10 risks to being a Mobile Notary Public.

Notarize at your own risk. Being a Notary is NOT safe!

Many of you think that being a Notary is an easy way to make a few extra bucks. Stamp a piece of paper, get $10, easy, right? Then you deal with nitpicky signing companies who make you fax things back and you get mad, right? That is an annoyance, but not the bigger problem. Being a Notary is dangerous, particular when you don’t do your job correctly. Most Notaries feel that you look at an ID and if it is close enough and the photo looks like the guy, that you are doing your job, right? Sort of. Here are some itemized risks to being a Notary Public.

1. Hoarders
If you go to someone’s house and they have things stacked to the ceiling, you might be in danger in their house. The signer doesn’t want to hurt you. It is just that they cannot control their psychological disease that causes them to engage in hoarding. My housemate is like this and she has stuff stacked to the ceiling which is dangerous and a fire hazard. Something could fall on you or you could get trapped in a fire.

2. Bio-hazards
Some homes that are not cleaned properly are dangerous. One house Carmen almost went into had some bacterial infection that would have gone straight to her lungs and caused her to go to the hospital. If a house smells funny, maybe you are not safe in there. If it is not ventillated properly, perhaps you should stay away. Poor hygene can be deadly, so be advised.

3. Dogs
Some neighborhoods have unsafe dogs around. Notaries could be harrassed or bitten by dogs. Carrying pepper spray or mace is not a bad idea.

4. Slummy neighbors
You might go to a signing in a bad area and people nearby might be hanging out who look unsavory. I am not sure if this is dangerous, but some people get upset.

5. Angry borrowers.
One Notary got pushed off a flight of stairs and broke her wrist. The borrower didn’t like his APR and I guess the Notary didn’t educate themself on how to give a professional explanation of the APR either. The borrower ended up in jail very quickly and the Notary healed in two months.

6. FBI and lawsuits
Roughly 2% of full-time Notaries will end up in court or with an FBI investigation for being involved with identity theft. If you do not keep a thorough journal with thumbprints and the right amount of journal entries, you are much more likely to be held in court as a witness, suspect, or cause yourself extended grief. Without a thumbprint, the investigators are often helpless to catch really really bad people. So, help them out and keep thumbprints. Do your part to safeguard mankind.

7. Getting sued by a borrower
One borrower got mad and sued the Lender, Title company and the Notary when the Notary had done nothing wrong. The Notary tried to use their E&O insurance, but the company wouldn’t pay out because the Notary had not made any error or omission. Of all the bad luck. So, the Notary lost $30,000 in legal fees. Talk about bad karma.

8. Getting sued by the bar association
If you life in an Attorney state and do loan signings without a law license, the bar association might come after you. Good grief.

9. Jeremy might phone quiz you.
Many Notaries who thought they had it together got a phone call from the infamous Jeremy (that’s me) and failed an over the phone quiz. They rationalized, “I’ve been doing this 30 years and therefore I know what I’m doing.” My rationalization is, “Not if you got 18% on my quiz which consists of very easy and every day notary questions.” You might not lose any money, but you could lose your dignity if you score less than 70%. So, study up!

10. Your seal could be stolen
It happened to me. I had to write to the Secretary of State. My car was broken into and I lost my seal, embosser and journal. What a tragedy. It took me two and a half weeks to be back in business. Think of all the money I lost not to mention the trauma of being robbed of my most prized possession — my inkless embosser that I used as a secondary seal to deter fraud! Boo-hoo.

There is also the risk of traffic accidents and having one of those talking GPS systems that talks back to you when you get in the wrong lane, but I won’t include details of those problems as they are common to all humans who drive and not just to Notaries. The end!

Notary Verbiage & Notary Wording

Notary verbiage is a fancy way of saying Notary wording. Notary verbiage is legally required on all notarizations that are in writing. Oaths and Affirmations might not contain any written proof of the transaction other than in the Notary journal. The Notary form where the Notary wording is documented or written is called a Notary Certificate. A Notary Certificate would be a separate piece of paper where official state Notary wording is written or it could be the official notary wording embedded at the end of a legal document after the signature section.

