2013 Phoninar Quick Course

Here is the study guide for the phoninar!

The purpose of the phoninar is to help notaries learn some of the basics of signing without taking an actual course. Many notaries do not want to take a course, or they already took a course without mastering the material. My solution is to have a free quickie course to start them out with. If they can pass our over the phone test, we will keep them on the site. However, if they fail miserably, then we will most likely remove them from the site if they have a free listing.

Topic #1
The Right to Cancel
Most notaries have a rescission calendar that they refer to when calculating the last day to rescind. Few notaries know when all of the Federal holidays are. Many notaries also can not think clearly about how to calculate the last day to rescind mainly because they have never practiced calculating this date. If you want to come across as a professional, learn to give quick and accurate answers to simple everyday signing questions.

In a residential refinance, the borrower has (3) days to rescind not including Sundays and Federal Holidays. Be careful, Presidents day and Washington’s birthday are synonymous. Also, Flag day is not a Federal Holiday, but banks might be closed. Some lenders do not count SATURDAY as one of the (3) days to rescind, but formally, Saturday is considered a business day in terms of calculating rescission. Other lenders allow the Friday after Thanksgiving to be considered a holiday when legally it is not. Basically, each lender is different, but you have to know the basic laws effecting rescission instead of relying on what the handful of lenders you work with say.

Here is a list of Federal Holidays — memorize these for the test
(1) New Years Day, (2) Martin Luther King Day, (3) Washington’s Birthday, (4) Memorial Day, (5) Independence Day, (6) Labor Day, (7) Columbus Day, (8) Veteran’s Day, (9) Thanksgiving, (10) Christmas

Quick Facts
(a) There are two blanks for dates in the RTC which are generally filled in by the lender. Once in a while the notary needs to fill in these dates or correct them. The technical terms for these dates are the Transaction Date and the Rescission Date. Please memorize these terms for the test.
(b) The date of the signing is NOT included in the (3) days to cancel. If a loan is signed on Monday then Tuesday is day 1, Wednesday is day 2, and Thursday would be the 3rd or last day to cancel.
(c) Loans must be cancelled in writing by the deadline in writing by fax or mail, but not by email.

Topic #2
The APR
Most notaries know a little something about the APR, but this topic is actually very critical for your success as a signing agent. Every borrower wants to know why their APR is higher than their Rate. How good is your explanation. Here is what we want you to know for the phone test. Sure, there is more to know than what we are telling you, so learn the basics from us, and learn more on your own.

Definition:The APR is the annual percentage relationship between the payments and the amount borrowed, minus the fees. This rate is often used to compare the different loans borrowers have to choose from. The APR is almost always higher than the rate. The rate, on the other hand, is a monthly percentage relationship between the payments and the total amount borrowed, including fees.

Quick Facts
(1) The APR is documented on the Truth in Lending Disclosure
(2) The APR is usually but not always higher than the Rate
(3) Your definition for the APR should include the fact that it could include loan origination fees, closing costs, appraisal fees, inspection fees, points, escrow fees, notary fees, and other costs of the loan — those are some of the big ones.
(4) If you mention that the APR is often used to compare loans, you get points on the phone test
(5) If you mention that the APR might be compounded, you get points.
(6) Several notaries have claimed that there is no government standard for computing the APR, it is up to each individual lender.
(7) You could also claim that the APR includes the interest rate, all fees and costs of the loan, and incorporates them all into a compounded Annual Percentage Rate.
(8) There are many ways to define the APR, the key is to mention all of the components in a clear and easy to understand way.

The Rate
The Rate or Interest Rate is more of a topic of confusion with the notaries than the APR although it is much simpler to understand and actually easier to find. Traditionally, the Rate is always documented in the Note. The note by definition discusses the Interest Rate, monthly payments, and prepayment penalties (if any). Once in a while there will be a Rider associated with the Note that might discuss these issues as well.

Inexperienced notaries typically claim that the best place to look for the Rate is on the Truth in Lending. Half of them say this because they are so uneducated that they can not distinguish between the APR and the Rate. The other half choose the Truth in Lending Disclosure because the Rate is actually documented there in many cases. But, let me ask you — if you are in front of the borrower and want to make a good impression — would you look for the Rate in a document where it sometimes is, or in a document like the Note where by definition it ALWAYS is? I vote for always because you will look like a fool if you go fumbling through the documents trying to find the right information in the wrong place.

