Notary fined $385 for botching a Notarization

Many of the Notaries on our site are so incompetent about communication and Notary practices that I shutter to list them. The fact is that I am not always informed when Notaries get in trouble. I would like to hear more stories of Notaries who goof and get in trouble because I want to learn how to prevent the problems from happening in the future.

The fact is that a Notary in Louisiana (I don’t remember clearly the name of the state but think it is Louisiana) did a Notary job for a loan signing. The Notary was new and had no idea what she was doing. There were numerous mistakes on dates, signatures, notarizations, etc. In fact there were so many mistakes that the Lender make the Notary pay for the redraw of documents. The bill came out to $385. Ouch. What a nasty surprise for this enthusiastic but clueless Notary.

The moral of the story is that you cannot just get a Notary seal and start working without knowing what you are doing. The states don’t prepare you at all for Notary work. Even California gives very little hands on training. NNA certified notaries have been trained in some basic aspects of loan signing, but that course does not teach basic Notary knowledge. So, if you think you “know what you are doing” because you are NNA certified, try taking NNA’s Notary Essentials course first. It is better to know how to be a Notary than a loan signer, because most of the mistakes notaries make are either rudeness, leaving people high and dry, not following directions, or you guessed it — Notary mistakes. Notaries very rarely get in trouble for not knowing their loan documents and rarely get in trouble for dating an RTC wrong although it could happen.

So, become an expert at being a Notary. You can get into trouble with me if you don’t and trouble with the law, lenders and customers as well. Knowledge is power and ignorance comes at a high expense.

Which Notary directories can help you get $150 jobs? Which Notary directory will help you get a high quantity of work. Which Notary directory will get you nicer clients? Here are some answers.

SnapDocs
SnapDocs is a clearinghouse for the lowest paid and most undignified Notary work out there. Notaries get cattle calls via mass texts to all Notaries in the area for low paying jobs that often only pay $50 or $60 per signing. If you are a beginner and want to get your feet wet then try them. However, Notaries with experience are dropping off this medium like flies!

NotaryCafe
This is a much smaller directory that capitalizes on quality Notaries. Jobs are often higher paying, but there are not a lot of jobs to go around. Quantity is not a specialty of NotaryCafe unfortunately, but we still recommend them to more experienced Notaries.

SigningAgent.com
NNA’s directory has a lot of Notaries. Most of the Notaries are newer while there are a few experienced ones on board. The high point of this directory is that you can see the dates when Notaries became NNA certified and/or background screened which means a lot to signing companies. However, this company has not generated that much work for signing agents for years.

Notaries who fail the California Notary exam

Did you fail your California Notary Exam? I passed it many years ago. I studied about 30 hours to make sure I passed the first time. I was nervous and so afraid that I would forget something. We were instructed to bring a see through plastic bag and put particular objects in that bag such as a pencil and a few other things.

The California notary exam is a a lot harder now than in 1997 and 2001 when I took it. The questions are harder, and the multiple choice questions are close variations of each other making it hard to spot the correct answer unless you know your stuff intimately. So study hard. You need to study from the California Notary Handbook but also there are updates on the newsletter from the California Notary Division.

The state carefully hides their questions so you won’t know what is coming unless you know someone who wants to share answers with you. You need to know your notary acts, fees, procedures and application process inside out or you will fail. I believe they allow seven wrong out of thirty, but the questions are so hard that is still not easy.

There are a lot of notaries failing the test and there are fewer Notaries in the state of California as a result. On a more pleasant note, the quality of Notaries in California is far superior to all other states. I know because I test people by phone on notary procedure since I run a notary directory.

I often have to make over one hundred welcome calls per day to Notaries who cannot give straight answers to questions. I have to ask each Notary five questions, but because they give roundabout answers, I have to ask each question sometimes two or three times which leads to 1500 questions for 100 calls when no questions would be necessary at all if they had filled in their listing properly. People who hire Notaries are seriously annoyed with all of the nonsense they have to put up with. So, make their life easy and just answer questions the way they were asked. Below are some examples.

1. How many loans have you signed?
“Oh, gosh… hmm, let me think for half an hour, well I did one yesterday, and I’m on my way to one now…”

This is inconsequential banter and a real waste of the other person’s time. Just try to give them a number. You were asked for a number, so don’t tell them how many years you have been doing it or how you are NNA certified, just say how many loans you have signed.

2. What counties do you cover?
“Well, it depends on what you are paying…” or “I go to Van Zandt for my normal fee and then Smith for a little extra, where is the assignment?”

There is no assignment. We are a directory and need to put you in the counties that you cover. If you can just tell me the names of the counties without the other rambling and questions, I would be able to fill that information in a lot more easily.

3. The names do not match.
If the ID says John Smith and the name on the document says John W Smith, would it be prudent under the circumstances to notarize the signature?
“I would just ask for another ID.”

