Notary Marketing 102: Phone & Communication Etiquette

Part of marketing is the act of actively promoting yourself. But, a lot of marketing is about doing a good job and communicating well.

To get hired to do Notary work, you need not only to know what you are doing, but you need to communicate clearly as well. Here are some major issues with phone etiquette.

DURING THE INITIAL CALL

.

1. Introduce yourself
Introduce yourself properly by phone when you answer the initial call to hire you. “This is June of June’s Notary Service” is a lot better than, “Hullo?”

2. Answer questions the way they were asked.
If someone asks what your hours are, tell them your beginning and ending times. Don’t say it depends and don’t be vague. Give them a clear picture of your availability without making them ask again. If someone asks how many loans you have signed, don’t give them a summary of your professional background, just give them a quick number. If someone asks if you are still in business, don’t tell them you are eating dinner or on vacation, just tell them that you are still in business. Just answer the question.

3. No background noise
Screaming children, televisions, or people talking in the background sound unprofessional. You need to turn the TV off, go into the next room where there is no noise, and apologize if there is any noise. That is called being professional.

4. Don’t scramble information
Asking people to repeat endlessly is horrible. If your phone is horrible, get a new one rather than accusing the other person of breaking up. If someone asks if you can do a notary for two signers on three documents, don’t repeat it back to them as, “Okay, three signers on how many documents?” That is called scrambling information and sounds ignorant.

5. Don’t brag
Notary Signing Agents have the desire to overprove themselves. The secret is to make a good impression by being helpful and not shoving your credentials down someone’s throat. It also makes a good impression to ask a few relevant questions about the type of signing or document. Asking a few pertinent questions looks professional.

6. Act calm
Acting calm and helpful is a lot better than acting anxious and overly helpful or overly unhelpful. People get put off by desperate or unfriendly behavior.

CONFIRMING THE SIGNING & AT THE SIGNING

7. Call to confirm the signing
Go over all pertinent points. Make sure the ID proves the name on the documents and that all the signers will be there. You should also verify that there is a clean table to sign on. You should go over how long the signing should take, if there is anything going back to the document custodian and if they have used morphine or Jack Daniels within several hours of the signing. Nothing beats a sober signer or a well organized Notary Public.

8. Introduce yourself at the door
It is good to mention that you are Joe the signing agent and that it is your job to facilitate the signing. Mention that they can address all of your questions to you, but that you cannot answer specific questions about their loan, but only general questions about loan documents and Notary procedure.

9. Small talk is good
People like a friendly Notary who can talk about small talk. But, avoid any topics that could be controversial such as gender issues, sex, guns, and how born again Christians should have a second birth certificate for when they were born the second time.

10. Don’t discuss guns and religion
Unless you are notarizing the Obamas, don’t bring up Joe the plumber, or religion. But, if you are notarizing the head of the NRA then you might reconsider guns. If you ask him to shoot you an email, don’t be surprised if he asks what you want him to shoot it with! Yee-haw!!!

11. Don’t park in the driveway
The driveway is for the residents to park in, not you. You are their humble servant who parks on the street (sorry.)

12. Dress for success. Business casual is great. People get complaints more for dressing poorly than for being a horrible Notary. So, go to Men’s Wearhouse first, and then buy that Notary course you were thinking of. And remember — it’s not what you know — it’s how you look! Notaries who show up in shorts and flip-flops get some serious complaints and even a bad review on their profile. In short, don’t dress like me.

13. Carry loose Acknowledgment, Jurat and other certificates in your Notary Carry All Bag that you purchased from the NNA. Carry a thumbprinter, wipes, and pens with you. Nothing is worse than a Notary that doesn’t have pens except one who wears flip-flops. Having good professional equipment makes you look like you know what you are doing even more than actually knowing what you are doing.

14. Arrive on time
Nothing is worse than a late notary other than one who wears flip-flops.

15. Follow up punctually
If you have to get the Fedex back, do so immediately. Do not wait to drop a package unless you are waiting for a call back. If you wait 90 minutes or more for a callback, consider that title needs their docs back and it might make sense to just drop it. That is a judgment call, so think carefully about it. If you get emails, answer them asap.

You have to be available after signings for up to the rescission date and sometimes later. If you become unreachable after the signing, you will get very serious complaints. The worst complaints we get about notaries are that they were rude, or unresponsive after they had completed work.

16. Don’t be rude
If someone is rude to you, don’t reciprocate. Your reputation is on the line. You can get penalized for being rude even if the other person deserves it. So, watch yourself!

10 ways to “deal” with SnapDocs

A guide to high survival in a low-ball world.

