by John Smith, her Attorney in Fact
John Smith, POA for Sally Smith
John Smith, AIF for Sally Smith

Summary
In some of these variations, the signer signs the name of the other person (which I am not comfortable with) and then describes their capacity. In other variations, you sign your own name, and then indicate your capacity after a comma after your name. As always, I cannot and will not give legal advice, so, ask an Attorney before you have a Power of Attorney drafted, and before you sign the document and before you sign in your capacity as Attorney in Fact.

Should 123notary sell background screening?

Notary Background Screening

We normally like selling items with a high profit margin otherwise our time gets zapped for minimal profits. Carmen doesn’t work for free and her sales commission could eat up profits from selling books from other vendors or other acquired products. Then, the credit card companies want their fees. And then there is shipping, handling, and charge backs on 1% of our average sales, but perhaps more like 2% of new sales. I guess background screening doesn’t have shipping thank God, but you do have to get people’s information and shuffle forms around. For this reason, I am not doing background screening at this time — maybe later.

But, do you guys think we should sell Notary Public background screening?

The other issue, is that NNA and Notary Rotary sell good background screening. We just refer people over to them. NNA offers good one stop shopping and Notary Rotary has advertising, supplies, and more. It seems very efficient to get background screening through these other companies. If we offered it, how would we differentiate ourselves from the competition? I don’t even know anything about it and wouldn’t know where to begin. But, maybe one day I’ll learn.

Letter to Florida Notary Division

Dear Florida Notary Division,
I run 123notary and am constantly made aware of the sloppy behavior of the Notaries that you commission. I will remind you that the purpose in having Notaries Public in the first place is to ensure the integrity of transactions done via signed documents. The Notary makes sure the correct person signed the document, fills out forms, keeps records, administers Oaths, and upholds the law regarding Notary Public. Based on my quiz results for many Florida Notaries: Florida Notaries do not normally keep proper records, rarely administer correct Oaths, and do not have a clear idea of the laws affecting their work in many cases. Below are my comments and suggestions.

1. Journal Thumbprints.
A journal thumbprint is a piece of biometric evidence that Notaries should keep in their journal. The reason is that the FBI can catch identity thieves that steal people’s assets a lot more easily with thumbprints. Florida recommends against Notaries keeping thumbprints which essentially stifles the FBI. Florida is afraid that the Notaries will not be reputable custodians of biometric data and therefore recommends that they do not take the evidence to begin with. This tells me that the following MIGHT be true:

(a) Florida might desperately want to assist identity thieves in having open season in Florida, and wants to make sure that identity thieves not only can defraud hard working citizens, but that the rights to privacy of identity thieves will be honored at the expense of the safety of society, borrowers, signers, and Notaries by recommending against taking journal thumbprints. Ludicrous! The State of Florida might want to make sure that identity thieves will be protected from being caught and wants to deter the justice system from having adequate evidence to book these very dangerous white collar criminals.

(b) Florida commissions Notaries in a position of trust and integrity equivalent to that of police, attorneys, judges and government workers, yet doesn’t trust them to safeguard a thumbprint. Either you trust them or you shouldn’t commission them. Maybe you should spend more time figuring out who is trustworthy and who is not. Since 90% of your Notaries cannot administer an Oath correctly (which is the notarial equivalent of tying your shoes), I would consider weeding your database of the Notaries who refuse to know how to do their job. Or you could resort to actually training your Notaries and screening them a little better.

(c) The State of Florida is confused and doesn’t realize how stupid they are being by safeguarding society’s most dangerous criminals by discouraging Notaries from keeping journals and taking journal thumbprints. Discouraging journal thumb printing is similar in essence to discouraging wearing seat belts or condoms. Notaries might not get Aids, or break their ribs, but they could end up in court or jail as a result of this stupidity.