(2) In loans over the last few years the Rate is also generally documented in the HUD-1 Settlement Statement which comes later in the documents than the note unless it was sent separately.
(3) Some lenders include the Rate in the Truth in Lending, although this should NOT be the place you look for it first since it is not always there.

Dealing with errors in signings

Errors on Notary Certificates
From time to time in a signing, there will be an error in the notary certificates. Please keep in mind that handling an error in a certificate might be handled very differently from an error in the actual documents, or in the body of the actual documents, so please make the distinction.

If there is an error in the notary certificate — such as an acknowledgment or jurat certificate to name examples, there are various ways to rectify the situations. The problem is that each method has an upside and a downside.

(1) Cross-out and initial
This is a messy way to solve a problem on a legally significant document such as an acknowledgment. If a person’s name is spelled incorrectly, crossing out an initialing could get the document rejected by a county recorder. One notary had to cross-out wording on an out of state certificate that claimed that she personally knew the signer when in fact she did not know the signer. She crossed that out, and the document custodian was very upset. I told her to consider adding a loose certificate.

REMEMBER, it is the notary who initials changes on notary certificates and NOT the signers.

(2) Add a loose certificate and start all over
Legally, you can always add a loose certificate. However, the person or entity to whom you are submitting the documents to might not like it. Please distinguish between what makes your work legally acceptable and popular as the standards often do not match. The loose certificate has the advantage of having whatever name and wording you want it to have so you don’t need to cross anything out.

(3) Notarize the document twice?
Not illegal. You can do two journal entries and notarize twice. Notarize the original acknowledgment embedded in the last page of the document with the cross outs, and add a fresh certificate as well assuming you have a 2nd journal entry to match that one. Document this well in your journal for your protection.

(4) Redraw?
Redrawing documents is time consuming and expensive. It involves making new appointments and risking not getting paid. But, for an out of state that needs to be worded in a particular way, you can have them word it however they want it to be worded, so that no cross outs or illegal claims or acts are necessary.

Errors in the right to cancel
Notaries typically do not know how to fill in the dates of the right to cancel. From time to time a signing will be postponed a day, and you need to change the two dates in the right to cancel which are the transaction date (the date you sign), and the rescission date (the last day you can legally cancel). Please try to appear educated and don’t say the signing date, or the cancel date as these wordings are not educated sounding and are also not clear.

To fix the dates on the right to cancel you can:
(1) Cross out, right the correct dates and have both borrowers initial
(2) Pull a fresh copy from the borrowers copies and start all over. The borrower’s copies might or might not have the dates printed in the blanks. If you made a mistake correcting dates, then sourcing the borrower’s copies definately makes sense.

Fees on the HUD-1 Settlement Statement
If someone wants to know where their fees and closing costs are, please direct them to the HUD-1 Settlement Statement. But, which fees are on the HUD. There is a huge conglomeration of information on the HUD. Too much to teach. But, to impress us, you should be able to rattle off a handful of fees on the HUD without batting an eyelash. Here are a few fees typically on the HUD.

Services: Abstract of Title Search & Title Charges, Appraisal Fee, Attorney fees, Document preparation, Notary Fees
Transaction Costs: Assumption fees, Broker fees, Credit reporting fee, Escrow account deposits, Escrow Fees, Loan Origination fees, Points or commissions, Settlement or closing fees
Inspection Fees: Lead based paint inspection fee, Termite inspection Fee, Other Inspection fees
Insurance: Flood insurance Fee, Hazard insurance, Mortgage insurance application fee, Title insurance
Payments: Interest, Cash payments

Initialing
There are no legal standards for initialing. However, the purpose of an initial is to have an abbreviated way of writing your name in a document.

Andrew B Clay Sr.
His initials could be ABC, or ABC Sr. Which is better?

Some lenders don’t want a Jr., or Sr., on an initial.
However, if it is part of the signers name on Title, then it is part of their name.
The initials for Junior would be Jr. Therefor in my opinion, it should be part of the initial representing the forth word in the name.