Notary verbiage varies from state to state
You need to make sure that the Notary wording you are using is prescribed for your state. Each state has different wording, and you can look up that wording on Google by using terms such as, “New Jersey Acknowledgment Verbiage.” You need to specify which type of Notary act you want to know the wording for. Acknowledgments and Jurats are the two most common forms of Notary acts, although some states allow for certified copies of powers of attorney and other specialized notary acts.

Out of State Notary wording causes confusion
If you are a California Notary Public notarizing a deed with Florida Notary wording, you are allowed to Notarize the document. Notary wording on out of state documents might be a little different than what your state’s official Notary verbiage is. But, so long as it is not substantially different it is allowed. That means that so long as there are no differences in meaning behind the words in the Notary verbiage then it is okay. Most Acknowledgment sections claim that the signer appeared before the Notary on a particular date and acknowledged that they in fact signed the instrument (document).

International Wording
Out of state notary wording has never caused a problem in my personal Notary career of eight years. However, international requirements can cause a huge nightmare. It is common for overseas document custodians (the entity who will record or hold on to the document after it is notarized) to have requirements which are not only “not done” in the United States, but could be illegal. It is common for Chinese organizations to want an American Notary to put a stamp on a blank piece of paper with no Notarial wording which is completely illegal. In such a case, you have to explain to the signer that you are required by law to staple a notary certificate to the document being Notarized, fill it out completely, and then stamp it to complete the Notarization. Most states also require the signer to be identified and sign a journal.

ACKNOWLEDGMENT CERTIFICATE WORDING FROM TOP TO BOTTOM

(1) The Venue

Q. What is a Venue?
A. The venue comes at the top of a Notary certificate and documents the state and states the county.

Certificate verbiage will contain a venue which is a section at the top of the notary certificate which includes the state and county where the notarization took place, and a signature section at the bottom which is where you put your signature and Notary seal impression. It is possible that a preprinted venue will have the wrong state which is a problem. If there is wrong information in the venue, you either have to do a cross out, or start with a brand new form. Most venues pre-print the state, but leave a blank where the county is to be inscribed. A prudent Notary will make sure all forms get filled out correctly with no cross outs as that is very unprofessional, especially on documents such as Deeds or Power of Attorney which are likely to be recorded by the county or some other organization.

(2) The body of an Acknowledgment.
Below the venue, the acknowledgment certificate will state that on such a date, a particular person or several named people personally appeared before a Notary Public and acknowledge that they signed the corresponding document. The wording will also include the fact that the signer was positively identified or perhaps known to the notary (some states allow for personal knowledge of a signer at a notarization.)

(3) The bottom of an Acknowledgment
Locus Sigilli is a lovely Latin term means the location of the stamp. At the bottom of the Notary certificate form is where the signature of the Notary goes and also where the stamp goes. Most Notaries use an inked Notary Seal while others use a non-inked Notary embosser in addition to prove authenticity of the notarization as it is possible to emboss all of the pages of the document to prove that pages were not swapped after the fact.

Crossing out verbiage is required
On an Acknowledgment form, the boiler plate wording in the middle of the form requires cross-outs. Normally on legal forms you don’t want to cross out anything, but these cross-outs establish whether you are dealing with an individual signer, a male, female, group, etc.
If you look at the California Acknowledgment wording above, you will notice the term “Person(s)”. If it is a single person, then cross out the (s). The term name(s) — if there is only one name then cross out the (s). If you are doing a name affidavit, you might have a single person and six or seven names in which case do not cross out the (s). Then there is the he/she/they wording which can be complicated if you are notarizing someone of ambiguous gender or for Siamese twins.

