Being a new signing agent vs. wannabe player

It is a sad state of affairs when I make this comparison, but yet there are many parallels.

The new signing agent who is on solid ground studies from the best, passes tests, writes nice notes sections on his/her/their listing, and never misrepresents themselves. There are people like this who come across as very professional even though they have no experience to speak of.

Then there are the phony sounding Notaries who try to hype themselves up. They say words about themselves that make them look like they are — all that, but the way they come across is as an amateur and a phony. It is a shame. I deal with people like this all day and I am tired of it. Keep it real please.

Here is what the new signing agents say and what the wannabe players say.

I have a zero percent error rate
Baby, I got what it takes. I could satisfy you.

But, if I do make a mistake — in that unlikely event, I will fix it right away.
Baby, I’ll love you forever, but if something happens, I know how to deal with it. I’ll figure it out.

I have signed every type of loan
Baby, I’m down with all the flavors, and I’ve had them all. Every description, every type, girl.

But, in real life the ones who claim they have signed every type of loan have only signed every type of loan that THEY have heard of which is very far from the ones on my list. I have 40 financial package types on my list. The ones who said they do all average only about 35% of the loans. But, one of 5000 notaries on the site got almost all of them, so when you say all, there is a sliver of chance you might be telling the truth.

But, why come across as phony when you can be helpful and factual with the information you give to others? Facts impress. People who deal with notaries all day long not only see through the fluff, they are a lot less likely to deal with a fluffer, in fact. Is there such thing as a fluffer?

If you are new, just answer questions, and don’t try to impress people. The minute you try to impress, you blow it. Just be helpful, without trying to help.If someone asks if you are still in business — don’t ask when the job is, and don’t tell them you are on vacation – just say yes or no. Being factual is easy – just stick to the facts. Answer numerical questions with numbers, yes no questions with yesses and no’s, and keep it real. Don’t tell people about your zero percent error rate — nobody believes you and nobody has time for that.

Notary loses NNA certification due to speeding tickets

I think I have heard it all now. But, to get NNA Certification, you need to successfully complete their background screening. Apparently, we no longer live in a free country. Big brother is constantly watching you, and the citizens like this — at least most of them. If you fail your background screening you can lose your certification as well.

I heard that another Notary suffered the same fate.

In real life, the way our industry works, is that the newer Notaries typically go for the NNA Certification and LSS and perhaps some of the other certifications. As Notaries progress in age and experience they drop the other certifications and keep the NNA as that is the biggest name in the industry.

But, many Notaries when they have ten or more years of experience think they no longer need to keep up their certifications. I learned this by going through people’s notes sections and contacting them regarding omissions of what I think belongs in a notes section.

The most important thing you can discuss in your notes is your notary experience, and the second are your designations — assuming you have any. Fidelity, RON, other title companies, signing agent certifications — they all look good on your listing. I recommend having as many as possible, especially the less common ones because that will get you more clicks.

I study what gets Notaries ahead, and designations are part of it.

So, for God’s sake — don’t speed, or you could lose your designations (certification).

My response to NNA’s article: Is the Notary industry overcrowded?

My opinion on this matter is that there is a lot more notary work than there used to be. The crazy ups and downs in the economy, people losing their jobs due to covid related causes and getting new jobs. People escaping from certain areas and moving to other areas. All of this transitioning necessitates a lot more Notary work and Notaries. And yes, there are more Notaries out there than before. When people lose their job, the first thing that goes through their head is whether or not to become a Notary — or so it seems.

However, for the last eight or so years, new notaries and old alike lack the willingness to master their trade and become experts. Many take classes and pass tests. But, when I test them on actual notary or situational knowledge, few can get more than 80%.

So having lots of poor quality notaries who can’t even administer an Oath properly is not overcrowded. The quantity of what I consider to be qualified Notaries is as sparse as the population in Northern Alaska in between sled dog races. Actually, I think those races are in central Alaska along the biggest river when it freezes over. And the Northern lights are good in both places. But, I digress. What was I writing about again? Ah yes — Notaries.

POINTS IN THE NNA ARTICLE DISCUSSED

The author of the NNA article says that many Notaries claim that there is not enough work to go around. Qualified Notaries are not making this claim. They claim that there is not enough work that pays what they want to go around. Notaries with no name recognition, no skills to speak of and no experience would not get much work even if there were enough work to go around. I understand the author’s point, but when you look at the situation a little below the surface it looks very different.