What about Andrew Hooper III
I would have him initial AH III

There is no way to shorten the III part. But we don’t want to confuse him with his father and grandfather who might have been on title, so we will include the III unless asked by the lender not to. There are pros and cons in the different ways of initialing. Be thorough unless asked not to be by the lender.

Many notaries don’t realize how involved the loan process is, and how many parties there are involved. So, if you make a mistake signing a loan, you might be inconveniencing more parties than you think. Here are a few:

If your stamp was smudgy
If your stamp (notary seal) isn’t clear on notary certificate forms, recorded documents might be rejected by the county recorder. If there are cross-outs, or anything that the recorder doesn’t like, they might reject the document as well which would mean that the notary would have to notarize the document all over again which is very time consuming and involves scheduling. Each county recorder is different and there are over 5000 different county recorders throughout the United States!

Attorney in Fact wording
If Sam Smith is signing in his capacity of Attorney in Fact for Sharon Smedley, how would he sign? There are at least two ways: Here they are.

(1) Sam Smith, as attorney in fact for Sharon Smedley (I like this way best)
(2) Sharon Smedley by Sam Smith, her attorney in fact (ambiguous as to who you are in the signature)

Memorize the wording including the commas if you want to pass our phone test!

Fraud & Journals
Not all states require you to keep a journal, but for your protection you need one regardless of what your state says. No state forbids you from having a journal. In your journal you record the date & time of notarization, type of notarization, document name, document date (if any), signers name and address, type of ID used, ADDITIONAL NOTES where you record anything unusual about the signing, or if you used credible witnesses, the signature of the signer, and a THUMBPRINT.

Quick Facts:
(1) If a signer is accused of committing fraud. OR, if a third party is accused of tricking a signer to sign something or of forging a signature, then the thumbprint in your journal could keep protect you.
(2) The thumbprint could stop an investigation in its tracks since you have evidence
(3) A thumbprint could drastically reduce the time involved in an investigation or court case. Imagine being stuck in court for 30 days with no income because you did a risky notarization for an elderly lady in the hospital who was on morphine and couldn’t think straight.
(4) Warning — beware of notarizing the elderly. Make sure they understand what they are signing and can paraphrase what is in the document for their protection and yours. You are not legally required to understand the contents of the document, but they can get into huge trouble, and drag you into the trouble if they are being tricked into signing something — especially a power of attorney or deed.

Spouse not on loan?
This question is very state specific. New York deals with spousal issues differently.

As a general rule, if the spouse is not on the loan documents, they might need to sign any Deeds including the Deed of Trust, (Mortgage), Right to Cancel, Truth in Lending, Correction Agreement, HUD, and perhaps a few others.

Define beneficial interest
If a party is a beneficiary to a document being signed, they would have beneficial interest. But, who else might have beneficial interest too? If you are a relative of the signer such as a spouse or child, you might benefit from the document being signed. If you are a notary who won’t get paid unless the document is signed, then you have beneficial interest in the document being signed which is illegal. To keep it legal, make sure you get paid regardless of if a document gets signed to keep yourself impartial and above board. A notary’s job is not to notarize, but to say NO when necessary. Stand in front of the mirror and practice saying NO!

What is the difference between e-documents, e-signings, and e-notarizations

e-documents are documents that are sent to the notary electronically via the internet. A password and various types of downloading software would be necessary for e-documents as well as a high speed internet connection and a fast printer with good ppm.

e-signings are signings typically signed on a laptop with a wireless card. Some of the documents are still physical, and the journal used is physical.

e-notarizations require a special eNotary commission. Only about (9) states have such a commission. The signer is still required to appear before the notary in all, or almost all cases (varies over time and state by state — AZ at one point had some exceptions to the personal appearance law). ENJOA or an eJournal is used for e-notarizations. Unfortunately, county clerks offices are not always able to fulfill their legal obligation to be the custodian of eJournals after a notary’s commission is over. An interesting twist on some new technology that has many serious issues.

I make mistakes too!