Jurat Wording
Jurat wording is substantially different from Acknowledgment wording in that the Jurat requires the signer to sign in the presence of a Notary and swear under Oath as to the truthfulness of the document. Many states have a simplistic wording that just says,

“Subscribed and sworn to before me this __________ date of ______, (enter year) _______. ”

Other states have more elaborate wording, but the basic facts documented are the same.

Certified Copy by Document Custodian
This is a type of Jurat that is used only from time to time. Many individuals want to make a copy of a document and then have a Notary “certify” that the copy is correct. Most states don’t allow a Notary to certify this information. However, a Notary could make the photocopy him/her-self and write a note claiming that they attest to the fact that the photocopy is a true and complete copy of the original. However, the offficial Notary act that takes place is a Jurat where the signer swears under Oath that the copy is genuine. I completed many such Notary acts for college transcripts especially for foreign clients.

Names for Notary businesses that can get you in trouble

In general, we recommend certain types of names for Notary businesses.

Geo-Keywords
The name can include a geographical keyword such as the name of your city, state, or region such as Los Angeles Notary Services or Koreatown Mobile Notary.

Professional Keywords
It can also be more professional oriented such as Karen’s Signing Services, or Notary Pro to Go. One successful Notary used the name After Hours Notary, At Your Service Mobile Notary, Notary at your Door, etc.

But, what if you got yourself in trouble picking the wrong name?
Many Notaries use generic business names that nobody will associate with the profession like LMT Services. I would not want to hire them to be my Notary because their name doesn’t gel with the profession. You need what I call anchor keywords to tie in your business with the work being done and/or the area it is being done.

Names that might get you in trouble!
You could also name your business First American Notary and probably get sued by one of our nation’s largest title companies. If you used the same name a signing company used, that causes trouble too. Many companies pick names that are very similar to other company names and get mistaken for each other. National Signers, National Signing Solutions, National Notary Service, Signing National, etc. You can see. So, if you pick a name, try to avoid using words that other services use. Be unique, classy, and relevant to your profession and perhaps to your area. You could use a hotel-like strategy for naming your business like Comfort Notary, Quality Notary, or Holiday Notary. I don’t think those names would serve you well, but who knows. Then there is USA Notary which is too generic and national and not specific to a particular area. Canada Notary would be in the wrong country. Inuit Notary would be good in Alaska, but not anywhere else. Hopi Notary might be good in Arizona, but the tribal leaders might object — just make sure they don’t put a curse on you! Star Notary Service is too generic, but what about Celebrity Notary Service? Royal Notary doesn’t make sense because we have no royalty in America.

Here are some names of Notary businesses our Notaries have:

A1 Notary Services — Will get you up high in the yellow pages. But, might get you confused with steak sauce.
Bay Area Notary — Great name, and has been in business for over a decade.
SOMA Mobile Notary — What does SOMA stand for?
Golden Gate Mobile Notary & Apostille — Sounds like they definitely go to Marin County.
Affordable Notary — Will they be classy enough for my needs?
The Notary To Call — This one has 33 reviews. Sounds like they really are the Notary to Call.
TheBestNotary.Net — He did well with his business.
Arden Mobile Notary Service — It’s a name, but not flashy.
Diamond Star Notaries — Okay
Sunshine Notary Service — Warm and inviting, but do they do late night service?
Dash Notary — Sounds like a good bet if you are in a hurry.
CA Notary Services — They did well in business, but California is a huge state. I prefer a more pinpointed regional name.
One-Call Closing Services, LLC — Exciting. You just call them once and the job is as good as done.
On Call Closing Services — They are waiting for you. Sounds like they take their phone to bed with them.
Denver Metro Notary — A geographically informative name. I know their coverage areas just by the name alone.
Signed-N-Sealed — Very professional sounding.
I & S Notary and Wedding Services, LLC — I’d prefer IB + SD Notary & Wedding; sounds more romantic.
D & D Document — Easy to remember and gets to the point.
1-2-3 Spanish Notary — I prefer 1-2-3 Notary en Espanol if you want to appeal to the prospective clients.
Mobile Notary Services — Very generic; bad name! Probably not even registered with the county clerk.
The S and S Group — Sounds like they don’t do notary work as their main forte.
Indiana Mobile Closers — Statewide coverage? Cool
Notary Mobile Plus — Gets the idea across.
C & S Mobile Closers — Sounds like a generic name like JB Trucking.
Drive by Notary — Sounds like they do notary jobs but do drive by shootings on the side.
DJ Mobile Notary — Someone’s initials at use here.
Emily The Notary — Classy and charming.

