Who is the authority at a Notary Loan Signing?

We often ask questions about authority to signing agents, and the results are horrifying. Most Notaries do not know who is in charge of what. So, this article will sum it up clearly.

Notary Public
A Notary Public is a state appointed state official who is paid by customers, but whose “boss” or authority is the state Notary division. Many Notaries Public seem to be confused as to who their boss is, the one paying them or the one commissioning them. The problem is further complicated by the fact that the ones paying them often pay them for more than just Notary services as travel, pick up, drop off, and supervision of non-notarized signatures and packages seem to be part of the deal if you are a Signing Agent.

The Notary is the sole authority regarding what goes in a Notary certificate such as an Acknowledgment, Jurat, etc., what goes in the journal, what is allowed or not allowed, and how a notarization should be done.

It is common that Notaries have questions during a loan signing and direct those questions to the Lender or Title representative. This is okay for Title or Lending questions, but not for Notary questions where the Notary may only turn for help to their state Notary division, official Notary handbook, or perhaps the NNA hotline.

Notaries should NOT ask the Lender for Notary advice because:
1. The Lender is probably not a Notary
2. If the Lender is a Notary they might be in a different state
3. If the Lender is a Notary and in the same state they might not be knowledgeable.
4. If the Lender is a Notary, in the same state, and knowledgeable, they might (are likely to) give you advice that would make the job go more smoothly for them, yet have tremendous liability for you.
5. You are the one appointed to the job, so even if the person you are asking for advice is a Notary, they are not the one whose commission number gets put on the certificate, and you are the one going to jail if something goes wrong. Therefor, you have to know your laws and what you can and cannot do, etc.

Who can initial and where?
Any initials on a Notary certificate are done exclusively by the Notary Public. It looks like tampering if the borrower or anyone else makes marks on a Notary certificate. The borrower may initial documents, but not the Notary certificate or Notary section in or attached to a notarized document

The Lender
The Lender is the “boss” of what happens with loan documents. If the Lender authorizes a change, initialing, cross outs, etc., on an actual loan document that is NOT in the notary section, that is up to them and they are the authority on that matter, not the Notary. The minute the issue becomes with a Notary certificate, then the authority swings over to the Notary (even if the Notary doesn’t have a clue what to do.)

The Title Officer
The appointed Title company might be a good source of information about how to handle any issues that might come up with Title documents or recorded documents. You can ask them if you have questions, but don’t let them answer Notary questions.

Issues of Preference can be asked to the Lender
Sometimes there is more than one legal way to handle a situation. If there is an error on a preprinted Acknowledgment, and your state allows a choice of crossing out & initialing vs. using a fresh Acknowledgment form, you have a choice. The Notary has the right to make that choice on his/her own and choose the option that he/she feels is more prudent or ask the Lender. However, this is a situation where the Notary can ask the Lender not for advice, but for preference. If the Lender would prefer a loose Acknowledgment stapled on to the document rather than crossing out & initialing the original form, the Notary can proceed accordingly.

The Borrower
The borrower has the right to sign, not sign, tell you where to park and more. Their preferences matter as well.

Your State
Your state Notary division decides what the laws are in your state, how they are explained or document in your official Notary handbook, etc. They are your boss, so you do whatever they say. Additionally, if you are weak on your Notary knowledge, that can lead to ending up in court as a witness, having your commission revoked, suspended or terminated. Additionally, it is possible to be convicted of a crime if you are thought to be involved in property related fraud, or if you filled out a form stating that an Oath was taken when in fact it was never taken which is a daily fraud that most Notaries engage in that is unacceptable.

Flight Attendant & Notary

JESSIE: Hi, my name is Jessie, and I will be your flight attendant Notary for the evening.

SIGNER: Welcome Jessie. Please have a seat.

JESSIE: Tonight we will be flying to St. Louis International for a refinance. The captain will be getting ready for take off in about ten minutes.

SIGNER: But, aren’t we already in St. Louis?

JESSIE: If you want to get technical. We are going to stay in the city, but have a Notarial flight, so to speak.