2. Journals
For the Notary’s safety, their notarial journal is their only hard evidence in court of what they did as a Notary on a particular date, or assignment as well as what they did NOT do should their seal be stolen, copied, or forged. By not requiring a journal for notarial acts you are endangering the public, Notaries, and their clients. There are many types of crimes that can be committed without a paper trail since you don’t require journals. The Notaries you have commissioned are mostly very lazy and negligent people who would prefer to spent an hour arguing with me about how journals aren’t required by their state so that they can save a few minutes each time they commit a Notary act. By not requiring journals you are encouraging people to be reckless. Additionally, one might argue that you as a state and as Notaries for that state are aiding and abetting criminals by not keeping proper records of highly sensitive transactions.

I give these Notaries the lecture about how California requires seat belts where India does not require having or wearing a seat belt in your vehicle. If you get into an accident in India, will you be any less injured since seat belts aren’t legally required? If an identity thief imposters you in Florida and steals the equity out of someones’ apartment complex, will you be in any less in trouble with the FBI in Florida simply because your state is too foolish to require you to keep adequate evidence of all transactions?

The reality is that the FBI has investigated many of the Notaries listed on 123notary.com. Many of the Notaries kept thumbprints in their journal which was a huge boon to the FBI. However, I heard that those without proper evidence are routinely accused of collaborating with frauds. Does the State of Florida really want their Notaries ending up in court or jail simply because they are too stubborn or stupid to require a simple journal? Millions of dollars of assets are on the line in each day of Notary work doing loan signings and you don’t even require a single record of the transactions conducted? Even third world countries are not this foolish.

Summary

My suggestions are as follows:

1. Be more careful appointing Notaries. Give preference to those who have held government jobs or highly responsible jobs in the past.

2. Have an IQ test and a meticulousity test to make sure Notaries are logical enough to make legal distinctions necessary to perform the duties of Notary Public. Many errors Notaries make are due to logic errors and scrambled thinking. Notaries also need to show they are adept at conducting themselves in a step by step manner doing paperwork otherwise they will not do good work filling out their Notary forms. You should test this before you put them through school otherwise you will be wasting their time.

3. Have a two day live seminar with hands on training. One day is not enough in my experience.

4. Test on Notary laws as well as on hands on procedure

5. Require Notarial journals and orthodox journal entry creation which means one entry per person per document notarized and no short cuts.

6. Require Journal thumbprints for Deeds affecting real property, Powers of Attorney, and transactions done with Credible Identifying Witnesses.

7. Check up on your notaries from time to time to make sure they are maintaining proper legal standards for your state.

8. Have a minimum fee of $25 per appointment for Notaries public plus $25 minimum travel fee as well as a minimum waiting fee for hospital, jail and other jobs that require more than ten minutes of waiting. Travel fees should be paid in cash at the door by law to discourage clients from manipulating the notary into committing illegal acts under the duress that the Notary will not be paid his/her travel fee if he/she doesn’t cooperate in some illegal act. Higher fees will give you a higher supply of higher level people which will be helpful when you weed out the incompetent Notaries in your state.

9. If you have fewer Notaries in the state, it will be easier to keep an eye on them. I recommend having roughly 25% of your current number of Notaries to ensure adequate quantity without sacrificing on quality!

Do I need $1 million (E&O) insurance to get more Notary business?

Do I need $100,000 or $1 million in Errors & Omission (E&O) insurance to get more Notary business?
It is not uncommon for some companies to require that a Notary have more than the standard amount of E&O Insurance. There is no state mandated minimum for E&O unlike a Notary Bond where the law requires every Notary to file an official bond for $15,000 which is designed to pay limited claims against the Notary Public.

But please make no mistake. All Notaries must carry some form of E&O insurance to protect themselves from unintentional errors and omissions they make. Of course, E&O policies will not cover fraudulent acts or intentional errors. Without E&O Insurance, you will have to pay for the cost of the judgment or settlement and your own legal expenses. The financial impact can force a Notary to renounce his/her Notary commission and possibly even declare bankruptcy depending upon then severity of the error.

