The Starbucks Oath Question

I created a quiz question for written quizzes about Starbucks. It is a very interesting and caffeinated question. Here it is…

A Notary goes to a signing.

The Affiant asks for an Oath on a document that is an Affidavit that reads, “I love Starbucks.”

The Notary proceeds to attach a Jurat…
and made a statement that was, “Do you solemnly affirm that you are the one who signed this document and that your name is John Smith?”

What did the Notary do wrong?

COMMON RESPONSES

1. Ask for ID?
Many Notaries feel the Notary should ask for ID. It is true that Notaries are responsible for identifying people. However, that is not central to this question and since the document, certificate, and journal entry have not been completed or stamped, that is irrelevant at this point. Unfortunately, Notaries tend to get sidetracked on irrelevant details that are not central to situations while missing very critical points that can get them in trouble. Talking about ID at this point would be going off on a tangent, especially if that is the only thing you mentioned — although in most states you probably would have to identify the signer.

2. Create a journal entry.
Yes, you should ideally create a journal entry. But, that too is not central to the question at hand.

3. The notary used Acknowledgment wording.
I have never heard of a state that makes you take an Oath while doing an Acknowledgment except perhaps that Massachusetts wants to make sure the signer signed on their own free will and makes them make some sort of statement confirming that fact.

4. Make sure the venue has the correct information.
This document has no venue, and Oaths in all states but Florida (not completely sure about this by the way) do not have certificates. Certificates have venues, but if you don’t have a certificate, you don’t have a venue. Oaths once again typically do not have certificates, and therefore do not have venues.

CORRECT RESPONSE

1. The Notary did three things wrong

(a) The Notary added a Jurat when he was asked for an Oath. Although Jurats have Oaths or Affirmations, Oaths do not have Jurats. Humans have diabetes, but diabetes does not have humans. So, please do not assume that an Oath has a Jurat. An Oath can be done as an independent notary act, and most Notaries don’t know this because they do not read up on Notary tutorials, nor do they ever do Oaths as independent acts. In fact, most Notaries do not do Oaths as part of Jurats either — they just skip over it and assume nobody will notice, or they think that filling out the subscribed and sworn written verbiage is the actual Oath (which is not true because Oaths are verbal by definition.) An Oath is a purely verbal act, however, in Jurats there is a written documentation that accompanies and documents the verbal act.

(b) The Notary gave an Affirmation when he was asked to administer an Oath which is bad for two reasons — one, because the notary did not do what he was asked and, two, because the notary CHOSE the Notary act on behalf of the signer which you are not allowed to do. Only the signer or client can choose the Notary act. So, what the Notary did looks like it is bad service, but also illegal.

(c) The statement the notary made was about the signature and the name of the affiant, but not about the content of the document. The Affiant asked for an Oath on their document, so therefore, the Oath should be made purely on the content of the document.

“Do you solemnly swear that this document is true and correct to the best of your knowledge so help you God?” — would be okay.

“Do you solemnly swear that you love Starbucks? — is paraphrasing and is okay assuming you don’t butcher the statement in any way that detracts from the logic of the statement.

“Do you solemnly swear that you love Starbucks, so help you the Starbucks Goddess.” — if you are politically correct and have multiple choice for what divine entity you want to swear to, you might be able to get away with this one. Read your state notary handbook and see if they allow swearing to the Starbucks Goddess, or as I call her — The Goddess of Caffeine.

Letter to California Notary Division

Dear California Notary Division,
I am someone who runs a Notary directory and is acutely aware of the deficiencies in Notary knowledge throughout the state and the nation. California Notaries are better than those in other states on average due to the excellent training, but the training does not cover practical aspects of the Notary profession. Additionally, there are issues with fees that need to be addressed.

PRETRAINING
As there are so many ethical violations out there among California Notaries, and misunderstanding of Notary law, it is clear that a longer and more comprehensive notary training is necessary. However, I also think that due to the incompetence out there, a few other pre-measures should be taken.

1. A IQ test should be administer to applicants. It can be a ten minute quiz. Notaries with low intelligence often bungle and misinterpret Notary laws which can lead to illegal activity and wrongful explanations to clients of what can and cannot be legally done.

2. A meticulousness test should be administered to Notaries to see if they can be orderly about conducting tasks which require multiple steps. Being a good Notary means filling out journals and forms correctly in their entirety, and a meticulous person is less likely to make errors. The majority of your Notaries are far from meticulous.

3. Following directions and ethics are some other problems that are common with California Notaries. How you test this is hard. You have to find a way to trick them into doing something right or wrong while they are being watched.

4. Preference to those with clerical, police, military, legal, mortgage, or settlement backgrounds might help attract better quality Notaries as those are professions that are normally high in terms of integrity, and clerical skills which are both critical in the Notary profession.

TRAINING
A single day course on Notary Public knowledge is not enough. California stresses theoretical knowledge and does not test on hands on aspects of being a Notary. When a Notary is out there in the field, they need to know how to handle various types if situations. Here are my detailed comments.

1. Oaths & Affirmations
Administer Oaths correctly and roughly half of Notaries in California do not administer Oaths at all, or not in a relevant and acceptable way. Here are some examples of irrelevant or wishy-washy Oaths.