SIGNER: And how long will the flight last?

JESSIE: 30 years with no prepayment penalty.

SIGNER: Do you have enough peanuts to last 30 years?

JESSIE: Well, the part of the flight where we will be up in the air will only last about 45 minutes. The emergency exits are to the left there where the front door is and there is another emergency exit through the back… I think… I mean is there one? Uh huh? I’ll take that for a yes. In the case of an emergency, I brought oxygen masks. The captain has turned off the “no signing” sign, so you are free to sign around the cabin, or the dining room table as the case may be.

SIGNER: Okay, so where do we start?

JESSIE: First of all I need to see your boarding pass and your ID.

SIGNER: Here it is, not sure what you mean by a boarding pass. And please sign my flight journal so that we know what date and time we took off and what we were signing.

JESSIE: In the unlikely event that we experience turbulence, you can press the “call the Lender” button to the left, and he will explain everything. I am a signing agent and can only answer very general questions, and not specific questions about the terms of your loan.

SIGNER: I need to use the bathroom. Am I free to move about the cabin?

JESSIE: Yes, the captain has turned off the wear seatbelt sign, so you may take off your seatbelt now and visit the latrine.

SIGNER: And where is the bathroom again?

JESSIE: Umm, I’m not sure, isn’t this your house?

SIGNER: I just wanted you to move your hands around like we were on a real flight. Oh, I’m getting altitude sickness.

JESSIE: Just don’t have an upheaval on the documents, unless its the borrower copies.

SIGNER: I just said that to see if you brought one of those little bags.

JESSIE: My bag was full, I brought seatbelts, oxygen, those little bags, mini bags of peanuts and almonds, and the mini-sized Coca Colas. Even Uber doesn’t offer all of that.

SIGNER: My APR seems to have experienced an increase in altitude, is that because it includes fees and certain closing costs?

JESSIE: Yes. Oh, and you previously requested a window seat, well one just opened up.

SIGNER: Okay, I’m done signing everything.

JESSIE: Super. Please put your seatbelt on, and now it is time for a smooth picture book landing. The weather in St. Louis is stormy, it’s raining harder than a cow peeing on a rock. Oh, I think I only use that one in Texas. What type of sayings do you have here in St. Louis?

SIGNER: We stick to Mark Twain references.

JESSIE: Okay, we have landed. The captain has turned off the seat belts required sign. You are free to exit the air bus.

SIGNER: Thanks, but I think you are the one who will be exiting.

JESSIE: Good point. Sometimes I get confused.

18 things you can do to offer better customer service as a notary

Most Notaries complain that they don’t get enough work. Others complain that they get too much work, but not enough of the good work. Life is like this. But, by providing super customer service, you will get more repeat clients and that is one of the most potent secrets to success. Here are some customer service tips for Notaries.

1. Answer questions the way they were asked
Don’t talk too much or give answers that beat around the bush or go on tangents. Pleasantly stick to the facts and answer the question.

2. Answer the phone stating your name
Don’t say, “Hello.” Let the world know who you are. After all, what if they think they dialed incorrectly? Also, they will feel that you are more professional if you do.

3. Avoid background noise during calls.
Apologize if you are in a noisy place and try to go to a quiet place. Make sure your radio, television, and children are “off” before you pick up the phone, otherwise excuse yourself. Most children’s mouths come with an off switch, it’s doesn’t always function though.

4. Be on time
Commentary: arrive slightly early and wait.

5. Confirm the signing and ask a long list of pertinent questions.
That way your signing will go smoothly.

6. Dress nicely
People are shallow and judge you based on how you dress. I’m not like that, but then you should see how I dress. I judge you on what you know, how cooperative you are, and if you are reliable. Your nice clothes are the icing on the cake if you have the other qualifications. Business casual is recommended for all three genders. There are three now, right?

7. Don’t discuss politics or religion
I know, in 2020 that is easier said than done. Our whole existences are controlled by our fascist governors who won’t even let us have Thanksgiving the way we want. Next thing you know they will say, “No cranberry sauce by decree of the emperor!!!” As a general rule, be polite and don’t upset anyone in any way.

