Notary Etiquette 104 — Confirming the Signing & At the Signing

1. Call to confirm the signing.
First introduce yourself on the confirmation call. Then go over all pertinent points. Make sure the ID proves the name on the documents and that all the signers will be there. You should also verify that there is a clean table to sign on. You should go over how long the signing should take, if there is anything going back to the document custodian and if they have used morphine or Jack Daniels within several hours of the signing. Nothing beats a sober signer or a well-organized Notary Public.

2. Introduce yourself at the door.
It is good to mention that you are Joe the signing agent and that it is your job to facilitate the signing. Mention that they can address all of your questions to you, but that you cannot answer specific questions about their loan, but only general questions about loan documents and Notary procedure.

3. Small talk is good.
People like a friendly Notary who can talk about small talk. But, avoid any topics that could be controversial such as gender issues, sex, guns, and how born-again Christians should have a second birth certificate for when they were born the second time.

4. Don’t discuss guns and religion.
Unless you are notarizing the Obamas, don’t bring up Joe the plumber, or religion. But, if you are notarizing the head of the NRA then you might reconsider guns. If you ask him to shoot you an email, don’t be surprised if he asks what you want him to shoot it with! Yee-haw!!!

5. Don’t park in the driveway.
The driveway is for the residents to park in, not you. You are their humble servant who parks on the street (sorry).

6. Call if you’re going to be late.
If you are going to be late, call and let them know ahead of time rather than keeping people hanging.

.

7. Don’t rush the borrowers.
On the other hand, if you have another appointment to go to, let them know when you have to depart. If you are under a time crunch, you can discuss their right to rescind if applicable and remind them that they have borrower copies.

8. No drinks on the table
Drinks can spill, so unless you want your Deed of Trust drenched, keep the drinks on a chair or a separate table — no exceptions.

9. Know when to call the Lender.
If the borrower asks questions, you need to know in advance which questions you can answer and which questions to refer to the Lender. You should have the phone numbers for Title, the lender, and any other relevant party. You can answer questions about what information is where in the documents as well as Notary questions. You should not answer questions specific to their loan.

10. Middle initials
If the signer doesn’t want to sign with their middle initial, politely tell them that they need to sign the way their name reads on title otherwise their loan might not fund.

11. How long to wait for return calls
If you try to reach one of the contact people for the loan such as Title, Loan Officer, Lender, etc., and they do not answer, try to give them a reasonable amount of time to respond. Twenty minutes to an hour seems reasonable.

12. Dress for success.
People get very put off if you do not dress like a business professional. Business casual or business formal is fine. Avoid jeans and definitely don’t wear flip flops, shorts, bathing suits, heavy makeup, short skirts, or night club apparel. Signers get in trouble all the time for not dressing for success.

13. Don’t bring your kids.
Believe it or not, some Notaries will bring their family to the signing. This is very intrusive and rude. Either keep your family at home, or in the car, but don’t bring them to the signing.

14. Don’t complain.
Don’t tell the customers how bad certain signing companies are or who didn’t pay you. Keep your personal business personal. It makes a terrible impression if you talk about this stuff.

15. Don’t give opinions about the loan.
The worst thing a Notary can do is to give an opinion, especially a negative opinion about a loan. You can get fired, blacklisted or even sued because of this. Some borrowers might cancel their loan because you told them they were getting ripped off.

16. Following instructions
If you were asked to sign in blue, then sign in blue. If you were asked to start at page four, just do it, don’t explain or make excuses, just follow instructions. If you are asked to fax back page 1 to 28, don’t complain, just do it.

17. If you make a mistake
If you make a mistake as a Notary, you might have to go back out there and fix the mistake. So, don’t keep people waiting. Go back out there and clean up after yourself.

18. The grace period
As a Notary, you might be asked to answer emails after a job is done. There might be a problem, error, or just an inquiry. If you don’t answer your email or phone because you are on vacation or just don’t feel like it, that can cause a big problem.

Signing with a former Airline Captain

NOTARY: Hi, my name is Captain Ronnie, and I’ll be your notary signing agent today. I’m experienced in the airline industry and will make sure your loan lands safely.

