We go to this trouble to make your title company’s screening and hiring procedure for new additions to your roster more streamlined, and lessens the chance of serious legal complications in the long run due to improper notary work.

We know that many of you would like to hire better quality Notaries. Are our current certified members up to your standards for being a “good Notary,” and how much extra do you feel they merit per signing? Would it be too much trouble to call a handful, talk to them for a few minutes and size them up and see for yourself how much better you feel they are compared to an average signing agent?

Our 2002 through 2017 tested mainly on loan documents and a little bit on Notary procedure, but involved mostly online testing which was taken advantage of by Notaries who found ways to game the system. As of 2018, we cleaned up our certification, removing those who cannot demonstrate a certain level of still on oral & email quizzes to ensure reliability to your hiring parties. We reduced the quantity of certified members from about 1600 to about 160 and will continue to screen certified members every year or two for quality control purposes.

Our 14 point certification process generates Notaries who are generally polite, responsive, cooperative, and technically competent. I can go over our process in as much detail as you like, but first I would like to let you know that most notaries will not aggressively pursue education on their own. They will only study hard if those who hire them recommend, require, or offer preferential treatment to those that do.

If you have Notaries who you would like to send over who you use regularly who would benefit from a tune up — or those who are not good enough to put on your list due to a lack of basic knowledge, we are happy to tutor, train, or enroll them in one of our courses. This collaboration of our forces will benefit both of us and does not cost title companies a penny. Our work on 123notary is for the greater benefit of title companies. However, we charge the Notaries for advertising and education and never charge title companies for anything.

THE CERTIFICATION PROCESS

a. 123notary certification starts with reading our educational materials. We have loan signing courses that we sell. We also have free Notary basics materials in our blog at Notary Public 101 which we are in the process of adding to our sold materials for the convenience of the buyer. However, that material on the blog is open to the public, so our students can see it at any time.

b. We also offer Q&A by email and even tutoring to those who want it. Sometimes the technical aspects of Notary procedure can be complicated and a one on one session can be the best way to learn.

c. Testing is done online, but also as a follow up by phone. Testing by phone is more reliable as a measuring stick as we can ask open ended questions, multiple choice, fill in the blank, etc. Additionally, we know that we have the correct entity taking the test and can adjust our questions to exactly what we want to ask. We can also more easily monitor how many times and when the person took the phone test than with online tests many people abuse the privilege and treat it more like a video game that they keep playing until they win.

KNOWLEDGE REQUIRED
The knowledge required to pass our test as of 2018 includes:

1. Notary Acts. We require Notaries to know when particular notary acts are used, how to explain these acts, and what the requirements of each basic act are including Acknowledgments, Jurats, Oaths, Affirmations and Proof of Execution. We do not teach other acts as they are uncommon and not necessary. We also require Notaries to know how to administer Oaths as they are required by law when executing a Jurat which is done on Affidavits as a matter of custom.

2. Notary Terminology. We require Notaries to know basic Notary terminology such as Venue, Affiant, Certificate, terms relating to Power of Attorney, etc.

3. Certificates. We go over how to fill in the additional and optional information in certificates which deters the fraudulent as well as accidental swapping of certificates to other documents.

4. Journals. We teach prudent journal entry procedure using the one entry per signer per document principle.

5. Power of Attorney. We teach Notaries to follow instructions to a tee on AIF signings and to call in if instructions are omitted or not clear as to how an Attorney in Fact should sign in their capacity.

6. Identification. We teach Notaries how to make sure the ID proves the name on the document. This may or may not be a legal requirement in their state, but it is a prudency requirement that helps reduce the chance of ending up in court.

7. FAQ’s. We teach the basics of FAQ’s at loan signings such as:
(a) When is my first payment due?
(b) Where can I read about my prepayment penalty (if there is one)?
(c) Why is my APR higher than my rate?
(d) Where does it say where my payoffs and fees are located?

8. We teach the basic loan documents. Our emphasis used to be mainly on documents while our current emphasis is on issues that can cause financial damages to companies involved in transactions which are normally Notary issues or issues pertaining to negligence in business matters.

9. RTC. We teach how to date the Right to Cancel in a Refinance for an owner-occupied property.

10. Errors on Certificates. We teach the various ways to deal with errors on certificates, but this gets into state specific areas and also in to areas pertaining to the preference of the Lender or Title company involved.

11. After-Service. After a Notary signs a loan, they still might be needed for several days to clean up errors or answer questions. Notaries are not normally aware of how long they need to be around, so we tell them what types of situations can arise after the fact and how being unresponsive by phone and email will not make them popular with Title companies.

12. Elder Signings. Issues involving the competency and state of mind of signers is critical with elder signings. Elder signings normally take place in the hospital, but it is possible that for loan signings, especially Reverse Mortgages, that elders could be there. If an elder is on morphine, they are not in a position to sign. And if they cannot paraphrase a document, it might be dangerous to notarize them for legal liability reasons.

13. Foreign language signers and foreign language documents. We address these points a bit. A Notary must have direct communication with the signer in all states but AZ where oral translators are, or were allowed. However, for safety, you should not rely on a translator, because if they make a mistake, you could end up in court and you would be ultimately responsible as the Notary Public involved in the particular transaction.

