The carrot, the stick, the notary, and the bag

We have all heard the story about the carrot and the stick. But, I decided to add complexity to the story by adding in the notary and the bag which are both relevant in their own way.

The Carrot
Most notaries are lured in by the benefit of getting paid for signing agent work. They are desperate to get work. They believe all of the lies they are fed by companies that string them along without paying them what they really deserve — or perhaps without paying them at all. Notaries keep chasing these bad companies around in desperations because these companies have a carrot — or at least a perceived carrot. (money would be the carrot in this case)

Notaries should NOT hover around bad companies like little puppy dogs jump around their master. Have some dignity! You need to market yourself to hundreds of signing companies. Get on their lists. And keep in touch with them. You need to see yourself as a carrot rather than chasing other people’s carrots. The notary’s carrot is that they can provide seamless service. Imagine a notary who is always on time, always well dressed, always polite, rock solid in reliability, doesn’t make mistakes, knows the documents inside out, and knows how much to explain and what to refer to the lender. If you can be that perfect flawless notary — you are valuable — and you would be more than just a perceived carrot to the signing / title companies. You would be a stick.

The Stick
Many notaries try waving their stick around without the carrot. They brag about themselves and try to convince others that they are great, and they are above the childish requirements for fax backs. Companies who use inexperienced notaries require fax backs since those notaries make a lot of mistakes. If you are “all that”, then why are you working for these chop shops in the first place? Don’t wave your stick around talking and whining — become a carrot on a stick instead.

The Notary
Notaries whine about not being offered much money for undesireable jobs with fax backs. The fact is that if you have experience and are 100% reliable and offer 100% quality service — such a notary is NOT REPLACEABLE… Then you develop a tremendous value. Those are the notaries that companies will wait for. They will say, “Okay, we will reschedule the signing for Wednesday if that is when you are free — we will wait for you”. If you are an average notary, nobody will wait for you.

The Bag
If you don’t make yourself into a super desireable notary, you will be left out by the more desireable companies who can pick and choose. And you will be left holding the bag.

Kamala gives a speech to kids about being a Notary

KAMALA: You can be anything you want to be.

KID #1: Anything?

KAMALA: Anything. Remember. Other people don’t tell you what you can be, YOU tell THEM what you can be.

KID #2: Aren’t YOU telling me what I can be by telling me I can be anything?

KAMALA: If you want to get technical, but since anything is ambiguous, that makes it okay, alright kid?

KID #3: Can I be an astronaut?

KID #2: She just said you can be anything. That includes astronauts.

KID #4: What about being a Notary?

KAMALA: You can be a Notary. If you do, there will be many unexpected things you will have to deal with.

KID #1: The way you describe being a Notary sounds a lot like how you describe being a Vice President.

KAMALA: The two jobs have a lot in common.

KID #1: Not going to the border being one of them.

KAMALA: We have the border completely under control. There is no need to go there. We like leaving it open. Why should people be prevented from coming here.

KID #1: I agree, it’s mean not to let people come here. On the other hand, what if those people we are being nice to are affiliated with the Taliban.

KAMALA: I’m sure our border guards will screen the four million people who came in this year one by one and keep us safe. Let’s go back to talking about being whatever you want to be and telling people who you are rather than letting them tell you who you are and that type of thing.

KID #1: Got it. I am a border guard. I self-identify as being a border guard, and you cannot tell me that I’m not.

KAMALA: Very good, and I’m sure that you will be the best border guard ever.

KID #2: Yeah, just go easy on the whip otherwise you might attract the wrong type of attention.

KID #3: I’m very good at evading issues and changing the topic of conversation so gracefully, you won’t even notice. Are there any professions I might be well suited for?

KAMALA: Sure, as a proud member of the Notary community, people will bring up politics and religion at signings. And in order not to get in trouble you have to change the topic of conversation ever so smoothly, so nobody even noticed.