These days, so many Notaries are complaining more and more about SnapDocs. In fact, the drama is so intense, that posts about SnapDocs are the most popular articles on our blog these days. SnapDocs is not bad, they just have a system which you haven’t mastered yet, Grasshopper! SnapDocs caters to companies who care about price, but don’t care about experience. Those who want top-notch seasoned Notaries come to 123notary as we focus on having the highest caliber of Notaries at the top of the list. So, read this and you’ll learn the secrets of high survival in a low-ball world.

(1) CALCULATE TIME
Calculate how many minutes you’ll need to fulfill the request.
Some Notaries complain if the fee is too low without looking at the time involved. $40 is not bad if the job is within ten minutes and there are no fax backs and very few pages. For a ten page signing ten minutes away, you might be there and back again in less than an hour. How many people do you know who complain about making $40 per hour? Read the text and see where the address is and how many pages are involved.

Regardless of the specifications, calculate how much time you need to:
Print, Drive, Call, Sign, Fax, and Fedex.

(2) BACKGROUND CHECK
Background Check the reliability of the company making the assignment
Tired of screwball signing companies? Low-balling is not the worst thing. Not getting paid, or being held hostage for three hours waiting for edocuments while your other clients are waiting is. You can background check companies on www.123notary.com/s using your iphone. I just updated the “votes” on all of the signing companies on our list in May 2016.

(3) MAKE COUNTER OFFERS
If you get a job from SnapDocs that comes as a text, you’ll be alerted to the location, number of fax backs and other basics about the job. You can use that information to calculate the amount of time needed to fulfill the order. Based on the time involved, you can decide how much to charge. If you have a base rate for your time (make it more expensive during the last week of the month) then you’ll know exactly what to charge. You might discount your fees a little for SnapDocs clients as they clearly don’t want to pay much.

If you get an offer for $50 to do a Refinance for two signers with twenty pages of fax backs, you can make a counter offer of $85. Some Notaries bid $125 and never get called back. You have to price your bid within the market otherwise you might as well just not use SnapDocs at all.

If you bill your time at $30 per hour and a job will require 54 minutes, ask for $27. Or if you’ll need two hours, then ask for $60. This is a very reasonable way of quoting rates that is fair to you as well as the client.

(4) NEWBIES — GAIN EXPERIENCE!!!
If you are new in the Notary business, I advise not being too picky about what people pay, providing they pay within 45 days. You need to get at least 1500 loans under your belt to be taken seriously by the big guys such as prominent title companies. You should pass the 123notary & NNA certification test if you want to be taken seriously as well. If you want to get experience in a hurry, SnapDocs is one way to do it. You’ll get tons of jobs, and all you have to do is drive, fax, and sign. You might not get paid that much, but experience is worth its weight in gold, so consider that your payoff.

(5) FILL IN YOUR EMPTY TIME
If your other customers book in advance, and your daily schedule has some holes, SnapDocs might be the perfect way to fill in those unused hours. Although you might not get paid that much, at least you will have something to do so you (and your printer) won’t get bored. If you make $200 a day average doing signings for your regulars and you can pick up another $60 from SnapDocs, that is not a bad daily average.

(6) WIN OVER NEW CLIENTS
What a new client will pay you is different from someone who knows and trusts you. Once you build up trust with a client over the course of a few jobs, or a few months, you might be able to charge more. If they have a written track record about your service and know that you won’t screw up, they might pay you $20 more than they would pay another guy even though they are low-balling. So, you can use SnapDocs to meet new clients, and then once you have them hooked, jack your rates up a bit — but, not too much of a bit as you are still dealing with low-ballers.

(7) THE FIRST 3 WEEKS OF THE MONTH
Business is normally sluggish during the 3rd to the 22nd. So, that might be a great time to augment your business by using SnapDocs! You might need to save time during the end of the month for your regulars, but when things are slow, you should be willing to work at a somewhat lower rate.

(8) LOOK FOR CLOSE JOBS
Working for cheap is not that bad if you can find close jobs. If you get twenty texts per day from SnapDocs, and one or two is really close, you can try to nab those close ones and make some fast money. The key is having something to do during the other seven hours of your work day. If you make $60 for a signing ten minutes away, you might be making $50 per hour when all is said, done, and faxed.

(9) GET PAID UP FRONT
Ken is on our forum all the time offering some old school common sense to our Notaries. The message is — you are not a bank, why do you offer credit to strangers with no collateral? You don’t know if or when those signing companies will pay you. So, why not get $85 up front via Paypal? If they really need you they will pay you!

(10) THE CARMEN METHOD — ABSTINENCE
Carmen thinks that Notaries just shouldn’t use SnapDocs as the fees offered are too low. You can use abstinance as a way of dealing with this situation. Seasoned signers will never get paid what they are worth on SnapDocs, your experience is just not valued enough. With all of the faxing back, they can double check a newbies work and get accurate work at half the price by micromanaging. Please consider that you need ACTIVE marketing as well as PASSIVE marketing. Active marketing involves contacting signing and title companies one by one in addition to Attorneys, hospitals, and anyone else you wish to work for. Active marketing will be more labor intensive in the beginning of your career as you do not start out by being on any organization’s list. However, once you are on the lists of at least 200 companies, then you will most likely be spending more of your time working and less of your time looking for work.

