The John & Sally Question Revisited

This is a simple question that throws Notaries off that I like to teach. John and Sally’s names are inscribed in an Acknowledgment for a Deed that the Lender pre-filled out. Sally cannot make it to the signing because she works the night shift. What do you do?

Wrong Answer
Notarize the form as is. Commentary — unfortunately, that is illegal, because you cannot perform an Acknowledgment for someone who does not personally appear before the Notary Public.

Another Wrong Answer
Just cross out Sally’s name and proceed. Commentary — unfortunately, forms have wording in the boiler plate section with he/she/they, capacity(ies), signature(s), etc. If you do not make sure the standardized wording and cross outs are consistent with how many people are there and of what genders, you have created falsified information in a certificate which is a crime.

A Messy but Acceptable Answer
You can cross out Sally’s name, check the wording below and make sure it is consistent with single man and a single signature if indeed there is only one signature on the document (better check to verify.) However, this is messy. Fraud could be suspected after the fact. If you cross out a county, that does not affect the transaction in any way because the loan would still be legal (I’m guessing & assuming) if you signed it in another county of the same state. However, if there is a debate as to whether Sally was there or not, or someone used the initial to add a third name fraudulently, you the Notary are in trouble. By having initials on legal documents and forms, you are opening up a can of worms and will have only your journal as evidence of what actually happened.

A Clean and Correct Answer
The best way to rectify the John and Sally issue is to either drive to the hospital where Sally works and get her to sign before midnight. That is not always possible. But, the forms could be stamped after she signs.

Or, use a fresh Acknowledgment form and just put John’s name on it, and notarize John’s signature as is. Another Notary can deal with Sally and do what James Bond calls — Notarize another day.

Quick information about loan documents

On our certification quiz, we ask a few questions about loan documents. For more detailed information, query our courses, but these are going to be quick pointers that we often quiz about.

The Deed of Trust / Mortgage
The Deed of Trust is the security instrument. It also goes over prepayment penalties and late fees. It goes over the address of the Lender and the Borrower as well as a lot of other information which we do not quiz on.

The Note
The Note contains the general terms or general business terms of the loan. It is the best place to look for information about prepayment penalties, when the first payment is due, loan amount, and other general terms of the loan.

The Right to Cancel
As a Signing Agent, you must know how to date a Right to Rescind or Right to Cancel. For a home owner borrower, they are given three days not including Sundays and Federal holidays. Please do not say three business days as the days are calendar days not business days, but not including Sunday, Federal Holidays, or the date of the signing. The borrower can cancel up to midnight on the third day to rescind and can cancel in writing.

The CD
This document has a lot of quick information on certain information about the loan, fees and payoffs. Although it mentions that you will or will not have a prepayment penalty, it does not go over the terms of the prepayment penalty.

First Payment Letter
This document goes over information regarding the first payment due.

Owner’s Affidavit
This document goes over maintenance issues regarding the subject property as well as occupancy status and other information about the property.

Occupancy Affidavit
The Occupancy Affidavit states that the borrower will move into the subject property within sixty days and will stay there as a primary residence for a year, or possibly two years or six months in some cases depending on how the document was drafted. I have only seen this document state a one year occupancy requirement in my experience.

Compliance Agreement
The Compliance Agreement makes the borrower agree to furnish additional information to the lender if requested after the signing. It also makes the borrower agree to cooperate if the Lender needs changes to clerical errors signed off on by the borrower.

Correction Agreement LPOA
This document has the borrower give consent to let the Lender / Title make changes to clerical and typographical errors to the documents on their own after the signing

1003 Residential Loan Application
The 1003 document typically has lots of information about the borrower including how many years of school they had, and other personal information. It is typical for this document to have clerical errors, however, those errors do not affect the final status of the loan.

APR
The APR is typically higher than the rate as it includes some of the fees and closing costs and is compounded.

The information in this section have to do with frequently asked questions. This information in this section is brief, and does not constitute a thorough knowledge of loan documents, but this is typically what we ask about in our over the phone quiz, so please learn this material well.

The signer would not sign the flood disclosure

If you go to a signing at 11am and the signer signs everything except the flood disclosure, what do you do? You call the contact person or people in title or lending. If they do not call you back, you cannot stay at the borrower’s house all day long. Let’s say you leave the signing at noon with everything signed except the flood disclosure. How fast do you drop the package?