14. Omitted Information. Sometimes a Notary will go to a signing. The instructions might say, “This page must be notarized.” However, there might not be a notary certificate. In some cases there might not be a signature line. We teach how to handle these situations gracefully.

DANGERS OF HIRING A SHODDY NOTARY

1. Oaths. If you hire a notary who does not administer Oaths, your loan could be questioned, or perhaps even overturned in court by a Judge once the judge finds out that an “incomplete notarization” has taken place. Omitting an Oath makes a Jurat notarization on a Signature Affidavit, Occupancy Affidavit, Identity Affidavit or other Affidavit incomplete and therefore a Judge could declare the document not notarized, and perhaps declare a loan as invalid as a consequence. This would cause serious legal and financial damages to many parties involved. 90% of Notaries we talk to do NOT know how to administer an Oath correctly and most do not administer Oaths at all… ever, because they think it is not “required” in their state. It is required nationally.

2. Dropping Packages on time. If you hire a Notary who holds on to packages when they don’t know what to do in a particular situation, or because they just are not in the habit of dropping documents quickly, you might not get your important documents back on time. This is dangerous and can cause delays in funding, missing the lock in an interest rate, or your loan getting cancelled. Often times several days later, the documents will be found in the trunk of the Notary’s car. Each incident of forgetting to drop a package can cost you hundreds or thousands.

3. Identification. If you hire a sloppy Notary who does not make sure the name on the ID proves the name on the document, it is possible for your loan to end up in court costing all parties thousands. The lack of thumbprints in a Notary journal also makes it hard to identify someone who used a fake ID.

4. Journals. If you hire a Notary who does not keep a journal, you might not experience trouble for years. The minute your notarizations are called into question by an Attorney, the lack of evidence (namely the notary journal) would come back to haunt you and cause a nightmare. Without evidence, you have no way to prove who notarized what, or if a fraudulent notary impostering a real notary did the work. You have no idea who did what or when or what type of identification was used, or even if the signers consented to being notarized.

Additionally, if your sloppy Notary uses the “cram it in” style of journal entries where one line in their journal accommodates all documents in a loan signing (legal in some states but not prudent) your borrower could claim that they never had all of the documents notarized, but only one, and therefore the loan is void and the transaction must be cancelled, etc. This happens once in a blue moon when a borrower wants to get out of a transaction, and legally it is hard to prove if they consented to be notarized on five documents in a transaction when there is only one signature in the journal for five documents. You could claim that the Notary was in cahoots with the lender and added four additional documents after the fact.

5. Confirming. Improper confirming of signing can lead to a lot of wasted time. If the name on the ID does not prove the name on the document, there is no point in going to the appointment. There are many other critical points to go over when confirming the signing. The majority of Notaries either do not confirm signings, or don’t do so thoroughly enough which can cause a lot of loss of time and perhaps delays in the loan process.

6. Following directions. Many Notaries do not follow directions well. This can cause a huge loss to companies that hire them assuming your directions are critical to the success of the the signing. We screen for following directions when certifying signing agents. None of them are perfect, but we weed out a lot by asking a few following directions questions.

7. Notarizing for non-English Speakers. If you notarize for non-English speakers, this can lead to liability if you cannot communicate effectively with them. Any misunderstanding could come back to you.

8. Dating the RTC. You would be surprised how many Notaries cannot date a Right to Cancel. That can cause financial damages to any company that hires them.

9. Elder Signings can be a source of liability. The elders don’t always understand what they are signing. A competent Notary makes sure the signer understands the document, especially if elderly or in the hospital.

10. Being responsive after the fact. Many Notaries disappear or play hookey after a signing. Notaries are needed to answer questions before, during and after the signing. If they are not, this could cause grief to the hiring party.

Shark Tank: A signing company wants to sell shares on Shark Tank

CONTESTANT: Hello Sharks, my name is Dave and I want to sell 50% of my company on Shark Tank. We are a signing company that caters to nationwide title companies. We get Notaries around the country to do signings for us, and then keep them waiting forever to get paid to improve upon our cash flow. There is nothing new or innovative about our business practices. It is similar to most other signing companies.

Mr. WONDERFUL: I have a great idea. Since you take forever to pay people who have done work for you, I’ll buy 50% of your business and then take forever to pay you for it.

CONTESTANT: Oh, well, I’m not sure I like that idea.

LORI: If you don’t like being treated that way, don’t treat others that way. What comes around goes around.

CONTESTANT: Well, that’s just the way our industry works. I don’t always get paid on time by title either.

LORI: As I was saying, refer to my last statement.

Mr. WONDERFUL: It seems like you are participating more in the bad karma business than the signing business. Maybe you should change your business model.

MARK: Yeah, perhaps you should pay people a day before they do the work and then they can keep you waiting indefinitely to actually do the work. That is how it is hiring programmers.

CONTESTANT: Please don’t bring up the “p” word.