Dormant Contacts
Even after you are on the list of a company, you still need to contact them from time to time to just let them know you exist and want to work. We suggest that when Notary business is slow in the beginning of the month you schedule time to call your contacts who are dormant in hopes that they might actually use you one day.

Requirements for work
* Certain big title companies like Chicago Title require 500,000 E&O Insurance
* Other title companies want 100,000 E&O
* Some Notaries show off by having a million in E&O which is expensive and makes you a target for lawsuits.
* Others want a current background check from a reputable vendor such as the NNA or Sterling, but not necessarily from the other vendors.
* Some want vast experience as a Notary while others prefer beginners who will work for cheap. If you work for companies that hire beginners they will micromanage you. If you are tired of being micromanaged, try to work directly for companies that hire experienced and reliable Notaries.

Certifications
Many companies like it when Notaries are certified. But, there are many vendors offering certification and which one is the best? NNA certification is the most widespread and widely recognized in the industry. But, on 123notary, people looking to hire Notaries pick 123notary certified members more then twice as often as they pick Notaries who aren’t. My suggestion is to be certified by three or more agencies — that way you’ve covered all of the bases and will make quite an impression.

Printers
As a Notary, you should have a fast and reliable printer and perhaps a backup printer. Dual tray laser printers are the standard tool of seasoned Notaries. Single tray printers might be okay if you have software to figure out what size paper is for which document. Some Notaries print everything on legal although some Lenders might not appreciate that.

Professional Dress
Business casual is the official dress code for Notaries. No shorts, flip flops, tank tops, jeans or torn clothing please.

Low-Ball Offers
As a Notary, you will receive a lot of low-ball offers. Notaries complain endlessly about this. If you are not an experienced Notary, low-ball offers might be your ticket to getting experience. Personally, I feel that new Notaries do not merit high paying Notary jobs and should work for low fees. However, once you have educated yourself in the “art of the signing” and have paid your dues by accumulating an experience of more than 2000 loans, you should get paid at least an average of $110 per signing otherwise something is very wrong. The economy does change over time and wages change too, so be flexible and work for whatever people will pay you.

Setting Prices
Notaries need to be flexible and realistic about what they charge. Some Notaries are too snobby to take low paying jobs and end up starving. Other Notaries take too many low paying jobs and miss out on the good jobs because they are too busy working for peanuts and then spending their profits on gas, toner, paper, and other expenses. You need a sophisticated model for pricing that incorporates the time of the month (month-end is busier and should be more expensive) distance, timing, traffic, and how many pages the job will be.

* Base your prices on how long you estimate a job to take including traffic.
* Lower your prices at the beginning of the month when business is slow
* Expect to be paid poorly until you have at least 1000 loans signed
* To get paid well, you need a constant supply of regular clients who pay well which you accumulate over time
* You need to advertise heavily to get a constant supply of new clients in hopes that some will become regulars.
* You need to be on time, be nice, not make mistakes and get docs back on time to get rehired.
* Base job time on the name lf the Lender as packages from particular banks are normally a particular (+/-) number of pages and then factor in traffic on the route you’ll take at that particular time of the day, night or weekend.

PASSIVE MARKETING
Passive marketing involves advertising on directories. Once your ad is out there, companies can find you. However, not all advertisements attract the same amount of business, and not all Notary directories are equal. Online yellow pages are yet another way to advertise as well as Google local, however we do not know much about the results of such advertising. Passive marketing is very powerful as you get motivated buyers calling you when they really need something done. However, most Notaries are neglectful in the creation and maintenance of their advertisements and do not get the full potential of their investment. A good Notary profile has reviews from satisfied clients, certifications, and a powerful and well organized notes section. You need to do everything right to maximize your results.

Where to advertise
123notary, Notary Rotary, Notary Cafe, and Signingagent.com are the four most powerful players in the Notary advertising business — in that order. You should advertise on all four with a paid listing. 123notary offers high placed listings. We suggest that you pass our certification before investing in a high placed listing. High placed listings get you more business as well as better quality (and better paying) Title company jobs — and it means that you will be seen first before people start scrolling deep and shopping around.

How to create an amazing notes section
We have written many articles on this overlooked topic which you should read and study. If you want to get ahead, become an expert at the art of the notes section. Companies read what you have to say about yourself, and if you have very little to say, or just a bunch of fluff, you are not likely to get hired. Notaries who do well have thorough and factual information about themselves that is neatly organized into paragraphs. They cover their areas of expertise, certifications, professional memberships, equipment, notes about what is unique about how they handle business, segments on their professional history before they were a Notary particularly if it has some sort of business or Mortgage related relevance, and more.

