Why you should consider getting 123notary Elite Certified.

Notary Certification

“Elite style” from 123notary!
At the time of this article being written there are only about 100 Elite Certified 123notary members. Elite Certified members get a lot more quantity of work, and get paid roughly $14 more per signing than someone who is not 123notary Certified. So, why would someone pass up more work at higher prices, isn’t that what we all want? Actually not. What people really want is to not have to study — and that is where the problem lies.

Standards for passing our Elite Certification have been raised and that is why it is so highly prized by title companies. You have to be good as a notary, signer and have some obscure knowledge about documents and the industry to get Elite Certified. In any case, here is some data about our Elite Certification.

1. Elite Certification is FREE for now.
We used to charge $179 for Elite Certification. Since we have recently changed our educational and testing requirements, we are allowing people to pass our test at no cost. However, you do have to study and very few can pass because the standards are high.

2. Get more $$$
Elite Certified members on 123notary get paid $14 more per signing than uncertified members. If you are complaining about not getting paid enough, your complaint will change to being paid too much. And that is a nice thing to complain about. You won’t know what to do with the additional income you have. But, I can help you with that. You can invest that in more advertising with 123notary!

3. Get a lot more attention from Title & Escrow
Title companies love 123notary because we have better quality control for our Notaries than other sites. They especially like our certified and elite members as well as people who are top on the list in their area as they are the cream of the crop in the Notary industry.

4. Impress others with your knowledge
Knowing more about the industry will impress people, especially when your knowledge is more solid than anyone else which will basically be true if you can pass our test. People pay more for knowledgeable, experienced and dependable people. But, they don’t pay more for people who fallaciously claim to be knowledgeable, experienced and dependable. Self claims of greatness are inexpensively bought credibility, but our Elite Certification is a highly prized mark of credibility that comes from an unbiased judge of ability — me!

5. Be safer as a Notary
Notaries who don’t know anything (97% of Notaries to be exact) are a danger to their clients, society and themselves. Not knowing how to handle notary situations prudently, not keeping your journal correctly and not knowing how to fill out forms correctly in all cases is not only negligent — it is dangerous and can get you sued, or forced to be a witness in a long drawn out court case, fired, investigated, or in some cases fed to the lions. Ignorance doesn’t pay, but knowledge can keep you and everyone else a whole lot safer. It is worth the ten or more hours you will need to study to get this icon.

6. Get more clicks on 123notary
Clicks and more clicks translate into more jobs. You still have to answer your phone, print documents and go to jobs, but there will be more jobs and better jobs if you can get this icon.

7. Feel more confident and less afraid
Many Notaries have a sense of dread, because they don’t know if they will run into a situation they cannot handle. Earning our Elite certification will have taught you how to handle a wide variety of problems common to Notary work. You might not know everything, but you will know pretty close to everything.

8. Get favorable treatment from Jeremy and Carmen
We both have the highest respect for our Elite members. They are smarter and we are very aware of that. We also respect their motivation as motivation is a scarce commodity these days. We are more likely to promote Elite members with discounted upgrades and special deals on additional counties (no guarantees, but this is our practice.)

Summary
Get treated like a king or queen, make more money and get recognition by virtue of your rightfully acquired knowledge. Nothing should be holding you back from being Elite Certified by 123notary for FREE. All we ask is that you take the studying very seriously, and study with the intent of mastery rather than just skimming the materials. Study and review and quiz yourself on every aspect of the information at hand. If you get less than 100% on a self-quiz, you will not do well on our quiz. But, try it and perhaps you will pass, and if not, you still will have learned something of value.

Notary Public 101 — Scenarios: What entities might want to see your journal?

I have gotten in hundreds of arguments with notaries from states all over the county. Those who live in states where journals are not legally required think they will not get into trouble if they don’t have one. If you end up in court, your journal is your only evidence of what happened. You might become a witness for a long case or a defendant if you don’t keep a journal regardless of what your state says.

The FBI investigates ALL Mortgage fraud. That means that if you notarize a fraudulent mortgage, don’t keep a journal, and the FBI catches up with you– you are in trouble as well as the Lender and they can name you as a suspect. The possibility of being slapped with a $20,000 Attorney fee is just not worth the risk. It is much easier just to keep a journal so that you will have some sort of evidence of what work you performed.