LORI: The “p” word? Programmers? Why? Did you pay them and then they didn’t do their work? That is a business model for most programming companies in the industry who cater to small clients. That’s why I get an air-tight contract before I hire a programmer to even write a single line of code.

BARBARA: Sounds like you need a better business model. I’m out by the way. But, if you consider paying people upon proof of having finished service by having them fax you a few pages of the work, that might be a reasonable system for having work done and paid for quickly.

CONTESTANT: Yeah. The problem is that if I pay the Notary before I get paid by Title, I might just be out the money.

LORI: That’s a cost of doing business. Pay the Notary whatever you can afford after you calculate the percentage chance that you won’t get paid. At least you will still have good Notaries working for you in this case.

CONTESTANT: Okay. I’m out.

Mr. WONDERFUL: You can’t be out. You’re the contestant. By the way I’m out.

CONTESTANT: Well, it sounds like I’m not going to get paid on time which is why I’m out.

LORI: We could paypal you the funds right away.

CONTESTANT: But, funds can be reversed and the policies are wishy-washy for non-tangibles.

LORI: But, I don’t want anything to do with your type of business model paying people late and not being innovative. Why not a more cutting edge business model where Title is forced to pay within 72 hours of you paying the notary or you either cut them as a client or raise their rates accordingly. You could have the whole pay structure as part of an automated system.

CONTESTANT: Snapdocs is the only intelligent business model these days. The rest of us use technology from the 90’s.

Mr. WONDERFUL: It’s time to get with the times. I’m out. Ooops. I said that already. Oh, running out of time speaking of time. It’s time for our next contestant.

Notaries should know how to handle these situations, because you can lose clients very easily. Clients do not want to know about your problems or your family. They want you to get a job done professionally. Here are some scenarios Notaries typically screw up.

Screaming kids in the background
You might be used to your kids, but your clients do not want to hear them in the background. If your kids are screaming, train them to be very quiet when you answer the phone or leave the room if they can’t control themselves.

Relatives answering the phone
When you use the, “Hullo???” method of answering the phone, it is impossible to know if you are talking to the correct person. This is unprofessional and makes a horrible impression. Of the Notaries who have lasted on 123notary for ten or more years, very few say hello. The ones who say hello are not professional and generally do not last more than a few years. Everyone who answers your phone has to announce themselves, otherwise get a mobile phone that only you answer. If your three year old answer the phone, this is very unprofessional, however, if they say, “Rutherford residence, this is Brandon” then it becomes more tolerable.

Answering the phone with an alias
If you answer the phone, “Hi, this is Kathy” but your 123notary profile says Andrea and the person says, “May I speak to Andrea.” and you say, “This is her.” This creates a very annoying confusion. The point of having a name is so people know who you are and what to call you. If there are twelve people named John in one home room class at school it becomes confusing. And if you have multiple names that you go by that is confusing. Stick to one name or use an AKA when you answer the phone. “Hi, this is Kathy AKA Andrea.” That way no more confusion.

Answering the phone at a restaurant
If you answer the phone while at a noisy restaurant, it is best if you are able to step out within seconds of answering the call. The first thing you must do upon answering is say, “I am at a busy restaurant and I apologize for the noise. I can step out if you need to talk to me.” If you don’t keep in mind that nobody wants to hear the background noise and have you continually saying, “what, what what?” every time they ask you something, then be considerate and professional and either don’t answer the call, or step out quickly upon answering. Or text the caller and let them know your situation.

Having a bad phone
If you have a bad phone with bad reception, don’t keep making the other person repeat themselves and then yell at them telling them they are breaking up. That is unprofessional and rude. It is YOU that have the bad phone and it is YOU who is breaking up, not the caller. So, invest in a better phone with better reception otherwise you will lose a lot of clients and will have nobody to blame except yourself.

In a signing
Don’t answer the phone only to tell the other person you can’t talk. That is just plain rude. If you can’t talk, don’t answer. If you do answer, give the other party 90 seconds before you get short with them — hear them out, and be considerate. After the clock strikes a minute and a half, then let them ,know that you cannot talk any more because you are at a signing.

Between signings
If you just got out of a signing, are between signings or are on your way to a signing and refuse to talk to someone, that is rude. If you are at a signing, there is a reason not to talk long. But, if you are between signings and someone calls about business and you tell them you are busy — then, they will have to call you back, but they will reach you at another signing when they call back. If you are impossible about talking to people you will lose half your business.

Part of marketing is the act of actively promoting yourself. But, a lot of marketing is about doing a good job and communicating well.

To get hired to do Notary work, you need not only to know what you are doing, but you need to communicate clearly as well. Here are some major issues with phone etiquette.

DURING THE INITIAL CALL

.

1. Introduce yourself
Introduce yourself properly by phone when you answer the initial call to hire you. “This is June of June’s Notary Service” is a lot better than, “Hullo?”

2. Answer questions the way they were asked.
If someone asks what your hours are, tell them your beginning and ending times. Don’t say it depends and don’t be vague. Give them a clear picture of your availability without making them ask again. If someone asks how many loans you have signed, don’t give them a summary of your professional background, just give them a quick number. If someone asks if you are still in business, don’t tell them you are eating dinner or on vacation, just tell them that you are still in business. Just answer the question.