JEREMY: When your administration so gracefully changed the conversation from the border to outer space, the folks in Texas who live near the border noticed loud and clear. They are no longer safe leaving their house. An in my neighborhood far from the border there are now muggings, robberies, assaults, and all types of other crimes that simply did not exist (on a regular basis) before your administration. We notice. We also noticed that during your astronomy video, when a girl asked you what it was like to be Vice President, that you conveniently glossed over that question and talked about how your mother was a scientist and how we can all wonder about the stars. I noticed that. We notice a lot of things you and your administration do — because it endangers us.

Many Notaries on 123notary get out of state title companies

I keep hearing that the type of business people get on 123notary is better than on any other directory. I work hard to keep 123notary good. I do this by quizzing people, and helping people with their notes section. I weed out listings with dysfunctional phone numbers and those who are not responsive too. All of this is the basic nuts and bolts of quality control.

But, I have heard from several Notaries that they get a lot of out of state work from 123notary.com, and mostly from title companies. This is great news. My hard work has paid off if people get great jobs. I feel like I accomplished something. But, honestly it is time for a long vacation.

My response to NNA’s article: Is the Notary industry overcrowded?

My opinion on this matter is that there is a lot more notary work than there used to be. The crazy ups and downs in the economy, people losing their jobs due to covid related causes and getting new jobs. People escaping from certain areas and moving to other areas. All of this transitioning necessitates a lot more Notary work and Notaries. And yes, there are more Notaries out there than before. When people lose their job, the first thing that goes through their head is whether or not to become a Notary — or so it seems.

However, for the last eight or so years, new notaries and old alike lack the willingness to master their trade and become experts. Many take classes and pass tests. But, when I test them on actual notary or situational knowledge, few can get more than 80%.

So having lots of poor quality notaries who can’t even administer an Oath properly is not overcrowded. The quantity of what I consider to be qualified Notaries is as sparse as the population in Northern Alaska in between sled dog races. Actually, I think those races are in central Alaska along the biggest river when it freezes over. And the Northern lights are good in both places. But, I digress. What was I writing about again? Ah yes — Notaries.

POINTS IN THE NNA ARTICLE DISCUSSED

The author of the NNA article says that many Notaries claim that there is not enough work to go around. Qualified Notaries are not making this claim. They claim that there is not enough work that pays what they want to go around. Notaries with no name recognition, no skills to speak of and no experience would not get much work even if there were enough work to go around. I understand the author’s point, but when you look at the situation a little below the surface it looks very different.

The author states that RON or Remote Online Notary work creates new opportunities. This is a very true point. However, RON work is feast or famine. The 80:20 rule of Real Estate where 20% of the agents get 80% of the work applies to RON, if you change it to the 99:1 rule. It seems that the applications and sites catering to RON work favor the very solid Notaries who have seniority and know what they are doing. A handful of Notaries are cleaning up where the majority are lucky to get even one job. So, understanding RON from a business perspective is complicated and it does not provide work for the masses.

The author recommends: use the support of your fellow Notaries. Yes, this is a great idea. However, any successful notary who teams up with others will be very picky who they choose or their reputation will go down the drain. If a new Notary thinks they can partner up with an experienced Notary with a good customer base, this is very unlikely unless you developed a stellar reputation or are very socially close to the experienced Notary. But, in the long run, networking is a good idea. I did it for years, and many Notaries on 123notary do it too. Networking — it’s a good idea, but there are catches and many considerations.

The author recommends: Network with local businesses that need notary services. Once again, another good idea. But, this is an idea you should be using anyway regardless of how the notary market is doing. Call up local businesses. Or drop by and give them your card. A certain percentage will use you, so go to lots, and have lots of cards.

Then the author recommends: Find opportunities outside of your local area. This is what I recommend too. It is called widening your net. You should do that in any case whether business is fast or slow if the price is right or if it is for a client you like enough to drive. This point is a good one, but has nothing to do with overcrowding.

SUMMARY
I feel this particular NNA article is helpful, but is a general marketing article with a title that is specific to a particular type of market condition that the article does not address. The fact is that for years, the NNA has been outstanding at marketing to new Notaries, getting them on board and turning them into signing agents. Many of these Notaries are Realtors, Insurance workers, Mortgage and Escrow people, etc. NNA tends to attract a good crowd and a big crowd and floods the industry with signing agents. However, how many of these signing agents can pass a tough notary or signing agent exam? The answer is very few. And the reason is that people since about 2013 (yes I noticed this), have become lazy and don’t want to study hard. Even people with four different certifications don’t like to study hard. This is hard to believe but it is my experience.