The most dreaded thing happened to me after all these years. I get a call from one of my regulars of many years now asking me when I can come through. She has a fee notarizations for herself and her husband. The own an architect firm. We set up a time for the following day. I arrive about 10 minutes early which is what I always try to do. She pleasantly sits me down in our usual conference room, excuses herself and leaves briefly to get the documents. She comes back into the room and hands me one document in particular from a stack that immediately looks familiar. It was a document that I had previously notarized the week before. She goes on (while handing it to me stating that the county clerk had rejected it. I am thinking WHAT!?!?! Are you serious??…cant be so. But unfortunately is was so. It seems in my haste I had forgotten to put the ‘notary public’ after my name. (For those of you in other states this is now a mandatory requirement for all California notaries.) And of course the county clerk had rejected it. They had attached a nice little note with instructions for me to fix it. Which of course I did.

I was thinking ( and I told my client ) ‘I am so sorry, I cant imagine what was going on in my head’ to forget to do this, I assure her that after all that I certainly know better”. ‘But I am human’ as she told me. “We all make mistakes”. But this mistake in my eyes was unacceptable and now I have inconvenienced the client. They have to go back to the county clerk. So to make amends I adjusted my fee. I would have liked (at no charge) to offer to take it to the courthouse for them…but didn’t think of it until later in the day.

So remember to check your work. ALWAYS! Try not to let outside influences distract you. This can easily happen but It can cost you jobs and regular clients. I am sure they will call me back. But I really felt bad about my error. I know better but for me this was a wake up call. I was careless and did not check my work. And ultimately, I could have paid for it by losing a valuable client Or even worse yet it could have been a time sensitive document and because of my error they could have lost their valuable client and/or they could have missed a deadline and I could have gotten sued…god forbid. So don’t forget to check BEFORE you leave them. Doesn’t matter if it is one document or 20. make sure you have done your job. We can’t afford mistakes!

Tips for notaries

People are making too many mistakes
One experienced Washington, DC notary asserts that, throughout the country, “Some of the people just coming into the profession are not literate and make too many mistakes… I get a few calls a week from titlecompanies where the closing was not done correctly, and they ask me to re-do the work… If we want to be professionals, we have to keep ahead, follow the law, and continue to act in the best interests of all.”

Don’t backdate
“Besides being careful and meticulous,” he adds, “do not backdate documents or signatures, ever! No matter how many times you are asked to backdate documents– supposedly to benefit the borrowers– DO NOT do it. It is illegal. Knowingly putting a different date on a document is fraud and you could go to jail. I have heard of many young notaries who are willing to experiment with backdating. They say ‘What’s the big deal? I was asked to do this.’ As a Washington DC notary, I know I am a state official, and I take this seriously. There is even another notary site where someone claims ‘everyone does this’. NOT everyone does it, and in DC, I personally know several notaries who are now out of work because they got caught. And when your documents are rejected, you will also have legal hassles. Not worth it–if you want to last in this profession. And just as notaries talk–companies talk. Do not risk getting a reputation as an ‘easy’ and inexperienced notary.”

Understand the documents, but don’t advise.
Our Washington, DC notary continues, “READ through all the documents carefully, so you know what the borrowers are and are not being asked to do. The most called-upon notaries and notary signing agents are the ones who know exactly what a document is saying and can confirm that if a borrower asks. If you are a new notary signing agent, read through some sample papers to be able to understand the language and the fees the borrower is agreeing to. Of course, some notaries feel that giving a brief summary of a section could be construed as giving ‘legal advice,’ which is prohibited…so you need to reiterate that you are not giving ‘advice.’ Many borrowers have many questions, and really do not understand a document well enough to sign it; in that case, you must call the loan officer and have him or her speak to the borrower. You can summarize… but you can’t give advice. The better you do your job, the more you will be in demand. This means explaining clearly and in a reassuring way what something says–without giving ‘legal advice.’ ”

Title Producer License
For this reason–the fact that some notaries have given “legal advice”–some states, notably Indiana and Maryland, as well as DC–require a notary signing agent to have a title insurance producer’s license in order to handle loan signings. A North Carolina notary told us that, despite the recent ruling that notary signing agents may continue to do closings, “There is a ‘movement’ in the state to make NC an ‘attorney only’ state.” In Connecticut, attorneys generally handle real estate signings anyway. But Delaware, Georgia, Massachusetts (except if the notary works for the lender), South Carolina, West Virginia, and Vermont require an attorney to be involved in the signing…and Texas requires that any HELOC loan be done in the office of a lender, attorney, or title company (but could be done by a notary!). Says our North Carolina notary, “South Dakota is not clear on this issue, and seems to say that an attorney usually handles a loan signing…but attorneys often send their notaries to do it! Honest! The point? This preference for having an attorney supervise a signing is becoming a trend, and you should check with your state and get any necessary certifications that will assist you.”