Obviously you would ask for another ID, but the question is a yes/no answer and you gave a “what would you do” answer instead. You will be marked wrong because once again, you did not answer the question as it was asked.

4. What hours do you answer the phone?
“I’m flexible.”

That answer is really not helpful, and “all day long” is not either. If someone asks for hours, tell them hours.

5. Do you have a dual tray laser printer?
“Well gee, I have a single tray printer but I have the software so that it can print letter and legal and my printer is very fast and …”

This answer does not answer the question. The answer is, “No.” You are bending the person’s ear with all of this rhetoric.

6. What types of loans do you know how to sign?
“I have signed most of them before.”

This is a useless answer. Just list the types of loans and financial packages you have signed before such as: Refinances, Helocs, Purchases, 1st, 2nds, Reverse, Reverse Applications, Construction, etc.

Beginner Notaries 103 — What beginners need to know

As a beginner Notary, there is a lot you need to know. Many things that experienced Notaries take for granted might take you a year or two to find out. Here are some quick pointers that might be valuable.

1. Your Listing’s Performance.
Listings on 123notary for new Notaries can give you miracle performance. However, no matter how much you pay for a listing on 123notary, the listing will not perform well unless you have a good notes section, reviews, and it helps a lot if you are 123notary certified (especially for newer Notaries.)

2. Your Profile’s Notes Section
Listings that lack a good notes section typically get ignored as that is the first piece of information that companies look for when they are hiring. If your notes are blank, short, or incomplete, your incoming phone log from companies will be equally blank. People want to get a sense of who you are, your professional background, and your skills before they invest in a phone call. Additionally, notes sections with spelling or grammar mistakes will be a huge issue for title companies who will bypass you if they have any cause for concern. 123notary’s blog has an entire section on how to write a great notes section with dozens of unique articles.

3. Notary Reviews
Reviews are your ticket to success. Never mind how great you say you are, talk is cheap if you are complimenting yourself. But, what your customers, especially title companies say about you really matters to those thinking of hiring you. 123notary has many articles about how to get reviews, so I suggest becoming an expert on the topic.

4. Reading Suggestions
Notaries should ideally read Notary blogs, forums, visit the NNA & 123notary Facebook groups (but not the private groups), newsletters, courses, handbooks, and anything else that could be considered helpful. Getting Notary advice from semi-unemployed Notaries who frequent Facebook is a very poor idea. Get your official Notary advice only from your state Notary division and no other source otherwise you might be very sorry.

Smart Notaries and dumb notaries alike realize that they need to spend time reading to keep up. Smart Notaries get courses from helpful companies and improve their skill sets. Smart Notaries also read what other Notaries say about various signing companies as some signing companies are not the best bet to work for. Dumb Notaries spend their time gossiping with other disgruntled Notaries on various private Facebook groups that generally engage in a lot of complaining and bashing. These dumb Notaries are also dumb enough to get Notary advice from Notaries on these groups who don’t know what they are doing. It is a perfect example of what Jesus said about the blind leading the blind. Get your notary advice from your state notary division. If you get any notary advice from any other source, cross check it with your state. We teach general notary concepts here at 123notary, but we cannot say with any certainty of our principles apply to your state.

5. Experience Counts
Signing and especially Title companies typically do not want to hire someone with less than two years of experience unless they are confident about that person’s knowledge. If you have an escrow background or are certified by 123notary, that will help compensate for your lack of experience. Knowing your documents inside out will help as well which would be a side effect of our certification.

6. Low-Ball Signing Companies
Companies that hire newer signing agents are generally not fun to work for. They require fax backs, micromanage, pay poorly and might nag you a lot. They have to, otherwise they would not be able to hire beginners and provide a high level of accuracy to their clients. So, expect to be treated like a child. Once you get some experience under your belt, you might be able to start accumulating title company clients little by little. On our blog we publish a list of companies that will hire beginners. You should talk to every company on that list.

7. Getting Title Company Work
Migrating from signing companies to working for title companies (who usually pay more, but how much more depends on how the industry is doing) is something people do as they gain experience, knowledge and skill. However, most Notaries cannot work purely for title companies after two years. It sometimes takes many more years before all of your clients are high paying wonderful clients who you love working for. So, there will be a lot of paying your dues.

8. Notary Etiquette
Most Notaries do not have good phone answering skills, nor do they have good communication skills. Having good Notary etiquette and good business skills can help you succeed. If your business skills are not completely up to par, it might be good to read our articles about etiquette and brush up. Answering the phone stating your name is a first. Answering questions the way they were asked without rambling on and on matters too. Accepting instruction from others and not engaging in bragging or whining matters a lot as well. Good etiquette will make you popular with all parties.

