Fingerprinting 101 – What’s worth Knowing
First, it’s necessary to clear up a bit of nomenclature confusion. Fingerprinting is the recording of the pattern of loops and whorls, typically on a standard FD258 (civilian, non-criminal) card. This is accomplished with either ink or a scanning device. “Fingerprint Kits” on Ebay are most often fingerprint “lifting” kits, essentially very fine powders that are applied to the fingerprint and a “copy” taken (lifted with tape, etc.), physically or they can be photographed.

I choose to not do fingerprint lifting as it would require me to prepare a written report and probably be called to testify in a courtroom. Yecch. Also, such activity is usually done by a Police professional – trained for the task. However, I do a lot of fingerprinting. New York State does not offer a fingerprint license; if they did I would have it. My authority to establish positive ID on the cards comes from being a Notary. I fingerprint people for FBI background checks, various licenses, and many immigration related purposes. There is no “oath” nor is there a need to be able to converse with the applicant, however, a translator is often helpful.

Back to the nuts and bolts. First, there is the “Live Scan” machine. Essentially a scanner hooked to a PC that communicates to a specific destination. All this must be prearranged and “type accepted” by the receiving party. A Live Scan setup is target centric and is generally not able to transmit (over telephone lines) to multiple destinations. This makes sense when many applicants go to a single place, which transmits to a single place. The more common and flexible fingerprinting is done with ink. Ink can be either embedded into a ceramic pad, similar to a common ink pad; or spread on a glass or metal plate with a roller. The latter is more time consuming but gives greater control to the fingerprint technician.

The FD258 fingerprint card is a bit narrower than a standard 8.5 inch wide sheet of paper. Of course the card holders are designed for the card to fit with no wiggle. Therefore a downloaded and printed image of the FD258 card does not fit a standard cardholder. It is possible to fold the edges and create an imprecise fit of the sheet of paper card image. Unfortunately, most computer paper is really not suitable for accepting standard fingerprint ink properly. Bottom line: printouts of the fingerprint card image should be avoided. Much better is to maintain a stock of FD258s. A common variation is the FINRA (used by the brokerage industry) cards. They are the exact same FD258 with the addition of preprinted barcoding, required by FINRA.

Proper finger preparation is essential. I have seen fingerprinting done without even having the applicant wash their hands! Access to hand washing facilities (soap and very warm water) is essential. Once the hands are washed the applicant should touch nothing, not even their ringing cell phone (I have had mixed results with this request!). Next, a mild solution of pepper extract (an “irritant”) is applied to the fingertips to raise the “friction ridges”. The friction ridges are ever so slightly “higher” than the underlying finger flesh; it is the ridges that form the fingerprint. This solution requires a second hand washing to remove prior to applying the ink.

It is critical that the minimum amount of ink be applied, lest the ink pass the friction ridges and collect in the “valleys” between the ridges. Perhaps the most common mistake is over inking. Using the traditional ink and roller allows greater control of ink application compared to the ceramic pad. If the layer of ink on the glass or metal plate is exactly correct; it’s impossible to transfer too much to the fingertip. With the ceramic pad the transfer of ink is directly proportional to the pressure exerted, and the risk of over inking is greater.
There is also a psychological aspect to fingerprinting. Many clients have two issues. Some don’t like to be physically manipulated; a necessity to take the fingerprint impressions. Always use a blank sheet of paper to check how the ink layer reacts to their fingertips. The test prints are good for explaining the procedure on a spare card while demonstrating the procedure. Emphasize that you must be in control and not be “assisted” – your subject must not press down or actively turn their finger. You must, when completed; check their ID and match to the name they printed and signed on the card. Lastly, you sign and date each card; or, if it does not meet the standard of clarity and completeness – break out another card and start over; it must be perfect.

When do I need to use a California All-Purpose Acknowledgment?

When do I need to use a California All-Purpose Acknowledgment?
A Notary Public in California only needs to use the notarial language found in an All Purpose Acknowledgment if the document is being filed in California.