8. Park where they want you to park, or park in the street if possible.

9. Introduce yourself at the door and briefly explain your function. Then find a nice table to sign on. Let them choose where to sign, but you do need a flat surface.

10. Explain, but not too much
If you are trained in introducing the documents, if your state allows that, then do it. But, don’t explain the legal meanings of the documents otherwise you are playing Mortgage broker or Attorney. Vague descriptions of what the documents are about is okay, and where critical information is works. Explaining the terms of the loan is not a good idea.

11. Ask them if they have any other questions
Some people have notary questions or spiritual questions. You might be seen as helpful if you help them with those. For spiritual questions, my suggestion for a canned answer would be to give them a serious and caring look and say, “Stay centered.”

12. You can ask them if they have anything else that needs to be notarized.
It doesn’t offer to do more at no extra cost. That increases your chance of getting a valuable review exponentially.

13. Some small talk is good
Small talk is very cultural. Americans seem to like it while Germans and Koreans seem to not like it. Africans like small talk, big talk or any kind of talk and tend to be more sociable than the rest of us. My analysis is that the less a culture engages in talking, the more successful they are. But, you will be seen as nice if you make just the right amount of small talk without getting into any uncomfortable issues, such as how you like Gretchen Witmer’s (D Michigan) new haircut or policy as to whether or not humans should be allowed to leave their house.

14. After you are done
Let them know you will drop the FedEx right away, and then do that. They want to know their documents are in good hands.

15. If there is a problem
Make sure you have all the contact numbers of the Lenders, Brokers, Title people, etc. You might need to call them to resolve some issues. Being prepared and helpful wins the game.

16. Resolve all issues with animals beforehand
If you have issues with cats, dogs, gerbils, oxen, etc., let them know before the signing so they can put them behind a locked door that doesn’t open on its own, hence the term locked.

17. Don’t show them your gun or pepper spray

18. Notary humor sometimes works
You can tell them about the notary who was asked to notarize a mannequin. But, the notary who was dragged into a bedroom by the hot female signer… save that one for a signer you know a little better. The joke about how many notaries you need to screw in a lightbulb is generally safe.

Ooops! Errors that Notaries make that courses don’t cover

Here are a few dumb mistakes Notaries make that courses might not address.

1. Missing signatures, dates or initials.

2. Sending the package back to the wrong Mortgage company.

3. Forgetting to send the package and finding it in your trunk three days after the fact only to find out that the borrower lost their lock as a result.

4. Forgetting to confirm the appointment and finding nobody home when you get to the destination.

5. Not making sure all signing parties are there only to find out that the wife is at work an hour away.

6. Not printing out the whole package.

7. Not having the correct printing or downloading software downloaded.

8. Telling the signer you will be there in 10 minutes and then showing up two hours later with some lame excuse

9. Answering all questions with a snow job trying to cover up the fact that you are new and know almost nothing. This just makes you look annoying in addition to being new. At least you could be a straight forward new person with dignity.

10. Not reading the directions sheet (if there is one) at the top of the package. You could get fired for that.

Common mistakes the borrowers make include letting their cat or dog scratch you or bite you. when they put their dog on the other side of a closed door, have you ever noticed that door always seems to open several minutes later only to create a scene? Some borrowers also read forever and didn’t go over the critical facts with their lenders. Other borrowers don’t have a table to sign on — and that is a serious issue.

123notary – are doing well because the other half aren’t functioning?

Many Notaries in August, 2020 were doing really well in business. Calls are up, people are purchasing, refinancing, and more. The market is booming partly due to lower interest rates. Another reason things are booming is that businesses aren’t borrowing much and the lenders have to lend to someone. Perhaps they have lightened their post 2008 restrictions on who can borrow and with what credit score.

The other reason things are booming is that half of the Notaries are older and afraid of Covid19. They are hiding in their basements while the working half are cleaning up. Such a great opportunity.