Taking the trouble to get a new certification
A few notaries have reported that they do not want to go to the trouble of getting a new license or certification of any sort…but it is one more tool to help you get the work you need. A title producer’s license (also called a title insurance producer’s license) just means that you will have taken 50-60 hours of special coursework and will have passed an exam and paid an extra fee. “This license may be one more certification you want to obtain if you want to stay ahead of the game,” our North Carolina notary asserts. “The more certifications you have, the more you will be ready to serve the public as a notary or notary signing agent.”

Have a business plan?
Finally, one of the best tips we’ve heard recently is to have a business plan. It is always surprising the number of people in the notary business who do not have a plan. A plan means knowing what the market is in your area, who your competitors are, how and where you will expand, how much to invest, and also what certifications and credentials you will have. This includes knowing your strengths–what people like about you– and good reviews from those you have done work for. Getting good reviews from people who value your work can give you–as well as others–a fresh idea of what your skills really are, how you look to others. And when others read the reviews of your work as a notary, they will choose you because they will feel your experience and way of doing things are most relevant to their needs.

Tisk tisk: notaries on Facebook.  You mostly misunderstood my discussion question about getting fees at the door for signings to prevent beneficial interest. this discussion took place in Jan 2012. I was NOT talking about loan signings.  At Loan signings they pay you three or four months AFTER the signing if you are lucky, not in cash at the signing. It is very obvious that I was talking about doing a traveling notary job for an individual person.  The problem is that most of you depend solely on loan signings for your living when there are many jobs for individuals which you either don’t know how to handle or reject because you are not familiar with it.
 

A typical botched jail notary job
Let’s say you drive 45 minutes to a jail to meet the girlfriend of a criminal.  You meet her in the parking lot or in the front door of the jail.  Let’s say you don’t collect your travel fee of $50 at the door.  Let’s say that hypothetically you walk to the guard, fill out the forms, but lo and behold, the prisoner has been moved to another jail 90 miles away.  Then you say, may I have my travel fee please.  The girlfriend says, “BUT YOU DIDN’T DO ANYTHING”.  And then you say, “Sure I did, I drove 45 minutes, talked to you on the phone, walked in here, and now I have to drive 45 minutes back home, and also go to the gas station which takes more time and money.  Pay up!!!  You will get stiffed, because they will feel that they do not owe you if you didn’t quote unquote DO ANYTHING.

Let’s say you drive an hour to a hospital at 3am to accommodate some desperate people.  You don’t get your travel fee at the door in cash like I recommend.  You go upstairs with the signer’s son in law only to find that the signer is on morphene, fast asleep, and in no position to sign anything or even sit up.  You ask for your travel fee for your 2 hour round trip, and the son in law says, “Sorry, but I’ll pay you when you come back next time, I didn’t realize that the nurse drugged Shelly’s dad”.  You just got stiffed again.
 
This isn’t rocket science. If you work with the public, they will leave you high and dry if you don’t protect yourself.
 
3rd example… beneficial interest
Lets say you go to a notary job.  You do NOT collect travel fees up front. Let’s say that the signer’s name on their ID doesn’t match the name on the document enough for you to legally or ethically notarize them.  They say, “Oh come on — you are being unreasonable”.  They say they won’t pay you a penny unless you notarize the signer. They have you by the balls because you didn’t think ahead.  If you have the travel fee up front, then you are in control and will not be persuaded under duress to break the law so you can get your lousy fee!
 
Last example:  The law office.
You are called into a law office 10 minutes away. You are instructed to show up at 1pm for a signing. Your trip fee is $30 and your waiting time fee is $20 per half hour with the first ten minutes complementary.  Let’s say that you never collected your $30.  The attorney says they won’t be ready for another 10 minutes.  But, 10 becomes 20, and 20 becomes an hour, and then finally after 90 minutes, you finally do the signing, and then they pay you, but they won’t pay for the waiting time.  If you had gotten your $30 at the door, you could threaten to leave if they don’t pay the wait time up front for each 30 minute increment.  If you don’t have the trip fee, you have no leverage. This has happened half a dozen times to me in my notary career!