Most Notaries will hold on to the package for dear life until the messiah comes. However, the Lender needs those documents. The borrower can take care of the flood disclosure on his own as it is not notarized. Here are some realistic scenarios about this situation:

(a) You drop the package too early, and you have to immediately go back to sign the disclosure. The Lender loses $50 on Fedex. A small loss that is completely his fault for not calling you back.

(b) You hold on to the package for several hours thinking you will drop it half an hour before pick up. Then, you get busy with last minute notary assignments and forget to drop it or have a scheduling conflict at a minimum.

(c) You are at home cooking or reading the paper and forget all about your package.

(d) Better yet, you get in a bad accident and are in the hospital and cannot drop it. If you forget to drop it, don’t have time, or can’t, you could get sued when the borrower loses their lock. Don’t let them lose their lock, rather, drop it like it’s hot!

(e) You have a family emergency because your mom had a stroke, or your daughter hit her head and you drop everything (except the package) and tend to your emergency.

(f) You wait 60 to 90 minutes after the first message is sent before you drop the package depending on what other assignments you have that day. You give the contact person a reasonable amount of time to call you back, but you don’t hold on the package so long that you create any significant risk of it not getting dropped that day due to issues elaborated in points b, c, d, and e. In my opinion, scenario (f) is the most reasonable way to proceed.

HERE IS THE QUESTION RESTATED AS A FOLLOWING DIRECTIONS QUESTION:

You are assigned a signing by Chad the Loan Officer. Chad’s instructions as he words it are, “If there is a problem, call me and only me, if you can’t reach me, then send me a text.” You get to the signing at 11am. The signer’s name is Jesse. Jesse signs half of the documents, but gets to the flood disclosure and says he won’t sign it until he can talk to someone. So, you call Chad, Chad does not answer, what do you do now?

Most Notaries immediately want to call Title. Then they argue with me when I tell them that the instructions say to call Chad only. Then I am told that in real life Loan Officers never hire Notaries directly. I tell the Notary that the purpose of this question is not to master real life but to master following directions so you don’t get fired.

Other Notaries say they will leave a message and sign the other documents in the meantime while they are waiting for a call back. That may be very prudent, but isn’t following directions.

The correct answer is to send Chad a text. What you do after the text is up to your judgment as there are no other instructions. The purpose of this question is to see if you can remember instructions and obey them. Otherwise woe to anyone who hires you.

What’s your sign?

As a Notary, there are various aspects to our job. The most important according to Carmen is identifying people. But, most Notaries just look at the name, and photo, and if it is close enough, that is good enough. If the name is missing a middle initial on the ID that exists on the document that is bad news. But, most Notaries just say, “close enough.” If you say “close enough” too many times, you might end up in court on an identity fraud case which could end you up in court for weeks with no salary, and you might lose a lot of your regular customers as well.

So, how can Notaries make identifying people more reliable? Here are some quick points.

1. If the name don’t match, you must not attach.
Most Notaries say you can over sign but not undersign. This is a Lender preference not a law. If the ID says John Smith and the document says John W Smith you are taking your commission in your hands if you Notarize the signature.The Lender might not mind, but you might end up in court over this if fraud is involved and once in a blue moon it will be.

Most states make sure that middle initials are in ID’s, but not all people are from one of those states. There are out of state people, foreigners, and people who changed their names due to marriage or some other reason, not to mention people with name variations. People from Mexico culturally have two surnames on a regular basis.

So, you have to be prepared for this type of situation even though it only happens 1-6% of the time. If you are going to notarize anyway, what can you do?

(a) Ask the signer what sign he is while holding the ID. If the fake ID has a fake birthday the signer will not know his fake sign. He might be a Leo that is pretending to be an Aquarius. On the other hand, the fake ID might have a real birthday but a fake name.

(b) Get a thumbprint from the signer in your journal. That way the investigators can catch him after the fact if there is any funny business. Thumbprints also deter frauds as they often would prefer not to be notarized than risk being thumbprinted.

(c) Ask their height or birth date.

(d) Ask for a birth certificate if they have one. That doesn’t have a photo, but does have the DOB which is something you can use to cross-check information.

(e) If they have a Social Security card, that is not an acceptable ID, but the first three numbers are part of the zip code where they were born. You can cross check check the info by asking them where they were born.

(f) A gas bill is NOT generally an acceptable form of ID for notarization. However, if you want to verify a middle initial, it is better than nothing.

What you can’t do.
Do NOT accept a signature affidavit AKA statement as a form of identification. That is a document for the LENDER and the source of the information is unknown and not official. Sources for government ID’s are official which is why you can normally trust government issued photo ID’s.