California Civil Code Sec 1189 ( c ) allows a Notary to use the preprinted acknowledgment language from another state as long as the Notary is not required to determine or certify in which capacity the signer is signing the document. Certifications are prohibited for Notaries to perform by California law. Notaries are not required to even include the disclaimer at the top of the notarization which essentially states that the Notary Public completing the notarization is only verifying the identity of the signer and not the “truthfulness, accuracy or validity of the document”.

A document that many Notaries see and something that I see brought to my office often at A1 Live Scan Fingerprinting and Notary Services in downtown Los Angeles is Form TSP-70 which is the Thrift and Savings plan Financial Hardship In-Service Withdrawal Request form. This form has preprinted Notarial Language for Acknowledgment and has specific instructions for the Notary that reads in relevant part, “Notary:……No other acknowledgement is acceptable (see instructions)”.

When you see forms such as TSP-70 that is being sent or filed in another state or jurisdiction, use the preprinted form as long as you are not being asked to certify the capacity in which the signer is signing the document.

Notary – Your Signature – Needs Work

No, I’m not referring to that strange squiggle you have on file with your notary commission. I’m talking about your “other” signature. It’s the one that your email program adds at the end of virtually every email that you send. Jeremy hoots and hollers about having a good “notes section” in your profile on 123notary.com. Well, I’m willing to bet that at least a hundred times more people see your “email signature” than see your notes section. So, why is your email signature, either non-existent, or, to put it bluntly: junky?

The automatically generated “signature” is a great source of advertising. In addition to complete contact information, you should have a graphic; and a bit about the services you provide. This is totally free advertising, and it makes it much easier for people to call you. They don’t have to hunt thru several of your emails to find contact information – it’s in each and every one you send.

And, they can do much more than call. Your signature should have a link to your web site! A real “click here” (without those tacky words, of course). Mine informs recipients that I am available for: Mobile Notary Public, Apostille Processing, Embassy/Consulate Legalization & Fingerprinting. It’s the simplest thing to use, once set up. Just click “reply” to an incoming email and your signature is generated at the bottom – there’s nothing to it. MS Word allows for at least two different ones; one for a new outgoing email, one for a reply. Depending on your email program, the signature can contain various fonts, text, pictures, logos, and links. A goldmine!

Your email signature probably “needs work” and it will be a bit of work for you to configure the signature if you never accessed that part of your email program. Read the related help section, there are probably examples and/or step by step instructions. It’s also possible to get “fancy” and have a variety of signature files and select the appropriate one for each specific email. One processing tip, for users of MS Word: I found it easier to use the full “word facilities” to create the signature, then to just copy and paste it into the signature entry facility.

While most people will just click “reply” to your email, it’s a good idea to specifically put your email address in your signature. That helps people to edit copy, edit paste your email address when forwarding email if they did not add you to their address book. A further step is to include Filename extension .vcf, .vcard. Internet media type, text/vcard … vCard is a file format standard for electronic business cards. The .vcf allows instant addition of your information to the recipient address book. You can personalize the entry with your picture, logo or a graphic.

You only get one chance to make a first impression. That’s true in person, telephone or via email. When you include an informative email signature you literally “display” both enhanced technical ability and your desire to be easy to contact. If you also take the second and more complex step, the .vef; you stand a good chance of being added (permanently?) to your client’s address book.

It’s also common to include, as the last line of the signature, a thought provoking quote; with proper credit to the author. It should represent your beliefs and philosophy, select your quote wisely. I chose a classic by Joseph Joubert: He who has imagination without learning, has wings and no feet.

Augmenting your skill set to make more money as an NSA!

Notaries are complaining that there isn’t enough work out there! But, what can these notaries do about it? The answer is that there are many avenues to make extra money without compromising your career as a mobile notary! Here are some ideas:

Get More NSA Certifications
Notaries are all over the boards stating opinions about having more certifications is not necessary and just makes money for those selling the certifications. Even some people who hire notaries don’t care about certifications as they care about skills, not badges. My experience has led me to believe that getting more certifications helps notaries to be more knowledgeable, and also helps them to prove their knowledge. If you rant and rave on the phone about how smart you are, nobody will believe it. But, if you can give smart answers to questions and show your badges, then you get real credibility! Otherwise, just studying up on your skills will help too even though it doesn’t get you a badge!