BORROWER: I’m more concerned that my loan gets off the ground at this point. By the way, love the captain’s hat.

NOTARY: Well, don’t worry. We’ll begin boarding procedures momentarily. They’ll make an announcement. I’m sorry that I couldn’t have been earlier, but, I was standing for five minutes in the parking area waiting for a shuttle. Then it dawned on me that there are no shuttles servicing your driveway with direct service to the check in area. Silly me!

BORROWER: That’s okay. Which way is the gate? We’re in the hallway now, so should I go into the living room or the dining room?

NOTARY: I think the living room better be the gate, because the dining room will be the plane.

BORROWER: I think I better go out for a cigarette before the captain turns on the no smoking sign.

NOTARY: Good point. I didn’t think of that.

BORROWER: I was instructed to show my identification and boarding pass when boarding the dining room table, and that the names on both must match. Is that true?

NOTARY: Yes, let me see that? I’ll record that information in my journal. Okay, now please remove all metal objects from your pockets and let me scan you.

BORROWER: What about my pen that says Chase Financial?

NOTARY: You are allowed to use that pen, but I’m not allowed to bring a pen with the name of the bank. By the way, I can’t let you into the dining room until you explain what that huge chunk of metal is in your head.

BORROWER: Oh, I had an accident as a kid, and the rest is history.

NOTARY: Got it!

(5 minutes later)

BORROWER: I’m back and all nicotined up — ready for take off. I hope I don’t get jet lag after this signing.

NOTARY: I wouldn’t worry too much about that unless you’re going to a different time zone. But anyway, first let’s get our luggage in the overhead compartment.

BORROWER: This is my dining room. There are no overhead compartments and I have no luggage.

NOTARY: That makes it all the easier.

ANNOUNCEMENT: The captain has turned on the seat belt sign. Please return to your seat and put on your seat belt.

NOTARY: The emergency exits are (making hand gestures) to the rear of the plane and also to the front. In the event of an emergency, calmly walk to whichever exit is nearest to you. If those exits are blocked, please move immediately to the closest window and jump out. Please bring one of the safety cushions below your seat to break your fall.

BORROWER: There are no safety cushions!

NOTARY: Feel under your chair.

BORROWER: Oh my god! There really are safety cushions. You might as well put a barf bag in the folder to my right, just to be true to your profession!

NOTARY: I brought my own safety devices. See this? It is a self-inflating notary seal. Great for crash landings as well as no-signs! Ooops…

(the self inflating seal popped and inflated itself as fast as an airbag.

BORROWER: Wow, that’s huge. I haven’t seen anything inflate so fast since I visited my neighbor’s teenage son’s bedroom and he showed me his… never mind.

NOTARY: I brought you one too. Yours is an oversized rubber ducky. You can ride if we have an emergency water landing. The experts say we are due for a tsunami sometime in the next few years, so it never hurts to be prepared. But, let’s not accidentally inflate yours too. They are so hard to fold back up.

BORROWER: Gee — thanks. Not exactly what I was expecting, but it is the thought that counts.

NOTARY: Now, we’re ready for take off.

BORROWER: Are you like that comedian who did a take off on take offs?

NOTARY: That was funny. I never thought of that.

BORROWER: This is hillarious… ha ha ha ha ha

ANNOUNCEMENT: The captain has turned off the no laughing sign. You are free to laugh around the cabin.

BORROWER: You are too much.

NOTARY: You think I am too much, wait until you see your APR. It is up in the stratosphere.

ANNOUNCEMENT: The captain has announced that we have successfully taken off. Please grab your pens and commence by looking over the Deed of Trust.

BORROWER: I think I need to use the bathroom. I hope there isn’t a line!

NOTARY: If there is, just use the bathroom towards the cockpit. It’s usually empty.

BORROWER: Okay, I’m looking at the Deed. It has my address correct, the lender information is correct, and the loan amount is correct. I feel like I am on stable ground.

NOTARY: Well, we’re in the air now, but glad you feel stable. I need you to initial each page on the small line in the corner, and sign at the end.

BORROWER: If I don’t like my rate, I’m going to make a paper airplane out of my Note, what do you say?

NOTARY: I think that is a bad idea, as Notes are not up to FAA standards.