Personally, I feel that we should let nature take its course and not do anything to disrupt the flow of nature no matter how gruesome it is, even if the numbers weren’t completely faked and paid for by the bribes of pharmaceutical companies. We can’t all be imposter Bidens and hide in our basement with a facemask dangling from our right ear.

I go for long walks in Los Angeles daily and have not seen one person coughing up blood, or turning blue walking down the street. I have not even seen anyone sneeze since 2019. It has been the healthiest I have ever seen America.

So, how long will things boom? It is hard to say. With business devastated, they might continue to be devastated for years to come and we might all become rich. We’ll find out. On the other hand, if there is a housing crash, nobody will have any equity to draw on which is another take on the issue. We’ll have to wait and find out. I’m tempted to say that I’m optimistic (for once), but I’m really more perplexed than anything else.

The appointment was booked, but the client didn’t answer

A Notary recently got a complaint. She accepted an appointment that had been booked, but canceled at the last minute because the client didn’t answer. As a general rule, you should confirm a signing before you commit to a time. But, if you already committed, and the other person (borrower, client, lender, etc.) doesn’t pick up, you still have to go because you are committed.

The Notary claimed that she called twice, and never received a return call. She wanted to know if anyone had traveled, or had Covid. She claimed that the client was expecting their call.

There are two sides to this story, but the Notary already committed, so it is too late to back out. Just hope that you get paid for travel time if the signing gets cancelled.

Why are the fees offered to us so low?
….because many of you keep taking them. Some folks are new to the profession and don’t know any better. They want to get experience at any cost. Others know better but take them because they are desperate and can’t seem to find better paying work. Whatever camp you fall in you should not be taking low fees. Why? Because it hurts all of us!

Let me give you some history on our profession. Years ago, it use to matter to signing services/companies who they used. There use to be oral and/or written tests given before they would hire you. And with the exception of a few they paid better and more timely. But those days are behind us. Most of them don’t seem really to care. They are looking for the most green, inexperienced notary so they can maximize THEIR profits. Most title and escrow pay anywhere from 150 to 300 per signing and the signing services know this even if you don’t. The money is allocated from borrowers closing fees and the (title/escrow) typically aren’t paying it out of their title/escrow fees, they are charging it the borrowers. So signings don’t cost them anything for the most part. (there are exceptions to this but no need to get into that now, that’s for another blog). 🙂

Many of you ask me why they use signing services in the first place. Bottom line is they use them for convenience. It is easier to just give the service the assignment and let them find a notary. It frees them up and saves them an enormous amount of time to follow lender instructions and make sure all conditions are met so they can close. But over the years as things have slowed up and due to many notary errors many have abandoned signing services altogether. So contrary to what many folks think many of them do still use notaries directly. But the notary signing professions is still over run with companies that are just out to maximize their profits. And this is our fault.

I had a notary just call in the other day and told me that she was offered a sellers package from a signing service for 20.00. (you know they were receiving WAY more than that) 20.00 dollars people! Unbelievable. Just take a moment and let that sink in. That paltry fee is not even worth starting your car up for. Here in Callie we get 15.00 per signature and then if you have to print (god only knows how many pages) and then take them to FedEx or UPS to ship them back, it is just not worth the time, energy or paper.

Now the saddest and worst part about this situation is probably not the ridiculously low fee of 20.00 being offered, it is the fact that although the notary speaking with me refused, we know somebody will/or did accept it. For those of you that have followed my blogs and or spoken with me, I predicted long ago that as long as there are notaries that take low fees, they would persist and they would eventually get lower and lower. That day has come. I too was just recently offered 65.00 to go to a place that is about 40 minutes from me. There were 2 copies needed to be printed, signed and dropped all at FedEx or UPS all for for 65.00. I would never accept such an assignment, even if I were desperate.

I know that a lot of folks don’t really understand this business and the learning curve is quite high. I also know that other notaries once they start to figure things out they don’t share information on pricing/fees. But we need to work together. We need to educate each other that fees need to be fair and reasonable. We are all in this to make a profit. And you can’t make a profit if others are making/taking the majority of the money (signing services) and you are undercutting one another just to say you had some work.