Being 24 hours helps a lot
If you want to get more business, offer service to more counties, and during more hours. It is just common sense — do the math. Some Notaries only want to service their home county during their “flexible” hours of 9-5 while others are 24 hours and cover eighteen counties. If you need to sleep, then limit your hours from 6am to midnight, but the more flexible you are, the more business you can accumulate.

Reviews are essential
We have written many blog entries on reviews and are publishing a comprehensive guide to reviews as well around the same time I publish this article. The important concepts to remember are:

* Six reviews will double your new business from our site
* After you have six reviews you will get a small marginal benefit from each additional review
* Well written reviews count more
* Don’t get multiple reviews the same day or it looks like you wrote them yourself
* Reviews that are three or more years old do not benefit you much, so always get new reviews.
* You might need to ask ten people to get a single review, but it’s worth it.
* Signing & Title companies are horrible about writing reviews since everybody bugs them to do it
* Individuals are easier to get reviews from, so do some jobs for individuals
* Ask for a review when someone compliments you on your work otherwise don’t ask.
* Email requests for reviews in addition to asking in person. Email them a LINK to your review page. That will take the work out of trying to find the page which I assure you people don’t have the time or patience to do.

Company Names
It will help you to have a company name in the long run. But, think long and hard about what you name your Notary business. Names with geographical significance are recommended. Names with notorial or Mortgage significance might be good. General business names that are not relevant to this industry might not be ideal.

Many Notaries create a listing and forget about it. Your listing is like a plant — it needs to be watered and trimmed from time to time otherwise it will wither. Snapdocs, this is what we’ve learned about their Notaries

I recently visited Snapdocs to see how good their Notaries are. I called a dozen or so to sort of dip my toe in the water so to speak. Here are some quick facts based on my experience:

1. Snapdocs mostly brand new Notaries. New Notaries are often very enthusiastic and excited about learning.

2. The # of signings listed on Snapdocs is not an accurate number. It reflects how many loans were signed through their affiliation with Snapdocs and not in total.

3. Many of the numbers I called on Snapdocs were disconnected

4. Many of the Notaries on Snapdocs do not answer their phone.

5. Most of the Notaries on Snapdocs are not listed on other Notary directories which is refreshing.

6. Information on profiles on Snapdocs is very limited

7. Snapdocs has a very good document downloading system and we’ve heard they have a good loan assignment dispatch system as well.

8. Snapdocs is very popular and has thousands of Notaries on their site which is unusual for such a new notary directory (except for the new directories that copied all of our listings and then went out of business.)

I don’t know if I would recommend for or against Snapdocs, but they are the only Notary directory that has caught on since 123notary became popular in 2002 — and that is exciting! Let’s see where their newly found success takes them.

VA signings for $85? With 200 pages? No Thanks!

As a blog writer, I need to come up with ideas for interesting blog articles. So, I often go to Linked In and see what was popular there. I was visiting last night and saw that someone was offered a VA loan for $85. But, the package had about 200 pages! As new Notaries, you need to understand that not all packages are alike. Some Lenders have short packages while others have longer ones. Some Lenders have their documents ready on time while others don’t. Additionally, there are different types of loans — some are longer and more time consuming than others.

Large Loan Packages
VA loans are normally a lot longer than regular Refinances. FHA loans are longer and more complicated too. Additionally, Reverse Mortgages are longer and take longer partly because the signers are normally elderly. VA loans are for Veterans, and they might tell you some war stories about getting ambushed by the Taliban, but they are probably middle aged and able to sign in a moderate amount of time. But, the packages are long and take a long time.

What to Charge?
The average Notary on 123notary makes about $105 per signing (interesting stat.) If your standard fee is $100, you need to charge more if it is going to be a slow signing or a signing with an above average number of pages. You will be using your printer more, and spending more time at the signing. So, how much more should you charge? In my experience, more pages won’t take you that much more time. It will cost you a little toner and paper, but an additional fifty pages might only take you an additional twenty minutes assuming the signer is not a slow poke. What does take time includes: sluggish signers who read every word, elderly people who can barely function, issues with the loan involving long calls to the Lender, multiple signers who don’t always show up on time, problems with the ID.

Before You Accept the Job
My suggestion is to call the borrower and ask if they will be able to sign within a sixty or seventy-five minute window for a longer package. If they say no, then you might consider charging more or cancelling the signing. If you have the luxury to call the borrowers before you accept a job, you can have a lot more flexibility. You should ideally charge for time, and NOT based on the length of the package. I signed a 200 page construction loan in 25 minutes because the borrower was a professional and had been through the process dozens of times. His time was worth a lot and he didn’t waste a minute. He was like an assembly line.