So, what are my favorite names?
Emily The Notary — This is a personal and easy to remember name that connects you with the person’s name and what they do. It is simple for the brain to process too.
Dash Notary — This name captures the character of our industry. We live on the edge, always ready to rush off to a signing at the last minute. It is not so different from the term Minute Man which is popular in Massachusetts where we used to have Minute Men.
Golden Gate Mobile Notary & Apostille — This name incorporates a world-class local geographical icon with the notary business. Very classy and relevant to our profession, but with a $6 toll going South (ouch.)

Start your tour by entering the park — get your ticket notarized. You could take the Notarial tram whose path is very twisty and turny as it is an exact giant replica of Mickey Mouse’s signature! Next, go to the haunted house for a signing. The problem is that the signers — are dead, or at least — they will be, and so will you!

Don’t be surprised if you find Mickey Mouse in the hall of records as he was a Notary before he became a famous star. You have to start somewhere.

10 things Notaries can do to screw up a notarization

1. When walking into a house where the borrower’s have large dogs, remember to not wear a suit of meat, as you will most likely get mauled ferociously

2. Always remember to have a small spare small container of vicks vapor rub, use just a little bit when entering the domicile of a hoarder or, of the special person who hasn’t figured out how to connect their ostomy bag

3. Under no circumstance should you ever bring your 175 lb ferocious rottweiler to a mobile appointment and let them attack your customer.

4. If you’re trying to conserve paper and think it is prudent to duplex (print on both sides), please don’t use that copy for the borrower’s to sign.

5. It’s common sense that if you don’t have your own solution, to print docs as in your own printer, don’t go into the borrower’s home and ask to use their printer to print their docs, and even more especially so, if they happen to be the respective secretary of state in your jurisdiction… remember to swear them in.

6. Body modification is great, and it is completely fine if you want to be an individual…. but if you look like you just bought the hardware section at home depot and affixed it to your face, maybe that isn’t the best way to impress a perspective client….

7. Always remember, the set of documents that the borrower’s signed, is the one you’re supposed to send back to the title company, If you have sent back the blank copy to the title company, you might not get away with stating you used invisible ink.

8. Always be prepared for almost every scenario, make sure you have extra stamp pads for when the ink starts to fade, blue or black pens depending on your jurisdiction, a writing or signature guide for the nearly blind or elderly goes a long way and you can be certain they’ll sign in the right spot. if you have a mobile printer, extra toner and always have extra paper.

9. If you plan on adding a piece of new technology to your equipment list, make sure to test it, find the faults, search the solutions, before you bring it out on the street. Also, before you go out for the day that your devices have a full charge. It’s great if you have a mobile scanner, but if something goes wrong, as things do… its even better if you have a solution or back up plan in place.

10. There is no ten. (sorry) I guess we screwed up!

13 ways to get sued as a Notary

Many people become Notaries to make a few extra bucks and don’t realize there are liabilities in this profession. Here are some ways you can get into trouble as a Notary.

1. You name your business a particular name, advertise with that name, but the name is not registered with your county clerk. Someone could sue you for using their business name.

2. You notarize loans in an Attorney state and the local bar association sues you. This has happened to a few Notaries in Massachusetts, and in Georgia the bar association antagonizes Notaries from time to time.