(a) Many Notaries have the signer to swear to their personal identity rather than to the truthfulness of the document.
(b) Many Notaries make the signer swear they signed the document but not to the truthfulness of the document.
(c) It is common for Notaries use Affirm in an Oath when they should ideally use the verb swear.
(d) Many Notaries do not understand the term “administer” in the sentence “Administer an Oath to an Affiant.”
(e) Many Notaries use a court Oath for a witness asking if they swear to the truth, whole truth and nothing but the truth when the document does not necessarily reflect a whole truth.
(f) It is common for Notaries not to mention the document being sworn to when administering an Oath, hence administering an Oath that is regarding thin air.
(g) Most Notaries do not know the difference between a court Oath for a witness, a document Oath and an Oath for a statement that has not been made yet.
(h) Notaries need to be taught asking “Oath questions,” such as, “Do you solemnly swear this document is true and correct?” or “Do you solemnly swear that the statement you are about to make is true and correct?” Many Notaries will ask the Oath question about the statement, get a yes, and then not have the Affiant make the actual statement. This is why an IQ test should be mandatory and a result of 95 or higher should be required. Most of the problems I have with Notaries arises from low IQ’s and bad attitudes.

The handbook makes it clear that an Affiant must swear to the truthfulness of a document. However, there is no prescribed wording or guidelines. My solution is to have prescribed components of Oaths, but no official verbiage just to keep life flexible. At a minimum, in an Oath, the Affiant must use the word “I”, and then the word “swear”, mention the foregoing document, and make reference to the fact that they feel the document is authentic or correct. Using “affirm” was asked to administer an Oath means that the Notary has overided the client’s request to have an Oath which means that the Notary chose the notary act instead of letting the entity who is paying or swearing.

2. Fill out their journal correctly
Many Notaries are unclear as to how many journal entries should be filled out if there are multiple signers signing multiple documents. The 2018 handbook does not make it clear HOW MANY journal entries are necessary if there are multiple documents per signer all using the same Notary act. This should be clarified as it is an area of common misunderstanding. One journal entry per person per document is how I was trained. Additionally, the use of arrows for repetitive information in appointments with multiple documents per signer are discouraged now from what I have heard, but the handbook does not mention this. There needs to be a SINGLE SOURCE of notary law information and that source should be the handbook and not some bulletin or blog article or other supplemental sources (although those can help teach the materials in the handbook.)

3. Understand the components of notary forms including the “Additional information” section of an Acknowledgment which might not be legally required, but deters fraud by making it very detectable if someone swaps an Acknowledgment and puts it on a different document than what was intended.

4. Many Notaries do not understand how to handle requests that are illegal or seem illegal. Many Notaries will accept illegal requests while declining acceptable requests. This is due to poor training. So, training needs to focus on handling questionable requests. Many Notaries feel it is illegal to EXPLAIN the various notary acts to clients while it is not. It is illegal to choose for them, but not to explain them as far as I know.

5. Foreign language signers are an area of misunderstanding as many Notaries are not aware that they are NOT required to understand the content of the document but ARE required to have direct communication with the signer/affiant.

6. Many Notaries are unaware that the ID does not have to exactly match the name on the document but must PROVE the name on the document. Many Notaries take liberties and will Notarize a signature that says John W Smith with an ID that says John Smith, etc. It is common for Notaries to refer to the “more than but not less than rule” which is a rule created for Title companies and not a law which states that the signer can over sign their name to include more middle initials or names, etc. However, the Notaries who remember this law often do not care if it is legal to notarize a name that is over signed. It is not clear whether you can notarized John W Smith as John Smith if the ID says only John Smith. This is another common occurrence that needs to be clarified.

7. Credible Witness law is a little bit complicated and perhaps should be simplified. Most Notaries are unaware that the handbook states that the credible witness is the entity who has to swear to the fact that he/she believes that the signer cannot easily obtain an ID. Since the Notary has OFTEN seen an ID with the wrong name on it, how can the Notary ACCEPT an Oath from a credible witness that the Notary knows to be based on false information or made fraudulently regarding how the signer cannot find an ID? This law about CW is convoluted and a source of a lot of trouble. Close to NONE of your Notaries would be able to recite these laws by memory. Therefor, I suggest simplifying it because most notaries cannot learn it properly and the CW rules are convoluted and make no sense. Here is my idea of a better set of rules.

(a) A Notary can use the Oaths of two credible witnesses to identify a signer.
(b) The credible witnesses must either be immediate family members or know the signer intimately enough so they know his/her middle names without being reminded. (The law for how well you have to know the signer to be a CW is convoluted, wishy-washy, and useless currently.)
(c) The Oath for the credible witness should be, “I solemnly swear that the signer in front of me is legally named _____.”
(d) A CW can be used regardless of whether the signer has ID or not as names on ID do not always reflect the whole, complete or current name of a signer.
(e) A journal thumbprint must accompany all Notary acts done involving credible witnesses.
(f) The CW must not have any beneficial or financial interest in the document being signed.