3. No background noise
Screaming children, televisions, or people talking in the background sound unprofessional. You need to turn the TV off, go into the next room where there is no noise, and apologize if there is any noise. That is called being professional.

4. Don’t scramble information
Asking people to repeat endlessly is horrible. If your phone is horrible, get a new one rather than accusing the other person of breaking up. If someone asks if you can do a notary for two signers on three documents, don’t repeat it back to them as, “Okay, three signers on how many documents?” That is called scrambling information and sounds ignorant.

5. Don’t brag
Notary Signing Agents have the desire to overprove themselves. The secret is to make a good impression by being helpful and not shoving your credentials down someone’s throat. It also makes a good impression to ask a few relevant questions about the type of signing or document. Asking a few pertinent questions looks professional.

6. Act calm
Acting calm and helpful is a lot better than acting anxious and overly helpful or overly unhelpful. People get put off by desperate or unfriendly behavior.

CONFIRMING THE SIGNING & AT THE SIGNING

7. Call to confirm the signing
Go over all pertinent points. Make sure the ID proves the name on the documents and that all the signers will be there. You should also verify that there is a clean table to sign on. You should go over how long the signing should take, if there is anything going back to the document custodian and if they have used morphine or Jack Daniels within several hours of the signing. Nothing beats a sober signer or a well organized Notary Public.

8. Introduce yourself at the door
It is good to mention that you are Joe the signing agent and that it is your job to facilitate the signing. Mention that they can address all of your questions to you, but that you cannot answer specific questions about their loan, but only general questions about loan documents and Notary procedure.

9. Small talk is good
People like a friendly Notary who can talk about small talk. But, avoid any topics that could be controversial such as gender issues, sex, guns, and how born again Christians should have a second birth certificate for when they were born the second time.

10. Don’t discuss guns and religion
Unless you are notarizing the Obamas, don’t bring up Joe the plumber, or religion. But, if you are notarizing the head of the NRA then you might reconsider guns. If you ask him to shoot you an email, don’t be surprised if he asks what you want him to shoot it with! Yee-haw!!!

11. Don’t park in the driveway
The driveway is for the residents to park in, not you. You are their humble servant who parks on the street (sorry.)

12. Dress for success. Business casual is great. People get complaints more for dressing poorly than for being a horrible Notary. So, go to Men’s Wearhouse first, and then buy that Notary course you were thinking of. And remember — it’s not what you know — it’s how you look! Notaries who show up in shorts and flip-flops get some serious complaints and even a bad review on their profile. In short, don’t dress like me.

13. Carry loose Acknowledgment, Jurat and other certificates in your Notary Carry All Bag that you purchased from the NNA. Carry a thumbprinter, wipes, and pens with you. Nothing is worse than a Notary that doesn’t have pens except one who wears flip-flops. Having good professional equipment makes you look like you know what you are doing even more than actually knowing what you are doing.

14. Arrive on time
Nothing is worse than a late notary other than one who wears flip-flops.

15. Follow up punctually
If you have to get the Fedex back, do so immediately. Do not wait to drop a package unless you are waiting for a call back. If you wait 90 minutes or more for a callback, consider that title needs their docs back and it might make sense to just drop it. That is a judgment call, so think carefully about it. If you get emails, answer them asap.

You have to be available after signings for up to the rescission date and sometimes later. If you become unreachable after the signing, you will get very serious complaints. The worst complaints we get about notaries are that they were rude, or unresponsive after they had completed work.

16. Don’t be rude
If someone is rude to you, don’t reciprocate. Your reputation is on the line. You can get penalized for being rude even if the other person deserves it. So, watch yourself!

Notary Marketing 102 — The Top of Your Notes

1. TOP — Selling Points & Experience
A good notes section should start out by mentioning some quick points about why someone would want to hire you. Here are some points that do well in the top section:

.

Number of Loans Signed – Most Notaries hide behind their years of experience. But, the Title companies want to know how many loans first as years is not a definitive metric of how much actual experience you have. What if you signed ten loans per year for ten years, that is only 100 loans. If you have thirty or more years of experience, list it in a format such as: Notary since 1985.

Jail & Hospital Signings — Many people need service in unusual places, so if you are specializing in jails and hospitals, you should mention this at the top of your notes.

100 Mile Radius — In remote areas, people need service far from where you live. If you offer this service with a smile, you will attract a lot more business.

eSignings — Listing unusual services makes you look highly skilled, and will attract specific types of work.

Hours — If you are a 24/7 Notary or a night owl, let the world know this first, because a lot of people need help at night and the other Notaries probably don’t want to be bothered.

Languages — Spanish and Vietnamese are the most demanded languages. But, if you speak another language, put that up top so people will know right away. If you speak Spanish, it is better to claim to be “bilingual” as it carries positive cultural connotations.

Specific Experience — Mention specific types of financial packages or documents that you are accustomed to signing. If a client has that exact package they might be more likely to call you first.

Catchy Phrase — Sometimes a catchy phrase about yourself, your business or service can win the game. Often it is a one-liner that is artfully phrased and catches people’s attention. Don’t bore them with fluff, dazzle them with class!