The author states that RON or Remote Online Notary work creates new opportunities. This is a very true point. However, RON work is feast or famine. The 80:20 rule of Real Estate where 20% of the agents get 80% of the work applies to RON, if you change it to the 99:1 rule. It seems that the applications and sites catering to RON work favor the very solid Notaries who have seniority and know what they are doing. A handful of Notaries are cleaning up where the majority are lucky to get even one job. So, understanding RON from a business perspective is complicated and it does not provide work for the masses.

The author recommends: use the support of your fellow Notaries. Yes, this is a great idea. However, any successful notary who teams up with others will be very picky who they choose or their reputation will go down the drain. If a new Notary thinks they can partner up with an experienced Notary with a good customer base, this is very unlikely unless you developed a stellar reputation or are very socially close to the experienced Notary. But, in the long run, networking is a good idea. I did it for years, and many Notaries on 123notary do it too. Networking — it’s a good idea, but there are catches and many considerations.

The author recommends: Network with local businesses that need notary services. Once again, another good idea. But, this is an idea you should be using anyway regardless of how the notary market is doing. Call up local businesses. Or drop by and give them your card. A certain percentage will use you, so go to lots, and have lots of cards.

Then the author recommends: Find opportunities outside of your local area. This is what I recommend too. It is called widening your net. You should do that in any case whether business is fast or slow if the price is right or if it is for a client you like enough to drive. This point is a good one, but has nothing to do with overcrowding.

SUMMARY
I feel this particular NNA article is helpful, but is a general marketing article with a title that is specific to a particular type of market condition that the article does not address. The fact is that for years, the NNA has been outstanding at marketing to new Notaries, getting them on board and turning them into signing agents. Many of these Notaries are Realtors, Insurance workers, Mortgage and Escrow people, etc. NNA tends to attract a good crowd and a big crowd and floods the industry with signing agents. However, how many of these signing agents can pass a tough notary or signing agent exam? The answer is very few. And the reason is that people since about 2013 (yes I noticed this), have become lazy and don’t want to study hard. Even people with four different certifications don’t like to study hard. This is hard to believe but it is my experience.

Commentary on NNA’s post about accepting tips

In the NNA blog, they published a very nicely written document about whether or not it is ethical to accept tips as a Notary Public. The law seems to omit covering this point.

An improper influence?
NNA’s position (I can see them asking me to not mention them in my blogs within hours of when this is published, but here goes) is that you should NOT accept tips as it could be seen as an improper influence.

Here is my commentary

In-house services
If you are providing in-house Notary services, there is a state maximum for which you can charge. In california it is $15 for an Acknowledgment or Jurat. You cannot ask for more than that. If someone gives you a gift of an extra tip, it seems a little questionable to me. On the one hand you are in the clear in certain ways since you did not ask for that extra money. On the other hand, you violated the maximum fee in a sense. In this situation, I agree with the NNA that it would be better not to accept a tip.

Mobile services (not called out-house unless you really need to go.)
If you are providing mobile notary services and your state doesn’t have any Marxist restrictions on your liberty to determine your own pricing, in my opinion, the customer can offer you any type of tip they like. You are not restricted in any way as there is no price fixing for mobile work in most states (there are nine states or so that do have restrictions.)

Any small tip could be construed as an influence, one perhaps for more favorable scheduling and service next time around. However, it doesn’t seem credible as a bribe to be coerced into doing something illegal or unethical like backdating or falsifying someone’s identity. Bribes for those types of illegal services would be in the tens of thousands and not an extra $5. An extra $10 is an innocent way of saying thank you and we value you, not a bribe.

One of the greatest joys as a mobile notary is to get one of those wealthy, generous and charismatic clients who is flamboyant in the praises and gifts that they give you. If you are a Notary who makes their life easy and pleasant, you deserve those gifts in my opinion. Notaries have been given gift certificates, movie passes, boxes of chocolates, and more. As an in-house Notary, it is slightly questionable and “safer” as the NNA claims not to accept this gift. But, it is not illegal to accept a gift from someone and you might offend them or hurt their feelings if you don’t.