Summary
You need to know your state laws on identifying signers. Many states do not require the name on the ID to exactly match the signature on the document or even for the complete name on the document to be provable based on the ID. Many states leave it up to your judgement. Just because you are following the law does not mean you won’t end up in court as a witness or conspirator to identity theft which is why you as a Notary must take as many precautions as possible.

If you are notarizing for a long term customer and want to take liberties to ensure that your business relationship does not end prematurely, then you might use the above techniques. If the customer means nothing to you, I would strongly consider JUST SAYING NO to any request that is at all questionable, especially those involving ID’s that have names shorter than that on the document.

But, the fastest way to verify if an ID is fake is simply to ask — what’s your sign?

Winging it as a Notary

Many Notaries get into the signing agent profession as a way to make some quick cash or at least make a supplemental income. What they don’t get is that being a signing agent is mostly about being a Notary Public. If you don’t know how to be a good Notary you might run into situations as a signing agent you might not know how to handle or even situations that can get you into legal trouble.

Carmen always tells me that most Notaries are just “winging it” and don’t bother to study to be experts in their field because they don’t think they need to. Being a signing agent requires no specific skill. Just sign as the names are typed in the document and initial where it says to initial, get the docs fedexed back on time and you are done. There might be some faxing or scannning too, but it is not a high skill profession unless…

Unless you want to really know what you are doing. But, what is there to know?

1. Basic Notary Procedure.
Most Notaries think that being a Notary involves stamping forms, but there is a lot more.

(a) There is correct journal filling outing procedure (your only evidenece in course and 15% of full-time signers end up in court at least once,) as well as…
(b) Knowing when to say yes or no to a request which requires knowing something about Notary law and prudency.
(c) Administering Oaths
(d) Knowing the difference between the various Notary acts
(e) Identifying people in prudent ways. Perhaps that should be #1 as it is the most important.
(f) Taking thumbprints as a backup just in case the ID was fake.

2. Introducing the Documents
Knowing how to introduce the loan documents is very different from knowing how to answer FAQ’s about the documents. You can memorize two sentences about each document to introduce the documents to borrowers.

3. Answering FAQ’s
If borrowers want to know which information is where, you had better know, otherwise you are not a signing agent, but only a point and sign Notary. There are many FAQ’s that people might ask. Do you write them down so you can master answering these questions or do you just wing it and hope for the best. What makes a professional is being prepared which is something few Notaries comprehend.

4. Dealing with snags in signings.
There are various things that can go wrong in a signing.
(a) The borrower has a question and the Lender doesn’t answer.
(b) The eDocuments don’t come on time.
(c) There is a cancellation while you are en route.
(d) The borrower doesn’t want to sign either because they don’t understand something or don’t like one of the terms.
(e) You have a package with an unsigned document and don’t know whether or not to drop it because nobody is answering your calls at Title or at the signing company.
(f) The borrower is upset because they are asked to sign John Emanual Smith when they never sign that way.
(g) The borrower hits the roof (and builds a sleeping area attached to the roof) because they find out they are in a flood zone.
(h) At the last minute the borrower finds out they need a cashier’s check.
(i) The borrower won’t swear under Oath because they are an Athiest.
(j) You are notarizing for John and Sally, but Sally is not able to arrive, but the Acknowledgment has John and Sally pretyped in there.

There are many snags, situations, and times when you need knowledge and experience as a signing agent. And then there are the “soft skills” like knowing how to dress and deal with people which matter equally as much if not more. If you go through your career trying to know as little as possible and respond adversely when people ask you questions or have demands of you, you will not do well in this job. Try to be agreeable, responsible, communicate well, and know your stuff. They you are giving yourself a chance and will make our lives easier as well.

The Notary Profession is a Profession — act like it is!

Carmen and I are tired of Notaries treating the Notary profession as if it is a quick way to make some cash on the side — Make a few extra bucks — five bucks here, ten bucks there. This is a very bad way to look at the profession. First of all, there is liability in this profession. You can get sued even if you don’t do anything wrong. People are doing big deals that are being Notarized. If something goes wrong, they can sue you for a few thousand dollars. If the Lender did something fraudulent, you might get wrongfully sued too. If you put your package in a drop box that doesn’t get picked up and the borrower loses their lock — guess what could happen? You get the idea.

The root of the problem lies with the states who mostly have low requirements or no requirements for being a Notary. If you are 18 or over, not a felon and are breathing, you can be a Notary. Being a notary is a profession that safeguards the transactions of multi-million dollar estates. Any lack of integrity or caution on the part of the Notary can lead to disaster.