Reverse Mortgage Training
Signing Refinances is relatively easy. But, there are other specialty loan signings that require additional knowledge. Many people do Reverse Mortgages without any formal training. However, imagine how much more trust you would win if you were one of the few notaries who did have training and experience at it? The more you know…

TEA
The NNA offers a Trusted Enrollment Agent program. Those with TEA designation can do additional tasks that get additional jobs. TEA agents are trained to understand digital certificates which are used heavily in the biopharmaceutical industry. They also are trained to understand how to apply to obtain a digital certificate and do identity-proofing. They must also learn to identify and distinguish between different types of identification documents. Word on the street is that TEA jobs don’t always pay well. But, any designation you can get will help. Personally, I feel there should be a choice between an Earl Gray TEA, and an Oolong TEA.

More E&O?
In real life, E&O is mostly a fashion statement. Unfortunately, the more you have, the more you invite law-suits since the Plaintiff will know that they might be able to collect. Fancy clients such as some of the nation’s larger Title companies have higher standards for how much E&O a notary should have. So, how much is enough? The number keeps changing. In 2014, half a million was enough to please the most picky Title companies. But, many notaries preferred to have a million just to be a notch better than the others!

Background Screening
The NNA’s new Certification and Background Screening seem to be very necessary, but not for everyone. More seasoned notaries have told me that they get jobs because people know and trust them. But, for newer notaries, you might be missing out on work if you don’t pass their extensive background screening and testing! If you are serious about this business – just do it!

Inspections
Notaries claim that inspections don’t pay much. But, on the other hand, you can go when you like, take a few pictures, take some quick notes, and leave. It is not nearly as demanding as a loan signing which involves rigid scheduling, difficult borrowers, and tons of documents. If you want to augment your income, I suggest that you at least try out doing inspections. You never know — you might like it!

Weddings (I do)
Florida, South Carolina and Maine allow designated notaries to officiate at weddings. I don’t know if you need to be in the clergy to do this or not, but you can inquire. Many notaries get a lot of extra income doing weddings. Or maybe it is the other way around that Wedding Officiants make additional money being notaries.

Process Serving
Every time we write a blog about how notaries can make more money, process serving is always on the list. This is a slightly dangerous way to make extra money as you are serving court documents to criminals. But, if you have bills to pay, it is worth looking into. You can fit this into your schedule, and we all know that notaries have many holes in their schedule, especially during the beginning of the month!

Fingerprinting
The rules for fingerprinting keep changing. In my day (I’m sounding old) we used FBI fingerprint cards and rolled each finger, and then did flat impressions. If you made a mistake you had to do the entire card all over again. Live Scan became the norm in the early 2000’s. I don’t know what is used these days or how expensive it is to get into this, but many people make a good supplement to their income doing fingerprints. Plus it is fun. You get to meet interesting people and book them!

Hospitals & Jails
Many notaries are intimidated about going to a jail, and are not fond of going to hospitals. Newsflash — there’s money in muck. The desirable notary jobs include doing highly paid signings for Attorneys and $200 loan signings. But, honestly, how often do you get those types of jobs? In real life, the jobs that pay the most are often jail and hospital jobs. You need to read our blog’s hospital and jail signing sections to learn all of our free tips on the subject first. But, you can make $100 plus per assignment doing these less pleasant and more hairy notary jobs.

Being a Birthday Clown
If you choose this route, just don’t forget to completely remove your clown makeup before going to a notary job, otherwise the borrowers might get the wrong impression. “Hi, I’m Bozo the Notary!”

Background Screening for Notaries?

Background Screening – who needs it?
 
