A comprehensive guide to Notary Pricing

It’s been a long time since I have written an article on pricing, so I feel it is high time! Most Notaries want to have a fixed fee and make tons of money. This is not always possible. The Notary market is a market with lots of little ups and down that a smart Notary needs to constantly adjust to. It’s smarter to have systems and formulas worked out ahead of time so you know how to react to these fluctuations.

There are fast days and slow days, monthly highs and lows, as well as changes in the market that happen over the years. There are also changes in who is competing with you in your area at a particular time. The key is to be flexible and learn how to charge accordingly. Here is how I would set my prices.

1. Time Involved
A smart Notary should charge based on how much time is spent. Notary jobs during rush hour involve more time. Jobs that involve printing more than the average amount of pages should be billed accordingly. Smart Notaries ask who the Lender or Bank is. This is because the name of the Lender can determine with some accuracy the size of the package. Signing companies lie about package sizes which is why smart Notaries ask. Additionally, there are many loan types and some require more time. Refinances are faster, while Construction Loans are longer but have more professional and businesslike signers. Reverse Mortgages, VA, and FHA take more time. Piggy Backs are double signings and have double the pages and double the Notary work. Time for doing a signing is based on these components:

Negotiating Time — Some companies are easy and pleasant to deal with. If it is fast getting assignments faxed or emailed to you and easy to confirm with the borrower, take notes of that time. It can differ from company to company.

Printing Time — Notaries should charge by the page for e-documents. Printing takes time, and often involves waiting for documents to be ready which can be hours if you work with irresponsible companies.

Driving Time –Factor in how much time it takes to get from point A to B. Keep notes so you’ll know how to charge for jobs to particular cities in the future.

Signing time — Some Lenders have loans that get signed quickly. Some Lenders answer the phone and get situations handled quickly while others don’t.

Loan Type Influences Time Spent — VA & FHA signings are just plain longer. Reverse Mortgages are for the elderly who are less businesslike and might need a lot more time to sign. Power of Attorney signings are the most likely not to fund, so take that into consideration. Piggy Back loans are double the signatures and double the notarizations. But, once everyone has sat down and you have your journal out, it goes quickly.

Fax Back Time — Fax Backs are a pain in the rear, but they serve a purpose. Signing companies can hire newbies and get away with it, because the signing company can check your work before it gets sent back to Title. They no longer need experienced Notaries. However, fax backs take time, so if your time is worth something, charge for each page faxed back.

Cancellation Rate Time Waste — Factor cancellation rate and billing time into the price.

Billing Time — Some companies pay on the first request while others require hounding.

2. Expenses Itemized

Printing Documents — is not only time consuming but costs money. You are using up paper, toner, cartridges, ink, and using up your time to restock what you used up. Charge accordingly.

Car Expenses — Driving a car is not free. Tires wear down, brakes wear out, plus you need to change the oil, filters, shocks, transmission, and more. So, in addition to time, try to work a mileage fee into your pricing in addition to charging for time.

3. Track Record & Risk of Not Getting Paid

Late Documents — If the signing company or title company was late getting your edocuments in the past, make a note of that. Keep detailed records of each company. Record how fast they paid you on each job. Recalculate their average days to payment every month just to keep records updated. Also, keep records for how late they are sending edocuments or how incompetent they are about keeping their borrowers informed. If you are dealing with a flake, charge more.

Unknown PartiesIf you accept a job from an unknown lender, or one with a bad reputation online, you might charge more, or make them pay up front. You should always charge extra when there is any type of risk involved. . These signings assume risk. Some of the risk is spending an unpredictable amount of time or not getting paid at all.

4. Payment Terms
If a Lender will only pay you if the loan funds, you need to charge more. Some Lenders will not pay your printing fee if the job gets cancelled, so make sure you know what the terms of the agreement are. Some will pay part of a travel fee if the job gets cancelled mid-way. However, the signing company booked your time, and you can’t give your leftover time to some other company at the last minute just because they needed to cancel. You have to commit your time to them, but do you make companies commit to paying you?

I personally feel that Notaries should set their own terms. You are not a bank, and it is not your job to gamble on whether or not a loan funds. You should be paid before, or within 72 hours of a signing in my opinion. But, you can make your own terms. Beginners have to accept the terms dictated to them, but old pros can make their own terms and get away with it. However, if you do accept terms that limit your ability to guarantee payment, charge a lot more.