As a General Rule
For most Notaries on 123notary, I would recommend charging $115 or $120 for VA signings and Reverse Mortgages. If you are very experienced with more than 5000 loans signed, then add another $25-$50 to that figure. Notaries should not try to charge too much unless they are so popular that they simply have to turn down good offers daily. Try to be reasonable and accommodating while you earn some notches in your belt! But, $85 is just too low unless you are a complete beginner!

How much more does a 123notary certified signer make?

How much more does a 123notary certified signer make compared to a 123notary uncertified signer? The answer is roughly $8 per signing average. I hear a bunch of “buts” in the background. “But, I’m NNA certified, so I’m already certified.” Yes, but you will make more money if you have the knowledge and the show that only 123notary certification offers you. Our numbers are the proof. Not only do 123notary certified notaries get more than double the new incoming calls from our site than 123notary uncertified notaries in comparable spots, but they get paid roughly 8% more as well!

I did a poll of the notaries on our newsletter. I asked what their average signing yielded them. The answers were not always very precise and some round-about. However, I was able to crunch some numbers.

Crunching the Numbers
I crunched figures from the first 22 uncertified notaries who responded.
I crunched averages for the first 20 certified (by 123notary) notaries who responded.
I crunched numbers for 10 Elite certified notaries who responded or who I had talked to previously about fees.
I wasn’t sure what to expect, but then who is.
My results are based on limited information, but enough to get a rough idea.

Average Results
The average Elite certified notary polled claimed they averaged $116 per signing
The average 123notary certified Notary polled claimed they made an average of $110 per signing.
While the average 123notary un-certified Notary polled made an average $102 per signing.

My Surprise
I was surprised that the 123 uncertified Notaries did so well. Most of them lack even the most basic of signing agent education. Most of them don’t know where to find the prepayment penalty or how to explain the APR intelligently let alone understanding the other documents. I am amazed they get paid so much!

$8 Extra per Signing Adds Up to Almost $30,000 in a Decade!
Many Notaries think that they don’t “need” our certification. However, Notaries who pass our certification test know approximately double what those who can’t or didn’t pass our certification test know. Additionally, Notaries who pass our test get double the new calls from our site, although our certification will not help you on other sites. Point (15) Technical Points; Marcy Attaches a Certificate

By now, Marcy had decided to really study her text book well. In this last signing, she narrowly avoided two disasters.

MARCY: Hi, I’m Marcy and I’ll be your signing agent this evening.

RUTH: Thanks for coming Marcy. I’m all ready.

MARCY: The Lender asked me to make sure we include a cashier’s check for $2500 in the package. Do you have the check?

RUTH: Oh, he didn’t remind me. But, I have it somewhere.

MARCY: Let’s take care of the check first, otherwise we’ll forget all about it and you’ll lose your lock.

RUTH: That bad?

MARCY: It’s happened before. I read about it in my course and I’m not making any careless mistakes.

RUTH: Here it is.

MARCY: Okay, the course says to staple it to an eight and a half by eleven paper and put it on the top of the stack of documents in the FedEx so the first person to open the package will immediately see it and hand it over to the correct person… Done! I’m putting it in the package, but at a 90 degree angle so I’ll see it. That way I won’t forget to make sure it’s first in line after we add all of the other documents we’re signing tonight.

RUTH: Boy, aren’t you careful?

MARCY: Well, you’d understand if you knew how many mistakes notaries often make in this industry.

(10 minutes later)

RUTH: Okay, I’ve initialed all of the pages of this Deed of Trust. Now, you need to notarize it, right?

MARCY: Correct… (stamps the document) Oooh! That came out smudgy. I better do it again.

RUTH: It looks fine. I wouldn’t worry about it.

MARCY: The Deed of Trust is a recorded document, and that means that it goes to the county clerk’s office. Some of the clerks are picky, and they have the right to reject a smudgy seal which might cause the loan to not go through on time. So, I need to attach a loose certificate and make sure my stamp comes out clearly… Perfect.

RUTH: You certainly dot your i’s and cross your t’s!

MARCY: If I didn’t, you would lose your loan.

(a day later)

LENDER: Marcy, I noticed you crossed out your Notary seal on the Deed of Trust. Why did you do that? That looks very sloppy.

MARCY: Quite to the contrary, the seal was smudged, and the county recorder would be unlikely to record such a document which is why I attached a lose certificate.

LENDER: But, did you have to staple it on? It is very difficult to disconnect — and messy.

MARCY: Legally I am required to attach the certificate. Completing loose certificates that are stamped is illegal because they can easily be used for fraud by being attached to a different document; So by un-stapling my work, you are leaving yourself open to looking very questionable.

LENDER: But, we always do that.