How valuable are the various types of notary knowledge?

Notaries these days who invest in Notary education study all types of topics. Some study Notary basics, others study TRID, Reverse Mortgages, Helocs, situational knowledge, elite knowledge, or just plain signing agent knowledge. Marketing skills are also taught by many agencies. So, which skills are the most valuable?

As a signing agent, companies typically babysit you unless you are very advanced and work purely for title companies. If you make mistakes, that is very unprofessional, but they generally catch you before it is too late due to the scan backs and fax backs. Notaries do not get complaints about errors on our site these days. When they do get complaints it is because they are rude or don’t show up, don’t return phone calls, or don’t get documents back on time.

So, let me make a pecking order of Notary skills in an order that makes logical sense to me.

Notary knowledge
If you don’t know how to be a solid Notary, you are endangering the public as well as yourself and leaving yourself open to legal liability. A mistake identifying someone, or filling out your journal can lead to a lawsuit, or lack of evidence in a legal proceeding. That is very serious and can ruin not only you, but all who are involved in a transaction with you. Failing to properly administer an Oath (when required) can lead to the termination of your commission if you ever get caught and is considered Perjury which is a Federal crime! If you don’t fill out forms properly or follow Notary law and procedure, you can ruin your life. So, Notary knowledge is the highest priority as a Notary Signing Agent and THAT is why we teach the finer points at no cost in Notary Public 101 on the blog.

Signing Agent knowledge
Knowing how to initial, date a right to cancel, and understanding the basic documents in a home-owner Refinances are skills that you will need to use a lot. You can ruin a signing if you miss signatures or initials, or put wrong dates on documents. Signing Agent skills seems to be a definite #2 in the pecking order of what you should study.

Marketing
If you know your basics, but don’t know how to attract work, you might get a few jobs here and there, but won’t have a side career of any scope. Learning Notary marketing is easy because there are good teachers everywhere. 123notary and LSS do a nice job teaching notary marketing. Some of the knowledge is available in our loan signing course and a lot more is on the blog in the marketing category on the right.

Specialty Skills
It is always good to learn more. Being TRID trained, or trained in reverse signings is great. But, that is the last step in my opinion. It impresses clients when you go above and beyond in your training. It shows motivation and effort and makes them more likely to hire you. But, learn the other stuff first as that is a lot more critical for basic survival.

How many certifications should I get?
The more the merrier. If you advertise with us, you should consider ours. If you are a paid member, we sometimes offer to test you by phone at no cost if you study from Notary Public 101, but we get very few takers. Our test is the hardest in the industry and our teaching materials are the most practical — and NOT the most expensive. We have the least expensive certification compared to the big players!

Notary Motivational Speaker

There are a few people in particular Notary agencies who do a certain degree of motivational speaking for Notaries. Normally they do this for the purpose of sales, or in my case to get you to study harder and write more in your notes sections. But, what if there were someone who specialized in Notarial motivational speaking? What would his name be? How about Chad Robbins, and we can pretend he is a distant cousin of my favorite motivational speaker Tony Robbins.

Chad never did well in school, or anything else he tried. He was failing in life. The only thing he had in his favor was that he was motivated, and could get other people motivated. He was at a job interview, and there were twelve others in the waiting room. He got them all pumped up for the interview, so that one of them got the job, but he did not. He couldn’t figure out what to do with his life. Years went by doing dead end jobs. He languished in despair, contemplated suicide, and moped around. Finally, out of the blue, someone came to him and said, “Why don’t you become a motivational speaker for Notaries?” He said, “Great, but what’s a Notary?” So, he took the 123notary certification course after becoming a Notary and signed up on 123notary.com — at least in the story he did. He learned from Jeremy how to motivate Notaries to greatness and decided to work with that and expand upon it. He became the greatest Notary motivational speaker ever.