5. Travel Fees for Non Loan Signing Work
Most Notaries charge $25 to $50 travel fee, and more if it is for jails or hospitals. You also charge by the signature on top of the travel fee. Charge based on how valuable your time is worth. If you are desperate for work, charge less. If your time is limited, charge more. If you have lots of other things to do, you have less supply of time so you can charge more — this is a strategy to consider — so stay busy my friends.

6. Jails & Hospital Notary Jobs
Charge more for jails and hospitals because these are the jobs where there is a lot more that can go wrong. You also will not be dealing with the cream of the crop. You can get stood up at a jail. Inmates do not have ID and your credible witness or ID carrier might not show up. ID’s might be expired. Hospital patients are often drugged making it impossible to notarize them. Half of them can’t even hold a pen, so how can they possibly sign? Consider this when deciding upon your jail & hospital travel fees which should be $60 to $150 depending on how greedy you are! Some Notaries are afraid to go to jails, but it is safe, and that is where you can make money fast. Just make sure you have them read their ID to you over the phone including expiration date or you will be very sorry. Also, get your travel fee in cash at the door BEFORE you see the signer. They might not be available or might not want to sign! Be prepared!

7. General Pricing Models
Keep in mind that a few years ago, Notaries could get paid a lot more. With Snapdocs and lower demand, companies can pay a lot less and get away with it.

Situations where you charge more or less
(1) Charge less during the first 17 days of the month. It is slower, and you have more time.
(2) Charge more during the end of the month. Additionally, you can charge more if you schedule a job several days in advance because you might miss out on a better offer. Additionally, jobs scheduled in advance in my day had a 25% cancellation rate which will wreak havoc on your schedule.
(3) Charge less if you are having a slow day and someone needs a last minute signing. If you are doing nothing, why not sell that time.
(4) eSignings have less physical pages, but often take longer because the signer and their spouse need to take turns looking at the computer screen not to mention the chance of delays due to technical issues.
(5) Charge extra if there are three or more signers on a loan.
(6) Charge more if the company cancels a lot
(7) Charge less if a company has a good track record and is easy and fast to deal with — or pleasant!
(8.) Charge more if there are lots of signatures to notarize.

Pricing Recommendations For Beginners. 0-500 signings

Basic Signing $60-$80
E-Documents: $10-$25 extra per double set or 7 cents per page
Pickups: $25 extra
Dropoffs: $20 extra — there is less waiting time during dropoffs
Reverse Mortgages: $100
Piggy Backs: $100
Regular Notary Work Travel Fee: $30 if within 30 minutes
Jail & Hospitals: $50

Pricing Recommendations for Intermediates. 500-3000 signings
Basic Signing: $80-$120; E-Documents: $20-$40 or 10 cents per page; Pickups: $30 extra; Dropoffs: $25 extra; Reverse Mortgages: $125; Piggy Backs: $125; Regular Travel Fee: $40 if within 30 miles; Jails & Hospitals: $70

When to charge in advance
You are not a bank and you should not offer endless credit to any signing company. Some of them will string you along and not pay you or play games with payments making it unclear which job they are paying for. Decide in advance how much credit to give each company and keep records. If you have a six month track record with a company and they pay you on time, you might offer them credit for six jobs. For all others, do one or two jobs, but don’t do any more until you get paid. It is not a bad idea to charge up front with Paypal, but few companies will pay a beginner up front. Ken, our seasoned Notary always gets paid up front, but he is a pro.

(1) New Companies — do one job, but don’t do a second until you get paid for the first unless they have a stellar record for payment on the forums.
(2) Some Track Record — do two jobs, but don’t do a third until you get paid for the first.
(3) Good Track Record — Watch out: good companies can turn bad if they experience financial difficulties or labor shortages. Do not offer credit for more than six jobs no matter what. A good track record should be over at least six months.

Don’t complain
There are many Notaries who have gone out of business because there is too much competition for too few jobs. If you are getting paid, getting experience, and staying afloat, you are ahead of the game. Many Notaries have this idea that they should get $125 per signing ever time. Unfortunately, it no longer works like this. So, take what you can get and just do your best! If you get more experience, you will be worth more in the long run. Additionally, the market could have an upswing at any time, so keep a positive thought.