Imagine that you Notarize John Hancock only to find out he was a different John Hancock and siphoned a million dollars of equity from someone’s estate. You might end up in court as a witness, accomplice, or get sued for negligence. You have no idea what you are playing with in this profession. You have to be careful what you put your stamp on. You might step on a mine.

Many Notaries also think that because their state has minimal requirements, that it is not necessary to go above and beyond your state minimum Notarial behavior — this is wrong. If you don’t keep a journal, don’t use an embosser and don’t thumbprint, you can get in huge trouble.

Think of state requirements like you think of speed limits. If the law says you can go 100 on the highway as was the case in Montana in the past and perhaps present, that doesn’t mean you are safe doing so. There could be deadly accidents. Just because you slow down to 95, you think you are being prudent, but are you really? You are still going faster than is safe. You can blame the state, but you are responsible for your own behavior.

Most professions have licensing tests that you have to take every year or two. Some professions make you take a test of 200 questions to make sure you understand all of the regulations and standards in your industry. The Notary profession has NNA tests that are taken every year or two. California has an exam you take every four years. But, people complain when I want to ask a few questions. People try to convince me that they know it all and don’t need to be tested because of all of the years they have been in business. These are the same people who score 20% on my quizzes.

Once again, the Notary profession is a profession — treat it like one. You should be quizzed every year on all the sites you are on. Since the states do not test your competency, I am forced to. It is a huge waste of my time and really frustrating dealing with all these resistant and incompetent people who think they are so smart.

If you really are so smart, just answer the questions, get an A, and then get on with your day. It would take two minutes to test people if they just knew the answers. The problem is that they resist, and then have to think about everything I ask, and then want to argue, and I need to teach them things and a simple quiz can take fifteen minutes that should take two minutes if I were dealing with professionals. How upsetting and what a waste ot my time.

To be a professional you need to do more than study. You need to master the art of being a Notary. You need to know everything and skip the snow job of trying to convince others you know everything when you don’t. The con jobs are getting very old. I have heard it all too many times. I really don’t even want to list such people. 123notary is a directory for professionals, not posers. At least that is the word young people use these days. When I was growing up we didn’t use that king of language, we said fakers.

14. Sixteen year old Samantha calls a Notary to notarize an Affidavit for her mom who does not speak English. The Notary arrives only to find out that he/she cannot communicate directly with the signing who is the mother. Samantha offers to translate as she does that on a daily basis for her mom. What do you tell Samantha? In 49 states, direct ORAL communication with the client is required REGARDLESS of whether the document is in English, has been translated, or whether the Notary understands the document. You cannot use an oral translator except perhaps in Arizona (check AZ handbook for an accurate answer). Refer Samantha to find a Notary who speaks their language.

15. John appears before you to sign a loan as an Attorney-in-Fact. He knows two verbiage variations for signing as an Attorney-in-Fact and wants to know which one to use. There are no written instructions. What do you do next? In this situation you have to call for instructions because POA verbiage is a matter of preference as there are eight legal verbiage variations for signing as an AIF. So, call the Lender or Title company in this case as the loan will not close if you did not use the verbiage of their choice!

16. Credible Witnesses.
Jim appears before you to sign an Affidavit. But, he has no ID. What do you do? Many states allow for credible witnesses. Some states require two CW’s who must both know the signer while others allow for one that must know the notary and the signer. 17. Name two situations where you might need subscribing witnesses. Subscribing witnesses are witnesses that watch someone sign their name on a document. They are used for Proofs of Execution (look this one up in our Notary Acts section) and for Signatures by Mark or Signatures by X which is allowed in certain states (look up in our glossary.)

18. The document is written in a language that the Notary does not understand. All states except for AZ require direct oral communication with the signer. However, written comprehension is a different ballgame and is very state specific. California only cares that the Notary notarizes the signature and doesn’t care if the Notary understands the document although the signer must understand what they are signing. However, other states can vary. Does your state require you to be able to read the language the document was written in? Look this one up in your handbook as we cannot help you in this matter because we don’t know!

19. You have been instructed to notarize a form that does not have a certificate.
You are at a notarization and the instructions say, “Notarize this page.” However, there is no certificate wording on the page. What do you do now?

The Notary may not choose the Notary act as that might be construed as UPL. So, just ask the client or signer what act they want and then attach the corresponding certificate to the document. That’s all.