MARCY: Well, you are at liberty to do what you like, but I am not at liberty to break my state Notary laws! If the Lender had the certificate wording on a separate piece of paper without a page number, it would be removable so that nobody would have to see the cross out should there be an error, and once in a while there are stamping errors. Notary seals are not always clear the first time.

LENDER: Isn’t there a better way to do this?

MARCY: If you want your loan to go through, and for it to go through legally, then no — there is no other way to do this.

Point (15) A handful of technical points
These technical points fall into the category of signing agent knowledge and are generally above and beyond purely Notary knowledge. Being an expert at these points will make you a much more impressive signer.

Checks in Packages
If you are sending a cashier’s check in a package, please note that these get lost much more frequently than you might think and the borrower’s loan will be delayed if this happens. These checks are for high dollar values, so make sure they don’t get lost between all of the many hands that will touch this loan package.

Staple the check to a 8.5 x 11 piece of paper, and put this paper at the front of the loan package so that whomever opens it (generally a secretary) will see it immediately and notify the person in charge of the loan. If you put the check in the middle of the documents, the check will not get seen right away, and there could be a delay. If you don’t staple the check, it will likely get lost in the shuffle.

County Recorder Rejections
If you make a mistake on a recorded document, the county recorder can reject the document which could slow down the loan processing time. The borrower might even lose their lock which would be very costly. Take extra care when notarizing recorded documents. Which documents are recorded?

Dates
What is the difference between a Document Date, Signature Date, Transaction Date, Rescission Date and a Notarization Date?
The document date is a random arbitrarily picked date that is often subscribed in the document. It is often the same date the document is signed, or perhaps drafted. The signature date is the date a document is signed. Of course, if there is more than one signer, there would be more than one signature dates. A Notarization date is the date a document was notarized. Legally, a document can be Acknolwedged more than once though! A transaction date is the date that a document is signed. A Rescission date is the last day to rescind. There, you have five dates to remember!

eDocuments, eSignings, and eNotarizations
eDocuments are documents sent by email to the Notary to be printed out. eSignings are signings done on a laptop with the borrower doing digital signatures on a signature pad — but, with hardcopy regular notarizations using a paper journal. eNotarization are Notarizations where the notarization uses a digital seal and digital journal.

The Prepayment Penalty
The Prepayment Penalty could be mentioned in any of these four documents, or perhaps even more. The Truth in Lending says you will, won’t or may have a prepayment penalty. The HUD may reference the prepayment penalty as well. But, the two documents that offer the most thorough information on the prepayment penalty are The Note (which every loan has) and the Prepayment Rider which is only included in a handful of loans that have complicated prepenalty agreements.

Most Notaries we talk to do not know the best place to look for thorough information on the prepayment penalty. They usually want to source the TIL, but this is wrong. Try to be a little more familiar with these very basic loan concepts as your borrowers will be more impressed with you if you do.

Recorded Documents
Here are various types of recorded documents sorted into categories.

Deeds: Deed of Trust, Riders to Deed, Quit Claim Deed, Grant Deed, Inter-spousal Grant Deed, Warrantee Deed

Title Docs: Subordination Agreement, Mortgage

Legal Docs: Affidavit of Trustee, Power of Attorney (sometimes recorded), some states record the Note although most don’t.

Lien Docs:Judgment Liens, Unsecured Tax Liens, Revenue & Recovery Liens

Other:Addendum, Condo Homeowners Approval, Tax Certificate, Affidavit of Continuous Marriage (state specific)

Commonly Notarized Documents in Loan Packages
Most packages will have certain documents to be notarized such as a Deed of Trust or Mortgage in all loans. It is also common to notarize other documents such as a Signature Affidavit, Occupancy Affidavit, Correction Agreement Limited Power of Attorney, Subordination Agreements, Grant, Warranty or Quitclaim Deeds, certain Riders, Identity Affidavit, and more.

Spousal Signatures
If a spouse is not on the loan, the documents they sign might vary from state to state and lender to lender, but these documents are typical documents that they need to sign:.
(a) The Deed of Trust and accompanying Riders if any.
(b) Grant Deeds and/or Quit Claim Deeds if someone’s name is being removed from Title.
(c) The Right to Cancel if the spouse is residing in the property.

Trusts
Notarizing Trusts is not brain surgery. However, when people sign with a capacity, it is common to sign their name, a comma, and then their capacity. Al Smith, as Attorney in Fact for Joe the Plumber. You are only notarizing Al Smith, but the additional information is sometimes helpful or critical. As a general rule, unless the document custodian wishes otherwise, You should have trustees sign as trustees: John Doe, as Trustee.

Then, there are Living Trusts which are instructions for what to do if a signer is incapacitated. These are usually long documents drafted by an Attorney that can be more than forty pages long in many cases. Living Trusts are quite different than regular Trust Documents and Wills.

Point (13) Call The Lender? Finding the Prepayment Penalty

Marcy had been studying up. She didn’t want to make a fool of herself anymore. She went to her next signing prepared.