BORROWER: I never thought of that.

NOTARY: Now, you’re beginning to sound like me. Now, let’s look at the Truth in Lending

ANNOUNCEMENT: The captain has announced that there will be turbulent weather ahead. Please firmly attach your seat belt and finish your drinks.

BORROWER: No offence, but how come you didn’t offer me a choice of root beer or Pepsi and those airplane peanuts.

NOTARY: Oh I do, I usually wait until we have been in flight for about twenty-five minutes.

BORROWER: Okay, the TIL is not that bad. Why is my APR higher than my rate?

NOTARY: That is because of FAA regulations which require APR’s to fly at a higher altitude unless it is a loan that doesn’t include fees.

BORROWER: I never heard it explained that way, but I must say that I like your explanation.

ANNOUNCEMENT: We will be serving drinks and refreshments in a moment. Please adjust your seat to an upright position.

BORROWER: Okay, now it is time for peanuts, right?

NOTARY: We offer a snack pack for five dollars. Due to tight profit margins in the airline industry, we can no longer afford to give free peanuts.

BORROWER: No free peanuts? What kind of a Notarial airline is this?

NOTARY: Just kidding! Here are some peanuts, and pretzels. I brought some lemons and sugar too for fresh lemonade!

BORROWER: You are the best.

NOTARY: And don’t forget not to spill your drink on the loan documents! Keep it on a separate tray or chair as a safety precaution.

BORROWER: I would if the guy in front of me would put his seat in its upright position. BTW, Is that FAA mandated?

ANNOUNCEMENT: We will be landing in twenty minutes. Please finish your loan signing by the appointed time as the captain has another appointment immediately after landing.

BORROWER: Well, I don’t like to be rushed, but I do have a three day right to cancel if I find any issues with the loan after we are done.

NOTARY: Correct, and your borrower copies are in the overhead cabinet or under your seat.

BORROWER: Got it. Above the safety flotation device. Okay, the other documents seem pretty straight forward.

(10 minutes later)

BORROWER: Okay… I’m done signing.

NOTARY: Just sign my journal here, here and here. I’ll put the journal on your tray once you get the remains of your peanuts off.

BORROWER: Okay, here we go. (bump) Ooops. There was some sudden turbulence, and my signature went off the page.

NOTARY: That’s okay. It’s my journal. Just sign again above it. The county clerk only looks at your recorded documents, not at my journal.

BORROWER: Got it. Okay, done…

NOTARY: I need a thumbprint for the recorded documents as well.

BORROWER: I’m all thumbs. Here we go.

ANNOUNCEMENT: The captain has announced that we will be landing in one minute. Please return your seats to their upright position and keep your seat belts on. Please refrain from visiting the bathroom at this time. In the event of a crash landing, please lean forward.

BORROWER: Okay, thanks for the signing. Can I go home now?

NOTARY: You are home. We’ve landed at First American International Airport, and I have to go to my next gig. Enjoy the rest of your lemonade!

BORROWER: Thanks!

Borrower etiquette from A to Z

A year or more ago I wrote a blog about notary etiquette from A to Z. The topic arose from a very interesting and detailed discussion about where it is polite to park. The discussion went on and on, and everybody made really interesting points! But, a discussion on NR broke out about borrower etiquette, and I’m surprised that I didn’t publish this topic first, since I love the topic of etiquette (even though I don’t have very good etiquetee myself). In any case, there are many points to consider in borrower etiquette — so, here they are.

PREPARATION

(1) Make sure you finish your meal and clean up your kitchen before the notary arrives. Make sure the smell of your cooking is somehow ventilated.

(2) Make sure you have communicated adequately with the LENDER before the notary arrives. You should be off the phone, and have listened to all of your messages before the notary arrives, especially messages (if any) from your trustworthy lender.

(3) Have all dogs, cats, snakes, birds, cockroaches, vermin, and other creatures behind a securely closed door at least 30 minutes before the signing — for good luck. Many notaries do not like dogs jumping on them. Additionally, if there is an angry or over-zealous dog in the driveway, the notary might be afraid to get of of his/her/their car.