CHAD: Working on that notes section will reward you for the rest of your career.

NOTARY: I know, I know, I know.

CHAD: What are you doing that is more important than creating that benefit for yourself which will probably translate into tens of thousands in extra revenue over the next ten years.

NOTARY: I have to clean the house and I have an assignment tomorrow.

CHAD: Will the assignment pay you $10,000?

NOTARY: No, of course not. They don’t pay enough. I’m only getting $60 if they pay me.

CHAD: If I had $1000 in my right hand that you could have if you wrote a good notes section and $20 in my left hand that I would just give you now, which would you take.

NOTARY: That’s easy, the $20 in the left hand so I would have time to do my crummy $60 signing tomorrow.

CHAD: You are a difficult case. It only takes a few hours of reading and modifying your notes to have a listing that stands out. If you don’t, you might get ignored and not even be able to survive in the Notary business.

NOTARY: Motivating with fear. Okay, you win. I’ll postpone the laundry, but if I get another $60 signing, I’ll take it before I complete my notes so that I have something to whine about.

CHAD: Good. Read the “Your notes section” category in the 123notary blog for tips and take notes. With your experience of 500 loans signed you will have something to talk about for sure.

CHAD: Linda, you are a new Notary, but you have no certifications. How will you stand out with potential clients?

LINDA: Oh, I’m certified by the State of New Hampshire.

CHAD: That’s not a certification, that is a commission. Getting a loan signing certification from one or more of the three best programs will help attract serious clients. It takes some work, but that work is what is going to jump start your career.

LINDA: I don’t have time. I have a $40 signing tomorrow. They are ripping me off.

CHAD: With no certifications and no experience you are lucky that people are even giving you a chance. The time you invest in Notary education will come back to you for the rest of your career. It only takes an hour per day for a month or two and you can be solid in your knowledge. That normally translates into an average increase of revenue per signing and also a lot more signings.

LINDA: I’ll wait until I’m really bored and then I’ll think about it.

CHAD: Older Notaries who don’t have credentials get used because of name recognition. They have been in the game for years. But, newer Notaries have no credibility at all. Let’s look at the search results on 123notary. Look, see Susie, she has four certifications as a signing agent, is a member of five Notary organizations, wrote a very comprehensive and well organized notes section and has a registered company name. Look at her, and then look at your notes section with your one liner that says, “Hi, my name is Linda. I am a Notary. I will travel. Call me first.” Why would anyone call you, when Suzie looks ten times as good as you.

LINDA: Oh my God, I never saw it that way. You win. I’ll buy the LLS, Notary2Pro and 123notary certifications and start studying. I will not be outdone by another woman!

CHAD: And remember — you need to be PASSIONATE about whatever you are doing. Live with ENTHUSIASM (raises fist in the air.)

LINDA: With me it’s not about passion. It’s about one-up-man-ship. I can’t stand the idea that someone else looks better than me. I’ll outdress her too. You’ll see. What does she wear?

CHAD: It says business casual.

LINDA: Well then I’ll wear fancier business casual or business formal. She will have something to worry about now.

CHAD: I’m not sure what I did. But, I hit the right button by mistake. Motivational speaking is all about pressing people’s emotional buttons. Greed, fear, revenge, passion, one-up-woman-ship, desire, vision, etc. Some people are more noble in their aspirations while others are more jealous, but I’ll get results any way I can.

BOTTOM LINE
If you write a thorough notes section on your listing, ask for help from Jeremy proofreading it, and get a few certifications, you will look really good to the clients. Get a few reviews as well from clients even if they found you somewhere else. The time you invest in bettering your listing could be worth more than $1000 per hour in long term benefits because you might keep your listing for ten years and reap the benefits every day for those ten years which can add up.

It is worth it to sacrifice less critical short term things you want to do for long term goals of studying, and refining your marketing presence. It doesn’t take that much time. If you compare it to the time you invested in high school or college, this is nothing, but the payback is often huge.