Examples:

EFFECTIVE
24/7 service; 8500 loans signed; last minute signings; Bilingual; Experienced with Modifications, eSignings, REO, Time Shares, Refinances, VA, FHA, 1sts, 2nds, and Helocs.

Commentary
The effective top of your notes section stresses time of availability, level of experience you can really put your finger on (# of loans is a better analytic than years because the reader could assume that you did very few loans per year for ten years which is not impressive.) “Last minute signings” is a great phrase because many notaries do not like to be bothered at the last minute. Unusual types of financial packages are also good to list and this section lists ten types of packages. I would stop at twelve types of packages per paragraph to avoid overload.

HORRIBLE
I have been a notary for twelve years and know my way around the business. I am responsible and know everything I need to know. NNA certified.

Commentary
The horrible top of your notes section commentary lists years which is bad because you don’t know what quantity of actual work was done per year. There is some bragging and self-promotion which I called “inexpensively bought credibility” which carries no weight because it is self-verified credibility. Then there is the NNA certification which is not a selling feature as almost all Notaries on 123notary are NNA Certified. You have to mention what makes you different and better, rather than what makes you average.

4. Coverage Areas and Special Terms
The lower middle of your notes can talk about what counties or cities you serve. I do not like lists of zip codes, but if you insist you can include them. Listing a radius is fine, but back it up with mention of specific counties or parts of counties so the public will have a clear idea of where you go. Clear information wins the game and vague self-descriptions looks sloppy. If you take credit cards, Square or Paypal, mention that too. Here is an itemization of what to put here:

Areas Covered — A radius in miles and the names of counties or parts of counties are most effective. You might list specific city names too. Keep county lists as county lists and it is confusing to mix cities and counties together. Notary Marketing 102 — Negotiating Fees

As a Notary, knowing what you are doing, having a good advertising presence, and being reliable all matter. But, if you don’t know how to negotiate fees, you will crumble in this low-ball world. Here are some of the best negotiating tips in the industry from our top players.

1. Let them name their price first
When bargaining, it is much better to let the other person bid first. You can always raise your ask price if they don’t offer enough. But, if they offer far too much, you would never get it if you asked first and asked too low.

2. Start with a high ask price
If you ask for $125 or $150, you can always go down on your price, especially if the job is close or fast. You can ask how many pages, fax backs, and notarizations are in the package. If the job is quick, then give them a quick price.

3. Never whine
If you whine about the condition of the industry or how low the fee was, people will think you are a low life. Professionals don’t whine. Professionals operate! So, if you are offered $60, ask for $85 and see what happens.

4. Decline the low-ball offers
If you spend all day working for peanuts, then when the good jobs come, you won’t have time. Decline bad offers so you are free for good offers.

5. Answer your phone
If you only offer when you are not in a signing and not driving or cooking or thinking, you will miss 80% of your calls. How can you negotiate a good fee if you don’t take the call in the first place?

6. Act professional
Try to impress them without trying to impress them. Most Notaries try to do a snow job and brag about how great they are. Seasoned operators don’t do this. Smart professionals will engage you in an intelligent conversation about the job, the industry and the state of the union. Ask them questions about the job, where it is, who it is for, what type of loan it is, and about their career and industry working in title or escrow. But, whatever you do, don’t talk about your zero percent error rate and how reliable and experienced you are — nobody can verify your claims and nobody wants to hear it.

7. Announce your name when you answer the phone.
Answer the stating your company name and personal name and never say, “Hullo?”. It sounds professional to announce yourself properly. If you have screaming kids in the background that sounds horribly unprofessional. Have a quiet place to answer the phone and if you are in a noisy place, try to go to a quieter place and apologize about the noise. Just because you don’t mind noise doesn’t mean the title company enjoys barking dog and screaming three year old.

8. Talk about real life
Sometimes I talk to Notaries who tell the Title company that you can call me to clean up the mess after you hire one of those $50 signers. Over half my work is clean up work. That sounds real to title companies unlike all the nonsense about how experienced and knowledgeable you are which just sounds like fluff. Tell real stories about how you handled complicated situations that others might have goofed. Mention that split signing where you did some complicated manouver on the Acknowledgment certificate and how you went out to sign the wife at 3am because she could only see you at that time due to her busy schedule as a nurse. This is impressive and much better than fluff.

9. Negotiate timing
You can offer a better rate if they get you late after rush hour. They might prefer to just offer you more and get the job booked.

10. Double book and get a bad review
You’ll get many bad reviews from this, but double booking makes sense. People cancel jobs all the time when they hire you, so why can’t you cancel a few jobs. If you book jobs tightly, generally at least one of the clients will cancel 20% of the time — at least. So, if you book a job for $60 and someone else offers you $150, you can ditch the first job and take the other. You will probably get a bad review that will last for three years, but you will have $90 extra in your pocket. It’s a dirty technique. Not recommended, but food for thought and great blog material.