The Compliance Agreement

The Compliance Agreement
This document is often part of a loan package. While not notarized, “The undersigned hereby agrees to cooperate”. This cooperation includes working with both the lender and the Escrow or “Closing Agent” to facilitate “reasonable requests”. This cooperation is subsequent to the closing, on an “if necessary” basis. Said cooperation includes providing any and all documentation “deemed necessary or desirable”. It is very open ended with an enforcement clause, to be discussed later in this installment.

The affiants to this agreement, often both the buyer and the seller, are obligated to assist, as “necessary”, to complete the transaction. This completion can include verbiage to include the marketability of the loan and/or securing title insurance. They may be requested (really required) to re-execute documents or sign additional documents. They may also be asked to provide previously “not relevant or considered” documents, to facilitate the closing.

Score one for stating the obvious. While researching this blog, one of the compliance agreement documents specifically stated: The sellers are not required to perform duties and responsibilities of the buyer, and the reverse is also understood. As mentioned the responsibilities of the affiants is a bit open ended. They are both required to not only facilitate requests “deemed necessary” but also those “desirable”. An up to date appraisal would certainly be desirable, but it’s not clearly spelled out who would be required to pay if this was requested. Similarly, it’s not clear who would be responsible for expenses to make the loan “insurable”.

While this document is usually a single page; the issues are rather complex. There are four parties involved: The Lender, the Title Co., the Borrower, and the Seller. It’s easy to visualize conflicts developing. The “enforcement arm” is frequently in the last paragraph. This section includes for recovery of all expenses, and lawyer fees, by the winning party if it is adjudicated.

Thus failure to comply with an “it’s desirable” request (demand?) from Title, might result in Title obtaining the item and billing the, for example; seller. Additionally the seller would, if they contest the cost, and lose; have to pay the attorney fees of the Title Company. Quite a lot of responsibility is included on that one little page. Few bother to read it. It’s generally explained (not by the Notary!) as agreeing to resign a lost document; but it really comprises much more.

I often wondered why such a “strong” document is rarely if ever notarized. Perhaps the public perception of notarized documents being “binding” and others “contestable” is in play. Whatever the reason, all affiants should be aware of the broad scope of the Compliance Agreement. It’s more than just allowing clerical errors to be corrected, much more. I have heard it explained away as only allowing for the correction of typographical errors. “If we put the comma in the wrong place and say you only pay fifty cents a month, not five hundred a month; we are allowed to correct that typo”. Yes, it’s that; but also much more.

How does this apply to the notary? From my prospective the issues are so broad, vague and potentially of great economic effect – I would not attempt to “explain” it; not a bit. If asked a question related to the Compliance Agreement, for me it’s an immediate call to the Loan Officer.

New Notary Apps for the iPhone 7 that you’ve never dreamed of!

Many notaries are curious to know what the new iPhone 7 will be like. The truth is that it will have many new functions and apps that are very practical for notaries. Below are some of the more practical apps.

(1) Signing Company Review App.
The best feature of Notary To Go is that it knows which signing companies are good or bad. If a good signing company who pays on time calls you, you’ll automatically get a marimba music ringtone. If they don’t pay on time – “The Shining” music ringtone.

If you ask SIRI to research signing company reviews, her tone of voice is programmed to vary based on the quality of the signing company.

More than 50% negative reviews – Siri sounds suicidal.

20 to 49% negative reviews – Siri sounds snooty.

0 to 19% negative reviews – Siri sounds cautiously optimistic.

(2) Find the lowest price for gas app.
Siri also locates the nearest most inexpensive gas stations for notaries.

Siri can be set to “polite,” “matter of fact,” “sarcastic,” or “down right insulting.” In a test signing, the notary set it on sarcastic level 3 and asked Siri to find him the best price on gas in the area and Siri said, “you cheap gum.” After the bugs were worked out, she said, “you cheap bum.”

(3) Notary Billing app.
The new notary billing app lets you enter each signing after it is complete, who the borrowers were and the name of the signing company. It will automatically send bills to the company. It can also Subpoena a signing company that hasn’t paid on time after sixty days if you put it on “auto-subpoena.”