8. Acknowledgment confusion.
(a) Box at top of page
Many Notaries get confused by the information in the box at the top of an Acknowledgment. Many Notaries feel that the signer does not have to verify the validity of the document where it says clearly that the Notary does not have to. It is better to clarify this point as many Notaries are lacking the gift of logical thinking which can cause a lot of confusion.
(b) Perjury clause in Acknowledgments
Many Notaries feel that the signer is signing under the penalty of perjury in an Acknowledgment where it is clear that it is the Notary who is filling out the form correctly under the penalty of perjury. This point is widely misunderstood and needs to be elaborated since there are so many who cannot think logically about this point.
(c) Notaries are often unclear about whether the signer has to sign in their presence. Since the signer must personally appear, Notaries misinterpret this to mean that the signer must sign while they personally appear which is not true in California. The signer can sign ten years ago, but cannot be notarized until they appear.
(d) Notaries are often unclear about who is acknowledging what in an acknowledgment. Many thing that the Notary is acknowledging that a signature is correct. This is not true. The signer needs to acknowledge that they signed a document in the presence of the Notary. This point needs to be clarified for your notaries because there is too much confusion and misinterpretation going on out there.
(e) The additional optional information on NNA forms should be REQUIRED by law on loose certificates as it deters the fraudulent switching of acknowledgments to other documents by virtue that it identifies the name of the document, number of pages, document date, signers, and more…

9. Chain of Authority.
Many Notaries work with Title companies regularly and think of the Title companies as their boss. Wrong! The state is not exactly their boss, but is the entity they have to refer to if there is a legal question. It is common for Notaries to ask Lenders and Title what they can and cannot do as a Notary. This is wrong. They will get either a wrong answer or an answer that benefits the Lender or Title both of whom have beneficial and financial interest in the documents being Notaries. This point needs to be drummed into the Notaries heads. The State of California should ideally have a Notary hotline because there are so many times when Notaries have questions about what they can and cannot do, and often late at night when help is not available. The point of a Notary is to ensure the integrity of transactions done involving signed documents. If the Notary cannot find out what the law says, then the notarization will not have any integrity. This is a very serious issue.

10. Hands On Training
Notaries take a written exam, but this is not really as important as practical matters. What is important is to have someone do hands on training and testing to see if the Notary can fill out forms, journals, administer Oaths, take thumbprints, use credible witnesses, and decipher between legal and illegal requests. A written test cannot do this.

SUMMARY

1. Notary training should be two, three or four days long for new Notaries with a refresher every year to keep everyone serious.

2. Notaries should be trained by hand to see if they can handle requests, explain terminology and fill out forms, etc.

3. Notaries need to be audited regularly. Not only journal auditing which you are already doing (super!!!) Auditing people by pretending to be customers and asking them to do Oaths, or asking them if such and such a notarization would be legal under particular circumstances will let you know which of your Notaries are acceptable and which are criminals. It takes work, but you are a prudent organization that values integrity and I believe you will do the work.

Should you use book wording for Oaths or improvise?

Most of our Notaries either don’t give Oaths or can’t give one without their cheat sheet. Some states have prescribed wording while others do not. The main thing when giving an Oath is to have them raise their right hand and swear to the truthfulness of a statement or a document.

If you don’t practice giving Oaths how will you know how to if you are put on the spot? You can experiment at home inventing Oath lyrics.

Do you solemnly swear you are a cyclops?
Do you swear you are crazy?
Do you swear that New York has bad traffic?

What I don’t understand is why it is so hard for Notaries to put together Jurat Oath verbiage from the top of their head. You need to say swear and refer to a document. Easy!

Another thing I don’t get is that I asked one guy to administer an Oath TO ME and he kept saying what he would tell THEM. I said, leave THEM out of it and just ask an Oath question to me so I can say I do, or I don’t. He kept telling me what he would tell them rather than following instructions and asking me an Oath question.

Oaths begin normally either with the phrase, “repeat after me,” or an Oath question. It is faster to ask an Oath question. Make it easy so they just say yes.

If your state has recommended wording, then memorize it. But, if you memorize an Oath without understanding the logic of what context it is used in, then it will not be very useful. You will probably use it at the wrong time.

14. Sixteen year old Samantha calls a Notary to notarize an Affidavit for her mom who does not speak English. The Notary arrives only to find out that he/she cannot communicate directly with the signing who is the mother. Samantha offers to translate as she does that on a daily basis for her mom. What do you tell Samantha? In 49 states, direct ORAL communication with the client is required REGARDLESS of whether the document is in English, has been translated, or whether the Notary understands the document. You cannot use an oral translator except perhaps in Arizona (check AZ handbook for an accurate answer). Refer Samantha to find a Notary who speaks their language.

15. John appears before you to sign a loan as an Attorney-in-Fact. He knows two verbiage variations for signing as an Attorney-in-Fact and wants to know which one to use. There are no written instructions. What do you do next? In this situation you have to call for instructions because POA verbiage is a matter of preference as there are eight legal verbiage variations for signing as an AIF. So, call the Lender or Title company in this case as the loan will not close if you did not use the verbiage of their choice!

16. Credible Witnesses.
Jim appears before you to sign an Affidavit. But, he has no ID. What do you do? Many states allow for credible witnesses. Some states require two CW’s who must both know the signer while others allow for one that must know the notary and the signer. 17. Name two situations where you might need subscribing witnesses. Subscribing witnesses are witnesses that watch someone sign their name on a document. They are used for Proofs of Execution (look this one up in our Notary Acts section) and for Signatures by Mark or Signatures by X which is allowed in certain states (look up in our glossary.)