Here is a list of entities that might want to see your journal other than your state which may or may not require it.

1. The FBI
2. Judges in court
3. Signers
4. Attorneys
5. People who were affected directly or indirectly by something you notarized perhaps such as beneficiaries, etc.

When I was a Notary, I had three or four inquiries about journal entries. Since I kept my books in order I was ready. How ready are you?

Letter to Florida Notary Division

Dear Florida Notary Division,
I run 123notary and am constantly made aware of the sloppy behavior of the Notaries that you commission. I will remind you that the purpose in having Notaries Public in the first place is to ensure the integrity of transactions done via signed documents. The Notary makes sure the correct person signed the document, fills out forms, keeps records, administers Oaths, and upholds the law regarding Notary Public. Based on my quiz results for many Florida Notaries: Florida Notaries do not normally keep proper records, rarely administer correct Oaths, and do not have a clear idea of the laws affecting their work in many cases. Below are my comments and suggestions.

1. Journal Thumbprints.
A journal thumbprint is a piece of biometric evidence that Notaries should keep in their journal. The reason is that the FBI can catch identity thieves that steal people’s assets a lot more easily with thumbprints. Florida recommends against Notaries keeping thumbprints which essentially stifles the FBI. Florida is afraid that the Notaries will not be reputable custodians of biometric data and therefore recommends that they do not take the evidence to begin with. This tells me that the following MIGHT be true:

(a) Florida might desperately want to assist identity thieves in having open season in Florida, and wants to make sure that identity thieves not only can defraud hard working citizens, but that the rights to privacy of identity thieves will be honored at the expense of the safety of society, borrowers, signers, and Notaries by recommending against taking journal thumbprints. Ludicrous! The State of Florida might want to make sure that identity thieves will be protected from being caught and wants to deter the justice system from having adequate evidence to book these very dangerous white collar criminals.

(b) Florida commissions Notaries in a position of trust and integrity equivalent to that of police, attorneys, judges and government workers, yet doesn’t trust them to safeguard a thumbprint. Either you trust them or you shouldn’t commission them. Maybe you should spend more time figuring out who is trustworthy and who is not. Since 90% of your Notaries cannot administer an Oath correctly (which is the notarial equivalent of tying your shoes), I would consider weeding your database of the Notaries who refuse to know how to do their job. Or you could resort to actually training your Notaries and screening them a little better.

(c) The State of Florida is confused and doesn’t realize how stupid they are being by safeguarding society’s most dangerous criminals by discouraging Notaries from keeping journals and taking journal thumbprints. Discouraging journal thumb printing is similar in essence to discouraging wearing seat belts or condoms. Notaries might not get Aids, or break their ribs, but they could end up in court or jail as a result of this stupidity.

2. Journals
For the Notary’s safety, their notarial journal is their only hard evidence in court of what they did as a Notary on a particular date, or assignment as well as what they did NOT do should their seal be stolen, copied, or forged. By not requiring a journal for notarial acts you are endangering the public, Notaries, and their clients. There are many types of crimes that can be committed without a paper trail since you don’t require journals. The Notaries you have commissioned are mostly very lazy and negligent people who would prefer to spent an hour arguing with me about how journals aren’t required by their state so that they can save a few minutes each time they commit a Notary act. By not requiring journals you are encouraging people to be reckless. Additionally, one might argue that you as a state and as Notaries for that state are aiding and abetting criminals by not keeping proper records of highly sensitive transactions.

I give these Notaries the lecture about how California requires seat belts where India does not require having or wearing a seat belt in your vehicle. If you get into an accident in India, will you be any less injured since seat belts aren’t legally required? If an identity thief imposters you in Florida and steals the equity out of someones’ apartment complex, will you be in any less in trouble with the FBI in Florida simply because your state is too foolish to require you to keep adequate evidence of all transactions?