So, I respectfully agree, while disagreeing with the NNA on this issue, but I do respect their correct idea that it is “safer” not to accept gifts. It’s also safer for a ship never to leave the harbor, but then what good is it being a ship if you just sit there collecting barnacles?

NNA’s Facebook page has been off the hook since November

For a long time, perhaps years, Facebook pages for Notaries have been dead other than the private discussion forums which seem to be where the buzz is these days. But, I was just on NNA’s Facebook and they are having questions for the visitors to answer and getting a lot of interaction. The interaction is not just on one or two posts, but on many. So, this is a good sign that the industry is finally turning around!

I have someone really good managing our Facebook page. We have many members, but the Buzz has declined although it is picking up a little.

Letter to the NNA about Notary Testing

Dear NNA,
It has come to my attention that the focus that both of our organizations have put on loan document knowledge seems to be a somewhat wasted focus for two reasons. First, the people we both have certified don’t know their loan documents that well. Second, Notaries tend to know their loan documents better than they know their Notary procedures.

When we get complaints about our Notaries, the complaints are normally that a Notary was rude, left someone high and dry after a botched signing not returning emails or calls, or that the notary made a Notary mistake (more common with beginners) or did not follow directions.

To certify someone as a loan signer who cannot function as a Notary is a mistake we have both made. I can show you many examples of individuals who have an intimate and flawless understanding of loan documents who cannot answer basic Notary questions.

For example, if you called your members up one by one and asked them the difference between an Acknowledgment and a Jurat two things would happen. First, they would be offended that you called them and second, 90% would not give a thorough or correct answer according to my findings.

Notary knowledge trumps loan signing knowledge as the most common errors that happen at a loan signing are notary errors. Notaries commonly stamp where they see the word “seal” whether there is notarial wording or not. Notaries stamp over wording. Many Notaries decline legal requests for foreign language notarizations in California. The most common misunderstanding is that in 44 states, an Acknowledged signature can be signed prior to appearing before the Notary Public. There are many other issues as well.

The main point of this letter is to let you know that we are testing people on the wrong things. We need to know if someone is a good Notary and if they have a good attitude first. If they don’t know the difference between an Occupancy Affidavit and a Compliance Agreement, that will probably not come back to haunt anyone. But, if you identify someone incorrectly and notarize someone with an ID that says John Smith as John W Smith simply becuase you are “supposed to” have the person sign as their named is typed in the document, you could end up in court on an identity theft case for months without pay, and possibly be named as a defendent in addition to merely being a witness.

Last but not least, journal thumbprints are a hot topic of debate among myself and the Notaries. Many Notaries are being discouraged from taking thumbprints simply because it seems invasive or offensive to some Notary customers. However, the thumbprint has been the one piece of information that has helped the FBI nail some really scary ponzi schemers and identity thiefs. Not all states require journal thumbprints yet, but people who lead Notary organizations should do more to encourage people to take thumbprints as a measure to protect society from frauds.

Thumbprinting should be encouraged by scaring Notaries into realizing that without a thumbprint, they might be in court for a very long time, or named as a defendent and conspirator in an identity theft ring. Unlikely or not, the truth is that the FBI does treat Notaries like suspects as a matter of practice whenever anything goes wrong that requires their attention. Keeping good records is a way to wrap up situations quickly and without being blamed as a shoddy record keeper.

So, let’s both invest more in testing Notaries better on what really matters which is the fact that Notary knowledge takes precident over loan signing knowledge, and that following directions, getting back to people and being nice in the face of adversity are the most important things! Knowing the details of the Correction Agreement is actually the least important thing to know. According to lenders I know, the POA is the only document in a loan package which they stress that I test people on!

When you really don’t wanna take the job

When You Really Don’t Wanna – Jackpot !!
Most of the time, like you, I look forward to the phone ringing with an assignment. But, not all the time. Today I had some reserved theatre tickets and really wanted to see the show. I had intended to shut off the cell phone, but reconsidered as I was hoping to hear from someone regarding personal matters. The tickets were for early afternoon, and the show was relatively close by.