Notaries are never quite sure whether background checks and background screening are an important part of the industry, or just a way for the agencies who provide it to make more money.  The state and DOJ screen you when you become a notary, right?  You can not be a felon and still be a notary, right?  So, why a redundant background check?  Does it make the signing companies feel better? Do they even want it?  The reality is that few companies ever ask notaries for background checks, but a few do.  How much work will you lose by not being background checked?
 
In California or Out of California – it makes a difference
If you are outside of California, aside from getting more inches of rainfall per year, the standards for becoming a notary are different.  California has been more stringent in commissioning notaries for more than a decade, than other states in the country.  After 2005, it got even harder… a lot harder.  Its now very difficult to become a California notary public.  The test is murder, and then you need to get live scan fingerprinting (last I checked — and this is always changing), and checked by the DOJ and the FBI, and in some counties of California maybe even the KGB.  Okay, maybe not the KGB, but I’m trying to illustrate how picky things are here.  Nobody who is the least bit sketchy or questionable will be able to become a notary, unless they didn’t get caught yet.  But, what about other states?  The rules change from state to state. It is possible that many states are very lax about background checking their notaries, and in those states, maybe the NNA should background check notaries!

Background checks are a very popular topic on the forum simply because there is so much confusion and emotion tied to the subject.  There is nothing notaries hate more than having to do something redundant.  Personally, I do redundant things daily, and I don’t mind providing I’m getting a benefit from it.  Others don’t see it the way I do based on these blogs.

Payment terms – set by the Buyer or Seller?

As often discussed “in the old days” the “Closer” had “pickups” and earned a significantly higher fee than current signing agents. Sure they took risk, but the higher fee (often several hundred dollars) made up for the few that did not fund…..

Fast forward to today. Notaries are the “seller” of their “signing agent services” and the buyers are Signing Services, LO’s, Title companies, Escrow companies, etc.

In every other case that I know of – it is the SELLER who sets the payment terms. The seller / service provider sets how and when they are to be paid. Common sellers are Ebay merchants, Exxon, McDonalds, your dentist, even the babysitter. As the BUYER in almost every case – you make payment “up front” prior to getting the service or merchandise. There are exceptions; when you leave your car for service, you pay when you pick up the car. Or, you don’t get the car and a “mechanics lien” kicks in and the car is either taken or held till payment is made.

What baffles me is the supposed “industry standard” whereby notaries are expected to up front expenses, services, and professional time; in the “hope” of later payment. Some, actually as I read the various posts, many – are never paid.

As mentioned the high fee true “closer” was paid at closing, and “on the HUD” – paid according to law – on time, with other disbursements.

With the proliferation of, to phrase it gently, “problem receivables”; I just don’t understand why so many notaries do not require “up front” payment. Almost all of my individual (non-signing) work is received in advance. My standard answer as to “why in advance” is that it is dangerous for me to go from place to place adding cash – it’s much safer for me to be paid by credit card. “Why in advance?” – because many cards often fail clearance. I tell clients that they receive a nice receipt from PayPal – and I receive a scheduling notification. Simple, clean and effective.

I require the same of all but the highest rated signing related work. Unless they have the best of 123 AND Rotary feedback – it’s in advance or I decline the job. I would not be able to maintain this policy if it was costing me a big chunk of work – but it is NOT. With “pay in advance” I can accept work from the WORST “duds” that most would turn down due to their “no pay / slow pay” reviews. That’s not a problem when the money is already in the account. Why would they do such an about face – because they are desperate to farm out the job to keep THEIR client happy. Soooooo, don’t have a “won’t take work from dud list” – have a PayPal account – and insist the dud’s prepay!

I have brought this subject up in various postings. Again I urge all to open a PayPal account and request/require advance payment. It greatly helps to have a website that provides assurances about your integrity.

It is the seller not the buyer who establishes the terms of the sale. You are selling your services; “they” are buying them. Putting up with the various delays, deductions, and out and out ripoffs makes as much sense as pulling into an Exxon station and asking them to fill the tank and “invoice” you. BTW: using a credit/debit at Exxon is still paying Exxon in advance – just not with cash.