The reality is that the FBI has investigated many of the Notaries listed on 123notary.com. Many of the Notaries kept thumbprints in their journal which was a huge boon to the FBI. However, I heard that those without proper evidence are routinely accused of collaborating with frauds. Does the State of Florida really want their Notaries ending up in court or jail simply because they are too stubborn or stupid to require a simple journal? Millions of dollars of assets are on the line in each day of Notary work doing loan signings and you don’t even require a single record of the transactions conducted? Even third world countries are not this foolish.

Summary

My suggestions are as follows:

1. Be more careful appointing Notaries. Give preference to those who have held government jobs or highly responsible jobs in the past.

2. Have an IQ test and a meticulousity test to make sure Notaries are logical enough to make legal distinctions necessary to perform the duties of Notary Public. Many errors Notaries make are due to logic errors and scrambled thinking. Notaries also need to show they are adept at conducting themselves in a step by step manner doing paperwork otherwise they will not do good work filling out their Notary forms. You should test this before you put them through school otherwise you will be wasting their time.

3. Have a two day live seminar with hands on training. One day is not enough in my experience.

4. Test on Notary laws as well as on hands on procedure

5. Require Notarial journals and orthodox journal entry creation which means one entry per person per document notarized and no short cuts.

6. Require Journal thumbprints for Deeds affecting real property, Powers of Attorney, and transactions done with Credible Identifying Witnesses.

7. Check up on your notaries from time to time to make sure they are maintaining proper legal standards for your state.

8. Have a minimum fee of $25 per appointment for Notaries public plus $25 minimum travel fee as well as a minimum waiting fee for hospital, jail and other jobs that require more than ten minutes of waiting. Travel fees should be paid in cash at the door by law to discourage clients from manipulating the notary into committing illegal acts under the duress that the Notary will not be paid his/her travel fee if he/she doesn’t cooperate in some illegal act. Higher fees will give you a higher supply of higher level people which will be helpful when you weed out the incompetent Notaries in your state.

9. If you have fewer Notaries in the state, it will be easier to keep an eye on them. I recommend having roughly 25% of your current number of Notaries to ensure adequate quantity without sacrificing on quality!

Dear California Notary Division,
I am someone who runs a Notary directory and is acutely aware of the deficiencies in Notary knowledge throughout the state and the nation. California Notaries are better than those in other states on average due to the excellent training, but the training does not cover practical aspects of the Notary profession. Additionally, there are issues with fees that need to be addressed.

PRETRAINING
As there are so many ethical violations out there among California Notaries, and misunderstanding of Notary law, it is clear that a longer and more comprehensive notary training is necessary. However, I also think that due to the incompetence out there, a few other pre-measures should be taken.

1. A IQ test should be administer to applicants. It can be a ten minute quiz. Notaries with low intelligence often bungle and misinterpret Notary laws which can lead to illegal activity and wrongful explanations to clients of what can and cannot be legally done.

2. A meticulousness test should be administered to Notaries to see if they can be orderly about conducting tasks which require multiple steps. Being a good Notary means filling out journals and forms correctly in their entirety, and a meticulous person is less likely to make errors. The majority of your Notaries are far from meticulous.

3. Following directions and ethics are some other problems that are common with California Notaries. How you test this is hard. You have to find a way to trick them into doing something right or wrong while they are being watched.

4. Preference to those with clerical, police, military, legal, mortgage, or settlement backgrounds might help attract better quality Notaries as those are professions that are normally high in terms of integrity, and clerical skills which are both critical in the Notary profession.

TRAINING
A single day course on Notary Public knowledge is not enough. California stresses theoretical knowledge and does not test on hands on aspects of being a Notary. When a Notary is out there in the field, they need to know how to handle various types if situations. Here are my detailed comments.

1. Oaths & Affirmations
Administer Oaths correctly and roughly half of Notaries in California do not administer Oaths at all, or not in a relevant and acceptable way. Here are some examples of irrelevant or wishy-washy Oaths.