3. You make a mistake on a signing and your E&O doesn’t cover you. E&O is for NOTARY MISTAKES and not for business mistakes you make with loan signing. If a document is not notarized, your E&O will not cover your mistake. For example if you sign the note wrong, that is not a Notary mistake, that is a document signing mistake.

4. You return documents back late and the Lender sues you because the borrower lost their lock.

5. You make a comment to the borrower about their loan, they cancel, and then the Lender blames you and sues.

6. You decline to Notarize someone whose name on the ID does not match or prove the name on the document. One Notary did exacty this and got sued and lost because her communication skills were so bad, but judge could not understand her side of the story.

7. You get in a car accident on the way to a signing and get sued as a result of the accident.

8. You make a mistake in a loan signing and then don’t answer your phone or email for days after. The Lender is pulling his hair out and sues you for his bill with Bosley hair transplants.

9. You don’t follow directions on an assignment. You don’t show the documents in the order the client asked you to. As a result, the client changes their mind about signing the document that will get the client their commission. The client loses $5000 because of you, sues you, and wins.

10. You forget to administer an Oath and your state fines you for malpractice. In California there is a $750 fine for each Oath you forget. Fining and suing are different, but the end is the same — you lose. Or should I say, I swear you will lose!

11. You give legal advice or something that can be construed, misconstrued as legal advice. Then, you get sued for UPL. If you give legal advice to a courier company you could get sued for UPL by UPS.

12. You put the wrong date on the Right to Cancel, the borrower thinks they have an additional day, and find out after the fact that they don’t. Good luck. You would be surprised how many Notaries do not know how to date a Right to Cancel.

13. You misrepresent yourself as an immigration expert and defraud some poor and helpless immigrants. Or you advertise as a Notario. You will be cracked down upon by many state governments for this.

10 rules for negotiating Notary fees

Many Notaries complain about how little they get paid. And then I complain about how little they know. The two tend to go together and the pay is not going to go up before the knowledge does. However, there are negotiating techniques that can help.

1. Let them name their price first
In a bargaining game, it is better to let the other person bid first. You can always raise your ask price if they don’t offer enough. But, if they offer far too much, you would never get it if you asked first and asked too low.

2. Start with a high ask price
If you ask for $125, you can always go down on your price, especially if the job is close or fast. You can ask how many pages, fax backs, and notarizations are in the package. If it is quick, then give them a quick price.

3. Never whine
If you whine about the condition of the industry or how low the fee was, people will think you are a low life. Professionals don’t whine. Professionals operate! So, if you are offered $60, ask for $85 and see what happens.

4. Decline the low-ball offers
If you spend all day working for peanuts, then when the good jobs come, you won’t have time. Decline bad offers so you are free for good offers.

5. Answer your phone
If you only offer when you are not in a signing and not driving or cooking or thinking, you will miss 80% of your calls. How can you negotiate a good fee if you don’t take the call in the first place?

6. Act professional
Try to impress them without trying to impress them. Most Notaries try to do a snow job and brag about how great they are. Seasoned operators don’t do this. Smart professionals will engage you in an intelligent conversation about the job, the industry and the state of the union. Ask them questions about the job, where it is, who it is for, what type of loan it is, and about their career and industry working in title or escrow. But, whatever you do, don’t talk about your zero percent error rate and how reliable and experienced you are — nobody can verify your claims and nobody wants to hear it.

7. Never say hello
Unless you work for an aloe vera companies, don’t answer the phone saying “aloe?” Answer stating your company name and personal name. It sounds professional. If you have screaming kids in the background that sounds horribly unprofessional. Have a quiet place to answer the phone and if you are in a noisy place, try to go to a quieter place and apologize about the noise. Just because you don’t mind noise doesn’t mean the title company enjoys barking dog and screaming three year old.