11. Negotiating on SnapDocs
You need to know how to negotiate if you use SnapDocs. The majority of Notary work (not the majority of the high paying work though) comes from SnapDocs these days. Their technology wins the game although their fees for using their system are a little exorbitant. When given an offer on Snapdocs by text, you need to turn the situation around.

Let’s say you are offered $60 for a job. Text them back saying I have signed “x” amount of loans in my career and “x” amount being the Purchase that you are assigning. I will accept the job and get it signed within three hours, but my fee is $85. Do you want a seasoned pro or a screw up? References available upon request.

There are Notaries who prosper on SnapDocs. Just not that many. And the ones who do well merit doing well with their superior notary and business skills. Negotiating fees will not get you far if you are an unskilled Notary or beginner. You are competing against 12,000 other Notaries (estimate) on SnapDocs who also don’t know anything. So negotiate only when you have a bargaining position.

12. Stress Availability
As a Notary, there are a lot of others competing with you. If you are fast returning texts, answer your phone promptly and are available, you can get a lot more work. The other notaries are not so responsive. Let people know that you are available and can get the job done. That is a huge bargaining chip. And do so without sounding desperate.

13. Be Willing to Talk
Many Notaries are unwilling to talk to others while in a signing. If someone calls about business, give them 90 seconds before cutting them off. You don’t know if what they are calling about could help you or hurt you. Not giving them a chance to speak their mind will be very frustrating. Many Notaries answer their phone only to tell me that they cannot talk. This is like opening your door only to slam it in someone’s face. It is better to answer and talk or don’t answer. Set a limit ahead of time. By being responsive and friendly, you will attract more business. If you think the job you are at is the only job, you are sacrificing your next job which might become a repeat client.

What’s your sign?

As a Notary, there are various aspects to our job. The most important according to Carmen is identifying people. But, most Notaries just look at the name, and photo, and if it is close enough, that is good enough. If the name is missing a middle initial on the ID that exists on the document that is bad news. But, most Notaries just say, “close enough.” If you say “close enough” too many times, you might end up in court on an identity fraud case which could end you up in court for weeks with no salary, and you might lose a lot of your regular customers as well.

So, how can Notaries make identifying people more reliable? Here are some quick points.

1. If the name don’t match, you must not attach.
Most Notaries say you can over sign but not undersign. This is a Lender preference not a law. If the ID says John Smith and the document says John W Smith you are taking your commission in your hands if you Notarize the signature.The Lender might not mind, but you might end up in court over this if fraud is involved and once in a blue moon it will be.

Most states make sure that middle initials are in ID’s, but not all people are from one of those states. There are out of state people, foreigners, and people who changed their names due to marriage or some other reason, not to mention people with name variations. People from Mexico culturally have two surnames on a regular basis.

So, you have to be prepared for this type of situation even though it only happens 1-6% of the time. If you are going to notarize anyway, what can you do?

(a) Ask the signer what sign he is while holding the ID. If the fake ID has a fake birthday the signer will not know his fake sign. He might be a Leo that is pretending to be an Aquarius. On the other hand, the fake ID might have a real birthday but a fake name.

(b) Get a thumbprint from the signer in your journal. That way the investigators can catch him after the fact if there is any funny business. Thumbprints also deter frauds as they often would prefer not to be notarized than risk being thumbprinted.

(c) Ask their height or birth date.

(d) Ask for a birth certificate if they have one. That doesn’t have a photo, but does have the DOB which is something you can use to cross-check information.

(e) If they have a Social Security card, that is not an acceptable ID, but the first three numbers are part of the zip code where they were born. You can cross check check the info by asking them where they were born.

(f) A gas bill is NOT generally an acceptable form of ID for notarization. However, if you want to verify a middle initial, it is better than nothing.

What you can’t do.
Do NOT accept a signature affidavit AKA statement as a form of identification. That is a document for the LENDER and the source of the information is unknown and not official. Sources for government ID’s are official which is why you can normally trust government issued photo ID’s.

Summary
You need to know your state laws on identifying signers. Many states do not require the name on the ID to exactly match the signature on the document or even for the complete name on the document to be provable based on the ID. Many states leave it up to your judgement. Just because you are following the law does not mean you won’t end up in court as a witness or conspirator to identity theft which is why you as a Notary must take as many precautions as possible.

If you are notarizing for a long term customer and want to take liberties to ensure that your business relationship does not end prematurely, then you might use the above techniques. If the customer means nothing to you, I would strongly consider JUST SAYING NO to any request that is at all questionable, especially those involving ID’s that have names shorter than that on the document.

But, the fastest way to verify if an ID is fake is simply to ask — what’s your sign?

How many journal entries do you use for two signers on three documents?

Many states don’t require a journal. However, your journal is your only evidence if you are investigated. As a Notary, for every 3000 Notary appointments (not acts) you do, you will probably be investigated once based on my personal experience. If fraud is involved on anybody’s part and you don’t have a journal entry, you will have no evidence and could be pulled into court for weeks which would result in your loss of income.

Additionally, we recommend the use of thumbprints in your journal for all critical notarizations, especially those involving Power of Attorney documents Living Wills, or Deeds affecting real estate. It only takes a few seconds to thumbprint someone. A thumbprint cannot be faked, but ID can, so you have no reason not to take thumbprints, and plenty of security related reasons to do so. NNA sells inkless thumbprinters for about $15.