(a) Many Notaries have the signer to swear to their personal identity rather than to the truthfulness of the document.
(b) Many Notaries make the signer swear they signed the document but not to the truthfulness of the document.
(c) It is common for Notaries use Affirm in an Oath when they should ideally use the verb swear.
(d) Many Notaries do not understand the term “administer” in the sentence “Administer an Oath to an Affiant.”
(e) Many Notaries use a court Oath for a witness asking if they swear to the truth, whole truth and nothing but the truth when the document does not necessarily reflect a whole truth.
(f) It is common for Notaries not to mention the document being sworn to when administering an Oath, hence administering an Oath that is regarding thin air.
(g) Most Notaries do not know the difference between a court Oath for a witness, a document Oath and an Oath for a statement that has not been made yet.
(h) Notaries need to be taught asking “Oath questions,” such as, “Do you solemnly swear this document is true and correct?” or “Do you solemnly swear that the statement you are about to make is true and correct?” Many Notaries will ask the Oath question about the statement, get a yes, and then not have the Affiant make the actual statement. This is why an IQ test should be mandatory and a result of 95 or higher should be required. Most of the problems I have with Notaries arises from low IQ’s and bad attitudes.

The handbook makes it clear that an Affiant must swear to the truthfulness of a document. However, there is no prescribed wording or guidelines. My solution is to have prescribed components of Oaths, but no official verbiage just to keep life flexible. At a minimum, in an Oath, the Affiant must use the word “I”, and then the word “swear”, mention the foregoing document, and make reference to the fact that they feel the document is authentic or correct. Using “affirm” was asked to administer an Oath means that the Notary has overided the client’s request to have an Oath which means that the Notary chose the notary act instead of letting the entity who is paying or swearing.

2. Fill out their journal correctly
Many Notaries are unclear as to how many journal entries should be filled out if there are multiple signers signing multiple documents. The 2018 handbook does not make it clear HOW MANY journal entries are necessary if there are multiple documents per signer all using the same Notary act. This should be clarified as it is an area of common misunderstanding. One journal entry per person per document is how I was trained. Additionally, the use of arrows for repetitive information in appointments with multiple documents per signer are discouraged now from what I have heard, but the handbook does not mention this. There needs to be a SINGLE SOURCE of notary law information and that source should be the handbook and not some bulletin or blog article or other supplemental sources (although those can help teach the materials in the handbook.)

3. Understand the components of notary forms including the “Additional information” section of an Acknowledgment which might not be legally required, but deters fraud by making it very detectable if someone swaps an Acknowledgment and puts it on a different document than what was intended.

4. Many Notaries do not understand how to handle requests that are illegal or seem illegal. Many Notaries will accept illegal requests while declining acceptable requests. This is due to poor training. So, training needs to focus on handling questionable requests. Many Notaries feel it is illegal to EXPLAIN the various notary acts to clients while it is not. It is illegal to choose for them, but not to explain them as far as I know.

5. Foreign language signers are an area of misunderstanding as many Notaries are not aware that they are NOT required to understand the content of the document but ARE required to have direct communication with the signer/affiant.

6. Many Notaries are unaware that the ID does not have to exactly match the name on the document but must PROVE the name on the document. Many Notaries take liberties and will Notarize a signature that says John W Smith with an ID that says John Smith, etc. It is common for Notaries to refer to the “more than but not less than rule” which is a rule created for Title companies and not a law which states that the signer can over sign their name to include more middle initials or names, etc. However, the Notaries who remember this law often do not care if it is legal to notarize a name that is over signed. It is not clear whether you can notarized John W Smith as John Smith if the ID says only John Smith. This is another common occurrence that needs to be clarified.

7. Credible Witness law is a little bit complicated and perhaps should be simplified. Most Notaries are unaware that the handbook states that the credible witness is the entity who has to swear to the fact that he/she believes that the signer cannot easily obtain an ID. Since the Notary has OFTEN seen an ID with the wrong name on it, how can the Notary ACCEPT an Oath from a credible witness that the Notary knows to be based on false information or made fraudulently regarding how the signer cannot find an ID? This law about CW is convoluted and a source of a lot of trouble. Close to NONE of your Notaries would be able to recite these laws by memory. Therefor, I suggest simplifying it because most notaries cannot learn it properly and the CW rules are convoluted and make no sense. Here is my idea of a better set of rules.