Precautions as a notary are like wearing your seat belt

One out of seven seasoned Notaries I talked to has ended up in court at least once. Generally this happens because of something outside of the Notary’s control. Fraud, theft, or someone taking advantage of a confused elder are the main reasons for court cases.

Notaries who have never been to court think it will never happen to them. It is like car accidents. Bad ones do not happen much, but when they do, if you are not wearing a seatbelt and/or don’t have good airbags, you might be in big trouble. Just because it hasn’t happened yet, doesn’t mean it won’t happen tomorrow, or in twenty years. So, take precautions. Think of these as wearing a facemask if that makes it more relatable.

If a signer is senile, elderly, in a hospital or nursing home, make sure you can identify they correctly and that they can explain to you what they are signing. Don’t ask yes or no questions as they will say yes to anything and are probably on morphine and not all there. If they go over the document point by point, then they know what they are signing today. They might not remember a year from now though, and that is dangerous for you if it goes to court.

Your journal is your only evidence, so if you say, “My state doesn’t require a journal” you are a fool. The state might not require it, but a judge or investigator needs the journal as that is your only evidence of what actually happened.

PRECAUTIONS
1. Make sure the name on the ID proves the name on the document. Don’t use the “you can have more but not less” rule, because notaries always forget which document you can have more on – the ID or the document. So, remember my rule. “The name on the ID must prove the name on the document.” The ID name can be matching but longer, or matching and identical to prove the name.

2. Take a thumbprint unless your state forbids it. I personally might take a thumbprint anyway in Texas because the state forbids selling or distributing that information and not taking it — and that is your only hard evidence of the identity of the signer. Fake ID’s abound, but fake thumbprints do not.

3. In the “Additional Notes” section of your journal write down about the situation, the mental state of the signer, who else is there, and that the signer explained the document to you. This could save your rear if you go to court three years later because you will not remember what happened off the top of your head. Write down anything else noteworthy about the situation to job your memory when investigated.

4. Decline jobs that are too sketchy or if you are unsure that the signer knows what is going on.

5. Have the signer verify who the other people are with them if they are elderly. Sometimes they are not related and sometimes they are scamming the signer.

6. Make sure you know how to give Oaths correctly. You could lose your commission if a judge finds out otherwise.

SUMMARY
I was investigated 3 times, but had my paperwork and thumbprints in order. It took me minutes to query jobs done a year or so ago since I had a stack of journals all in chronological order. I always identified people correctly and took notes in my journal for credible witnesses and other pertinent facts. Be sure to do the same, or even more. If you do everything correctly, you still might end up in court, but it will be a shorter case as you have more compelling evidence as to what happened — especially the thumbprint which is your only hardcoded proof of identity.

Tips for getting more assignments as a new Notary

Here are a few tips for the new folks to get more business.

1. Take jobs that others won’t.
Most Notaries are picky. They want the best jobs for the highest price from the nicest companies. If you are trying to develop a reputation and get signings under your belt, do the opposite! Take signings that are far away, pay little, involve a lot of fax backs, or sound difficult. You have to get your foot in the door.

2. Advertise on all the major portals and directories
Snapdocs, 123notary, Notary Rotary, Notary Cafe, and others

3. Advertise in more counties on 123notary
We don’t even charge for this. Once you are listed you can have up to 12 counties, and sometimes we can accommodate for more. If the database cannot accommodate them on one listing, we can create additional listings which generally is not free, but for an affordable cost if you want a larger net.

4. Call all signing companies in the nation that are doing a lot of business. Talk to all title companies within 90 minutes of you as well. If they need pick up and delivery, you might be their person.

5. Having mobile equipment helps
Mobile printing, scanning, faxing really helps. But, if your equipment is at home, make sure to have a dual tray printer, a reliable scanner, fax, and whatever else your clients say they need.

6. Network
Get listed with your local chamber of commerce, let local hospitals, Attorneys, nursing homes, airports, jails, bail bonds people and Real Estate brokers know you are in business. Often they have their own Notaries, but people get sick, quit, or won’t notarize due to conflict of interest.

7. 25K E&O Insurance
This is the minimum, but some people get up to a million to let people know they are serious. An absolute beginner should probably stick to 25 or 100K. But, you an upgrade if you start getting title work because the title companies want more.