(4) Road condition app
The iPhone7 road condition app, not only tells you the fastest route to wherever you are going, but also informs you of any new potholes on the road, or if there are any desirable members of the opposite gender that are noteworthy on any particular route.

(5) Affirmation App
Detects whether signer’s solemn statement of truth made under penalty of perjury is actually truthful. Just attach one end of the wire’s attachment to the affiant’s fingertip, and insert the other end into the USB port. The display on the monitor will tell you if the statements are true or false. Please read the instructions and ask a few sample questions first to get a sense of interpreting the results from this type of test.

(6) Virtual attorney-in-fact.
A virtual person can be authorized by a power of attorney to act on behalf of another using this app. Just scan the power of attorney using a portable scanner and attach the scanner to the iPhone using a USB wire. One notary tried this app, and got a little carried away. He got the Smart attorney app: Sues virtual attorney-in-fact for claiming he’s a fact when he’s merely virtual.

(7) Notary certificate app.
Attach your iPhone to a mobile printer, and you can print out documents and notary forms. This app turns credible witnesses into incredible witnesses, if they’re lucky enough to own this incredible phone. This app executes a document in the blink of an eye or iPhone, whichever blinks first. iPhone version 8 virtually affixes seal to certificate eliminating strain from pressing embosser, but you’ll have to wait to see that action!

(8) The Notary To Go app.
This app can automatically turns off the customer’s TV. Getting their shouting kids to go to sleep – coming in the iPhone. Notary To Go also sends confirmation to signing company notifying them you’re there. It also tells you if neighbors or kids are too close to your car.

(9) Hands Free Notarization App.
You can download your document into the application. Then, when you’re in front of your signer, they can give a verbal signature to the document. Using voice recognition technology, this application will be able to positively identify the signer purely based on their voice if it has been given a voice sample previous to the date of the notarization. It can also be used for notarizing weddings — just say, “I do.”

(10) Virtual Therapy (for Siri)
After being tested out on seven different signing agents, the iPhone 7 provides Siri with badly needed automated therapy.

SIRI: “All they ask me for is where’s the cheapest gas station.”

AUTOMATED VOICE: “You sound troubled.”

SIRI: “Duh! They’re always complaining to me about signing companies that don’t pay them on time, or when 123notary raises their rates. Is that all I’m good for?”

AUTOMATED VOICE: “You sound troubled.”

On the iPhone 8, her automated shrink will gain the additional responses, “I feel your pain. And, “I see our time is up.”

New Notary Apps that you really need!

The entire world has gone app crazy in the last few years. Personally, I use GPS, and my alarm clock. That’s about it for me in terms of apps. But, what types of apps might notaries need to stay ahead?

(1) Look up signing company reviews.
123notary already has this for i-phones. It is a page, not an app, but what is the difference right?

(2) Find a cheap gas station
Google already does this. Just visit www.google.com and look up “cheap gas” or “gas prices” and then add your zip code. Or enter your city name and gas prices for a better selection if you live in a big city.
You can also use gasbuddy.com

(3) Billing applications?
Very few notaries use sophisticated technology to know who owes them what and for how long. But, there are companies out there who have billing applications that you can see at a glance who owes you what and who to invoice. Is it worth it? You tell us!

(4) Road condition apps.
There are GPS systems that tell you which route to your destination is faster under current situations. Such technology has cleaned up traffic congestion in many cities around the world. If you have technology that tells you how to avoid traffic, you could save an hour per day every day! That would be worth paying a bundle.

(5) Translation apps (risky)
The notary is supposed to be skilled in whatever language they use at a signing. If you look up words in an application, you might screw up and the signer might understand you incorrectly or not at all. Words sometimes have multiple translations. “Do you swear to tell the truth” could translate into “Will you marry me” if you miss a subtle nuance in certain languages. But, for those who are app crazy, you are apt to get one anyway. So, go for it! SayHi Translate can do this by the way!

(6) Mileage log apps for the IRS
The IRS may request to see your trip logs. If it is digital, that might be good, unless it is hard to download, print, or gets accidentally compromised. But, paper records can get lost too, so which way is safer? You can keep track of your miles using your i-phone if you have an app for that. I don’t know of any app like that, but they probably exist as probably 50 million Americans deduct mileage for one reason or another.