The high coverage of an E&O policy is based on the false perception that the companies would get a better class of Notary or that they are protected from any and all errors made by the Notary. This is farthest from the truth. I have more than 20 years of experience being a Notary and have never increased my E&O Insurance above the standard amount of $15,000/- primarily for 2 reasons. First, the number of companies requiring $100,000 or even $1 million in E&O Insurance are few and far between and the number of jobs that a Notary gets does not make up for the increased premium for the additional coverage. Second, the E&O policy only covers clerical errors and does not cover any fraudulent acts committed by the Notary. As a matter of practice, I double and sometimes triple check my work and am always cautious of the people who appear before me for a notarization. More importantly, I never do anything that even has the appearance of a scam or fraud. I have no intention of being someone’s boyfriend with no escape clause!!

Letter to Donald Trump about the State of the Notary Industry.

Dear President Donald Trump,
You have initiated this wonderful idea of draining swamps. I will inform you that the state of the Notary industry in forty-nine of the fifty states in the nation is a big swamp, except in Florida where it is more of a glade(s).

A well thought out political system should had a network of checks and balances. The minute an organization is not checked, it can run wild and get away with endless mischief or negligence. This is how I believe the Notary industry is at this point. The Notary divisions are generally not watching their Notaries, and the Feds are not watching the Notary divisions at all. The result is rampant ignorance, fraud and criminal activity on the part of Notaries generally done out of negligence. But, why should you or anyone else be especially concerned? In short:

Notary Agencies need to be regulated by the Feds to reduce the incidence of very damaging fraud, perjury, and general ignorance.

1. Journals and Property Fraud
If someone impersonated a Notary, the impersonator could sell one of your $300,000,000 properties without your consent and get the Deed recorded. Since in NY State, a notary is not required to keep a journal, the fraudulent sale would not have any particular paper trail back to the notary’s journal who was impersonated. Such an instance would cause immeasurable grief to you and all involved which is why it behooves Federal Law to include statues about keeping journals that all states must abide by or be fined, etc. Journals are very good record keeping tools for notaries, because the name of the individual signing, the name of the document date, time, etc., can be notated. But, a thumbprint can also be taken which can help find someone who gave a fake ID to a Notary. Fake ID’s do not surface more than 1/5000 notary appointments in my experience. But, if a serious act of fraud is done using one, you need a paper trail that can help investigators find the perpetrators. The journal can help prove who did what and when and help prove if a document was falsely notarized.

2. Perjury and Felonies
It is considered by some to be a felony if the Notary claims in writing to have given an Oath to an affiant when in fact they did not. Many Notaries fail to administer Oaths when legally required on a daily basis which means they could be considered a serial felon. A felony is a serious offence, and felons are generally barred from becoming notaries in all states. The fact is that none of the states bother to quiz their notaries on whether or not they administer Oaths, and whether or not those Oaths are relevant, or worded appropriately (or logically.) In my experience, 70% of notaries do not administer Oaths and the other 30% very rarely administer correct Oaths.

3. Mandatory Journal Thumbprints for Deeds
For Deeds affecting real property and Power of Attorney documents, a journal thumbprint can safeguard the transaction from serious fraud. Journal thumbprints are discouraged in Texas and Florida because the governments do not trust Notaries to be custodians of such information. It is feared that the notaries will engage in the unlawful distribution of these biometric data for fraudulent purposes. My opinion is that Notaries should be trusted as much as police, Attorneys, military personal and Judges. If not, then the notary should not be commissioned as a notary to begin with. Few states require thumbprints, but in my opinion all states should

4. Mandatory training and quizzing
Few Notaries know what they are doing (I quiz them which is how I know). Therefor, a simple solution would be for all states to have a Notary class, written test and hands on test. Some states have a day long class. However, I believe that to attain mastery of the Notary profession, between two to four days of class are necessary and should go over theoretical knowledge as well as hands on training. Mastery of what to do when an unusual situation comes up is also critical as Notaries are often asked to do unlawful things and should become experts at saying no to illegal requests. Notaries should also be able to discern between an unusual request and an illegal request because many notaries illegally decline acceptable requests which is a moderate problem. Additionally, Notary divisions should audit notaries from time to time when the Notaries are not expecting it just to keep everyone honest.