Remember, the goal is to work direct! Marketing and advertising is key to your success in reaching those title and escrow that have had it with signing services. It is time to works smart not hard. Know your worth.

10 reasons to get 123notary certified

Back in 2004 to 2012, many people wanted to get 123notary certified and studied hard to get this designation. In the last few years, we retested our certified members and found that the overall skill level of people on our site had declined a lot and that most people were not willing to study. This is a huge mistake. Title and signing companies care about experience above any other qualification. However, they still reward people for knowledge and the clicks and jobs dispatched prove my point. If you want to have an edge over the other Notaries, 123notary certification is one of the most effective investments of your time — the other two being reviews, a stellar notes section and accumulating mass amounts of experience the old fashioned way. Below are some significant benefits for 123notary.com certification.

1. Get more clicks (but, not on route 66)
123notary certification currently gets Notaries an average of about 30% more clicks to their listing. It is one major factor of several that determines whether or not your listing will even get looked at. More clicks typically translates into more jobs, however, this relationship is not directly proportional. 30% more clicks in real life would translate into 40-50% more jobs. Many people will click once on your listing during a query. But, if they give you extra clicks, that means they are strongly considering hiring you which is why the click to job ration is disproportional and in your favor.

People who work for title want solid Notaries, and they look at a number of factors including certification — and for God’s sake, please don’t have any spelling mistakes in your notes section on your listing or you can expect your phone to be dead.

3. Feel more confident about yourself
Many Notaries who master our materials like the fact that they know what they are doing. At the risk of sounding more like a deodorent commercial — many signing agents have told me that the feel happier and more confident talking to title and going to signings. Yes, they spend many grueling hours studying for our test, but they feel it was worth it and I respect their diligence.

4. Be one step closer to elite certification
You cannot just become elite certified at 123notary. You need to have a solid understanding of Notary procedure and vocabulary as well as a 123notary basic certification. Certification brings you one step closer to being ready to study for the elite test which is very different material and much more obscure.

5. 123notary certification is sought after by particular companies
I have gotten correspondence from Notaries who claim that 123notary certification is informally recognized by 1st American Title among others.

6. You will be a safer Notary
Many Notaries put themselves at legal risk because they do not know the legal significance of how they handle situations. Not keeping your journal correctly could end you up in trouble with the FBI or a Judge in court. Not keeping thumbprints could get you named as a suspect in an investigation as it looks like a cover up. Doing cross-outs when it is not necessary can get you in trouble with certain county recorders or Lenders. Knowing what you can do, and knowing what you can do that is prudent are two different questions. Learn how to please your client without creating liability for yourself by mastering our Notary materials. We have written blog articles where Notaries have gotten into legal trouble and had to pay up to $20,000 to defend themselves when they were innocent. Imagine how much easier it would be if you kept proper records and acted prudently at all steps along the way.

7. Multiple certifications make you look serious
As someone who deals with Notaries all day long, I can attest to the fact that I have a higher level of respect for Notaries who have three or more certifications. Those who just get the NNA certification and say, “That is all I need.” seem like underachievers to me. I have a higher opinion of those who took notary2pro, NNA, and 123notary certification, or Loan Signing System. When I was a Notary I got certified by five organizations to give you an example of someone who takes this business seriously.

8. Make $8 more per signing.
We did a poll many years ago and learned that our 123notary certified members average income made per signing (according to their claims after a mass email was sent asking them how much their average signing netted) was $8 higher than people not certified by 123notary. Elite members made $14 more per signing. Making more income per signing means that after expenses, you will be making a lot more per year. The extra income could add up to $5000 to $10000 extra per year for a busy Notary which might be $200,000 in their lifetime. It only takes ten hours to do a good job studying for our test. Is your ten hours worth $200,000? That’s $20,000 per hour. What else can you do that is worth that much even if you do brain surgery (or are a hitman) on the side?