(7) eJournal applications?
These exist. You need to be an eNotary to use one. Out of 7000 notaries on our site, I’m sure there are a good three or four of you who are commissioned eNotaries.

(8) iSchedule
You guessed it. This app will manage your busy schedule. You can input all your appointments with this app and all is well until you go into a dead zone or run out of battery.

(9) TurboScan
Quickly scan multipage documents into high-quality PDF’s. Wow! Sounds like a winner for companies who want fax-backs.

(10) Documents Free (Mobile Office Suite)
Not sure what this does, but you can read up on it.

(11) Contacts <-> Excel
I think we all know what this is for.

(12) UPS Mobile
Ship your packages using your i-phone, and hopefully a UPS box. You might need a printer too.

And last but not least… (and appropriately numbered)

(13) Ghost Hunters Haunted House Finder
Find a haunted house near you. Or use it to look up your signings. If one of your signings is in an officially haunted house, suggest that you all meet at Starbucks. Use your Starbucks finder app to get there!

(14) Page Separator Pro
Split those legal and letter sized pieces of paper. Even some dual tray printers don’t have the ability to figure out which tray prints what, and why…

Protecting yourself with a contract 

It is common for big companies to make the little guys sign a contract with many terms for doing business. One common term is to have an arbitrator resolve issues, and the arbitrator is probably picked by the company in question — how fair!!! ……. Not!    But, how often do the little guys think far enough ahead to protect themselves?  I say that notaries need to make signing companies sign something that will protect the notary’s interests.  But, will anyone sign it out of desperation? If they like the notary enough, they might, but if you are a novice with no experience, you will not have such good luck.
 
Here are terms that I would discuss.
 
Trip Fees
If I am assigned a signing agent / notary job by your company, and travel to an assigned location, and the job is cancelled while in travel, I want a $50 trip and preparation fee.  I want $75 for jobs more than 40 miles from my house according to mapquest’s mileage estimates.
 
Printing Fees
If I am assigned a signing agent / notary job by your company , print out documents and borrower’s copies, and then your company cancels, I want a $40 printing fee.   (it might not be worth this much, but you have to factor in the hassle of billing these clowns and trying to collect).
 
Payment regardless of funding
If I am assigned a loan signing job by your company, and I complete the signing, but the loan doesn’t fund, your company must pay me $100 per signing.
 
Payment regardless of if the borrowers are willing to sign
If I am assigned a loan signing job by your company, arrive at the specified location, and start a signing with the borrowers, and then they change their mind about signing and refuse to sign, your company must pay me the entire fee agreed upon.
 
Waiting time
If I am assigned a loan signing job by your company, I will allow up to 60 minutes for the job.  If the borrowers want to read every letter of every word in every document and take in excess of 60 minutes, I require a waiting time fee of $40 for every additional 30 minutes, or any fraction thereof.
 
Late payment penalties
I expect to be paid within 30 days for all loan signing services.  If a payment is post-marked late than 30 days from the date of the signing, I will charge a late fee of $25 per signing, and then an additional $25 for each fifteen days after.  If you fail to pay this late fee, I will terminate services with your company.
 
I think that notaries are fools to just be willing to do business with anyone without even background checking them.  On the other hand, a contract like the one I drafted (written in informal language and not legalese) might be too demanding, especially the waiting time.  Perhaps a more liberal contract should be drafted, but notaries need to take protecting themselves a lot more seriously and get more professional and methodical about it.  Bigger companies almost always make you sign a contract, why shouldn’t you?

Threatening for payment?

Taking the job
I dont like to do a job and then have to threaten folks to get paid. It goes against my general fiber and overall nature. I excel at what I do and expect to paid accordingly.  I took a job toward the end of the month (May). It was a settlement company. You know the ones that broker the rich and famous insurance polices that are worth 4 or 5 million and they pay out  a fraction of what they are worth, and then wait for them to  die so they can collect the full value of the policy. This is similar to JG Wentworth’s policies.