(a) A Notary can use the Oaths of two credible witnesses to identify a signer.
(b) The credible witnesses must either be immediate family members or know the signer intimately enough so they know his/her middle names without being reminded. (The law for how well you have to know the signer to be a CW is convoluted, wishy-washy, and useless currently.)
(c) The Oath for the credible witness should be, “I solemnly swear that the signer in front of me is legally named _____.”
(d) A CW can be used regardless of whether the signer has ID or not as names on ID do not always reflect the whole, complete or current name of a signer.
(e) A journal thumbprint must accompany all Notary acts done involving credible witnesses.
(f) The CW must not have any beneficial or financial interest in the document being signed.

8. Acknowledgment confusion.
(a) Box at top of page
Many Notaries get confused by the information in the box at the top of an Acknowledgment. Many Notaries feel that the signer does not have to verify the validity of the document where it says clearly that the Notary does not have to. It is better to clarify this point as many Notaries are lacking the gift of logical thinking which can cause a lot of confusion.
(b) Perjury clause in Acknowledgments
Many Notaries feel that the signer is signing under the penalty of perjury in an Acknowledgment where it is clear that it is the Notary who is filling out the form correctly under the penalty of perjury. This point is widely misunderstood and needs to be elaborated since there are so many who cannot think logically about this point.
(c) Notaries are often unclear about whether the signer has to sign in their presence. Since the signer must personally appear, Notaries misinterpret this to mean that the signer must sign while they personally appear which is not true in California. The signer can sign ten years ago, but cannot be notarized until they appear.
(d) Notaries are often unclear about who is acknowledging what in an acknowledgment. Many thing that the Notary is acknowledging that a signature is correct. This is not true. The signer needs to acknowledge that they signed a document in the presence of the Notary. This point needs to be clarified for your notaries because there is too much confusion and misinterpretation going on out there.
(e) The additional optional information on NNA forms should be REQUIRED by law on loose certificates as it deters the fraudulent switching of acknowledgments to other documents by virtue that it identifies the name of the document, number of pages, document date, signers, and more…

9. Chain of Authority.
Many Notaries work with Title companies regularly and think of the Title companies as their boss. Wrong! The state is not exactly their boss, but is the entity they have to refer to if there is a legal question. It is common for Notaries to ask Lenders and Title what they can and cannot do as a Notary. This is wrong. They will get either a wrong answer or an answer that benefits the Lender or Title both of whom have beneficial and financial interest in the documents being Notaries. This point needs to be drummed into the Notaries heads. The State of California should ideally have a Notary hotline because there are so many times when Notaries have questions about what they can and cannot do, and often late at night when help is not available. The point of a Notary is to ensure the integrity of transactions done involving signed documents. If the Notary cannot find out what the law says, then the notarization will not have any integrity. This is a very serious issue.

10. Hands On Training
Notaries take a written exam, but this is not really as important as practical matters. What is important is to have someone do hands on training and testing to see if the Notary can fill out forms, journals, administer Oaths, take thumbprints, use credible witnesses, and decipher between legal and illegal requests. A written test cannot do this.

SUMMARY

1. Notary training should be two, three or four days long for new Notaries with a refresher every year to keep everyone serious.

2. Notaries should be trained by hand to see if they can handle requests, explain terminology and fill out forms, etc.

3. Notaries need to be audited regularly. Not only journal auditing which you are already doing (super!!!) Auditing people by pretending to be customers and asking them to do Oaths, or asking them if such and such a notarization would be legal under particular circumstances will let you know which of your Notaries are acceptable and which are criminals. It takes work, but you are a prudent organization that values integrity and I believe you will do the work.

Cross out and initial, or use a fresh form?

Most Notaries like to cross-out and initial changes in certificates. Keep in mind that these are legal documents affecting million dollar properties. Cross-outs look like tampering. It is CLEANER to take a fresh acknowledgment form from your Notary bag, fill it out thoroughly including the additional information section with the name of the document, number of pages, etc., And then staple it on to the document. On the other hand, using a new form could change the recording fees for the loan which would affect the truthfulness of the information on the Closing Statement.

If there is a cross-out for a name on a certificate that is a quite serious legal issue. It could lead to complications should you ever go to court. It is your right to decide to use a fresh acknowledgment form and staple it on the document even if the Lender doesn’t want it that way. Lenders sometimes prefer to use the original form because it is inscribed within the document. But, also because a new form will be charged extra money from the county recorder. Lenders sometimes lose loose acknowledgment forms which is yet another reason many Lenders prefer to fix the original.