Ring, Ring. We have an emergency, the assigned notary did not show, and our client is furious, can you be at their location within the hour? The CD is with the client. Please help us. OK, I say, I understand. But, I have theatre tickets for today and did not plan to work today. If I accept your assignment I will miss the show. This is a very high priority client – forget about the show – we need you!
They offer an amount at the high end of the normal edoc range. I tell them their offer is fair but I would have to add an additional xxx$ for the lost use of my tickets. If you have not been to a NYC Broadway show – tickets are much more than an edoc fee. Any edoc fee. Somewhat stunned, I get the “we will have to get back to you”.

About ten minutes later another call for a structured settlement. Again the “urgent” routine – and, much to my surprise – another story of a notary “no show”. The conversation goes exactly the same way as the edoc discussion. Fortunately, they want a time slot toward the end of the show. The same fee discussion takes place – again with a gasp about the high cost of NYC Broadway shows. But, this one was different – they wanted to close the deal immediately. I told them the fee was in advance and once paid I would only then be committed to their assignment. Within five minutes the fee was in my account, bye bye Broadway. They email me the slim package immediately and I confirm that the documents were printed. Previously, as with the edoc job, the ID requirements were discussed and guaranteed.

Ring, Ring. It’s the edoc job calling back to accept the way greater than normal fee. Hmmm, both jobs are now paying for my “not to be used tickets”. And again, as per my requirement; the fee is in my PayPal account. It’s good that the edoc and the structured settlement times did not conflict; and there would be adequate time to go from the edoc to the other.

This is getting really weird. Will there be a third “emergency – notary no show” in the same day – with the caller having Very Deep Pockets? Nope, that did not happen. But, two did, much to my astonishment. The tickets I had in hand went to some very nice neighbors, who were delighted to change their plans for the same day. They would see the show for free, and so would I; as I was being paid twice for the same tickets!

So, what’s the “take away” from my rantings? Well, my message is that if you “can” do the job – but, for some reason – “don’t wanna” – let the caller know your situation. Tell them honestly and frankly that logistically you are able – but have a specific reason to not want the assignment. Of course some reasons cannot be bought for any amount of money. Family commitments, medical plans, and similar obligations are not for sale. But, the tickets were going to be available again; it was not a “now or never”.

Sure – I got lucky. Rare is the windfall that creates a high dollar “double dip” fee expansion. But the concept of being “flexible” is my theme message. I know, our clients use that word to, in lieu of more pay, compliment us for waiting 5 hours for the docs to be ready. Stranger still is their inability to, in New York City of all places; not to find a base fee notary. Perhaps because it was a “go away” Friday of a holiday weekend?

Whatever their reasons, nothing would have happened if I brushed them off with a “Sorry, I’m booked”. That was not the case. I had something that I “wanted” to do; but did not “have to do”. Letting the caller know, frankly and honestly your situation (within reasonable limits) – allows them the option to bail out or to “work with you”. It was obvious to the callers that a routine fee would not work. Though very extreme, both were willing to cause me to change my plans, without incurring a severe financial hardship. A week later I will see the show, have earned two fees; and have enough left over to purchase a pair of tickets for a different show!

Need an NNA Alternative?

NNA is a very reliable and quality organization that has been helping Notaries with education, supplies, background checking, and a world-class technical hotline for years. We at 123notary recommend them highly. However, their fees can be a bit high for some budgets, and you are probably thinking of alternatives for your Notary needs. Some claim that NNA has gotten too big, and is no longer the optimal source for Notaries to rely on. I refrain from having a personal opinion on this matter, although I would say that you should analyze your various Notary needs, and find the ideal source for each need rather than relying on one-stop shopping unless you feel that one-stop shopping makes more sense. So, here are the alternatives.

Signing Agent Education
(1) 123notary offers good loan signing combos with solid marketing advice and the convenience of take home course in printable, online, or take home book.
(2) We recommend Notary2Pro if you want thorough training and hand holding. they train their Notaries better than anyone else. Their courses are not as affordable as 123notary’s and do not have the marketing expertise that 123notary does, but they excel at nuts and bolts technical training.

Background Checks
NNA and Sterling are the two acceptable names for background checks. So, if you want an alternative to NNA, try Sterling.

Directories
SigningAgent.com used to deliver more jobs to Notaries than it does now. Over the last six years it has gone down hill from what I’ve heard.
(1) 123notary is a good source for high paying notary work
(2) SnapDocs is a good source for low-ball signing work for beginners
(3) NotaryRotary is the runner up for a mix of signing agent work ranging from top-notch to low-ball.