8. Talk about real life
Sometimes I talk to Notaries who tell the Title company that you can call me to clean up the mess after you hire one of those $50 signers. Over half my work is clean up work. That sounds real to title companies unlike all the nonsense about how experienced and knowledgeable you are which just sounds like fluff. Tell real stories about how you handled complicated situations that others might have goofed. Mention that split signing where you did some complicated manouver on the Acknowledgment certificate and how you went out to sign the wife at 3am because she could only see you at that time due to her busy schedule as a nurse. This is impressive and much better than fluff.

9. Negotiate timing
You can offer a better rate if they get you late after rush hour. They might prefer to just offer you more and get the job booked.

10. Double book and get a bad review
Yes, you’ll get bad reviews from this, but double booking makes sense. People cancel jobs all the time when they hire you, so why can’t you cancel a few jobs. If you book jobs tightly, the other person will cancel 20% of the time — at least. So, if you book a job for $60 and someone else offers you $150, you can ditch the first job and take the other. You will probably get a bad review that will last for three years, but you will have $90 extra in your pocket. It’s a dirty technique. Not recommended, but food for thought and great blog material.

11. Never let them see you sweat.
Appearing calm and collected are the way to go. If you seem flustered, that is bad. Oops, that was eleven rules and I promised ten. Okay, disregard point eleven and just use antiperspirant.

Certain things you don’t learn from experience

Notaries who have a lot of experience seem to forget that you can keep doing the same thing wrong for twenty years and nobody will correct you. People with thirty years of experience often know less than beginners. But, how is this so?

1. Document knowledge
If you want to know more about documents, you can read loan signing courses. You can also read the actual documents. Be aware that many documents have document variations and one document name could have multiple meanings. Therefore you need to be aware of all of the potential meanings and assume the possibility that the document might be completely different from what it normally means as well. Many Notaries go through their careers never reading documents yet claiming “familiarity with the docs.” If you don’t read them then you are only familiar with the names of the documents and not the actual content of the documents.

2. Handling situations
As a signing agent, there are many tricky situations you can get into. Experience might help you to figure out how not to botch certain situations, but might not teach you how to handle less obvious situations. I suggest reading up on handling situations.

3. Notary knowledge
You cannot know the rules of notarizing or know how to explain specific notary acts unless you read about it. You might have performed 50,000 notarizations, but if you performed them wrong, then the experience is worth nothing, or might be counterproductive. Reading up on notary procedure and law might be a good idea. After all, you are handling legal documents.

4. Marketing
Many Notaries go through their career doing the minimum in marketing. You might make a lot more money if you took marketing a lot more seriously. We have many blog articles on the topic.

5. Thinking about danger
What if you are in a house and the borrower goes psycho. That doesn’t happen often. There are techniques for handling danger. Some Notaries sit closest to the door, or at a particular angle from the door so they can see who is coming in. Other Notaries can spot a house with health hazards a mile away and redirect the signing to Starbucks. I’m not sure if there are any good guides to dealing with notary danger, but you can surely try to think of all the possibilities before you go out on a job. Otherwise you have to improvise at the last minute like a comedian doing improv at the Improv!

123notary changed its business model a little bit

This year due to the change in the type of demand there is for Notaries, we changed our algorithm at 123notary. We used to emphasize quality of the Notaries. However, we reduced the size of the site down to 5300 and lost so much market share compared to Notary Rotary that I decided that my former business strategy no longer applied as the market changed. So, I proceeded to add many more notaries to the site and put a greater value on click averages.

The quality based algorithm (still a major factor in our overall algorithm but toned down a bit) was based on how Jeremy (that’s me) felt about the quality of the notaries. That algorithm helped for many years, but lost its effectiveness recently. So, now I am basing placement of free listings and discounts for high placed listings more on click averages. Click averages are an indication of how popular you are with the users. Since my goal is to attract users, I decided to give preference to those that they liked rather than to those that I liked although I still give some points to those who are pleasing to me on the basis of phone manners and notary knowledge.

Now we have 7600 Notaries on the site and a modified algorithm. The new system has attracted 20% more clicks and a lot of new high placed sign ups.