20. Deeds of Reconveyence.
You go to a signing and one of the documents is a Deed of Reconveyance. Under the signature line has the word Trustee. Who is the Trustee, and do you notarize this document?

The Trustee is normally the Lender, but could also be the borrower if he has a company and is lending money to himself in another capacity. The Trustee could be anyone, so without specific instructions you should probably not have this form signed or notarized.

Notary Public 101 — Review Quick Pointers

Here are some review pointers. Rather than teaching in index format like I usually do, these are quick facts you need to know. Besides those other facts your embarrassed parents thought you didn’t need to know.

An Affiant is someone who signs an Affidavit and swears under Oath. A Harvey Weinstein is someone who signs a check to a woman to hush her up and swears under his breath.

An Attorney in Fact is another way of saying Agent or Grantee for a power of attorney. An Attorney in Fiction is another way of saying Perry Mason.

A certificate is a form a Notary uses for executing Acknowledgments, Jurats, and other Notary acts that require a certificate. Florida and Texas use certificates for Oaths while most other states do not. You can buy certificates in pad format from the NNA and other vendors. You should keep these in your notary bag at all times because you WILL be using them.

A Principal is the main person who signs an Power of Attorney or who is signing a document that is notarized using the Proof of Execution procedure. It just means the main person who signs a document. Consider it your Notary bag of tricks. The other kind of principal is the person you’re sent to when you’re caught chewing gum in class. Memories!

The Venue is the part of the certificate where you document the state and county where the notarization is taking place. It is also the physical location where you might be at any point in time, especially during a notarization. On the other hand, if you pick up a Notary in a bar, the venue could be your place or mine.

In an Acknowledgment, the signer must acknowledge having signed a document in the physical presence of the Notary Public, but does not need to sign in front of the Notary (although Lenders prefer that they do.) Some lenders I know also prefer that the well-known phrase, “Neither a borrower nor a lender be,” NOT be acknowledged, because it would mean they no longer be!

In a Jurat, the affiant or signer must sign and swear to the truthfulness of the written statement or document in the presence of the Notary which is evident based on the Jurat wording, “Subscribed and Sworn to BEFORE ME.” Note that acknowledgments do not include the before me part when referring to signing. They also don’t include any swear words, so the “sworn to me” part is confusing.

Your Seal must be clear, complete and not smudgy and not have light or missing corners or you will be hearing from the county recorder and might have to redo your work. Seals may look smudgy even if they aren’t, if you forgot to wear your contacts.

It is illegal to omit an Oath or Affirmation when executing a Jurat. Many Notaries say that they never have to administer Oaths in their state. I’m not sure whether or not to believe them. But, you need to know how to do an Oath if you see the words, “Subscribed and SWORN to before me.”

Oaths begin with the verbiage, “Do you solemnly swear…” If you omit the term swear, then the proceding is not an Oath. Oaths are made under God while Affirmations are made on your personal honor. If you’re Harvey Weinstein, the personal honor part doesn’t apply. I affirm that will be my last Harvey Weinstein joke.

Affirmations use the verb “affirm” or “state” but not swear. If you swear it is not an Affirmation and if you affirm it is not an Oath.

Oral statements do not get the same Oath as a written document or statement. Do you solemnly swear that the statement you are about to make is true and correct is a good Oath verbiage for an oral statement, but would be completely wrong for a document Oath for obvious reasons. Don’t let the fact that oral hygiene is good and documented hygiene is also good confuse you.

In your Notary Journal create one entry per person per document. If there are two signers each signing three notarized documents, then enter six entries. Each one signed by the corresponding signer. And keep journal thumbprints just in case someone gives you a fake ID. (If you’re a liquor store owner and someone gives you a fake ID, give them your thumbprint down!) Keep additional notes if there is more than one document with the same name such as escrow numbers, addresses, or anything to distinguish the documents.

The purpose in keeping a journal is not so much to please your state although many states require this, it is to please the FBI & Judges as they will be the ones inspecting your journal if something goes wrong. (However there’s no pleasing some people, like my old girlfriend who complained when I had the toilet paper roll under, not over, and also when I had it over, not under.) California audits journals from time to time too and they will suspend you if you keep a bad journal or no journal.

If the identification does not prove a person’s identity then that is a questionable and possibly illegal notarization. Think of all the trouble you could get yourself into taking liberties notarizing. You could end up in court as a defendant. The ID does not have to exactly match the signature, but the name in the signature must be provable based on the ID. i.e. the ID says John William Smith and the signature on the document says, John W Smith — then it is provable and you should be okay. If your ID says “John Doe” and you’re checking into a hotel with a harlot, it isn’t provable but you should be okay if you wear protection.