MARCY: Hi, I’m Marcy, and I’ll be your Signing Agent tonight.

GLORIA: Oh wonderful. It is so nice to see a well prepared Notary.

MARCY: We can start here with the Deed of Trust and I’ll explain the documents as we go along unless you want to start with the HUD and work our way back.

GLORIA: Oh, very sophisticated. You sound like one of those really experienced Notaries who has signed 3000+ loans and advertises on 123notary.com.

MARCY: Well, I’ve signed about 20 by now, and I’m only 2980 short of 3000. I am working on the 123notary course, but haven’t finished it yet, but I’m almost there.

GLORIA: Great. The Deed is fine, the Note is fine, now, why is my APR higher than my Rate in my Note?

MARCY: I just studied this… I know the answer. The APR is the annual percentage relationship between the payments and the amount borrowed, minus the fees. This rate is often used to compare the different loans borrowers have to choose from. The APR is almost always higher than the rate. The rate, on the other hand, is a monthly percentage relationship between the payments and the total amount borrowed, including fees.

GLORIA: Wow, very professional. You are even better prepared than the notaries who signed 3000 loans. They just told me, “It is the cost of the loan expressed as a percentage rate.” Your answer was so professional.

MARCY: I spent two hours memorizing it and I practice daily so I won’t look like a fool.

GLORIA: Oh, no, you don’t. I’m going to tell your boss that you are the best Notary I’ve ever had, and we refinance every five years. Now, where is my prepayment penalty?

MARCY: Oh, just look on the Truth in Lending.

GLORIA: Okay… It says that I will, won’t or might have a prepayment penalty. I’ve gotten more decisive answers from a magic 8 ball. Can you do any better than this?

MARCY: Oh, hmm. I thought it was there. Do you want to call the Lender?

GLORIA: Sorry to lecture you after I complimented you, but aren’t YOU supposed to know this?

MARCY: We could call the magic 8 ball? Better yet, let’s call the Lender.

(ring-ring)

FRANK: Yeah, Frank here.

MARCY: You are the first Lender in human history to actually answer his phone.

FRANK: Glad to be of help.

MARCY: Your customer wants to know what the terms of her prepayment penalty would be.

FRANK: You mean my BORROWER. Never call them customers. Gloria DiStefano. She doesn’t have one.

MARCY: Where is that documented – In the Prepayment Rider?

FRANK: No, if there is no prepayment penalty, then there definitely won’t be a rider. Check the Note. Anything else?

MARCY: We’re good. That was fast. 45 seconds exactly not that I’m counting.

GLORIA: I’m on it. I thought we went over the Note. I guess I skimmed it too fast. Here it is. It says I don’t have a prepayment penalty. Great. I’ll pay the whole thing off tomorrow. That was easy.

MARCY: Sorry, I’ll study harder. But, I am doing so much better than three weeks ago when I first started. I hadn’t a clue then, but now I get most of the questions correct.

GLORIA: That’s good, but you need to get ALL of the questions correctly and handle all situations like a pro if you want my business!

MARCY: Sadly, you are right. I’ll finish my course and review it regularly. I might even take a few other courses too.

Point (13) Calling the Lender
Notaries are often confused about when to call the Lender. Some Notaries are over-confident and never want to call the Lender while other Notaries call whenever the borrower sneezes. A high quality Notary knows when to call the Lender and when not to bother the Lender. You have to understand many of the common situations that arise when you have a small problem. If you call the Lender, leave a message, and wait 20 minutes and then call again. Call other entities related to the loan too if you can, such as the Signing Company, Escrow, Title, etc. If the Lender does answer, the borrower might talk to them for 45 minutes while you are running late to an appointment. You will save a lot of time and aggravation if you ONLY call the Lender when you absolutely need to.

The 1003
The 1003 Universal Residential Loan Application is the one document that is universally wrong. There are always mistakes on everybody’s 1003. I’m not sure if there is a law requiring it to always be wrong, but it seems like there is some sort of cosmic law mandating that. Since the 1003, and the Good Faith Estimate are not final documents, don’t worry too much about it. Just make sure that the HUD Settlement Statement is correct, otherwise you’ll have to redraw your loan!

The APR
Many borrowers ask why the APR is higher than the Rate. If you study and rehearse explaining the APR, you can save yourself the time and aggravation of calling the Lender only to find out they are not able to answer their phone. The borrower will feel a lot better, and you will have one less problem at your signing.

The Prepayment Penalty
Borrowers ask about their Prepayment Penalty all the time. Look for it either in the Note, or the Prepayment Rider if there is one (and once in a while there is) The borrower can read the terms themselves instead of being frustrated that they can’t find it.

Letter of Instructions
Consult the letter of instructions before beginning any loan. That way you will know what to do if there is a problem. There might even be phone numbers in the instructions.