If your state doesn’t require journals, use one anyway for your protection.

Back to the question. If there are TWO signers and THREE documents, you will need SIX journal entries. One per document per signer. What some Notaries do is they create one journal entry per signer and then indicate a list of all the notarized documents they signed. This is wrong and perhaps illegal. Not only is it bad to only create one journal entry per signer, but you might forget to add a document, or if there are cross outs after the fact it will look very sketchy.

However, you don’t need to write all of the info for each journal entry. The signer’s name, address, and ID information can be copied by putting a down arrow or “ditto” quotation marks. However, legally, the signer needs to sign for each document that is notarized and the name of the document, date, time, and type of notary act needs to be indicated for each document.

Additionally, there is an “additional notes” section of each journal entry near the right. If the building looks unusual you can take notes about the building. If the signer is acting weird or looks weird or has a tattoo on his neck or anything else unusual, you should write that in your journal to jog your memory if you ever have to go to court.

I did about 7000 Notary appointments and they all became a blurr to me. The only people I remember were Gary, the guy who blew up his apartment while experimenting with explosives (not a good idea) and a Korean lady who had me notarize the sales of her massage parlors (she paid cash). I also remember Dr. Kwak (pronounced Dr. Quack) who was an acupuncturist. I vaguely remember an impatient rich guy who lived in West Hollywood, did business deals in his pajamas, and played golf. And of course Mr. Yee the Attorney who had me do all of the Health Care Directives each with 80 pages of which I embossed every single page every single time to be prudent.

So, the moral of the story is that if you don’t know how to use your journal like a pro, the NNA has tutorials that you can purchase, and they are highly recommended as they could keep you out of court (or jail.) Or both!

We got a very disrespectful comment about my rebuttal to comments on Black Notaries vs. White Notaries Comedy Edition. This was the most popular comedy post we have written in years, yet the comments were hateful. I guess Americans have nothing constructive to say about race relations. There is either an imposed silence reflecting a social restriction on freedom of speech — or, there is downright hatred — but, very little in between.

So, this commenter claimed that Chris Rock reflected black Notaries poorly because I depicted him as having bad grammer. My rebuttal to his comment on my rebuttal is — Chris Rock is far more talented than any Notary on 123notary: black or white. The post in question was not supposed to be realistic of real Notaries as real Notaries are rarely funny, and would not be good characters in a blog article unless they are brilliant or outrageous. Let satire be satire and don’t try to overanalyze it. So, to appease the aforementioned commenter, we will make an equally erudite man named Sedric Watkins who happens to be black as the star of this blog.

TOMMY: So, why did you become a Notary?

SEDRIC (Black Notary): I became a Notary to supplement my bustling Real Estate management career.

TOMMY: But, isn’t being a Notary a low paying side job?

SEDRIC: I assure you that it is as high or low paying as you make it. I set my minimum at $90 because I have other things of value to do that compete for my limited time resources. Like reading Shakespeare. Or inventing a vaccine that can cure Bill O’Reilly.

SAM (White Notary): (ring ring) Hello?

ABC SIGNING SERVICE: Hi, this is Samantha from ABC signing service. We have a job in Compton where you will need to print out two sets of documents 300 pages each, do 65 fax backs, and notarize twelve signatures for a family of six. Can you do the job for $45?

SAM: I’d love to do the job for $45, but I’m afraid of going to Compton.

ABC SIGNING SERVICE: Figures… Hmmm. We need to find someone who isn’t afraid of going to the hood.

(ring ring)

SEDRIC: Punctilious Signing Services, this is Sedric.

ABC SIGNING SERVICE: Hi Sedric, let’s cut to the chase. And that wasn’t a dated reference to OJ. We need a Notary to go to the hood. We’ve tried twenty other Notaries, but they are all chicken. Mmm, chicken! Can you do the job?

SEDRIC: Why certainly. Ah yes, I remember the days of my impetuous youth when South Central used to be a black neighborhood.

ABC SIGNING SERVICE: Oh, it still is, where we’re sending you. The signing is for a higher up in the Crips who started a business. It’s 300 pages, 65 fax backs, and twelve signatures per person for a family of six. Can you do it for $45?

SEDRIC: Yes — $45… per signer with a $90 minimum for single document signings and $150 minimum for loan signings.

ABC SIGNING SERVICE: Hmm. So, you’re asking for $270.

SEDRIC: My time is in limited supply, and with six signers, if even one doesn’t show up, the whole signing is delayed.

ABC SIGNING SERVICE: Oh, so you’ve done this before…

SEDRIC: Of my 2500 signings, seven were for multiple signers and those were prolonged to say the least.

ABC SIGNING SERVICE: How about $150

SEDRIC: You’re paying for experience and a flawless track record.

ABC SIGNING SERVICE: You folks do have quite a record when it comes to track.

SEDRIC: How patronizing of you.

ABC SIGNING SERVICE: Thank you. Okay, $155

SEDRIC: $200 paid in advance via Paypal. I agree to stay there up to 75 minutes just in case a signer doesn’t show up or doesn’t have ID.