9. Get perks from 123notary!
If we notice you are 123notary certified, you would be more likely to get opportunities for free or paid upgrades that the others might be overlooked for. Stop being overlooked and get certified today! If you are late paying your bill, we might give you a little longer grace period. And in general we will value you more because you represent knowledge, quality, and come across as being a serious Notary. Over all you will get better treatment from 123notary if you pass our test.

10. Be more fluent explaining things to borrowers
In real life there are certain things you can and should explain to the borrowers while there are others that you should refer them to a professional about. If you pass our test you will know where to find the prepayment penalty, how to explain the APR, what is on the HUD or CD, and when their first payment is due. You will have this information memorized. You will know that a signer can legally presign an Acknowledgment (in most states) whether the Lender “prefers” that or not and how to administer an Oath without falling on your face. You will be more professional and smooth in all of your transactions.

SUMMARY
Certification will help you get more clicks, get more work, make more per signing, be smarter, feel better, be a smoother Notary, and get on the good side of 123notary. It only costs a few hours of study and a small fee, so the only thing holding you back is lethargy. Get off your assets and get 123notary certified today!

Notary Test about Notary acts and more

Here are some test questions for you guys to see who’s got it and who has been faking it all this time.

1. In an Acknowledgment, who acknowledges what?

2. In a Jurat, does the signer swear that they:
(a) Signed a particular document and that they agree to it
(c) Are the person who they claim to be

3. If a document was signed on March 1, 2001, and today is March 2, 2020, what type of notary act can you use to notarize the document without having it resigned?

4. When administering an Oath to an affiant, after having the affiant raise their right hand (or paw) the Notary should start with the words:

How long does it take to get through a signing?

Most Notaries allow around an hour for a signing. But, for a HELOC, Reverse Mortgage, or other longer packages, the timing can be unpredictable.

I did a huge construction loan for someone. I was in and out in 20 minutes with a 180 page package. He was a business professional and knew the drill. He didn’t read. He just signed. There are others who read all day at your expense.

One Notary claimed her average signing is 45 minutes. But, it depends on the lender and the type of package, type of borrower, number of pages, etc. Another Notary on Linked In claimed 45 minutes to an hour. A third Notary claimed 45 minutes as well. A forth Notary kept track of her signings over the course of a year and came up with the figure or 45-75 minutes unless there are multiple signers in which case it might take 15 or more minutes longer.

Older clients (the kind that leave their left blinker on for half an hour in Florida) might need 90 minutes for a signing. They can barely see their pen, so how can they possibly know what they are signing?

Summary
The considerations for how long a package will take to complete should be thought about in this order.

Age
Age determines how long a package will take to complete more than any other factor. Elderly people cannot see well, can’t hold a pen well sometimes, and get very tired. Allow a lot of extra time for Reverse Mortgages, Hospital signings, etc.

Experience
Professional businessmen can get in and out of a signing quickly, unless they make you wait for their busy partner to arrive which might take an additional ninety minutes without waiting time unless you negotiate well.

# of Signers
If you have five signers, you might be there for a while. They will have more bathroom breaks, more showing up late, and if even one doesn’t have proper ID, that throws the whole game off.

# of Pages
A fast signer can get through a long package quickly. But, a “reader” will take forever. The type of sign(er) is more important than the type of sign(ing) as a professional signer can whip through a 300 page loan faster than a nit-picky suspicious “reader” can get through an 80 page signing, especially if they have to call their lender.

Prepared Lender
If the Lender on the loan prepares his borrowers well, the signing will go fast. But, what if you get a Lender who waits until the last minute to fill in the blanks. You will be at the signing over an hour with a Lender like that. I had a best client who never prepared his borrowers well. The money was not bad, but they really took advantage of my time. Most Lenders have a few screws loose, and the Notary is the one who pays for that.

# of Notarizations
I was a fast Notary and could do 11 notarizations for two people = 22 notarizations in less than half an hour. But, it is a lot faster to do one notarization especially if the signer whips out their ID quickly (use a stopwatch for measuring that.)