As a Notary, you may be faced with the unpleasant reality that the Lender may have already filled out your Acknowledgment form, and with wrong information. If the form says you are in Orange County when you are in Seminole, you cannot notarize that form as is. So, what do you do and what are the consequences?

I cannot tell you what your state laws allow or require, I can only tell you how to handle forms in a prudent way.

Fix the Existing Form
If you are going to fix the existing Acknowledgment, just cross-out the wrong information with a single line, write in the correct county, and the Notary initials. The borrowers can initial changes to documents, but should not initial changes to certificates unless your state says so in writing. Fixing the existing form has the advantage that there will not be any changes to the recording fee for the loan. If you start adding additional pieces of paper, that will change the information on the HUD or CD and open a can of worms which some Lenders don’t like. On the other hand it is cleaner to replace the form rather than to fix it as fixing it looks like potential tampering.

Replace the Form
To replace an Acknowledgment, just staple on a new Acknowledgment, fill it out, sign and seal. Please also fill out what is called the optional and additional information which is normally about the document such as number of pages, document date, etc.

Communication Errors
When I ask Notaries how to fix a wrong county on an acknowledgment, some of them tell me how to replace it. Fix and replace are not the same word, so please do not answer a different question from what I asked. Please also be aware of the benefits and costs of replacing the form rather than fixing it.

In this article I will address multiple points affecting fixing errors on certificates.

WHAT IS THE CLEANEST WAY TO RECTIFY AN ERROR ON A NOTARY CERTIFICATE?

Most Notaries like to cross out and initial changes in certificates. Keep in mind that these are legal documents affecting million dollar properties. Cross-outs look like tampering and there is always a small chance that your cross-out will cause a long and drawn out delay in a court case if an Attorney suggests that perhaps there was tampering. It is CLEANER to take a fresh acknowledgment form from your Notary bag, fill it out thoroughly including the additional information section with the name of the document, number of pages, etc., And then staple it on to the document.

To be prepared for this type of situation, please do the following:

1. Keep Notary certificate pads on your person
Buy Acknowledgment, Jurat, and Copy Certification forms from the NNA. These forms come in pads and fit in your notary bag or at least in your trunk. A good Notary carries these and uses them regularly.

2. Ask for preferences, not for advice
Know when to ask the Lender or Title company for their preference. Please remember that as a Notary, it is your exclusive jurisdiction to be the expert and sole authority as to how Notarizations should get done and how Notarizations do get done. However, if there are two legal ways to handle a situation such as fixing an error on a certificate (does not apply to Maryland as I have heard that you may not add a loose certificate there — look it up in the MD Notary Manual to be sure) you can ask for a preference as to which legal way the Lender prefers. But, you must not ask a Lender if it is “okay” to do something in a Notary form, but only if they have an “issue” with it.

The way you think about asking Lenders questions matters as many Notaries think of Lenders as their authority and boss. As to completing the assignment, loan documents and shipping, they are your boss. For the actual Notary procedure, the Secretary of State Notary Division (or whatever they are called in your state) is your only authority and YOU are the authority over the Lender in this regard. You have the right to say no, and they do not have the right to boss you around about Notary issues, but only to voice preferences.

3. Recording fees & issues with adding forms
If you add a loose acknowledgment to a notarized document in a loan signing, that will change the recording fee which might be recorded on the CD, Closing Statement or HUD-1. You are opening a can of worms if you do that. However, in my opinion, the integrity of the notarization trumps any recording fee issues as you are not likely to end up in court because the recording fee went up by $10 or $50, but you might end up in court if someone thinks there is tampering due to initialing and changing information on a Notary certificate.

WHAT IF THE LENDER WANTS YOU TO USE THE ORIGINAL?

Lenders are particular to the fact that they might have trouble reselling their loan if there are too many abnormalities in the Notary section such as adding certificate forms. Additionally, recording fees can go up if you add a certificate to a recorded document, and that affects the information on the CD or HUD which opens up a can of worms. However, please consider that if there are any accusations of tampering, it is you who might spend a long time in court. Adding a fresh certificate that has its additional and optional information filled out, which identifies the document clearly, eliminates most possibility of suspicion.