My request is that you require the Notary divisions to verify that:

1. All Notaries commissioned in their state keep a journal with thumbprints (will require changes to statutes).

2. All Notaries know how to administer Oaths and Affirmations

3. All Notaries know how to correctly fill out notarial forms completed

4. All Notaries know which types of typical requests are legal and which are not.

Since there are so many thousands of notaries in each state, this might be time consuming, but it is very necessary. Additionally, it would be beneficial to the industry to have:

1. A minimum fee of $25 per Notary appointment to ensure more applicants feel an incentive to apply for a Notary commission.

2. Fewer Notaries per state so that the states can pick those applicants with higher test scores to keep the average quality high

3. Official minimum fees of at least $25 for travel and $20 waiting time (if at a hospital or situation that merits more than ten minutes waiting time) that must be paid up front at the door to ensure that Notaries will not have their arm twisted to do illegal acts under the duress of not getting paid their travel fee (a very real issue which happens a lot.)

Scenarios: The FBI is at your door

False Identification

What piece of information will the FBI want from you if someone gave you a fake ID?
A journal thumbprint. If you don’t keep journal thumbprints, consider starting now.

But, why keep a journal thumbprint if your state doesn’t put a gun to your head and require it?

Most Notaries disdain the idea of doing anything that isn’t forced on them. Doing the absolute minimum seems to be the gospel of many Notaries these days which is a problem. Laws are often too inconclusive to include safety measures that protect the Notary and society from fraud.

A few states are against journal thumbprints
Some states recommend against taking thumbprints as that information is highly sensitive and could be used for fraud. But, the police take fingerprints don’t they? Should society tell the police to stop taking fingerprints since the information could get into the wrong hands? My opinion is that a Notary Public is a member of a profession based on trust and integrity. If a state doesn’t trust a Notary with a thumbprint, they should not commission that Notary to begin with. Would you hire a policeman you don’t trust? Bad example, in Los Angeles there are many police I wouldn’t trust with a dime (but might with a peso since we are a sanctuary city). But, the point is that the position in society of an integrous Notary is based on trust. If you don’t trust someone, don’t marry them, and don’t appoint them as a Notary. If the Notary needs special training to safeguard a thumbprint, then give the training.

You could be named as a suspect
Without a journal thumbprint you do not have a paper trail sufficient in many cases for the FBI to nail the bad guys. It is a common practice for the FBI to treat the Notary as a suspect in identity fraud cases. So, if you don’t want to be pegged as a suspect, you should consider leaving a paper trail. You are notarizing for million dollar properties, and it behooves you to leave a paper trail using any legal methods you can.

Without a thumbprint
Without journal thumbprints, someone could sell a million dollar property to another party fraudulently and there would be no paper trail other than a fake identification serial number and expiration date in a notary journal as well as a falsified signature. Where will that fake evidence point the FBI? The signature might be mildly helpful to forensics, but it is a bum steer down a one way road to a cul de sac. It goes nowhere. It is good to be helpful to investigative authorities. States like Florida and Texas don’t care about investigations, they just don’t want you taking thumbprints. They don’t care if there are consequences to the Notary either. They only think about what bothers them, and not about the bigger picture.

Without journal thumbprints, society is not safe. If society is also not safe with Notaries having thumbprints, then society needs to choose more trustworthy Notaries. California Notaries have been taking thumbprints for years and I have not heard of an issue relating to that fact in my life. Therefore, I feel that the risk to society for Notaries to keep thumbprints is minimal, yet the risk of Notaries not keeping thumbprints will cause a problem in one of every several thousand transactions. The FBI has asked many of my customers for thumbprints over the years, and the California Notaries had the thumbprints and really helped investigations lead to arrests.

Notary Education

Many Notaries want to get started in the loan signing industry. What they forget is that to become a successful loan signing agent, you first have to know how to be a good Notary Public. Being a good Notary is not rocket science, but there are a few things that could trip you up. Many states have insufficient requirements for Notaries. Some of the lacking requirements could present Notaries and their clients with legal dangers.

Being a good Notary means being knowledgeable and safe. Being knowledgeable means knowing your state notary laws inside out. But, being safe means limiting your exposure to liability. We cannot teach you your state notary laws here, but the handbooks for most states are online and easy to access by searching on Google.

Notary Knowledge References:

(1) Your state’s official notary handbook. Search for it on Google.