18. The document is written in a language that the Notary does not understand. All states except for AZ require direct oral communication with the signer. However, written comprehension is a different ballgame and is very state specific. California only cares that the Notary notarizes the signature and doesn’t care if the Notary understands the document although the signer must understand what they are signing. However, other states can vary. Does your state require you to be able to read the language the document was written in? Look this one up in your handbook as we cannot help you in this matter because we don’t know!

19. You have been instructed to notarize a form that does not have a certificate.
You are at a notarization and the instructions say, “Notarize this page.” However, there is no certificate wording on the page. What do you do now?

The Notary may not choose the Notary act as that might be construed as UPL. So, just ask the client or signer what act they want and then attach the corresponding certificate to the document. That’s all.

20. Deeds of Reconveyence.
You go to a signing and one of the documents is a Deed of Reconveyance. Under the signature line has the word Trustee. Who is the Trustee, and do you notarize this document?

The Trustee is normally the Lender, but could also be the borrower if he has a company and is lending money to himself in another capacity. The Trustee could be anyone, so without specific instructions you should probably not have this form signed or notarized.

Notary Public 101 — Review Quick Pointers

Here are some review pointers. Rather than teaching in index format like I usually do, these are quick facts you need to know. Besides those other facts your embarrassed parents thought you didn’t need to know.

An Affiant is someone who signs an Affidavit and swears under Oath. A Harvey Weinstein is someone who signs a check to a woman to hush her up and swears under his breath.

An Attorney in Fact is another way of saying Agent or Grantee for a power of attorney. An Attorney in Fiction is another way of saying Perry Mason.

A certificate is a form a Notary uses for executing Acknowledgments, Jurats, and other Notary acts that require a certificate. Florida and Texas use certificates for Oaths while most other states do not. You can buy certificates in pad format from the NNA and other vendors. You should keep these in your notary bag at all times because you WILL be using them.

A Principal is the main person who signs an Power of Attorney or who is signing a document that is notarized using the Proof of Execution procedure. It just means the main person who signs a document. Consider it your Notary bag of tricks. The other kind of principal is the person you’re sent to when you’re caught chewing gum in class. Memories!

The Venue is the part of the certificate where you document the state and county where the notarization is taking place. It is also the physical location where you might be at any point in time, especially during a notarization. On the other hand, if you pick up a Notary in a bar, the venue could be your place or mine.

In an Acknowledgment, the signer must acknowledge having signed a document in the physical presence of the Notary Public, but does not need to sign in front of the Notary (although Lenders prefer that they do.) Some lenders I know also prefer that the well-known phrase, “Neither a borrower nor a lender be,” NOT be acknowledged, because it would mean they no longer be!

In a Jurat, the affiant or signer must sign and swear to the truthfulness of the written statement or document in the presence of the Notary which is evident based on the Jurat wording, “Subscribed and Sworn to BEFORE ME.” Note that acknowledgments do not include the before me part when referring to signing. They also don’t include any swear words, so the “sworn to me” part is confusing.

Your Seal must be clear, complete and not smudgy and not have light or missing corners or you will be hearing from the county recorder and might have to redo your work. Seals may look smudgy even if they aren’t, if you forgot to wear your contacts.

It is illegal to omit an Oath or Affirmation when executing a Jurat. Many Notaries say that they never have to administer Oaths in their state. I’m not sure whether or not to believe them. But, you need to know how to do an Oath if you see the words, “Subscribed and SWORN to before me.”

Oaths begin with the verbiage, “Do you solemnly swear…” If you omit the term swear, then the proceding is not an Oath. Oaths are made under God while Affirmations are made on your personal honor. If you’re Harvey Weinstein, the personal honor part doesn’t apply. I affirm that will be my last Harvey Weinstein joke.

Affirmations use the verb “affirm” or “state” but not swear. If you swear it is not an Affirmation and if you affirm it is not an Oath.

Oral statements do not get the same Oath as a written document or statement. Do you solemnly swear that the statement you are about to make is true and correct is a good Oath verbiage for an oral statement, but would be completely wrong for a document Oath for obvious reasons. Don’t let the fact that oral hygiene is good and documented hygiene is also good confuse you.

In your Notary Journal create one entry per person per document. If there are two signers each signing three notarized documents, then enter six entries. Each one signed by the corresponding signer. And keep journal thumbprints just in case someone gives you a fake ID. (If you’re a liquor store owner and someone gives you a fake ID, give them your thumbprint down!) Keep additional notes if there is more than one document with the same name such as escrow numbers, addresses, or anything to distinguish the documents.

The purpose in keeping a journal is not so much to please your state although many states require this, it is to please the FBI & Judges as they will be the ones inspecting your journal if something goes wrong. (However there’s no pleasing some people, like my old girlfriend who complained when I had the toilet paper roll under, not over, and also when I had it over, not under.) California audits journals from time to time too and they will suspend you if you keep a bad journal or no journal.

If the identification does not prove a person’s identity then that is a questionable and possibly illegal notarization. Think of all the trouble you could get yourself into taking liberties notarizing. You could end up in court as a defendant. The ID does not have to exactly match the signature, but the name in the signature must be provable based on the ID. i.e. the ID says John William Smith and the signature on the document says, John W Smith — then it is provable and you should be okay. If your ID says “John Doe” and you’re checking into a hotel with a harlot, it isn’t provable but you should be okay if you wear protection.