YOU HAVE THE WRONG STATE IN THE ACKNOWLEDGMENT
Assuming the form is acceptable in all other ways other than the state, just cross out the state, write in the new state, initial, and you are done. Do NOT let the borrower initial Notary certificate forms — that is exclusively the jurisdiction of the Notary.

WRONG COUNTIES VS. WRONG DATES OR NAMES
Having a cross-out in the county of the venue would probably not affect the nature of the contact. Whereas changing a date would affect rescission which could nullify the effectiveness of a loan if challenged in court. Crossing out a name on a certificate can really change the contractual significance of a loan document. I cannot recommend how to handle situations with any authority. However, please realize that changing a county is a small issue while crossing out and initialing a date or name on an acknowledgment for a loan document could cause havoc down the line.

Notary Education

Many Notaries want to get started in the loan signing industry. What they forget is that to become a successful loan signing agent, you first have to know how to be a good Notary Public. Being a good Notary is not rocket science, but there are a few things that could trip you up. Many states have insufficient requirements for Notaries. Some of the lacking requirements could present Notaries and their clients with legal dangers.

Being a good Notary means being knowledgeable and safe. Being knowledgeable means knowing your state notary laws inside out. But, being safe means limiting your exposure to liability. We cannot teach you your state notary laws here, but the handbooks for most states are online and easy to access by searching on Google.

(1) Your state’s official notary handbook. Search for it on Google.

(2) The NNA has a Notary Essentials Course which many people like.

(3) 123notary has a much shorter brush up course called Notary Public 101 which is about best practices and does NOT cover state specific laws.

Please be advised that Notary safety is as important as making money because you want to stay out of court and not get in trouble. Safety precautions include:

(1) Keep an official journal of Notarial acts whether your state requires it or not. That is your only evidence in court of what you notarized and more important — what you did NOT notarize if impostered (yes, it happens.)

(2) Keep thumbprints in your journal to assist the FBI in catching identity thieves. You will probably never run into one in your career but many notaries do. The FBI might name you as a suspect if you do not provide an adequate paper trail, as a bad paper trail looks like a cover up.

(3) Be wary of elder notarizations. If someone is in a hospital, not fully with it, or on morphine, they are more likely to be cheated in a transaction which means that you will be likely to end up in court or investigated.

Signing Agent Knowledge

Once you are a commissioned notary as well as being a competent notary, it is time to study your signing agent knowledge. You will need to know most of the attributes of common loan documents, signing and initialing procedures, how to fix errors in notary forms, and how to date a Right to Rescind correctly. If you have 2 signers each signing 10 Grant Deeds

If you have two signers each signing ten Grant Deeds, how many journal entries should you create and what should you put in the document section?

Wrong Answer
Just create one journal entry and enter both names of the signers and in the document section put ten Grant Deeds.

Another Wrong Answer
Create one journal entry per signing and put “Ten Grant Deeds” where it says name and description of document. Don’t forget to create a journal thumbprint if you want to safeguard against fake identification.

Correct Answer
Create twenty entries, that is ten per signing. Write the term Grant Deed in the document section as well as some unique identifying information about each Grant Deed such as:

Document date, address of property, APN number, name of grantor, grantee, or anything else that is unique.

Why?
If one of the Grant Deeds you notarized for a particular client ends up in court and your journal is queried, you will need to let the judge know which of your journal entries reflects the one for the particular Grant Deed in question. If you did not keep your journal straight in this respect, there could be a debate as to whether you even notarized that particular Grant Deed or if an impostor did. Your journal is not for fun, but is to safeguard you the Notary, Judges, FBI agents, your clients, and society as a whole.

Journal abbreviation keys

Many people take the easy way out with their journal. Journal keeping is seen as just an arduous task with no higher meaning. Many people feel that they can do a shoddy job doing their journal since it is not required in their state. However, if you are in front of a judge you need a clearly filled out journal whether your state requires it or not.

Many Notaries use the check box journal. I recommend against this. The check box journal says, “E&O” as one of the names of a document. If the real document says, “Errors and Omissions Compliance Agreement” that is a completely different document. E&O is an abbreviation for the first three words, but what about the last two words? Don’t take liberties.

