Inspecting Journals

Many Notaries do not bother to learn how to correctly fill in their journal. This is important because you could be investigated by the FBI (it happens to our notaries from time to time) and you could end up in court before a judge. You might be treated more leniently should anything go wrong if you keep very prudent and correct looking records. If you have omissions, sloppiness and don’t follow sensible procedure, you increase the chance that you could end up in trouble.

The most important rules to remember in journal entries are:

1. Fill out all fields in the journal. The additional notes section can be used for anything noteworthy about the building or signer that might jog your memory years after the fact in court.

2. One journal entry per person per document. Three people each signing four documents = 12 journal entries, not three and not one using the squeeze it all in method. Those signatures and thumbprints that you could keep in your journal are evidence that might be used in court – treat it as such!

3. Make sure your journal is locked up and stored properly after it is filled up. There are 512 entries per journal, so make sure you have extra blank journals for when you need them.

California actually inspects Notary journals regularly. If you live in California you need to know this. They can have you copy and mail your journal entries from a particular date range. If you are not following proper procedure based on what they currently want (ask them not me what they want) then they can suspend you. California suspends or revokes many notary commissions due to exactly this reason. Additionally, the rules keep changing so keep up with the times, man.

Does a signature need a signature line?

Does a signature require a signature line? Does a car need a road? Does a taco need a plate (or banana leaf?)

This question opens up a can of worms, especially since many signatures resemble worms. A signature does not require a signature line. But, it is customary to have a signature line that you sign upon. Many Notaries might be tempted to draw in a line in their own handwriting if there is no signature line on a document that needs to be notarized. Is this practicing law to alter a legal document? Or is the alteration such that it does not compromise the content or character of the document in any meaningful way? These are questions for an Attorney and I cannot answer them myself.

I have seen a particular document show up in many loan packages. It says, “This form must be notarized.” However, there is never any notary wording, or a signature line on the document. So, I would add an Acknowledgment form and have the person sign the document. If the borrower wanted to draw a signature line that is better – that way they are doing the tampering and not you.

A document that lacks a signature line is definitely unprofessional and not well thought out. But, technically, a document doesn’t require a signature line, strange or “misaligned” as that might sound.

How Much Can I charge for a mobile notary assignment and be sure that I will get the job?

There is no easy or definite answer but based on my experience over many years, I have the following suggestions.

First and foremost, don’t immediately say YES when you are asked if you are available to do a notary signing.

The first question should never be, “how much are you paying”? Instead ask informative questions.

When (day and time) do they need it, what type of signing is it (Loan, refinance, POA etc), where is it and how many signatures are being notarized?

If you are comfortable with the answers you get on the above questions even if you don’t get all of the answers, then proceed with getting further details.

Who has the documents? If they are going to email them to you, when is the latest you can get it? Do you need to print one or 2 sets? Do they want you to fax or scan & email them back or drop it at a FeDex or UPS office? I always tell them to email the borrower a copy of the loan documents so they can review them ahead of time and not waste your time reading all of it and ask you questions when you get there for the signing.

After going through your questions, now is a good time to ask them how much they pay for the notary signing and for you to negotiate. You know the distance, date, time and hopefully number of signatures to be notarized. You need to know how much your time is worth and is it worth driving 1 hour for $75 or $150. Be prepared to let them know your reasons for your fee. In Los Angeles, the traffic can set you back 2 to 3 hours depending on where and what time you are traveling. What revenue are you giving up during the travel time otherwise known as Opportunity Cost?

I was recently blindsided when I accepted a notary signing for $250/-. On the surface it seems like more money than the average signing. The two critical mistakes that I made are not finding out definitively if the loan signing is for California or out of state and total number of signatures to be notarized. Out of state loan documents especially New York require more notarizations which require that you prepare California Acknowledgments or Jurats. Never assume that the number of signatures notarized are generally the same at around 4 or 5 for loan signings. The number of signatures I notarized was 30, not including numerous signatures and initials. Without the traveling fee alone, I could have charged up to $450/-. The signers wanted me at their house on the west side of Los Angeles at exactly 6 p.m. because it was convenient for them. That is rush hour and I spent an hour and one half on the freeway and only got there at 6:30 p.m. and offered my apologies to the signers.