(2) The NNA has a Notary Essentials Course which many people like.

(3) 123notary has a much shorter brush up course called Notary Public 101 which is about best practices and does NOT cover state specific laws.

Please be advised that Notary safety is as important as making money because you want to stay out of court and not get in trouble. Safety precautions include:

(1) Keep an official journal of Notarial acts whether your state requires it or not. That is your only evidence in court of what you notarized and more important — what you did NOT notarize if impostered (yes, it happens.)

(2) Keep thumbprints in your journal to assist the FBI in catching identity thieves. You will probably never run into one in your career but many notaries do. The FBI might name you as a suspect if you do not provide an adequate paper trail, as a bad paper trail looks like a cover up.

(3) Be wary of elder notarizations. If someone is in a hospital, not fully with it, or on morphine, they are more likely to be cheated in a transaction which means that you will be likely to end up in court or investigated.

Signing Agent Knowledge

Once you are a commissioned notary as well as being a competent notary, it is time to study your signing agent knowledge. You will need to know most of the attributes of common loan documents, signing and initialing procedures, how to fix errors in notary forms, and how to date a Right to Rescind correctly. What’s your sign?

As a Notary, there are various aspects to our job. The most important according to Carmen is identifying people. But, most Notaries just look at the name, and photo, and if it is close enough, that is good enough. If the name is missing a middle initial on the ID that exists on the document that is bad news. But, most Notaries just say, “close enough.” If you say “close enough” too many times, you might end up in court on an identity fraud case which could end you up in court for weeks with no salary, and you might lose a lot of your regular customers as well.

So, how can Notaries make identifying people more reliable? Here are some quick points.

1. If the name don’t match, you must not attach.
Most Notaries say you can over sign but not undersign. This is a Lender preference not a law. If the ID says John Smith and the document says John W Smith you are taking your commission in your hands if you Notarize the signature.The Lender might not mind, but you might end up in court over this if fraud is involved and once in a blue moon it will be.

Most states make sure that middle initials are in ID’s, but not all people are from one of those states. There are out of state people, foreigners, and people who changed their names due to marriage or some other reason, not to mention people with name variations. People from Mexico culturally have two surnames on a regular basis.

So, you have to be prepared for this type of situation even though it only happens 1-6% of the time. If you are going to notarize anyway, what can you do?

(a) Ask the signer what sign he is while holding the ID. If the fake ID has a fake birthday the signer will not know his fake sign. He might be a Leo that is pretending to be an Aquarius. On the other hand, the fake ID might have a real birthday but a fake name.

(b) Get a thumbprint from the signer in your journal. That way the investigators can catch him after the fact if there is any funny business. Thumbprints also deter frauds as they often would prefer not to be notarized than risk being thumbprinted.

(c) Ask their height or birth date.

(d) Ask for a birth certificate if they have one. That doesn’t have a photo, but does have the DOB which is something you can use to cross-check information.

(e) If they have a Social Security card, that is not an acceptable ID, but the first three numbers are part of the zip code where they were born. You can cross check check the info by asking them where they were born.

(f) A gas bill is NOT generally an acceptable form of ID for notarization. However, if you want to verify a middle initial, it is better than nothing.

What you can’t do.
Do NOT accept a signature affidavit AKA statement as a form of identification. That is a document for the LENDER and the source of the information is unknown and not official. Sources for government ID’s are official which is why you can normally trust government issued photo ID’s.

Summary
You need to know your state laws on identifying signers. Many states do not require the name on the ID to exactly match the signature on the document or even for the complete name on the document to be provable based on the ID. Many states leave it up to your judgement. Just because you are following the law does not mean you won’t end up in court as a witness or conspirator to identity theft which is why you as a Notary must take as many precautions as possible.

If you are notarizing for a long term customer and want to take liberties to ensure that your business relationship does not end prematurely, then you might use the above techniques. If the customer means nothing to you, I would strongly consider JUST SAYING NO to any request that is at all questionable, especially those involving ID’s that have names shorter than that on the document.

But, the fastest way to verify if an ID is fake is simply to ask — what’s your sign?