Identification for the purposes of notarization should be government issued photo ID’s and be current (some states have exceptions to the current part.) A Social Security card or AKA statement is NOT acceptable for a Notary to use to identify a signer or verify a middle initial. If Social Security runs out in 30 years, you can use that to identify millennials’ middle fingers.

A thumbprint is the most unique and reliable way of identifying someone as a supplemental form of identification. Use a photo ID as a primary ID and thumbprint in your journal. That way if you are ever investigated you will have hard bio-metric data to find dangerous criminals. If the criminal had his thumb blown off, you’re on your own.

When doing a POA signing with an Attorney in Fact, there are multiple ways an AIF can sign. John, as attorney in fact for Sue. Sue, by John her POA, etc. To choose the right variation is NOT YOUR JOB. There are perhaps eight legally acceptable ways of doing the verbiage. It is up to the LENDER to decide which variation they want. Rely exclusively on them for this as choosing a variation is a matter of preference, and the loan will not go through if you goof on this. If you goof on your younger siblings, it’s perfectly normal.

Do NOT send loose certificates in the mail. You could end up in jail as it could be attached to anything. Certificates must be stapled to the document they correspond to — period! Do not send loose women in the mail unless she’s going to Harvey Weinstein. Darn! Okay, I promise, that’s the last Weinstein joke!

Do not ask Lenders or title people for notary advice. They will tell you what they want you to do which is often illegal and for their short term benefit. Rely on your state government and NNA’s hotline for reliable Notary knowledge. Other people are NOT experts at Notary law and might lead you astray by accident or for their convenience. Don’t trust anybody except Santa Claus and the Tooth Fairy. They don’t exist? Okay, don’t even trust them!

Notary Public 101 — Certificates

NOTARIAL CERTIFICATES

There are certificates for various types of Notary acts. Acknowledgments, Jurats, Proofs of Execution. Some states even have certificates for Oaths and Affirmations. Let’s focus on Acknowledgment Certificates for now.

There are various parts of an Acknowledgment form.

(1) The venue. The venue is normally on the upper part of a certificate. In California now there is some verbiage in a box that I am not trained in. But, above the boiler plate wording there is a venue which documents the county and state. Is a venue the county where you did a transaction or two lines of information in a form? Both! However, the documentation of the venue is the one in the certificate and it is informally called the venue and not the documentation of the venue.

(2) The date. The date is a field the Notary is often held responsible to fill in. The date falls into the area of the boiler-plate wording of the form which is standardized wording from your state or perhaps another state.

(3) The names of the signers. As a Notary, you need to input the names of the signers or affiants into the Notary certificate if required. Sometimes it doesn’t make it clear whose name goes in the form. If it says, “Subscribed and sworn to before me by,” then after the “by” put the name of the affiant or signer otherwise you will ruin the form.

(4) The name of the Notary. The name of the Notary once again is entered into the boiler-plate wording area.

(5) Pronouns, singulars and plurals. Each state has a different wording for Notary certificates for each act. However, it is common and typical to have some sort of Notary verbiage that includes he/she/they executed the instrument, his/her/their signature(s), or his/her/their authorized capacity(ies). The critical thing here is to cross out the incorrect words and leave the correct wording. If you do a notarization for John, then cross out the her and their and the (s) assuming John only signed once. If you do a signing for Bruce Jenner then use a special form called the T-acknowledgment which says he/she/it’s complicated/they

(6) Testimonium Clause. Where it says “witness my hand and official seal,” that is called the testimonium clause. Below the boiler plate wording is the signature area where you sign and then affix your notarial seal. And by the way, “Locus Sigilli” means the location of the seal.

CHANGES TO CERTIFICATES

Making any change on a Notary certificate is messy in my opinion. You can consider crossing out and initialing wrong information. Remember that ONLY the Notary can initial or write on the certificate forms and the signer cannot touch it. However, it is cleaner to create a new certificate using an Acknowledgment that you get from a pad that you keep your Notary bag. That way you can start all over, fill the form out correctly and then staple it to the document in question.

ADDING LOOSE CERTIFICATES

If you notarize a document that either does not have acceptable Notary wording or doesn’t have any Notary wording (or wrong information on the form) then you might want to add a loose certificate from your pad of certificates that you purchased from the NNA (recommended). Additionally, if there is no room for your seal in some pre-existing Notary verbiage, you might be forced to add a certificate for logistical reasons.

If you add a loose certificate, the certificate must be filled out thoroughly. This means that in addition to the legally required verbiage, you fill out the ADDITIONAL INFORMATION section. The additional information section includes:

Document name — if you don’t put the name of the document on your loose certificate, it might be unstapled and added to a wrong document by accident or on purposes.

Document date — if you don’t put the document date, your certificate might be added to a different document with the same name by accident or fraudulently.

Number of Pages — if you put nine pages, then it will be hard for a fraud to swap the certificate and put it on a similar document with eight pages.

Other Signers — You can name the other signers on the document.

Capacities — California no longer allows this, but you can mention if any of the signers are signing as Attorney in Fact or some other capacity.