8. Let everyone know you are a Notary
People often need a Notary and it is handy if one lives nearby who people know. Mention you are a Notary on your Facebook page, Twitter, at networking events, to your neighbors, the local stores, and anyone else you can think of.

9. One certification is good, but…
It is good to be “certified”, but having three or four certifications lets people know you are three or four times as serious as the others.

Biden; Pipelines; The Economy; and Jobs (or the lack of them)

I guess I’m getting used to President Biden now. I am less put off when he speaks, forgets what he is talking about, or trips and falls. I think that he is not trying as hard. His voice doesn’t put so much emphasis on his keywords like “DIG-nity”, and “UN-ity.” He is saying these words in a less affected tone of voice which is pleasant. He is being more himself now rather than doing play acting which is refreshing. I never liked operettas anyway, although the songs are nice. But, the silver lining in the Biden presidency is that Kamala is a cool and stylish person and hopefully will designate masala dosa to being our new national dish, or at least our national top ethnic dish — high in protein and not lacking in taste especially if you use the “gun powder” seasoning — and yes, it’s spicy.

Pipelines
Biden put many pipeline people out of work. I am pro-environment, but putting people out of work doesn’t “work” for me. I prefer the idea of starting a solar program and putting those pipeline guys to work doing something OTHER than fossil fuel related. But, now we have less energy production, and dangerous countries like Venezuela, Russia, and Bahrain (It’s near Iran & Saudi Arabia) are going to benefit from Biden’s energy move – at least for now. But, I heard that we would have more solar jobs down the pipeline — bad analogy, but a good thought. The bottom line is that less Americans will have job, and the other Americans will have to pay more for imported energy resources. Sounds like a lose lose.

Minimum Wage
The economic departments know that when you raise minimum wage, you get higher unemployment. You don’t need a PhD to figure this out. If you price a product too expensive so that people can’t afford it, they won’t buy it. Beginner workers, or workers with drug problems or who are questionable, or just not that good will be a lot more likely to be unemployed. But, Biden and America don’t seem upset about this… yet. But, once unemployment hits 20%, even Trump haters will be scratching their heads. Some workers are worth $3 per hour, so they will be permanently unemployed even if minimum wage is $3.10. These people turn to selling drugs, robbing, and loafing as there are no other alternatives. Many people are in this situation already, but society ignores them.

Notaries
Biden wants many freelancers to be classified as employees. It will be a lot more paperwork and risk for signing companies to hire notaries as employees. They might have to play social security tax, unemployment, and other taxes on Notaries. It might get a lot more expensive to hire notaires, and notaries might be unemployed. 123notary might lose half its members. The future looks dreary. On the other hand, perhaps Biden won’t make any executive orders about this, or perhaps the courts won’t allow it.

Already in California, many people who worked freelance have left the state because they can’t get hired due to the AB5 bill which classifies many freelancers as people who must be defined as employees.

SUMMARY
Although I care deeply about the environment, I think that it would be better if Biden can offer incentives for companies to develop solar infrastructure. But, this industry is so weak in the USA. China leads the world in solar, so Biden might just be helping his friends in China sell solar panels to us. Creating a boat to jump to energy-wise seems a lot smarter than sinking our existing fossil fuel boat prematurely. We’ll find out the hard way. A carbon tax would be a good place to begin.

But, in general, life would be so much better and profitable for almost all parties if the government would just shut up and back off. Now you know what I put my parents through — hint, hint!

A PARTING THOUGHT
I really like the idea of a solar pipeline. I’m not sure how that would work though.Maybe batteries charged by windmills could go on a conveyor belt through a pipeline. I wonder what Native Americans would say about that type of pipeline — I don’t think it would leak which is a huge improvement over the old kind.

Biden is not being realistic about solar energy. It will take time to develop a mature solar program. It has to start in a healthy way, grow, and become efficient. Currently there are no huge solar companies in the USA, only tiny ones. Coming up for a way to nourish the fast growth of free-market green companies is my goal. Maybe America will come to its senses and start talking about that.