ABC SIGNING SERVICE: Done…

SEDRIC: (ring ring) Hello, this is Sedric from Punctilious Signing Services. I will be seeing your party today at 3pm for a signing. Please have appropriate and current identification.

CRIPS BOSS: You got it. Oh … and one more thing. Wear light blue.

SEDRIC: I’m wearing a black suit today, but I’ll wear a blue tie to show solidarity with your movement.

(In the hood — Sedric parks his car in a busy commercial area to go up to the office.)

PASSERBY: Hey man, what-chu doing in our hood dressed like that? Are you going to a funeral or something?

SEDRIC: No, I happen to be a businessman.

PASSERBY: So, what is it with this uppity lingo you’re using. Are you sure you’re even black?

SEDRIC: “Uppity” is code I don’t appreciate. I assure you that I am black. Must we speak in this dialect?

PASSERBY: You’re the one with the dialect my brother. So, what’s up with you?

SEDRIC: To put it in your vernacular, I’m a “high brow brotha!”

PASSERBY: I heard that. But, you ain’t black ee-nough.

SEDRIC: What prey tell do you mean by black ee-nuff? I’m sure that your definition comprises using incorrect grammar, being opposed to the powers that be, failing out of high school, having an addiction and being a minimum of two months behind on your alimony. You just described a white acquaintance of mine, but I digress. I pay no heed to your juvenile and grievously preposterous sense of cultural sensibilities.

PASSERBY: You got it all wrong man. I never finished junior high school, and they couldn’t find my legal address to make me pay any alimony because I don’t have one — so the joke’s on you! Basicaly what I’m saying, is that there ain’t nothing black about you. Can you dig it?

SEDRIC: My definition of blackness is based purely on genetic lineages tracing back to West Africa. my dear friend. Culture is not a well-defined science you see and therefore not a logical characteristic for racial classification.

PASSERBY: Well you seem like an Uncle Tom.

SEDRIC: Thank you. My Uncle Thomas, much like myself, drives a Ferrari, studies karate, and has a fine lady friend. Here’s a photo of my lady.

PASSERBY: Damn!!!! She got it going on!!! Honeylicious!

SEDRIC: And my mother likes her too, because in addition to being visually appealing, she is a nice person.

PASSERBY: Nice honey, but you’re a mamma’s boy.

SEDRIC: If your mamma looked like Halle Barry, you would be too. Be that as it may, I’m a very well paid mamma’s boy.

PASSERBY: Well, yo mamma’s an auntie Thomassina! A female uncle Tom!

SEDRIC: What did you say about my mamma? (kick, crash, bash, crunch, smash, chop, knock, clash.)

PASSERBY: That wasn’t karate. That was jujitsu — Okanawan style. When I said there was nothing black about you, I take that back. There is something black about you — but only one. You don’t like it when nobody says nothing about yo mamma. Can you tell me… ummm..

SEDRIC: The GPS coordinates of the nearest hospital so that you can heal the damage that I just did to you? I would, but I have an appointment to go to. Oh, and one more thing. Your Theory about Uncle Tom’s cabin has a hole in it — in the roof!!!

CRIPS BOSS: Here’s our man… We have our ID’s ready and we’re ready.

SEDRIC: I’ll be here for 75 minutes. I just hope that that statistical probabability of one of the six of you getting arrested in the next 75 minutes is low so I don’t disappoint my new client.

CRIPS BOSS: Here are our six ID’s. I’ll just lay them out on the table Vegas style — like a fan. Oh, and don’t worry, we alerted the police to your presence, so they won’t bother you.

SEDRIC: You make it so easy.

CRIPS BOSS: What happened to the side of both of your hands?

SEDRIC: I had to take care of some business on the way over here.

CRIPS BOSS: Another appointment on such short notice. I sure like the way you do business. You know something. You should join our operation.

SEDRIC: Not in this lifetime. But, call me if you need a Notary Public, Real Estate Manager, or Okinawan Jujitsu teacher.

CRIPS BOSS: I know you claim to be Okinawan… but, are you Okinawan eee-nuff?

SEDRIC: It’s not me… it’s the Jujitsu that is Okinawan… never mind…

(ring ring)

SAM (White Notary) I just got this job in Beverly Hills. They have good Chinese food here too if you can find a parking spot.

SEDRIC: Good for you. I hope you charged them enough or should I say, “ee-nuff.”

SAM: Oh, I charged them $100. I’m learning from you. But, you’ll never guess what the job is about. There’s a guy from the hood in the Beverly Hills hospital who says he got beaten up by some uppity Notary who thought he was too good for the brotha’s.

SEDRIC: Did he have a huge bruise on his upper right temple?

SAM: Why yes.

SEDRIC: Never seen him before in my life! Just out of curiosity, after you told him about the Chinese food, did he tell you that you weren’t “white ee-nuff”?

SAM: I think he only says stuff like that to you. But, after your little interlude, perhaps from now on he’ll make his flip remarks to people like me.

SEDRIC: It’s a distinct possibility.