EMBOSSERS

Cautious Notaries often use an embosser when notarizing. You can use an inked seal and also a non-ink embosser that leaves a raised seal. If someone photo copies your certificates, the embossed impression will not show up in the photocopy. Additionally, you can emboss each page of a document to discourage page swapping.

AUTHORITY

If there is a disagreement between a Title company involved in a transaction and a Notary regarding what venue or information goes in an Acknowledgment or Jurat certificate, the Notary has absolute authority. The Notary may ask for the Title company’s preference if there are two legal ways of doing something such as crossing out and initialing vs. adding on a loose certificate if there is an error. However, it is the Notary who is legally responsible for filling out the form and it is the Notary who will end up in court if there is a problem.

WHO TO ASK FOR HELP WITH CERTIFICATES

If the Notary does not know what to do when filling in forms or notarizing, do NOT ask the Lender or Title companies as they have a beneficial interest in the transaction AND because they are not experts in the field. The tiel rep might be a Notary, but not necessarily in your state, and not necessarily an informed Notary. Title and Lenders will typically tell you whatever it takes to get the job done whether it is legal, recommendable, safe, or kosher, or not. They don’t care just as long as their loan goes through and YOU, the Notary are the one who gets locked up if you did something illegal just as long as it is your seal on the page.

Notary Public 101 — Basic Notary Acts

BASIC NOTARY ACTS

Each state has a different list of official Notary acts. Some state handbooks don’t make it clear if certain actions are considered “official” notary acts or not. However, all states or the vast majority have Acknowledgments, Jurats, Oaths, and Affirmations. Many also have Protests and Proofs of Execution, while only a few have Witnessing, Attesting, immigration form filling, and depositions as acts. There are a few more acts I will not mention as they are obscure and very state specific. Let’s focus on the main acts that we will hold you responsible for knowing.

ACKNOWLEDGMENTS

When I studied to be a Notary, my teacher said you Acknowledge a signature, Execute a Jurat and Administer an Oath. This is not true. The Notary is not the one who acknowledges a signature. The SIGNER acknowledges the signature and then the Notary CERTIFIES that the signer acknowledged the signature by virtue of filling out the Acknowledgment Certificate. Here are some basics on Acknowledgments.

1. The signer acknowledges having signed the document.

2. The signer must physically personally appear before the Notary for such an act.

3. The signer does NOT have to sign before the Notary according to most if not all states such as AK, IA, SC, SD, VT, and WV. Lenders might require the borrower to sign in the presence of the Notary, but that is a particular Lender’s standard and not necessarily a state standard or even a best practice.

4. The Notary must positively identify the signer using identification documents acceptable to their state which normally include Drivers Licenses, State issued identification photo ID’s, Passports, and Military ID’s. Other ID might be accepted on a state by state basis and you can look that up in your handbook. Also, see our section on identification.

5. The Notary should ideally keep a journal entry of all Notarial acts even if their state does not require this.

6. There should be Acknowledgment wording appropriate or acceptable to your state inscribed within the document, or you can attach a loose acknowledgment form with a staple.

7. After you fill out the certificate form, you sign and stamp the page (some states allow you to write in your seal information without a stamp.) Make sure your stamp is clear and not smudgy otherwise the county recorder has the right to reject the Notarization.

8. Note — some states require the Notary to ask the signer to attest to the fact that they signed in their own free will. Please be aware if your state has any unusual requirements or special wording on forms.

9. A California Notary faces many restrictions as to what type of out of state forms they can use. Please check the California Notary Handbook to see what you can accept and what you can’t otherwise you could get in trouble particularly if it is a recorded document.

JURATS

Jurats are a Notary act where the signer or affiant by definition signs and swears (and/or sometimes affirms) before the Notary. Jurat wording differs from state to state. However, some basic verbiage includes the phrase, “Subscribed and sworn to before me.” What does this mean? This means that the document was signed in the physical presence of the Notary Public as well as sworn to before the Notary Public at the signing. In an Acknowledged signature you can sign prior to seeing the Notary, but you acknowledge before the Notary. A Jurat is completely different. Modern verbiage for Jurats sometimes says, “Subscribed and sworn or affirmed to before me.” This does not mean that you can administer an Oathfirmation and mix the Affirmation and Oath verbiage. This means that you can have the client choose if they want an Oath or Affirmation and do one or the other. Don’t mix these Notary acts unless your state specifically says you can.

Many Notaries are unaware that when executing a Jurat, you do need to administer an Oath particular to the document being signed. Please see our commentary on Oaths below. Failing to administer an Oath on a Jurat is illegal and could void the legal completeness of the document. Some states additionally will reserve the right to suspend your commission if you omit a legally required Oath.

“Subscribed and sworn to before me” is NOT Oath verbiage! That is the written documentation that you gave an Oath. When you ask the affiant to raise their right hand, do NOT utter the words, “subscribed and sworn to before me.” otherwise they will think you are an idiot and there will be no way for them to respond unless they repeat. Start an Oath with, “do you solemnly swear” after they have raised their right hand.

A good Oath for a document could be, “Do you solemnly swear under the penalty of perjury that the information in this document is true and correct to the best of your knowledge, so help you God?” Then the other person says, “I do.” Then you pronounce them “man and document” by the powers vested in you.