Identification for the purposes of notarization should be government issued photo ID’s and be current (some states have exceptions to the current part.) A Social Security card or AKA statement is NOT acceptable for a Notary to use to identify a signer or verify a middle initial. If Social Security runs out in 30 years, you can use that to identify millennials’ middle fingers.

A thumbprint is the most unique and reliable way of identifying someone as a supplemental form of identification. Use a photo ID as a primary ID and thumbprint in your journal. That way if you are ever investigated you will have hard bio-metric data to find dangerous criminals. If the criminal had his thumb blown off, you’re on your own.

When doing a POA signing with an Attorney in Fact, there are multiple ways an AIF can sign. John, as attorney in fact for Sue. Sue, by John her POA, etc. To choose the right variation is NOT YOUR JOB. There are perhaps eight legally acceptable ways of doing the verbiage. It is up to the LENDER to decide which variation they want. Rely exclusively on them for this as choosing a variation is a matter of preference, and the loan will not go through if you goof on this. If you goof on your younger siblings, it’s perfectly normal.

Do NOT send loose certificates in the mail. You could end up in jail as it could be attached to anything. Certificates must be stapled to the document they correspond to — period! Do not send loose women in the mail unless she’s going to Harvey Weinstein. Darn! Okay, I promise, that’s the last Weinstein joke!

Do not ask Lenders or title people for notary advice. They will tell you what they want you to do which is often illegal and for their short term benefit. Rely on your state government and NNA’s hotline for reliable Notary knowledge. Other people are NOT experts at Notary law and might lead you astray by accident or for their convenience. Don’t trust anybody except Santa Claus and the Tooth Fairy. They don’t exist? Okay, don’t even trust them!

POWER OF ATTORNEY

Notaries need to know the terms for the people involved in a Power of Attorney signing. The principal is the main person who signs the document who is the Grantor. This is the person who gives power of attorney to someone else to do tasks for him/her while he/she is incapacitated or out of the country. The Grantee is the same person as the Attorney in Fact or otherwise known as Agent. It is important to know these words and yes, we do test on them. However, at loan signings, people will do what is called a Power of Attorney signing. This happens when there is a completed Power of Attorney document and the Attorney in Fact will sign a loan on behalf of the principal. In these signings, they get rejected half the time for technicalities, so pay attention.

There are various ways for an Attorney in Fact to sign in their capacity.

There are more variations, but those are some common ones. The key thing to understand her is that:

The Lender decides the verbiage when you do a POA loan signing. The Notary might know the “correct” verbiage. However, legal information sites cite at least eight ways an AIF could sign in a POA signing that are all not BAD. The signing will be rejected if you do not sign exactly how the lender wants it. So, if there are no written instructions, ask the Lender.

How can I get a Power of Attorney Notarized?

DEED OF RECONVEYANCE

The Deed of Reconveyance (DOR, not DOA by the way) is often signed by the Trustee and often has the term Trustee inscribed in the signature area instead of someone’s actual name which is very confusing and leads to trouble on a regular basis. Many Notaries have the borrower sign where it says trustee. Usually the trustee is a Lender, or might be the borrower in one of his capacities. If you are not sure who the Trustee is, then ask before you have someone sign there. It is safer to leave this form unsigned than guessing, otherwise you might cause a delay to the Lender and get fired. So, if you are not sure what to do, don’t have anyone sign where it says Trustee.

DOCUMENT DATES

In the Notary world there are four types of dates. Transaction dates, rescission dates, document dates, and signature dates. The day you sign is the signature date and generally the transaction date. The rescission date is the last day to rescind. But, the document date is arbitrary and is created by the document drafter. It is normally either the day the document was drafted, the date it is intended to be signed, or an arbitrary date. There is no rule for what that date can be.

SIGNATURE by X

If a signer is partially incapacitated and cannot sign their full name, many states will allow a Signature by X procedure. The procedure can vary state by state, but the way I was trained is as follows. The principal signs an X on the document and in your journal. There should be TWO SUBSCRIBING WITNESSES who witness the person sign. Witness #1 signs the person’s first name to the left of the X and witness #2 signs the person’s middle and last name to the right of the X. Do the same in the journal. Add a note to the document to let the readers and custodian know what happened as they might not be familiar with this procedure. Keep the phone numbers and ID info of the witnesses in your journal just in case.