9. Notary Education
All Notaries need to study up and be experts at their state’s notary laws. But, knowing how to handle situations, and knowing your documents matters just as much. Reading blogs is a good way to keep informed, but there is no substitute for taking actual classes. For newer Notaries, passing our certification test is a great way to gain credibility as well.

10. Risks and Liability
It is risky being a Notary. 15% of our long term full-time Notaries have been to court at least once generally as a witness. A few Notaries even get sued or end up in legal trouble that can cost them big bucks. It behooves you to keep good records and follow Notary law to a T. Understanding Notary law is not enough. You need to know how to explain to clients what you can and cannot do as well as explain to a judge why you did what you did in a particular situation. One lady turned down a Notarization on correct grounds, got sued and lost because she could not communicate clearly to the judge what her reason was for declining the notarization. You also need to have direct communication with all signers and make sure people are aware of what they are signing, particularly if they are elderly. The Notary does not need to understand the documents, but the signers do, otherwise you might end up in court.

11. Your Attitude
Most Notaries have the attitude that they already know it all and there is nothing more that they need to know. Those who are NNA certified think of themselves as blessings to the industry. The fact is that those who have passed NNA’s test typically get very poor grades on our test. There is always more to learn in this business. It is best to stay open, assume that you do not know everything, and accept criticism from those in hiring capacities or those who run Notary agencies (like me.) You will be more popular with all parties involved if you are open to suggestion and take guidance from those who are a lot more experienced and knowledgeable than you are.

12. Advertising on 123notary.
Companies that pay well love 123notary. However, they typically only hire from the top of the list. If you are not in the top three or top five, you will probably only hear from companies that don’t pay that well. Top spots are not always available, so what should you do? Get the best spot you can, and then try to pass our certification, write a good notes section, and keep getting reviews. That way if a better spot opens up, I will be likely to give it to you rather than someone else. I give open spots to the most qualified member downline, so while you are waiting, try to work on your merit, so that you get the promotion!

13. Marketing Plan
Do you have a marketing plan? Many Notaries just wing it. That is not advisable. We suggest having a definitive, well thought out written plan. You can discuss that plan with others too for suggestions.

14. 123notary is here to help.

Snapdocs has a good algorithm, but…

Snapdocs has a good algorithm that sorts their Notaries well. The better ones are on top based on their reviews and performance and how recently they logged in. But, some of them are no longer in business unfortunately. Snapdocs lets you know if they have logged in during the last 45 days, but beyond that it is a crap shoot. There are many has beens on that site. Hmmm. The other problem is that their best Notaries are not that great and the general overall quality of Notaries on their site is dismal, but their technology is super.

I guess the various sites have different business models.

Snapdocs focuses on great technological platforms.
123notary focuses on having the best Notaries.
NotaryRotary has the closest Notaries and also has many high quality Notaries.
Signingagent.com has the best quantity of Notaries and NNA Certified, but not necessarily experienced or serious.

So, for each need, there is a niche in the market. The problem is that there are so many tens of thousands of mobile notaries, it is hard to keep track of all of them.

The other thing about Snapdocs that is interesting is that they show you Notaries who are really close to the job. Normally within 12 miles. That is great, but in areas where there aren’t so many Notaries you might not get so many good choices, and if you did, the choices would be too far. I guess it is hard to win.

123notary has the opposite problem. We list people who serve particular areas regardless of how far away they are, within reason. If they are more than 60 miles away, I generally do not list people that far unless it is a very remote area.

So, who provides the best search? I guess that depends on your search needs!

Notary Marketing 102 — The Top of Your Notes

1. TOP — Selling Points & Experience
A good notes section should start out by mentioning some quick points about why someone would want to hire you. Here are some points that do well in the top section:

.

Number of Loans Signed – Most Notaries hide behind their years of experience. But, the Title companies want to know how many loans first as years is not a definitive metric of how much actual experience you have. What if you signed ten loans per year for ten years, that is only 100 loans. If you have thirty or more years of experience, list it in a format such as: Notary since 1985.

Jail & Hospital Signings — Many people need service in unusual places, so if you are specializing in jails and hospitals, you should mention this at the top of your notes.

100 Mile Radius — In remote areas, people need service far from where you live. If you offer this service with a smile, you will attract a lot more business.

eSignings — Listing unusual services makes you look highly skilled, and will attract specific types of work.

Hours — If you are a 24/7 Notary or a night owl, let the world know this first, because a lot of people need help at night and the other Notaries probably don’t want to be bothered.

Languages — Spanish and Vietnamese are the most demanded languages. But, if you speak another language, put that up top so people will know right away. If you speak Spanish, it is better to claim to be “bilingual” as it carries positive cultural connotations.

Specific Experience — Mention specific types of financial packages or documents that you are accustomed to signing. If a client has that exact package they might be more likely to call you first.