Specific Questions
If a borrower asks a question that is specific to their loan, call the lender. If they ask a general question about what information is in what loan document, you should know. Study up!

The RTC
What if the borrower signs in the wrong place on the Right to Cancel? Just go to the borrowers’ copies and get a fresh copy. You just saved yourself a lengthy discussion with the Lender.

Errors on Certificates
If there is an error on a Notary certificate, this is purely for the Notary to resolve. Don’t get the Lender involved in your job as you should know your job.

When is my first payment due?
Look in the TIL, HUD, Payment Coupon, but don’t call the Lender unless you have to.

Power of Attorney Signings
Call the Lender regardless. Even if you know exactly how to sign, call the Lender to confirm. Power of Attorney signings are rejected 70% of the time in my experience even if they are done correctly.

If the names printed on the documents are spelled wrong
If there are any problems with names of signers on the documents, you should call the Lender. If the ID doesn’t match the borrower’s name printed on the document, you have a problem. The Lender might not care about what Notary law says, but does want to get the loan signed. If the signer is not comfortable signing the way their name is typed on the document, the loan will probably not fund otherwise, but you can call the Lender or read our section about the Signature Affidavit.

Missing docs or docs the borrower won’t sign
If you are missing any of the loan documents that normally appear in a package, sign the ones that are there, send them back, and call the Lender immediately upon discovery that you are missing a document. Or, if a borrower won’t sign a particular document, call the Lender. You can send it back unsigned at the top of the stack. Or, if the borrower wants to keep it and send it back after talking to the Lender, that is another common option.

Deceptive Fax Backs: The good ole’ bait and switch tactic

These days notaries are complaining about many things. There is the good old, “They never paid me.” Then there are those who got paid late. Cattle Calls with low-ball offers via email or text are a new source of notary exasperation. But, deceptive fax backs are another source of annoyance and grief.

Did I forget to mention the fax backs?
Notaries have been complaining about fax backs for a long time now. But, the types of issues I have been hearing about have been getting worse. It is common for companies to simply not mention fax backs, or to lie and claim that there are no fax backs. Then, later on, the notary will read the instructions and see that 50 pages of fax backs are required. What should a notary do at this point? Should they demand more money? Even if the signing company agrees, the notary will not likely get the extra cash. Should the notary just cancel the job knowing that they will never get paid for their extra 30 minutes of work? In my opinion, the way you handle this type of situation should be contingent on one fact — do you want to ever work for this company again? If yes, press 1 and do whatever they tell you to. If it is just not worth it in the long run due to bad past experiences, or it is below your well thought out standards then press 2 and tell them to forget about it because they did a bait and switch.

20 pages of fax backs will be necessary!
When negotiating fees, notaries want to know how many pages of documents will be in the package, and how many fax backs. It is typical for a notary to be promised a package of “about” 100 pages with 20 pages of fax backs. When they get the actual package it is 178 pages with 50 pages of fax backs. This happens more than you might think. The key to dealing with this is to have a policy that is well thought out that you create beforehand for how to deal with these types of situations.

If you are flexible, you will just do whatever the companies ask and deal with it.
If you have a lot of other things to do and time is tight, you can have your rate be based on a particular size of package, and then charge an additional rate for each additional page and each additional fax back. If the company signs a contract with you regarding your additional fees (which they will not likely do) then you are in business. However, many companies won’t pay your additional fees after the fact, so incorporate that sad fact into your policy.

Sample Fee Structure for notaries with 1000-3000 loans signed
Signings: $100 (eDocs not included)
eDocuments: $20 for first 100 pages per set; 12 cents for each additional page per set.
If the package is 200 pages, you charge them $32. And refused to work for them again until they pay this.
Fax Backs: $5 for first five, 50 cents for each additional.

Beginners Sample Fee Structure
Signings: $60
eDocuments: $15 for up to 200 pages per set
Fax Backs: Up to 25 included, additionals are 40 cents a page.
Beginners should price themselves low to get at least 500 signings worth of experience, and then consider raising their rates by $5-$10 if the market will tolerate that.

In real life, fax backs are mostly for complete beginners. And for them, I recommend that they just do it without complaining. Signing companies have no other way to ensure that the package was signed correctly. There are many notaries out there who don’t know what they are doing, and they have no way to know that you are the one notary who really does know what they are doing without fax backs, otherwise a half million dollar loan could be ruined which is not worth their risk.

Don’t work for them if they don’t pay the incidentals
If a company won’t pay for incidentals on extras that they didn’t tell you about up front, then don’t work for them again. If you lose too many customers, it is time to increase the number of pages and fax-backs that you will accept for your base fee. There is no right or wrong in rate structures. It is about charging what the market will bear, and not trying to charge based on what you think is fair.