E&O Insurance
Notary Rotary and other organizations also sell Notary E&O insurance. Not sure who has better prices, but you can shop around.

Supplies
There are various companies around the nation that offer supplies, Notary Rotary being one of them. Personally, I always relied on NNA as my sole destination for thumbprinters, acknowledgment pads, carry-all bags, and anything else I needed.

Summary
NNA seems to be the best destination for one-stop Notary shopping. However, the alternatives might offer better prices and in some cases better quality especially for signing agent education, background screening, and directory marketing. However, for E&O and supplies they would be my first choice. I am not here to make your decision for where you should go for what. But, compare the competition for each type of items or services that you need, perhaps try each option out, and then optimize your decision making skills!

For Background Checks, NNA & Sterling come highly recommended

The more seasoned Notaries know that they will lose a certain percentage of their business if they are not a background checked notary. Newer Notaries either are oblivious to this fact, or just get it without questioning the entire concept. While the ultra-seasoned Notaries with ten or more years of experience sometimes do not get background checked since their clientele trusts them and depends on them so much, that they can get away with no having it.

If you are a Mobile Notary Public and are not fully booked to capacity with great clients who deliver eDocuments on time, pay on time, and pay well, I strongly suggest getting a background check so that you won’t get weeded out by companies who have standards (which is a lot of them.)

But, whom do you get certified by? People in the industry told me that there are two companies whose background checks are highly prized. Keep in mind that not all background checks are created equal and the process of background checking and “What they are checking” in each check is not equivalent. Some checks are more thorough than others and some checks are honored more than others.

NNA & Sterling’s Background Checks are highly recommended
National Notary Association is a great place for one-stop Notary shopping. They sell Notary training materials, great supplies including Acknowledgment pads, The best journals in town, and more. Their Background Checks are recommended as well as they are highly recognized in the industry. Sterling is another quality source of background checks. A background check won’t do you any good unless it is recognized. So pick from the best. Background Checked Notaries get a lot more business, so it is definitely worth the cost.

Is having an NNA background check really necessary to get work?

There is not enough work for signing agents these days. We have heard that in the last month or two it got a little better, but this is the worst the mortgage business has seen in seventeen years. To be a CSS, you need a yearly background check. But, it is expensive, and many feel that it is unclear if they really need this to get work.

What does the NNA background check query?
Social Security number trace
County criminal court records
Federal criminal records
Statewide criminal records
Nationwide criminal database
Motor vehicle records
National sex offender database
USA Patriot Act lists
Office of foreign assets lists

But, I’m already background checked through my state!
Although California background screens notaries when they apply for a notary commission, this is only done once every four years. Additionally, the standards for working in the finance industry are higher than those for becoming a notary, and the state background checks don’t check as many sources of information as the signing agent background check does.

Sharing Personal Information?
Another question is whether the NNA or other testing agencies will be sharing your background information with financial institutions or others and whether or not this is legal. I do not have detailed information on this matter. However, the background check is pass fail, and some notaries are claiming that the only information that will be shared is if you passed or failed, and not your personal information.

On NotaryRotary, one notary claimed on May 26th, that before a background check can be done — you have to agree that NNA or BGO may share a detailed report of your background screening with any institutions that issue a written request. So, it remains fuzzy as to how much of your personal information can be shared. Another notary claims that her social security number was not shared, but that her Driver License information was.

Do you really need it?
I read many Linked In discussions on this topic and learned that it is becoming increasingly necessary to be background checked to get work. The requirement is taking effect little by little instead of all at once. Another claims that it is the NNA background check that many companies are looking for and background checks by other agencies are not being accepted nearly as much. One notary claims that NNA background checks are a cost of doing business at the moment which cannot be circumvented. One long time notary claimed that he did just fine without the background check, but his point of view is in the minority at this time.

Summary
Although I personally feel that yearly certifications and annual background checks are overkill, it appears that many companies are requiring this, and that more will soon follow suit. To me, a very thorough background check once in four years is plenty. The chance that you will suddenly become a freelancer working for Al-Qaeda in the middle of your notary term is slim. And the chance that you will suddenly engage in Mortgage fraud is also slim. We have only heard of two notaries out of millions that have been convicted of any serious frauds involving jail time in the last decade.