As I drove back at 8:30 p.m., I reflected on how I can avoid repeating my mistakes. Although I asked for the number of signatures to be notarized, they told me that they did not know. Going forward, if I was told that they did not know the number of notarizations, then I would confirm via email that the mobile fee is good for up to 6 signatures and anything more they will be charged an additional $15/signature notarized. Next, I will not accept any assignment that will force me to drive during rush hour. If they insist, I will charge an additional fee depending on how long I expect to be stuck in traffic. If they don’t want to pay, that is fine. They can find another notary but at least I am valuing my time and they will know it.

What could be more exciting than attending the biggest notary high school reunion of them all, the big 5-0? A chance to feel great that the cool kids grew up to be old and dumpy. And the geeks grew up to be old and dumpy. It’s the 50th. You were expecting “svelte?”

Jill: Hi?? … (noticing Jack’s notary high school picture nametag): Ohhhhh… Jack! Sorry for your loss.

Jack: Yeah, I went bald in notary college. You still look hot.

Jill: Thanks!

Jack: As in hot flash.

Jill: Menopause happened back in my fifties, so I’ll take that as a compliment. Are you still performing Notarial Acts?

Jack: I still witness signatures. The ones my kids make trying to sign me into a home.

Jill: At 68, they’re trying to put you in a nursing home? That’s not very nice.

Jack: I’m joking. I retired last year. Made a killing.

Jill: That’s great. How did you do it?

Jack: I was a notary specialist. My clients were all octopuses. Eight arms. Eight signatures.

Jill: That adds up. Remember our teachers in Notary Junior High? Mr. Guther?

Jack: How could I forget? He suspended me for embossing my private parts.

Jill: Oh yeah! You were a wild kid.

Jack: But I got an A in shop class for making the stamping device.

Jill: You affixed it to a tangible record, all right.

Jack: Weren’t you a cheerleader back then?

Jill: I sure was. I still remember our chant. “Give me an A, give me an F, give me an F, give me an I, give me a D, give me an A, give me a V, give me an I, give me a T, what’s that spell?

Jack: Affidavit?

Jill: I don’t know. I was a great cheerleader but a lousy speller.

How long does it take to fill in the journal entries for one loan?

Many Notaries use the “cram it in” style of journal entries and claim that it saves time and that it is okay. But, there are several problems with it. First of all, what is the cram it in system of filling in your journal?

If you put multiple documents in on a single journal entry — that is what I call the “cram it in” journal entry style. Normally there is a single signer for these multiple docs on the entry, but some people put two which is even more crazy. Below are the problems associated with this wrongful technique.

1. Fees
Most states allow a Notary to charge a maximum fee per Notary act. If you put multiple Notary acts on a single journal line, you cannot document what you charged for each Notary act.

2. Notary Act Type
If you are notarizing multiple documents in a loan, traditionally there will be different Notary types. There will be acknowledgments for the Deeds and perhaps other documents and Jurats for the Affidavits. You cannot distinguish which document received which type of notarization if you use the cram it in method of journal entries.

3. Court Issues
If your signing goes to court, the signer could claim to not have authorized the notarization of any of the documents listed in your journal as you theoretically could be in cahutz with the Lender and could have added the names of more documents after the fact. It is rare to have an issue in court due to the cram it in method, but I have heard of two examples in my career about how it makes the court case a lot more confusing and you can’t prove that someone consented to be notarized. It can result in a situation that looks like fraud was likely. Why put yourself in that position?

4. Kosher Issues
It just isn’t kosher to add extra document names in a single journal entry. Proper journal entry procedure means one document and one signer per entry — that’s it.

SUMMARY
It is easier to just fill out the journal entries one by one. You might have to write the address many times. It might take about 45 seconds per entry, and with a loan of 12 notarized signatures you might spend 10 minutes total filling out the journal and another minute getting people to sign and thumbprint multiple times. That is about 8 minutes longer than the cram it in method and could save you lots of time in court after the fact. Additionally, if your state audits journals, it could save your career — a valid point to remember in California and in the future perhaps other regions!

Maximum Notary fee $5, but the signing pays $200?

Each state has a maximum notary fee per notary act or procedure. Some charge by the signature, Florida charges by the stamp if I’m not incorrect (better look that one up.)

But, if you are allowed $5 per signature, the signing has four signatures, but pays $200, then what? Are you breaking the law? Or are you being paid for mobile fees and supervising fees? The truth is that you are being paid for a bunch of responsibilities within your service:

Printing documents
Confirming an appointment
Supervising the signature and initialing of documents
Answering simple questions (perhaps)
Not answering questions you are not supposed to (unless you are a know-it-all who is looking for trouble)
Notarizing
Waiting while people read or have long conversations by phone with the Lender.
Getting the documents safely back where they belong
Availability for after service.