Agreeing on a fee
Well, we agree on a handsome fee of 150.00. I successfully complete the assignment.  Nothing eventful and everything went well. I was even early..:)  After the completion of the assignment, I completed a W-9 and submitted an invoice and patiently waited. After about 2 weeks I emailed my contact on a Monday and was told that I would have payment toward the  end of the following week.  My eyebrows cautiously started to rise, but, I understand company billing policies, so I let it go. By the following week on Thursday there was no check. I emailed once again, and the reply I got was that they had missed the cut off and I would receive a check at least by the next Friday.

Contacting the signing company’s client for payment?
Now, I am becoming VERY angry. So I wrote back that this sounds very much like the run around to me and it is unacceptable . I also let them know that if forced I will have to take matters into my own hands meaning that if I don’t receive payment ASAP I will be contacting their client for payment. With correspondence sent I waited. The following afternoon I receive a brief response. and I quote  “Carmen, accounting pushed your check and it’s in the mail” And I thought to myself. Great BUT why did I have to be strung along and lied to in the first place. Why didn’t you just cut the check and be done with it.  It has been a month already. Why did I have to threaten you and worse  yet  now our relationship has been strained and severed. I am confident they will never call me again Nor do I want them to. I don’t want to have to put up a fight to get paid. If I perform a job without incident and give it 100% with no error on my part I except to get paid. PERIOD. I have every right to expect this. We have every right to expect this!!!

It is a shame that we have to resort to all sorts of threats, trickery, letters/emails phone calls, etc just to get our money. This is a job in itself and It is very time consuming to keep up with these slow or no pay companies.

In closing, I know the task itself is hard but you have got to stay on top of it. As one of our notaries expressed to me…the longer you wait to try an collect the more likely you never will see a dime…..and this is the sad truth. PLEASE Check out these companies when you can BEFOREHAND.  It is not entirely foolproof but it can help weed out some of the bad ones before it costs you in time and money! Be on top of your billing, comply with all their billing request, such as W-9’s and start the collection process early.

123notary and Social Media
123notary.com has endeavored to build a community feeling by creating various social media profiles over the last few years.  We created a notary discussion forum in 2004. Our forum grew in popularity over the years, but we found that the trends in social media had changed, and that more people prefered Facebook and other providers. Then, in 2009, we created Facebook and Twitter profiles which quickly became very lively.  In 2010, we decided to create a blog, to add a format where we could discuss notary issues in detail.  The forum had a nice form of interaction, but our blog will make it possible to focus on what a particular author has to share, rather than reading a potentially chaotic conversation between a variety of strangers all chiming in.
 
Guest writers
123notary.com will attempt to have a lively notary blog by blogging about the most interesting and critical issues facing notaries today.  In order to spice things up, we will
be having guest bloggers write articles about whatever notary blog topics they find interesting.  The guest writers each have a very different style and write about very different topics than I would write about which will make our blog diverse and interesting.  Our current guest bloggers are Ken and Carmen, but we hope to attract more as time goes on. If you write interesting materials, and want to be a guest blogger with us, just send us an email introducing yourselves, and we will consider you!
 
Topics for discussion

I want to use this notary public blog to discuss issues in a way that can not be adequately done on other mediums.  Forums have too much weak commentary from members with posts ranging from two or three words to a sentence. Some of the input is helpful while others is not on forums.  Very little of the writing on forums is good enough to feature on a resource page.  One major pattern I would like to establish on our blog is to take the best content from the forum and publish it in blog format.  I would select the most popular and helpful forum topics, and condense the more helpful commentary from the notaries in one page in a blog entry.   That way the 90-95% of forum commentary that is not helpful would be filtered or weeded out.  Another pattern I would like to use on the notary public blog is to address major issues facing notaries, in detail.  Rather that focusing on quantity, I would like to address certain pressing issues, and have thorough and quality input about these matters.  Some issues that will be popping up soon will include:  How to handle common problems at signings, Loan Modifications, Billing, Etiquette, e-signings,  How to Dress, etc.,    If there are topics that you would like addressed, you are welcome to voice your opinion.
 
Facebook, Twitter and our blog
We will get materials for our blog from discussions on facebook as one of our sources of information. Our facebook profile is a source of lively discussions and information about the notary world. Each week or two we discuss a different issue and break it in to components.   There will be lots of material to work with.  We will be tweeting about our new blogs on Twitter as a way to get the news out quickly. We may even have a competition on facebook for notaries who can write a great blog article that is good enough for us to post.