OATHS

Not all Notarial acts include a written document or written certificate. Some are purely oral. Oaths and Affirmations are oral acts where most states do not have a certificate for the Oath. You should write in your journal if you administered an Oath and where it says, “Name of document” you should write that you gave an Oath about a particular topic. You do not write the actual verbiage of the Oath in your journal. You might write, “Oath regarding military duty” or “Oath of citizenship,” etc.

Oath verbiage is generally up to the Notary and few states have any actual requirements for what you should say. However, common sense and tradition dictate certain things about Oath verbiage.

Raise Your Right Hand — you traditionally have the signer raise their right hand before swearing under Oath.

Solemnly – it is traditional to ask the signer if they solemnly swear. An Oath is a solemn occassion and swearing to a Notary is as official as swearing to a judge in a court of law.

Swear — you must use the word “swear” in an Oath otherwise it is no longer an Oath.

Document or Statement — in an Oath you should make a reference to the content you are swearing to. It might be a document, or a statement you are about to me. Just make sure you reference the content in a way that makes sense. Asking someone to swear to “the information” is not as precise as asking them to swear to the truthfulness of “this document” while pointing to the document.

God — Oaths traditionally refer to God. If someone doesn’t like God, rather than remove God from the Oath, do an Affirmation INSTEAD of an Oath.

Correct Oath wording for a Notary to make for a Document
“Please raise your right hand. Do you solemnly swear that the document you signed is true and correct to the best of your knowledge, so help you God?” — The answer would be, “I do.”

Wrong Oaths for a Document
“Do you solemnly swear that the statement you are about to make is true?”
“Do you solmenly swear that the information you provided is true?”

Commentary
If you are swearing to a document there is no statement you are about to make. There is a document you already signed that you swear to. You cannot swear to a statement you are not going to make — that is nonsense. The information in the document might have been provided by a Lender or Attorney, so don’t make them swear to WHO provided the information. Just have them swear that it is true.

Administering an Oath
When you are a Notary and you give or supervise an Oath to someone, you are administering an Oath. When you administer an Oath there are two ways to do it. You either ask an Oath question such as the ones mentioned above, or you say, “Repeat after me.” Repeating after me is really tenous as every three words the affiant has to repeat those words and it is like being six years old doing the pledge of allegience. How annoying!

AFFIRMATIONS

An Affirmation is similar to an Oath. The are equal in their significance and used during the same situations. Affirmations are legal in most states. Check your state’s handbook to see if they are used in yours and if there is any state specific wording that you must use. However, you cannot mix and match the wording in an Affirmation. If your client wants to do an Affirmation, you use the word Affirm or State rather than swear, and you do not mention God. Leave God out of it! Other than that, the verbiage is the same as an Oath, so help you nobody!

To administer an Affirmation for a document just say, “Do you solemnly affirm or state that the information in this document is correct?” or for a purely oral statement just say, “Do you solemnly affirm or state that the statement you are about to give is true and correct?”

PROOF OF EXECUTION

Not all states allow proofs of execution, but it is a traditional Notary act that I would like you to know about. In a proof of execution, the principal who is the one who signs the document signs when a subscribing witness is witnessing his signature. The definition of a subscribing witness is one who watches someone else sign. Then the subscribing witness appears before a Notary and swears under Oath that he/she witnessed so and so signing the document. I have never heard of this act being done, but for less formal documents, it is often allowed and it is interesting to read about as it is so unusual.

PROTESTS

Not all states have protests. Protests are normally done by people working in banking to protest the non-payment of a bill or bounced check. We do not hold our Notaries responsible to understand this act although it is good to know what it is.

Notary Public 101 — Basic Notary Vocabulary

Affiant
An Affiant is a person who will swear under Oath and is commonly used to refer to someone who is signing an Affidavit. A Defiant is a person who swears under a tunnel when he loses the AM reception of a basketball game he bet on.

Affix
When you attach something to another thing that is considered affixing. But, in the Notary profession when you stamp something with your seal that is also called Affixing. If you forget to stamp a document you notarized and title finds out, you will really be in affix (a third usage of the word.) When you attach someone with another person, that’s called fixing up.

Agent
Someone who has received special powers from a Power of Attorney signing is called an Agent or Attorney in Fact and also referred in the document as a Grantee. Someone who’s received special powers to go fight crime is called a superhero.

Apostille
An Apostille is a Notary procedure or act that involves both the Notary and the Secretary of State where the Secretary of State officially verifies that the Notary used in a transaction is indeed a real and current Notary in good standing. This procedure is used when sending certain documents outside the country and Authentications are also used to send to other particular counties. If you’re a real and current notary who gave up your seat on the subway for an elderly person, you’re good, standing, in good standing.

Attorney in Fact
The person who receives Power of Attorney is called an Attorney in Fact or Agent. When this person signs on behalf of the principal they sign: John Smith, as Attorney in Fact for Sharon Smith. There are other versions for how to sign as an Attorney in Fact. The person who receives power of X-Ray Vision is called Clark Kent.

Borrower
The borrower is mistakenly referred to as a “client” or “customer” by newer Notaries. The borrower of a cup of sugar is mistakenly called “neighborly.” The signing company regards the title company as their customer while the signer of the loan is called the borrower in oral language. Please also distinguish between a loan signing notary who supervises the signer and is not himself a signer although many Notaries refer to themselves as signers as a professional designation. The Notary Signing Agent is a signing facilitator, not an actual signing in real terms. The borrower can also be referred to as a Mortgagor who borrows from the Mortgagee (the Lender).