All of those combined definitely merit at least $125, don’t you think?

So, how do you document this in your journal? $5 per notary act. Two people x two notary acts per person is four lines in your journal each stating $5 for the notary fee. And then in the additional info section for the first notary act of the set, put down you got $180 travel / supervising fee for a loan signing. Then it is all documented just in case the IRS has any questions. Notary fees are not subject to self-employment tax but travel and supervising fees are. Look it up in the SE instructions.

But, what if you live in California and the Notary fee is $15, you have ten signatures, but the job only pays $100. You could charge $150 plus travel for that signing, but your Lender or signing company isn’t paying that. Just put whatever you want for the notary fee between zero and $15 per notarized signature in your journal. And do a reasonable estimate for what the travel and supervising fees should be — just estimate and try to be proportionate.

Travel fees vs. Notary fees in your journal

For those of you who keep a Notary journal, you need to record the Notary fee as one of the fields. But, what if you get paid $65 for a signing with a travel fee and two signatures? How do you differentiate between the travel fee and the signature fees?

You can either arbitrarily decide how much is a travel fee and how much is a signature fee if the job is a flat fee. Or you can base the fees on the fees you quoted the client.

When you fill in your journal, the main thing is to put a Notary fee that does not exceed the fees allowed by your particular state, otherwise you could be accused of charging excessive fees which is illegal. If California allows $15 per notarized signature on an Acknowledgment or Jurat, then you cannot inscribe more than $15 per journal entry for each Notary act.

For those of you who use the “cram it in” style of journal entries, you cannot put a notary fee for five documents on the same line. It just doesn’t make sense. This is yet another potent reason why you should not use a style of journal entry that inputs more than one document per line. It is impossible to prove in court that the signer consented to all of the documents being notarized since he is not signing for a particular one. It is also not possible to know what the fees involved are either which means you are not doing proper bookkeeping.

As far as the travel fee, you could input the travel fee for a particular appointment in the additional notes section of the journal entry and indicate that is is a travel fee. The travel fee I would indicate once on the first journal entry for a particular appointment. Correct and prudent journal entry procedure requires separate entries for each person and document. So, once again, three people each signing four notarized documents would result in twelve journal entries with the travel fee indicated in the top entry.

The Notary Pride Parade in West Hollywood

We are having a Gay pride parade or event in West Hollywood. Lots of people were practically naked and the clubs were booked. You cannot drive through that area without huge traffic problems. A waiter asked if I was going and I said, “Hell no!” I don’t want to be molested. Gay people in this area tend to reach out and touch someone. Why can’t hot women be the same way? If we only lived in an ideal world.

But, I think that Notaries should have a Notary pride parade. Except the Notaries should not get naked please. Maybe if you are 20 years old and hot, but not the over 50 crowd please.

There could be a Notary float with a huge notary seal on it — inflatable.
Another float could have signatures hanging on it and off it.
A third float could have an embosser.
Other floats could have documents or certificates.

Notaries could dress up as notary seals or documents or signatures. It would be like Halloween — notary style.

Good God this sounds scary. I think I like it though. I just hope none of the signatures in the parade are false otherwise it would be a falsified parade. What do you guys think?

Foreign language documents (California)

I get calls weekly from the public about notaries in California giving them a hard time with documents in a foreign language. Many California notaries are turning folks away (most of the time in error) because they are under the impression that they can’t notarize a document in a foreign language. The notaries feel that if they can’t read it, they shouldn’t notarize it. Unfortunately, this is not the case. Please read your handbook. You can find this information in the 2019 California Notary Handbook, page 20.

California notaries you can and must notarize any document presented in a foreign language provided you can communicate with the signer. What this means is that if the document is in Spanish (and providing all other conditions are met; such as personal appearance, have current picture government issued ID, etc. are presented) and you CAN communicate in either English and/or Spanish you must notarize their document. You don’t need to be able to read the document. Notaries notarize signatures on documents not the contents of the document. Period.

However, if you are presented with a document in a foreign language and they ONLY speak that language and you don’t speak their language you CANNOT notarize the document. You would then need to refer them to a notary that speaks their language.

Remember, don’t analyze, notarize.