Protecting yourself with a contract 

It is common for big companies to make the little guys sign a contract with many terms for doing business. One common term is to have an arbitrator resolve issues, and the arbitrator is probably picked by the company in question — how fair!!! ……. Not!    But, how often do the little guys think far enough ahead to protect themselves?  I say that notaries need to make signing companies sign something that will protect the notary’s interests.  But, will anyone sign it out of desperation? If they like the notary enough, they might, but if you are a novice with no experience, you will not have such good luck.
 
Here are terms that I would discuss.
 
Trip Fees
If I am assigned a signing agent / notary job by your company, and travel to an assigned location, and the job is cancelled while in travel, I want a $50 trip and preparation fee.  I want $75 for jobs more than 40 miles from my house according to mapquest’s mileage estimates.
 
Printing Fees
If I am assigned a signing agent / notary job by your company , print out documents and borrower’s copies, and then your company cancels, I want a $40 printing fee.   (it might not be worth this much, but you have to factor in the hassle of billing these clowns and trying to collect).
 
Payment regardless of funding
If I am assigned a loan signing job by your company, and I complete the signing, but the loan doesn’t fund, your company must pay me $100 per signing.
 
Payment regardless of if the borrowers are willing to sign
If I am assigned a loan signing job by your company, arrive at the specified location, and start a signing with the borrowers, and then they change their mind about signing and refuse to sign, your company must pay me the entire fee agreed upon.
 
Waiting time
If I am assigned a loan signing job by your company, I will allow up to 60 minutes for the job.  If the borrowers want to read every letter of every word in every document and take in excess of 60 minutes, I require a waiting time fee of $40 for every additional 30 minutes, or any fraction thereof.
 
Late payment penalties
I expect to be paid within 30 days for all loan signing services.  If a payment is post-marked late than 30 days from the date of the signing, I will charge a late fee of $25 per signing, and then an additional $25 for each fifteen days after.  If you fail to pay this late fee, I will terminate services with your company.
 
I think that notaries are fools to just be willing to do business with anyone without even background checking them.  On the other hand, a contract like the one I drafted (written in informal language and not legalese) might be too demanding, especially the waiting time.  Perhaps a more liberal contract should be drafted, but notaries need to take protecting themselves a lot more seriously and get more professional and methodical about it.  Bigger companies almost always make you sign a contract, why shouldn’t you?

Where do credible witnesses sign the notary journal (register)(book)? 

Some states require notaries to carry an official journal of notarial acts while others recommend it, but don’t require it. Some states call the journal of notarial acts a journal, while others call it a registry or a book.  The main thing to remember, is that a good notary journal must be bound and sequential. Each entry must be in chronological order.  Different journal manufacturers make journals differently.  I recommend getting one with a thumbprint section and space to write notes. Most states don’t require notaries to take thumbprints, but for your security as a notary, you need thumbprints to keep you out of court if anyone questions whether the signer was a fraud or imposter.  Thumbprints are a better proof of identity than any other means.
 
The credible witness signs the notary journal in the additional notes section!
They do NOT sign in the signature area!!!  Signature areas are for the document signer, and only one document signer can sign in a particular journal entry’s signature area. If there are two signers, then make two journal entries!  The credible witness must sign in the notes section because there is blank space there.  You should document the credible witness’s identification, phone, and address to be thorough.
 
The notary needs to administer an Oath to the credible witness where the credible witness must swear to the identity of the signer. Make sure the credible witness really knows the signer well, otherwise they are not really qualified to identify someone that they know only as “Ralph”, and don’t even know his middle or last name!

Notarizing your Foreign Language Document

“The bank refused to notarize the document because it is written in Hungarian”, said the exasperated client to me. “No Problem” for http://kenneth-a-edelstein.com was my reply. There is no requirement for the New York notary to be able to read the document, none whatsoever. Consider a 765 page document regarding the sale of a Supertanker – do you think the notary will read it prior to notarizing the signature on the last page? Well, if they are not going to read all pages of all documents – why would they want to be able to read some pages of some documents? I doubt if I will ever know.