Catchy Phrase — Sometimes a catchy phrase about yourself, your business or service can win the game. Often it is a one-liner that is artfully phrased and catches people’s attention. Don’t bore them with fluff, dazzle them with class!

Examples:

EFFECTIVE
24/7 service; 8500 loans signed; last minute signings; Bilingual; Experienced with Modifications, eSignings, REO, Time Shares, Refinances, VA, FHA, 1sts, 2nds, and Helocs.

Commentary
The effective top of your notes section stresses time of availability, level of experience you can really put your finger on (# of loans is a better analytic than years because the reader could assume that you did very few loans per year for ten years which is not impressive.) “Last minute signings” is a great phrase because many notaries do not like to be bothered at the last minute. Unusual types of financial packages are also good to list and this section lists ten types of packages. I would stop at twelve types of packages per paragraph to avoid overload.

HORRIBLE
I have been a notary for twelve years and know my way around the business. I am responsible and know everything I need to know. NNA certified.

Commentary
The horrible top of your notes section commentary lists years which is bad because you don’t know what quantity of actual work was done per year. There is some bragging and self-promotion which I called “inexpensively bought credibility” which carries no weight because it is self-verified credibility. Then there is the NNA certification which is not a selling feature as almost all Notaries on 123notary are NNA Certified. You have to mention what makes you different and better, rather than what makes you average.

What NOT to put at the top of your notes section

The battle to get our Notaries to fill in their notes section is huge. But, the next hurdle is to get people to put the right stuff. Smart Notaries read our blog articles on how to write a great notes section or see what other Notaries in high places are doing. But, most Notaries write very generic and poorly organized notes. Here are some things you should not put in your notes section, or at least not at the top.

I have been a Real Estate Agent for ten years.
People are hiring you as a Notary, and not a Realtor. If you want to mention low in your notes additional things about yourself as a “by the way” type of thing, then fine. But, don’t put this at the top of your notes or you won’t get clicks.

NNA Certified
Certifications are good, but NNA certification doesn’t help so much on 123notary. Our certification helps on our site. You can mention NNA certification near the bottom of your notes where you talk about your E&O, and other background information.

Background Screened
Once again, this goes in your additional info section lower in your notes section.

I am dependable and responsible
The worst Notaries start their notes section with these meaningless adjectives. All Notaries consider themselves to be responsible, but when people hire them, it’s a different story. Responsible Notaries describe themselves and their skillsets WITHOUT using the word responsible.

I will keep your information confidential
That is as useful as to promise not to kill the borrower’s dog. People take for granted you won’t share their information with others as that could be considered criminal or grossly inconsiderate.

I’m flexible
How flexible? People who are open 9-5 claim to be flexible. The word means nothing. Give hours, not vagueness.

Repeating your name
The top of your notes section shows up on the search results page. People already know your name. They need to know your skills.

I am an experienced Notary Signing Agent
How much experience? Give specifics not wishy-washy statements.

Areas Covered
Put this near the bottom of your notes, not at the top. People want to know what you can do before they know where you can do it.

I understand I am representing you and your reputation
If you want to ramble on and on about wishy-washy understandings, do this low in your notes section in the section where you talk about your personal style.

NOTE
The way I normally try to organize notes has a particular structure. First of all, information is separated into paragraphs. The top has punch points which are quick points that have a strong selling feature. An unusual service like Weddings, or a high amount of loans signed, jail or hospital signings might go on top. Last minute signings or a wide radius are also good and quick pieces of information to put on top.

After that, I like to talk about experience. Many Notaries bury their valuable experience under inexpensive claims of how “reliable” and “professional” they are. The least professional Notaries stress how professional they are, so why cheapen yourself by emphasizing what makes you look like a chump? A list of loan types, document types, or who you are on the white glove list with really helps a lot. That way people know what you are capable of.

Next, a note about your personal style or what is unique to you is good. This is where you talk about how you put the customers at ease and triple check your work.

Bullet points come next with certifications, equipment, the fact you have an MBA, etc. Bullet points should be two to six words long otherwise they won’t look good as bullet points.

Coverage area comes near the bottom and try to make it easy to read without too much rambling. Try to avoid a long list of zip codes. A final note can come at the bottom .

Do you compare yourself to others on the 123notary search results?

We want to remind all Notaries that you are in a constant state of competition. It behooves you to look regularly at what the others are doing in your area wherever you do notary advertising. If you in Timbuktu, IL, see how the others are doing. Otherwise, the phone will stop ringing and you won’t know why. Perhaps Tom in your area will have twenty new reviews while your last review is collecting cyber dust. Or perhaps Mary will have passed our Elite test while you failed our regular certification test two years ago and never tried again.

If you compare yourself to others on the list you will quickly notice certain things.

1. Some Notaries offer late night service. Our icons for Owl hours and 24 hours attract a lot of callers.