(4) Tell your children not to come into the room of the signing. If they must come, then make sure they are quiet, dressed, and don’t make any sudden movements. Please find a way to deal with screaming babies too as that can be very distracting during a signing.

(5) The TV, radio, and all other noise should be silent during the signing so that people can focus and not make mistakes

(6) There should be a clean surface for the signing, preferably a dining room table. The ENTIRE surface should be free of any clutter and have been cleaned with 409, or Fantastic, etc., immediately prior to the signing.

(7) Make sure that all of the parties involved in the signing are there 30 minutes in advance and have their ID’s ready.

(8) Make sure you know what your rate and APR are supposed to be BEFORE the notary shows you the corresponding pages with that information.

COMMUNICATION

(9) Leave your outside lights on for night signings, so the notary can intuitively know which house to go to.

(10) It is polite and helpful to let the notary know where to park

AT THE SIGNING

(11) Offer the notary a drink right away. Most borrowers are cheap and inconsiderate — it takes them 30 minutes to figure out that, “Oh, did you want something to drink?” And then, they offer you tap water. Why not offer the notary something of a higher quality such as fruit juice, soda, or coffee? Unless you are so poor that you are dying of malnutrition, it is cheap behavior to only offer tap water.

(12) Keep drinks off the table. We have had in-depth discussions about spillage, and what happens when you spill your latte on the deed of trust. Check our forum and blog for older discussions on this topic. Keep the drinks on a chair, or an adjascent table.

(13) Don’t read documents for two hours. The notary came for a signing appointment, not a reading appointment. Your borrower’s copies are for reading. Behave in such a way that the signing will take 45 minutes or less. Read the key points, and the rest can be read on your own time.

(14) Don’t blame the notary for the faults of the lender doing the old bait and switch, or for other problems you have with the lender.

(15) Don’t make phone calls or leave the room during the signing except to go to the bathroom.

(16) Smoking during the signing shouldn’t happen. If it is a really long signing, and after an hour you need a smoking break, perhaps one quick smoking break might be reasonable.

(17) (State specific for MT and TN) It is poor etiquette to expose a gun or other weapon at the signing, or to discuss guns. Notaries usually don’t feel comfortable around guns — at least the notaries that I know!

(18) Don’t discuss politics, gender issues, or anything else controversial at the signing.

(19) Don’t have an argument with your spouse, kids, or anyone else at the signing.

(20) Sign your name as it is typed below the signature line — don’t argue with the notary about this. This should have been discussed with the lender a long time ago.

(21) Don’t make a fuss about being thumbprinted

(22) After it is all said and done, visit the notary’s page on 123notary.com and write a very glowing review about how wonderful and capable the notary was.

Clarifying vague claims in your notes section

Vague: I am experienced
Better: I have signed a million loans including reverse mortgages, HELOCS, 1st & 2nd mortgages, and Debt Consolidations

Vague: I am dependable
Better: I always confirm the signing from my car. I let them know my ETA and let people know if I am running late (which is not the norm)

Vague: I am meticulous
Better: I always triple check my work and make sure that my stamp is clear, especially on recorded documents.

Vague: I love people
Better: It is so nice to constantly be meeting new people all the time at signings.

Vague: I love animals
Better: I always introduce myself to all of the animals at a house when I do a signing. Animals understand me — and if you don’t believe me then ask them!

Vague: I am detail oriented
Better: I am very particular about where each initial goes, and how it is formed. I like people to put suffixes on their initials such as Jr. or III when applicable just to be thorough.

Vague: I am very professional
Better: I wear business casual to all signings. I introduce myself at the door and NEVER park in the driveway unless requested to by the borrowers. I introduce the documents one by one and show the borrowers all critical information on each one, before we start signing.

Vague: I have a flexible schedule
Satirical: My schedule is very flexible because IT does yoga. I do not do yoga, but my schedule takes regular yoga classes at Bikram, so I can accommodate signings at the oddest of hours.

Better: I am available from 8am to 10pm, but will consider signing after that if given advanced notice and extra financial compensation.

Vague: 10 years of notary experience
Specific: 1000 loans signed (more more informative)

Vague: I have 20 years in the financial industry
Specific: I was a Mortgage Broker for 10 years and a Title Officer for another 10 years.