There are some interesting considerations regarding languages involved in the notarization process. But none have anything to do with the actual document. The main language requirements in New York are related to the required oath given by the notary. The notary must be able to give the oath directly (no interpreter allowed) to the person whose signature will be notarized. The person signing must be able to read the document in order to swear/affirm that the document is truthful/correct. That is the relevant language consideration – the document could be in Braille or Latvian – it does not matter to me.

Part of some NYC notaries’ refusal to handle this situation is their employer’s desire to avoid the possibility of being involved in a lawsuit. Some Manhattan banks will not notarize a Power of Attorney, some refuse a Bill of Sale – the reasons are the same; avoiding being involved in
litigation. If the notary can’t read any of the document it “might” be a prohibited (by “bank” policy) – thus all “unreadable” documents are often refused. At http://newyorkmobilenotarypublic.com that is never the case.

It is a “best practice” to prepare foreign language documents in both languages. Most times this is done by formatting the document into two columns with English on one side and the other language on the other. One advantage of doing this is that it allows the affiant to sign twice. The signature on the English side will be compared to their ID – the other language is not. Thus, it is the English signature that is being notarized – and most ID documents in this country have English signatures.

A.  Any individual over the age of 18 can be a witness to a document signing or Will signing.
 
Q.  Can a notary charge for acting as a witness?
A.  If acting as a witness is an official notary act in the state where the notary is commissioned or acting, then they can charge whatever their state’s maximum appointed fee is.  In all other states where witnessing is not an official notary act, then the notary can charge whatever the client will agree to.
 
Q.  Should I hire a notary to act as a witness?
A.  You can if you like, but unless you need some special documentation done, that only a notary can perform, there is no real need to have a notary around.

If you are a California notary public, and you are at a signing where the signer doesn’t have a current government issued photo identification document, (or EXPIRED is okay if issued within the last five years) you will not be authorized to notarize the signature of that signer without the use of credible witness(es).
 
When can a California notary use credible witnesses?
If the signer has no identification, or if it is going to be very difficult to obtain (perhaps it got misplaced and is very far away), then you can use one or two credible witnesses depending on whether or not you know the witnesses.
 
When can I use only 1 Credible Witness?
If the Notary in California knows the credible witness relatively well, and the credible witness knows the signer’s full name (without you having to tell them the complete name), then you can use just 1 Credible Witness
 
When can I use 2 Credible Witnesses?
If the California Notary Public doesn’t know the Credible Witness, then you need to depend on the Oath of 2 Credible Witnesses who know the signer’s full name.
 
Identifying the Credible Witness
You need to check the identification cards or documents of the Credible Witnesses. If they don’t have any, then you can not use them.  They need to have current, (or EXPIRED if issued within the last five years) government issued photo identification with a physical description, signature, serial number, and expiration date.
 
Oath of Credible Witnesses in California
The California notary needs to have the Credible Witnesses (one by one) swear under oath that they will tell the truth, the whole truth, and nothing but the truth.  Then, ask them what the name of the signer is who you are pointing to.  If the answer is, “Joe”, then make sure to ask if “Joe” has a middle or last name that they are aware of. If they can’t answer this question, then perhaps they are not the ideal witness for you!
 
Documenting the Signature of the Credible Witness in your journal.
It is required by law to document the signature of the Credible Witness or Witnesses in your journal.  Have them sign in the notes section, NOT the signature section.  Have the document signer sign in the signature section.  It is optional but recommended that you also document the printed name, address, phone number, and identification information about the Credible Witnesses in your journal.
 
If the idenfication is expired – what is the issue date?
On California drivers licenses, there is an issue date documented at the BOTTOM of the card.  This date is not labeled as an issue date, but it is clearly several years before the expiration date, and you can logically deduce that that was the issue date.
 
Get a thumbprint? It is a stronger proof of identity than anything else!
If you are identifying a signer in California based on the oaths of credible witnesses, I would strongly recommend getting a thumbprint of the signer in your journal.  Although only required by law for Deeds and Powers of Attorney notarizations, the thumbprint is a much stronger proof of the identity of the signer than the Oaths of a few people who hardly know the signer.  Please keep in mind that in rural Tennessee, you probably know your neighbors well, and your family’s have probably known each other since not far after the Mayflower landed.  But, in urban or suburban-sprawl California, you probably don’t know anyone well because people tend to not know each other in California.  Credible Witness rules were created a long time ago when people used to know each other a lot better.