Certificate
A Notary Certificate could be a loose piece of paper attached to a Notarized document. (An unattached loose piece of a** would rather be called promiscuous.) A Jurat could be on a loose certificate where the Affiant writes a statement that they will swear to and sign in the presence of the Notary. Not all Notary acts use a certificate such as purely verbal acts such as Oaths and Affirmations and in some states Witnessing. Please understand that although a Jurat uses an Oath as part of the act, that an Oath by itself does not use a certificate. Some also swear that Donald Trump is a true copy of The Annoying Orange.

Copy Certification by Document Custodian
Some states allow for document copy certifications to be an official Notary Act. Some states only allow for a certified copy of a Power of Attorney. However, the Copy Certification by Document Custodian is an unofficial copy certificate and a glorified Jurat with special additional verbiage where the document custodian swears to the fact that the copy is a true copy of the original document.

Grantee
A Grantee is a term used to refer to someone who has been given something such as Power of Attorney agent privileges. The actual Power of Attorney document uses this term to describe the future Attorney in Fact or Agent.

Grantor
A Grantor is a term used to describe someone who has given Power of Attorney privileges by naming an individual as Attorney in Fact or Agent in a Power of Attorney document. A take it for granted-er is a term used to describe someone who knows his wife will throw his dirty laundry in the hamper.

Principal
The main signer of a document could be refered to as a principal. This is the Grantor in a Power of Attorney signing although the two terms are not synonomous. A Principal is also a term used in a Proof of Execution signing and is the person who signs the document. Another proof of execution: Kim Sung Un’s uncle’s tombstone.

Subscribing Witness
A witness who watches someone sign is called a subscribing witness. A witness who watches somebody else’s Netflix is called a non-subscribing witness. The Signature by X procedure uses a subscribing witness who is also commonly referred to as a credible witness meaning a witness who can be trusted. Proofs of Execution use a subscribing witness as well to appear before the Notary Public on behalf of the principal who is the person who signed the document. The Signature by Ex procedure is commonly referred to as divorce papers.

Venue
The venue is the part of the Notary certificate generally near the top that is used to state the state and county. All states have a venue somewhere in the top third of the certificate for all Notary acts that use a certificate such as Acknowledgments, Jurats, Proofs of Execution, etc. A venue is also the place where the notarization takes place. If you change the venue, does that mean you get up from your chair and go to a different address or does it mean you cross out and initial the venue in the Acknowledgment form. I’ll leave that to your imagination. The venue in my brain that conjured up that question is now closed.

Airline meals verses Notary Oaths & Affirmations

Have you ever wondered what airline meals have in common with Notarial Oaths? More than you think. In the old days airlines would only have one choice. The choice would normally have meat, and a few sides. Those were the good old days when women stayed at home and men supported them, and children had fathers. But, we solved the problem of children having fathers (so old fashioned and unnecessary.) Now, we are all the more wiser and realize that children do just fine without a live-in father and don’t need school prayer either. What a waste of time. Additionally, we have stopped reproducing for the most part which is another way to solve our sociological problems.

On the other hand, a preacher from Tennessee on television says, “If God goes out, then the Devil comes in… Since we have stopped prayer in school, there has been an upsurge in drugs, teen pregnancy, violence, and the list goes on…” But, I digress.

Now, you can get the regular airline meal, vegetarian, vegan, gluton free, high fiber, and about ten other choices. Singapore air even has some good Asian delicacies (yes please!) But, let’s get to the point of this article. It does have a point, right?

AIRLINE MEALS

Let’s say that on Trans-Notarial Airlines you have two choices of a meal.

(1) THE REGULAR MEAL: which has a chunk of certified angus beef, two veggie sides and an embossed oreo plus a can of Affiant Cola. And then, there is

(2) THE VEGETARIAN OPTION which gives you the broccoli with tofu, their signature salad, corn, chocolate cake and a drink.

The problem is that the Notaries who ran Trans-Notarial Airlines thought they knew everything about notary food law, but didn’t. What the Notaries did was to offer vegetarians the regular meal, but remove the meat. The Notaries did not know that there was a vegetarian meal since they had not been trained.

Similarly, Notaries are unaware that most states have an OATH and an AFFIRMATION. The affirmation was created or invented as not to offend those who did not want to mention God or swearing. But, what Notaries often do is to administer an Oath, but remove the required Oath verbiage of “swear” and “God” as to please the politically correct and religious zealots instead thereby bastardizing an Oath rather than administering an Affirmation. The other mistake Notaries make is to only do Affirmations when legally they might (are likely to) be required to offer a CHOICE of acts.

MY RECOMMENDATIONS

Offer your clients a choice of an Affirmation or an Oath in a Jurat execution or if they want a purely oral sworn statement. It is their choice, so you have no place choosing for them. It is the same as offering a choice of the regular meal or the veggie meal rather than giving the regular meal without the meat. Where’s the beef? My opinion is that if you leave God out, the devil comes in. So, when you administer a sworn statement to me, don’t forget the God part. Without him/her, we wouldn’t even exist! And for New York Notaries, I recommend not doing Affirmations with the cab drivers because cabbies prefer to swear!