Then there are other Notaries who just write, “10 Grant Deeds.” If you are ever in court, you need to know which Grant Deed is in question and if you really notarized it. Keeping escrow numbers, names of parties involved and addresses helps to narrow it down.

DOT could be a good abbreviation for Deed of Trust. However, if you are in court years later what will the judge say? What if you have bad handwriting and use abbreviations?

My philosophy is to keep an abbreviation key in the inner cover of each journal you use. I had 70 journals in my career so I could have a lot of keys. You can have a key that says:

DOT = Deed of Trust
AFF = Affidavit
E&O Comp Agree = Errors & Omissions Compliance Agreement.
Corr Agree = Correction Agreement.

This way you have a system that is documented just in case.
Or, just write the entire name of the document out. Or you could only abbreviate Deeds of Trust since they are so common and not abbreviate the others just to keep reading the journal more straight forward.

The worst thing you can do is to write, “Loan Docs.” When you put the names of documents in your journal, each document is legally separate, and the fact they are part of a package does not make them legally all have the title, “Loan Documents.” Each document has a name that must be entered in your journal if you notarize it.

What’s your sign?

As a Notary, there are various aspects to our job. The most important according to Carmen is identifying people. But, most Notaries just look at the name, and photo, and if it is close enough, that is good enough. If the name is missing a middle initial on the ID that exists on the document that is bad news. But, most Notaries just say, “close enough.” If you say “close enough” too many times, you might end up in court on an identity fraud case which could end you up in court for weeks with no salary, and you might lose a lot of your regular customers as well.

So, how can Notaries make identifying people more reliable? Here are some quick points.

1. If the name don’t match, you must not attach.
Most Notaries say you can over sign but not undersign. This is a Lender preference not a law. If the ID says John Smith and the document says John W Smith you are taking your commission in your hands if you Notarize the signature.The Lender might not mind, but you might end up in court over this if fraud is involved and once in a blue moon it will be.

Most states make sure that middle initials are in ID’s, but not all people are from one of those states. There are out of state people, foreigners, and people who changed their names due to marriage or some other reason, not to mention people with name variations. People from Mexico culturally have two surnames on a regular basis.

So, you have to be prepared for this type of situation even though it only happens 1-6% of the time. If you are going to notarize anyway, what can you do?

(a) Ask the signer what sign he is while holding the ID. If the fake ID has a fake birthday the signer will not know his fake sign. He might be a Leo that is pretending to be an Aquarius. On the other hand, the fake ID might have a real birthday but a fake name.

(b) Get a thumbprint from the signer in your journal. That way the investigators can catch him after the fact if there is any funny business. Thumbprints also deter frauds as they often would prefer not to be notarized than risk being thumbprinted.

(c) Ask their height or birth date.

(d) Ask for a birth certificate if they have one. That doesn’t have a photo, but does have the DOB which is something you can use to cross-check information.

(e) If they have a Social Security card, that is not an acceptable ID, but the first three numbers are part of the zip code where they were born. You can cross check check the info by asking them where they were born.

(f) A gas bill is NOT generally an acceptable form of ID for notarization. However, if you want to verify a middle initial, it is better than nothing.

What you can’t do.
Do NOT accept a signature affidavit AKA statement as a form of identification. That is a document for the LENDER and the source of the information is unknown and not official. Sources for government ID’s are official which is why you can normally trust government issued photo ID’s.

Summary
You need to know your state laws on identifying signers. Many states do not require the name on the ID to exactly match the signature on the document or even for the complete name on the document to be provable based on the ID. Many states leave it up to your judgement. Just because you are following the law does not mean you won’t end up in court as a witness or conspirator to identity theft which is why you as a Notary must take as many precautions as possible.

If you are notarizing for a long term customer and want to take liberties to ensure that your business relationship does not end prematurely, then you might use the above techniques. If the customer means nothing to you, I would strongly consider JUST SAYING NO to any request that is at all questionable, especially those involving ID’s that have names shorter than that on the document.

But, the fastest way to verify if an ID is fake is simply to ask — what’s your sign?
